Complaint: This is in relation of the case which was just closed with Bank of America. I believe that Bank of America has submitted fabricated information to the CFPB and has taken advantage of the death of XXXX XXXX to take money out of my checking account. They never told me that I needed to set up more payments after a specific date. Furthermore, when the payments stopped, I assumed the debt was payed off, as would anyone else. In the attached screenshot from the information Bank of America submitted, the underlined text shows the information that Bank of America has fabricated. This is not the first time they did this. Bank of America has been caught in deceptive marketing tactics, https : //www.consumerfinance.gov/policy-compliance/enforcement/actions/bank-america-fia-card-services/ and this action has forced Bank of America to pay out over {$720.00} XXXX in relief to affected clients. Bank of America is back to its old practices again. I feel I need to be compensated with damages. I plan pursue this further. I am in contact with my congressman and I am also planning to contact media and attorneys who were involved in suites against Bank of America. I am not letting this issue go until Bank of America either compensates me in damages, returns the funds or is forced to close its doors. On top of that, I find it shameful that a bank would take advantage of the hardship of its clients. When I noticed there were insufficient funds, I had called Bank of America and went out of my way to deposit money in the account and that the could redebit my account. They never did. I also explained that my mother ( XXXX XXXX ) was ill and I was caring for her so I could not work as before. Then the nerve of Bank of America to default on XX/XX/2019, the day I was burying XXXX XXXX, who passed away on XX/XX/2019. This is a terrible and cowardly thing Bank of America has done, considering they " claim '' to have records of our conversations. In those records they should have brought up the fact that there were hardships involved. Bank of America is shameful and I don't know how its employees can sleep at night knowing that they are working for a cold-hearted institution.

I filed a new complaint and XXXX XXXX called me. During that phone call he refused to provide me an XXXX mail to correspond with him regarding a resolution to my complaint. I told him I would send him a letter. He assured me he would answer my questions in writing once he received it. Once he received it he refused to address a single point in my letter and merely attached a copy of his initial response to the first complaint which contained the misstatements. Debt was result of identity theft
Complaint: Dear CFPB, ( cc : Office of Comptroller of the Currency, IRS, FBI, Senate and other authorities ) Please find my combined Qualified Written Request, Debt Validation and Complaint against XXXX XXXX XXXX, XXXX ( XXXX ) for their relentless false statements, failure to comply with the law ; failure to validate the debt ; and evasive and incomplete response to my lawful and direct questions.
In XX/XX/XXXX respond XXXX and their employee XXXX insisted that XXXX who first appeared in XX/XX/XXXX, is an Issuer of XXXX XXXX securities while my XXXX loan was purportedly pooled into XXXX pool where XXXX XXXX XXXX XXXX XXXX is a Trustee.
All my direct and specific questions regarding information such as Trusts name ; Trusts Closing Day ; proof of value paid by XXXX for the purchase of my loan were declared as overly broad lacks specifics or proprietory which is blatant lie typical for a Ponzi scammer as defined by Securities and Exchange committee. https : //www.investor.govXXXX. * Mr. XXXX previously identified XXXX as a purchaser/owner/investor/servicer of my loan which is an impossible combination. Servicers are not owners of the loans. Investor/guarantor is XXXX XXXX who requires every Issuer to register XXXX XXXX on MERS as Investor and MUST enter the pool or loan package on the MERS system, as described in XXXX XXXX MBS Guide, 5500.3 Chapter 9, Section E ( 3 ), page 7 ( attached ). It was not done by neither XXXX or XXXX.
Moreover, XXXX failed to provide explanation from whom they purchased my loan if XXXX is not the owner but merely Servicer who has NO rights to sell anything to third parties ; XXXX XXXX does not sell performing loans from its pooled securities to private funds ; here is no proof of value paid for my debt as a purchaser or owner ; here is no information who appointed XXXX as a Servicer if XXXX has no authority to appoint anyone as a Servicer for XXXX XXXX Pooled Securities.
My loan is a VA loan and heavily regulated by XXXX XXXX MBS guide ; XXXX XXXX Trust Agreement ( aka Pooling and Servicing Agreement ) ; IRS Publication 26-860G ; IRS Pub 938 ; Uniform Commercial Code Article 9 203 ( attached ) ; and many other laws.
According to XXXX XXXX Guide, the Issuer for certain securities where XXXX is a Trustee - is XXXX. XXXX was never mentioned in ANY XXXX XXXX public disclosures which are readily available online and accessible to anyone, contrary to XXXX and Mr. XXXX statements.
ALL XXXX XXXX Trusts are published online and file annual reports with XXXX XXXX and IRS.
None of it is proprietory or overly burdensome to respond, particularly Trust Name and its closing date. XXXX is a Trustee for only one Class of XXXX XXXX securities while XXXX XXXX has merely three different types of Securities and every change of Servicers is heavily regulated.
The securities must be issued and assigned to the Trust no later than 90 days from its closing day. The Closing Day for my loan was back in XXXX, no later that XX/XX/XXXX. Attached is a list of ALL XXXX XXXX pooled securities in XXXX none of them have XXXX pool. Moreover, XXXX XXXX does not even use XXXX or XXXX to codify their pool types. See attached.
Similarly, no one XXXX Trust published by IRS Pub. 936 in 2016, 2017, 2018 and 2019 have pooled security XXXX ''.
All that XXXX was able to produce as a proof was a Letter of Transfer from XXXX who themselves can not provide any validation of my debt ; or explain who was Mr. XXXX XXXX who prepared a poorly forged Allonge to my Note and transferred it to XXXX on XX/XX/XXXX while XXXX deny its involvement until XX/XX/XXXX.
Moreover, according to XXXX response on XX/XX/XXXX, assignment is not required which is a fatal violation of all applicable laws and rules, particularly IRS rules which govern EVERY XXXX Trust.
Furthermore, in each letter XXXX stated their billing address in California. ALL my Billing statements are coming from XXXX TX, from the SAME post office where XXXX collected my payments ( cashed by Bank of America ( BOA ) ).
My latest payment ( extorted under duress, in violation of all applicable law, particularly FDCPA which requires to cease collection while XXXX ( fake conduit for BOA ) accelerated it ) was also cashed directly by BOA.
In XXXX BOA sent me a billing statement from XXXX TX where they demanded over $ XXXX payment. I responded that this amount is incorrect. In XXXX BOA sent me another statement ( while XXXX said its billing address is in LA and while XXXX failed to validate my debt and provide mandatory disclosures to my QWRs ). This XXXX statement still listed a wrong amount PLUS illegally charged me late fees! Which is pure daylight robbery and extortion racket.
My contract with XXXX was a contract for DEBT. There was no contract for revenue for Bank of America and for a fake party ( XXXX and XXXX ) with a fake claim. Moreover, the contract has already been destroyed through securitization to create a windfall which already occurred when the BOA, the XXXX XXXX sold the parts of my debt for 12 times the amount of the actual debt and avoided to pay taxes from profits since my loan, according to XXXX and all evidence was NOT assigned to any legitimate investor.

Complaint: On Tuesday XX/XX/2019 I paid my balance in full ( XXXX ) to Bank of America for the card I have with them. It then showed I had a XXXX balance. I called in because I was seeking a credit limit increase. I looked 2 hours later at my Bank of America account and saw that there was no reflection of my payment. I called in and the operator couldnt find it either. This morning I looked and there was no reflection of my payment and now there is a new balance of XXXX.
The confirmation number of the payment was XXXX For XXXX. I looked at the close date and realized that if Bank of America doesnt reflect this payment until the 10th they would have a right to interest, this is a tactic to fee harvest. And I would like it brought to light. Ive had this card for 4 years and Im sure this was not the only time I have been cheated.

Complaint: On Saturday XX/XX/XXXX I went into a Bank of America branch to deposit my payroll check, as always I am expecting the check to clear my account the next business day. ON Monday I see that the funds were available so I start paying my bills online, but something told me later the day to check my account again and I saw that the funds were reversed. I called customer service to see what was going on the gentle stated it had to do with my employer releasing the funds ( odd ). Tuesday they posted 4 {$35.00} dollars non sufficient funds due to the reversal and also causing me to have late fees on the bills I paid that were returned. I waited for Wed XX/XX/XXXX to see if they release the hold and they didn't. At this point I reached out to my employer to see the issue and they did in fact confirm the funds were released to bank of america on XX/XX/XXXX. I called customer service to see if they can give me back the XXXX dollars since it was not my fault the funds were reversed, the customer service supervisor refused stating it was my fault. Again not sure how this is my fault when I confirmed with ADP and my check cleared meaning the bank already received the funds for my pay check. I simply wanted my XXXX and for someone to tell me the truth and not give me the run around for days. Bank of America has lousy customer service on the phone and are not will to help not even when it is not the account holder fault.

Complaint: I have contacted Bank of America regarding fraudulent accounts opened in my name. I have never opened a credit card with them. XXXX was able to remove one of the credit cards from Bank of America from my credit report. When contacting Bank of America they tell me they are backlogged for 60 days. When contacting XXXX they tell me that they get their information from the creditor. Conflicting/confusing information. 100 % fraud.

Complaint: On XX/XX/2019 I deposited a check through the Bank of America ( BoA ) mobile banking app. This was check number XXXX, in the amount of {$2200.00}. This is cashier 's check written from Bank of America. As it was deposited through the mobile app and on a weekend, I assumed {$200.00} would be released immediately and the remaining amount released on Tuesday, XX/XX/XXXX ( the second business day after the deposit ). This is also the date that it was indicated to me online that the funds would be released. I checked my account on Sunday and a hold was placed on my entire checking account. On Tuesday ( XX/XX/2019 ) the funds from the check were released and credited to my account but a debit in the amount of the check was also placed on my account. Now I am being told the funds will be released tomorrow morning at XXXX XXXX ( XX/XX/2019 ). I have contacted BoA twice ; on Monday and Tuesday and given misinformation both times. This is unacceptable, the cashier 's check is written from a BoA account so verifying funds should not be an issue, I have had this account with BoA for about two years, and this is an account in which overdrafts are not possible.
