Complaint: I have reported fraud since XXXX XXXX to all credit reporting agencies and banks and accounts I have recently obtained NEW information during a legal proceeding on XX/XX/XXXX at XXXX XXXX.
THIS IS NOT A DUPLICATE COMPLAINT TO BANK OF AMERICA XXXX XXXX XXXX XXXX XXXX Virginia As per XXXX XXXX letter dated XX/XX/XXXX after intense research of my claims of fraudulent use of my monies and my personal information since XXXX. XXXX XXXX states without a doubt that the only bank of America accounts I have had are as follows XXXX opened XX/XX/XXXX XXXX opened in XXXX XXXX XXXX but sent me a signature w9 card of XXXX XXXX XXXX with a recorded CD BOA CK # line and page # beside a fraudulently added cosigner as proof it was WHITED out at bottom on right of whatever card that was from.
Bank if America has REFUSED TI GIVE ME the amount if the certificate deposit made by XXXX XXXX recorded beside his fraudulently added name to my sole account.
Mr XXXX has stated under oath that we had a joint account while living at XXXX XXXX XXXX XXXXXXXX XXXX nc XXXX we moved there in XXXX XXXX thru XX/XX/XXXX. XXXX under oath stated that I received a check every 2 weeks and deposited into a joint account during this timeframe. False. He also states under oath I never cashed the checks just deposited them He also states under oath that he would deposit my solely owned checks into a joint boa account. During this time while we lived at XXXX XXXX XXXX ..NOW he might have deposited into a joint account with someone else but it was not me. So I have attached a ledger for my solely issued checks from XXXX XXXX XXXX and it XXXX XXXX or they might be XXXX company issued checks I just found out in the name XXXX XXXX.
Maybe the joint account is in this name since I was just advised that some of my solely owned XXXX checks were issued this as a pay or. I have no knowledge of this payor account thru XXXX that was in this fraud name of XXXX XXXX.
The amount that is being stated by XXXX. Was approx 260 thousand dollars plus of solely owned checks of mine in the names XXXX XXXX -XXXX or XXXX XXXX XXXX XXXX I recently was informed SO PLEASE BANK OF AMERICA RECHECK YOUR FILES and advise me of any other joint accounts that had my names attached or as authorized user or beneficiary.
Now I reported several boa accounts in XXXX as fraud one of XXXX and a fia. Which neither was removed from my credit. They stated individual accounts so both were fraud. The XXXX says last payment was XXXX XXXX. I NEED THESE SIGNATURES ALSO AND the actual address where the bills were being sent - the account number is attached to this complaint Also the line of credit account that boa denies of XXXX attached And the XXXXxxxx that boa denies maybe it was not a loan type account after all maybe a CD or other type loan account. please bank of America I need your assistance in recovering from this horrible identity theft and my monies over a million dollars.
The statements I have made in regards to XXXX are being transcribed and I have asked for a copy in my civil case as. I am the pro se counsel for myself since I don't currently have my monies and I can provide if necessary to bank of America the statements Mr XXXX on record states of depositing my solely owned checks into a bank of America joint account while living at XXXX XXXX XXXX. Complaint: Bank of America 's employees damaged my home, stole my mailbox, personal items, and added charges to my mortgage that for work never performed thus inflating my mortgage balance to an amount that is not correct. Furthermore, Bank of America misled me stating that I could do a short sale to avoid foreclosure. Unexpected increase in interest rate
Complaint: I have a Cash reward Bank of America credit card. I paid off my balance in full the day before my due date. I was charged interest for a {$0.00} balance statement. No where on my statement does it state that there would be an x amount charge additional. In all the statements they should provide an pay off in full option by a certain date to not be charged anything extra.

Problem during payment process
Complaint: I schedule all of my payments online and print payment receipts when payments are scheduled. I always schedule the payment for the end of the month before the payment is due. I scheduled a payment for the total amount due on XX/XX/2019 of {$1400.00}. Then for the XXXX Total balance of {$1000.00} I scheduled the payment on XX/XX/2019. I have the transaction receipts for both of these payments. Then on XX/XX/2019, Bank of America took out an additional payment in {$1400.00} out of my checking account without my authorization. When I saw the error, I contacted Bank of American on XX/XX/2019. They could not explain to me how this could happen and told me they would initiate a refund back to my checking account for the {$1400.00}. In the meantime, I have to move money around, borrow cash from my employer just to make sure I had enough in checking to cover my withdrawals. I called them back on XX/XX/2019 when the money still had not been returned to my checking account. They still could give me no reason as to how this happened and only gave me the answer of, " it takes up to 5 business days to process the refund ''. On Monday, XX/XX/2019 when the money was STILL not in my checking account, I called Bank of America again, only to be told by 2 more people that they could not explain what happened and that I should have the money back by the following day. As of right now, I am still trying to make sure my impending withdrawals are covered and I am still waiting for my money to be returned to my account. The fact that Bank of America STILL can not tell me how they were able to access over {$1400.00} from my checking account without my consent is baffling. I will cancel this card when all of my bonuses have been redeemed and my money has been returned.

Complaint: I responded to an offer which involved a {$300.00} bonus for meeting certain direct deposit requirements that was being advertised through the bank of america website, I was presented with this offer, as I have an open credit line with them. upon establishing the new checking account, and met all requirements, not bonus payment was made. The first time I called, they assured me the system would kick in after 60-90 days. I have not seen a single Bonus deposit after nearly 6 months. Either I was mislead to open a new checkings account, or their system is not functioning properly. Either way, they do not honor their word and should not be advertising false claims.

Complaint: On XX/XX/2019, when I logged into my Bank of America account I was prompted to call to review my account information. I had two credit cards with the grantor. One had a {$6000.00} limit and one had a {$12000.00} limit. I've always paid on time and have good/great credit. Upon calling, I was shuffled around between 5 or 6 different representatives all unable to really confirm what the issue was. They asked me if I was trying to complete a balance transfer. Almost as if saying I was would have led to a different decision. When I said no I was only trying to keep the information current on my account they informed me that " my account was up for review '' and decided to close the {$6000.00} limit account ( which had no balance previously ) and reduce the {$12000.00} limit to {$500.00} ( which had about a {$200.00} balance on it ). When I asked why they said I have alarmingly high credit usage of about 60 % across all of my accounts, which is not true. My overall utilization has never been over 25-30 %. When I asked for proof or other reasoning behind this they essentially told me that they can do what they want and their decision is final. I have been a long-term customer, only with credit accounts, but I guess that wasn't good enough for them. They wanted me to open more accounts and fully tie my finances into their horrible practices. They saw they weren't going to make extra money off of me so decided to drop me.

Complaint: During my flight home from XXXX to XXXX on Spirit Airlines XX/XX/19, I applied for their credit card. I gave all my information .... Name, address, SS. I have not got a response about the offer in any way good or bad. I have excellent credit and now fear my information may have been stolen. I sent an email to Spirit and did receive acknowledgement and that they would look into the problem. That was over a week ago and still nothing has come back. Please help.

Complaint: On XX/XX/XXXX I purchased a computer from a local computer /cellphone repair company for {$450.00} dollars. I purchased it from the owner he told me to make sure it worked when I got it home this was confusing to me but I agreed. I hadn't had time to try the computer until Sunday the XXXX. However on Saturday I received a call from the owner asking me if the computer worked with him on the phone I connected the computer and it indeed turned on. The next day I had the first chance to use the computer it was then that I realized the computer wouldnt update to any of the products that I needed if for. Because the system was outdated and wouldnt allow for updates. I immediately called and left a message with the owner stating I'd he returning the computer.
I returned the computer the following week within 1 week.
When I got to the store to return the computer one of the owners received the computer but said the other owner had my money for the return since it was a debit card transaction I said it so the funds should be returned to the original form of payment. When the money wasnt returned I contacted the merchant he said it was a consignment it and the owner hadnt returned his calls so he only had half of my money which he offered to give me but he wanted me to sign an agreement stating I would accept half of what he sold it for if and when he sold it no matter how much that was. I questioned him regarding no posting of the return policy. His response was well ypu should have asked me about the policy. I told him that the state of MA allows any return policy but whatever that policy is it must be posted and it wasnt. All of this was made clear to Bank of America when I disputed the transaction they denied the dispute stating the merchandise wasmt returned even the merchant didnt dispute that they have the computer the merchant also supplied there return policy which states that consigned items can be returned within 1 week. The merchant also supplied a false invoice that states consigned items cant be returned but they also supplied there return policy that they claim is on the wall in clear view of customers within this policy under merchandise you will see my claim that comsogmed items can be returned it's my contention that bank of America didnt investigate this claim they simply denied it I have all the supporting documents to send proving my claims

Complaint: Back in 2015 I reported my car being broken into, wallet was among my personal belongings that was taken it include a fee debit cards n credit cards, social security card, driver 's licenses, a accordion that held my birth certificate pay stubs prior year income tax returns and utility Bill 's. The reason why all this documents were in my car because I had a employment interview the day before and had left my items overnight in my car. I immediately filed a police report, and since then auto loans, new bank accounts, credit cards have been made in my name and thousands of DOLLARS have been borrowed or used to make purchases in credit with my identity. I have contacted the Merchant like Bank of America, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, and hundreds more that shows in XXXX XXXX XXXX XXXX XXXX and many other systems that I'm a high risk and that these accounts were used fraudulently by me. I contact these merchants on more then one occasions in person, via email, and telephone and the end result is that they belong to me and I have to settle the debt and now that I would like to open a checking account, make a major purchase or obtain credit I'm denied by all banks and lenders stating that I'm a high risk or don't meet the criteria because of what these merchants have stated on my credit report.

Complaint: I received an email from Bank of America 's Fraud Department on XX/XX/2019 stating there was activity on my account and they needed to speak with immediately. I called them on XX/XX/2019. They went over 4 transactions and all 4 transaction were fraudulent transactions involving transfers using XXXX. They only stopped one transaction. The fraud representative from Bank of America told me that someone hacked into my XXXX account and transferred money to 4 individuals who were not known me. They instructed me to change my email and/or email password and my login id and password at Bank of America and my password at XXXX. The claim would be sent to the fraud department at Bank of America and I would here back from them. I change my email password at gmail and my Bank of America login ID and password at Bank of America. Because I was a victim of fraud, and a customer of Bank of America for over 20 years, I thought Bank of America would work with me to resolve the fraud and refund the funds that were stolen from my checking account.
On XX/XX/2019 I received a secure email from Bank of America stating my fraud claim was denied and I had a right to review the documentation that was used to determine the denial of my fraud claim. I called Bank of America and the fraud representative at Bank of America told me that my fraud claim was denied because someone used my cell phone, a XXXX XXXX, to transfer funds via XXXX. I told the representative at Bank of America I thought this was not possible because I had the phone in my possession and did not lose it. He told me the fraudsters " spoofed '' my phone and phone number. I was very confused. He instructed me to contact my phone company and they can detect my phone for " spoofing ''. He told me they needed their report to prove their was spoofing. He made it clear that in order for me to receive my money back, Bank of America needs to prove their was fraud. The spoofing report would help Bank of America prove fraud.
I didn't understand exactly what I was asking for, but I called my cell phone company. I told them I was a victim of fraud and someone " spoofed '' my phone number and phone on XX/XX/2019. I told Bank of America needed proof my phone and phone number was spoofed. The cell phone company was confused but stated my phone number was not transferred to another carrier. They told they did not have access to my phone. The recognized my SIM card, not the phone itself.
I called Bank of America back and spoke to another fraud representative. She basically told me that there was nothing they could do because someone used my phone to transfer the funds via XXXX. She told me my preference on XXXX was to use my phone, not my email, and because the funds were on a recognized device and the preferences on were set to use my phone " the device '', there was nothing they could do.
I told her that I was told someone hacked into my email previously by Bank of America. She told me someone my phone was used to send the funds. She told me I chose the preference to send the funds via the phone 3 years ago and because they were my preferences, there was nothing she could so. I told her the bottom line was I am a victim of fraud and did not send the funds. I told her Bank of America notified me of the fraud and stopped one of the transfers from happening. I told her I don't understand how someone used my phone to send money. I told her the letter Bank of America sent said had a right to receive information of how/why they declined my claim.
*******Then she told me Bank of America made a mistake. She told me the money was not sent from my XXXX XXXX. She told me someone hacked into my computer and transferred the funds from my Bank of America account via XXXX. I told her that she and another representative told me the reason why my claim was denied was because the perpetrator used my XXXX XXXX to transfer the funds. I told her she told me Bank of America determined that my preferences were set to send funds via my phone and that is why my claim was denied. I told her now that the funds were not sent via my phone, Bank of America should approve my fraud claim. The representative told me I had to request in writing for Bank of America to reconsider my claim. She also told me to have the results of a virus/malware scan faxed to them. She told me she would email me the documents that Bank of America used in the investigation that evening.
I faxed the results of the virus scan and requested Bank of America to reconsider my claim. I was upset and called Bank of America 's Fraud Department because I was lied to and/or mislead. I requested to speak with the Bank of America 's CEO, XXXX XXXX. The fraud representative stated she did not have a direct line to Mr. XXXX and there were already 3 claims to their Executive Team. She was note this is another complaint. I told her that I am victim of fraud, but Bank of America was treating me like I was the fraudster. I have been a customer with Bank of America for over 20 years as well as a XXXX XXXX. I have bent over backwards to assist in the fraud investigation. I have been either mislead and/or blatantly lied to by Bank of America. I have never received the documents used in Bank of America 's investigation. I told her I was told my cell phone was used to send money and because my preferences were set up use my cell phone my claim was denied. She told me their was no such thing as preferences to send money via XXXX. I told her the previous representative told me Bank of America recognized my cell phone and my preference were set to send money by phone. She again said their was no such things as preferences and the other Fraud Representatives misread the notes. A member of Bank of America 's Executive Complaints Team has not contacted me. Bank of America has not notified if the request for reconsideration was approved. They also have not provided me with the documents used in their investigation. I don't know what device was used to send the money. There were viruses and spyware on my laptop and the results were faxed to them. I don't know what to do. I am requesting the CFPB to assist me. No consumer should be treated like I have been treated by Bank of America.

Complaint: On XX/XX/XXXX I received a call from my bank of America, and text message stating that my ATM card ending in XXXX had been compromised, and they will be sending out a new card in replacement, I spoke with bank on XXXX of XXXX, I was told that I could use card, till XXXX of upcoming month, in which I asked why, since its compromised why use, so I discarded it..in outside trash in a plastic bag ... 3 days later I received a letter from them stating the card would arrive in 7-10 business days ... during that time frame several transactions were presented, I only disputed those in that time frame, nothing prior ... so chip card may have been found and used during that time frame, after receiving a lretter from Bank of America , that the investigation was closed??? I never spoke to them during the process, they left a fast message and the return callback number, put me into voicemail questions ... whwere I left messages ... on XX/XX/XXXX a Saturday I received a letter stating I was to be charged XXXX dollars, due to the findings ... as in the amount of disputed charges ... they stated a merchant said they deliver product, I requested proof of this delivery, via a signature of receipt ... the bank lady said that was not normal??? they are intending to take XXXX from my account on XX/XX/2019 ... this is not proper, and im disputing..they did not give me any credits for fees I was charged by regular merchants I pay, due to having to change ATM card, and I am out adds XXXX in fees ... please help
