Complaint: This is the second time we have had to file a complaint ( complaint number XXXX ). My brother is the homeowner but I have been communicating with the mortgage company since the beginning on behalf of my brother. I am authorized to communicate with them. My brother lost his job at the beginning of the year. The mortgage was transferred from XXXX to Bayview Loan Servicing as of XX/XX/2018. He filed for a loan modification in XX/XX/XXXX. After XX/XX/XXXX when they kept asking for copies of his paystubs I reminded them numerous times that he was no longer employed and could no longer afford to keep the home. He wanted to do a deed in lieu as he no longer wanted to keep the property, I was told by Bayview that they do deed in lieus very rarely and they wouldn't recommend it. I told them that he had to vacate the home as he could no longer afford the condo assessments, utilities, etc. They kept insisting that there was someone still living in the home even though I told them that their appraiser took photos of the wrong unit and that my brother 's unit was clearly marked with his name and unit. They finally admitted they had the wrong unit after we filed the first complaint. The second time I told them he wanted to do a deed in lieu I was told he couldn't do it until the loan modification was denied. They sent the denial to his vacant home dated XX/XX/XXXX ( over 6 months from the time he filed it ). They stalled for over 6 months. They knew he was living with me and had no idea they sent a XXXX package with the denial until much later. He was served with a complaint for foreclosure at my residence on XX/XX/XXXX. The complaint indicates you should call your mortgage company or the attorney for help. I called Bayview, left a message and got no return call. I called them again, got someone who didn't have a clue what she was talking about so I asked to speak to a supervisor. I was told he was in a meeting and would return my call. Never did. I called their attorney 's office and was told to call the mortgage company. I will be filing a complaint against this company with every government agency I can think of.

Complaint: I have contacted both XXXX XXXX and Bayview Loan Servicing several times over the last months asking for the date of first delinquency to be fixed on my reports. The most recent contacts to both companies were by phone on XX/XX/XXXX, by phone on XX/XX/XXXX, by email/fax on XX/XX/XXXX and through disputes with XXXX on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. They have not updated the date as of yet. The date of first delinquency that is showing on all 3 credit bureaus : XXXX, XXXX and XXXX. The delinquency shown is XX/XX/XXXX but the date of first delinquency was XX/XX/XXXX. The mortgage loan was originally owned and serviced by XXXX XXXX XXXX. It was then transferred to XXXX XXXX and finally to Bayview Loan Servicing. Per FCRA 605 & 623, when a debt is sold and was delinquent, the date of first delinquency is to be reported as the original creditors date of first delinquency. In the case of this account, the account went delinquent with XXXX XXXX XXXX in XX/XX/XXXX. As it was never brought current, the date of first delinquency is XX/XX/XXXX. You will see in the XXXX XXXX Report the XXXX XXXX XXXX Information ( bottom of page 4, top of page 5 ) the account history for XXXX XXXX XXXX and the information that is was transferred. Bottom of page 5 to top of page 6 shows the incomplete XXXX history. XXXX received the loan in XXXX XXXX but did not report until XX/XX/XXXX until XXXX XXXX. Bayview received the loan in XX/XX/XXXX-XX/XX/XXXX. The 2 were the follow-up letters that I submitted after the XXXX disputes were not updated properly. The XXXX XX/XX/XXXX Document shows that the XXXX XXXX XXXX account has been removed due to the 7 year rule but both XXXX and Bayview are still on the report ( pg 11 & pg 16 )

Complaint: I have been requesting Mortgage Assistance with my lender Bayview who was transferred from XXXX XXXX XXXX. I have done what i can to keep close communication with my lender Bayview, but it seems Bayview is having employment issues going on and cant keep people employed with them. I had my file submitted to them about 3 times now and I had been told when my 3rd Party was calling that they got the docs and no more docs are needed- then they would call back a week later for a update and get complete different answer with who ever answered the call had no experience at all and no clue what they are doing. I have about had it with Bayview and need your assistance getting this file assigned and to stay assigned to one person w/ Bayview and not ever be transferred to one other person again. You will see the notes from XXXX XXXX XXXX that have been doing all that can be done to help this process move forward to get me a resolution with my lender, this is my home and I am very ill and suffer from XXXX and have many major other medical issues going on and i know i dont need a lender that cant hire a staff of people to do the job correctly

Complaint: Bayview Loan Services still continues to lie about the facts of my complaint. 1. They have yet to disprove my claim of the over paymentom my loan. Their answer is, " this matter closed. '' If indeed the amount of the refund of {$2600.00} was incorrect, this should have been resolved at the time the check amount was agreed upon. The issue of the check at {$2600.00} is their admittance that the over payment amount, with the check register I sent them, from my bank account, was correct. 2. Since they have admitted their incorrect accounting, no late fees should apply. These need to be removed. All payments have been received by Bayview before the XXXX of the month. Again, I sent a copy of my bank statement showing the dates all payments cleared. It took Bayview nearly 3 months to refund my money, yet I do not get to charge them a late fee or interest!

Complaint: On XX/XX/2018 ; I started a loan modification application with my servicer, Bayview Loan Servicing. I received a notice that Bayview would transfer the servicing of my loan to XXXX XXXX XXXX XXXX on XX/XX/2018. On XX/XX/XXXX and as of today 's date ; I have contacted XXXX XXXX XXXX consistently about the transfer of my loan while in default and to find out whether my loan modification application package would be transferred from Bayview to XXXX XXXX. As of this date, XXXX XXXX has informed me that they do not show any of my loan information in their system - they do not even have a loan number assigned to my loan ; a fact which has prevented me from submitting their loan number to this complaint and from getting the servicer any missing information that might by needed to make a determination on my application before the XX/XX/2018 sale date.

Complaint: Bayview keeps writing to me about my past due payment. I made a payment arrangement for the payment to come out on XX/XX/2018. But somebody took out money they wasn't suppose to and caused it to bounce. Bayview doesn't need to keep writing to me constantly because I know the payment is behind. But I have made two payment arrangements for XX/XX/2018 and on XX/XX/3018. I have also requested for my payment to be lowered. But i haven't heard anything back from them.

Complaint: The property in question is my family home since XX/XX/XXXX. My father has an ARM Mortgage with XXXX XXXX XXXX, Payment is about {$480.00}. 2 weeks prior to my fathers death, he quit claimed the home to my mother, his spouse ( XXXX XXXX aka XXXX XXXX ) of 48 years. My mother took over the home mortgage. The mortgage payment had no Escrow or Insurance Payments with the mortgage payment. Then my mother died. The house went into her Estate and the Property Taxes due went stale due to the house being probated in her Estate Will. I continued to make the mortgage payments as required. Taxes for XX/XX/XXXX were waived due to her Estate in Probate. About XX/XX/XXXX a XXXX County Probate Court Executor 's Deed was made and placed the house in to my name ( XXXX XXXX ). XXXX XXXX XXXX was notified in writing and told that I was the property owner and responsible for the mortgage and house issues. I was then sent a letter notifying me that I was place as a contact for the loan and allowed to make property payments. Then about XX/XX/XXXX XXXX XXXX XXXX went paid a non-existent property tax bill to XXXX County. They did this without without any communication with me inquiring about the tax bill or any other issues. Then in XX/XX/XXXX I receive a letter stating they are placing an Escrow Account on the Mortgage for payment of the Taxes. I then call the toll free number and also send a letter disputing the actions. In the telephone call, I am told that someone one will call me back. I hear nothing. I make the payment on the fist of the month as usual. XX/XX/XXXX, XX/XX/XXXX. I receive another statement from XXXX stating that I am late on the Mortgage. I go and make a Payment on XX/XX/XXXX and XXXX accepts the Payment but gives me a hard time to make the payment. The accept the payment. I called again to dispute the Property Tax Issue and on XX/XX/XXXX I sent another letter to XXXX XXXX XXXX, addressed to XXXX XXXX to make an official objection to the way my mortgage account is being handled and to file an objection under the Fair Debt Collection Practices Act. Then I received an XX/XX/XXXX Statement and I made the payment. I find out later when I receive the XX/XX/XXXX. Statement that the XX/XX/XXXX payment is being held in suspense and not posted to any account. I called the XXXX toll free number, and attempt to talk to a Representative. They tell me that they see where I have called previously and someone will contact me. I then send another letter to XXXX XXXX XXXX making my objections known. Then on XX/XX/XXXX I receive a Debt Validation Letter from Bayview Loan Services, LLC advising me that they are attempting to collect a Debt on the Loan. I then called XXXX XXXX XXXX and they advised me that the Mortgage was sold to Bayview Loan Service and XXXX XXXX XXXX could not help provide me any information, I need to contact Bayview Loan Services. I have several disputes pending under the Fair Debt Collection Practices Act waiting on XXXX Responses and communication. I then contact Bayview Loan Services and they tell me they can not provide me any information. I need XXXX XXXX ( My father whom is deceased ). They make me upset. I then wrote a another letter addressed to XXXX XXXX XXXX and Bayview making my Objections Known and disputing everything that has happened. This is the 4th Objection I have sent to XXXX XXXX XXXX in writing and the first to Bayview. I make an Objection to the Debt Validation Letter and the purchasing of the Mortgage that had previous accounting disputes in the account. I am being charged fees, interest and even taxes that they paid that were not due. Now Bayview is assessing their own fees and taxes, plus the purchasing of the mortgage has lost any standing objections that I previously had made. On XX/XX/XXXX I sent Bayview the Objection Letter with signature receipt requested, I enclosed the {$970.00} for the payments of XX/XX/XXXX & XX/XX/XXXX and requested them to be posted. No one will communicate with me about these issues and XXXX is attempting to stick me with a Tax Bill that they paid, that was not due. On XX/XX/XXXX Bayview purchased the Mortgage from XXXX XXXX XXXX without notifying me and, Bayview Loan Services went and paid the XXXX Property Taxes that were not due. I found out when I went to pay them. Bayview Loan Services is trying is adding fees and interest that is not even valid and this is in addition to the issues the started with XXXX XXXX XXXX and I have no avenue to talk to anyone because I keep getting the runaround.

Complaint: We have tried a number of times to come to some type of solution to save our home from foreclosure. When they initiated the foreclosure were were only {$10000.00}. in arrears. We tried to make payment arrangements. We tried top do a forbearance. We tried everything we could to avoid foreclosure. We had an attorney who to our knowledge was familiar with the foreclosure process but did not represent us in the manner in which we wanted. Leaving us in a very bad situation. We have overcome our hardships and we have money saved to workout a solution to save our home. Please help us save our home from foreclosure. We have XXXX ( XXXX ) small children under the age of XXXX. We need our home for our children. We are both working and do have savings to pay ourm mortgage. Thank You

Complaint: Hi, I have a very urgent matter due to a foreclosure sale on XX/XX/2018. I applied for a loan modification to Bayview Loan Servicing numerous times before and they always prolong the process. Never gave an offer and never accepted my loan modification. Ever since then I have been trying to get a loan modification and I can not get one from this company. I mailed in my rma packet and all required documentation as per guidelines. Im in a loan modification review as they should have requested documents for a review. From the past Ive had trouble calling Bayview Loan Servicing to ask about any status or updates for the loan modification and a status on the loan modification I get nowhere. I call in, the phone system asks for my social security number or my loan number, I put in the loan number and or social it rings couple of times and then I get nowhere. Seems like when I put in my information the phone system recognizes my information and does not connect me to anyone. This has happened multiple times on multiple days and each one does this until I clicked the number 0 for a very long and tedious process I finally got someone. After speaking to the employee she did not give me any information regarding my loan and said that only one person could talk to me but I can never get a hold of that person. Also asked for a supervisor and was on hold for over 40 min and never got one. Bayview is playing dirty games for me to not resolve my issue and get an update on my loan modification. Im being thrown around the phone system and no one can speak with me. Is this a game they play to hold off so long until its too late to speak to someone and then they sell my home? I have done everything needed to do and i have sent them all documents. If Im not mistaken Bayview Loan Servicing is in violation of my Homeowner Bill of Rights. Seems like they do not want to help me but to just sell my home.

Complaint: This is the FOURTH time this complete loan mod file has been sent to Bayview. I will be filing further complaints against Bayview with the OCC and the CFPB as Bayview clearly is not reviewing the modification accurately. This is a XXXX-year woman in fear of losing her home with nowhere else to turn. She qualifies for a modification if Bayview could accurately underwrite the file and stop asking for erroneous information that does not apply to this account. THERE ARE NO PAY STUBS STOP ASKING FOR THEM SHE IS ON SSI AND SELF-EMPLOYED XXXX XXXX IS NOT ASSOCIATED WITH THIS LOAN STOP ASKING FOR HIS INFORMATION ON THE RMA This may be under the umbrella of elderly abuse, as these documents have been provided repeatedly and no one is reading them, as the same documents are requested over and over and over again. Complaint: I closed on the sale of my home in XX/XX/XXXX and paid off my loan with Bayview Loan Servicing. I received a letter from Bayview that my loan was paid-in-full in XX/XX/XXXX. However, I received a notice from XXXX and XXXX that Bayview is reporting my account delinquent and 30 days late with {$0.00} due. I had this issue fixed in XX/XX/XXXX but it has reappeared again in XX/XX/XXXX. There are no managers or supervisors or points of escalation that have been able to fix this reoccurring problem. It is a violation of the Fair Credit Reporting act and fraudulent to try and collect on a loan that is paid in full.

Complaint: My name is XXXX XXXX XXXX my mother and grandmother purchased a home with my mother in XX/XX/XXXX my mother later died without having a will which I am also an only child. It was my understanding when I talked with my attorney that there could not be any loans on this house unless I myself signed off on the loans. In XX/XX/XXXX my grandmother was told by the same company and bank XXXX that she could put a Loan on the home which I still remained to have both her name and my mothers name on the deed to this house at XXXX XXXX XXXX XXXX XXXX, NC XXXX. My grandmothers home was paid off in full at the time of my mothers passing. I am her only heir she was never married this loan was given and my grandmother and myself was taken advantage of One was given two loans with the same year of each other which she is unaware of the second loan all together. She has paid over {$200000.00} back for a loan her daughters death paid in full for. She had setup automatic draft payments to have this money taken out of her banking account and now Im being told on the maturity month she needs to have {$32000.00} more because she made the payments late. How would payments be made late if theyre being taken out on auto draft! Im very concerned not just for her which she is retired and have really been taken advantage of from the beginning. The loan was originally through with XXXX it has been transferred several times with the same checking account information they have drafted the money every month now that this loan last payment is transferred to bay view its been told she owes interest for having late payments I spoke with them last year about this loan and it was advised the last payment would be XX/XX/XXXX of this year. Loan number XXXX. Theres a home equity on the house the same thing occurred where my grandmother was told she didnt have to ask or get my permission on getting the loans it was hers my rights and her rights were violated. Another loan is with XXXX XXXX XXXX loan number XXXX.
