Problem with a credit reporting company's investigation into an existing problem

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Investigation took more than 30 days
Complaint: On XX/XX/2019, I mailed a debt validation letter to Bank of America, which is my legal right under the FCRA. I obtained proof that Bank of America received this validation request on XX/XX/2019. My validation letter was received by XXXX XXXX at XXXX XXXX on XX/XX/2019. I have attached both documents in this inquiry. According to the FCRA, Bank of America had 30 calendar days to respond to my request. Today is XX/XX/2019, and Bank of America failed to even respond to me, and is therefore in violation of the FCRA. They have to remove this account that they are reporting delinquently immediately from my credit bureaus because they are in violation of the law.

Managing an account

Checking or savings account: Checking account

Problem using a debit or ATM card
Complaint: I use my debit card for everything so much so that I memorize the card number. as soon as I moved I changed my address on the Mobile App. I was having some problems with the chip on my card over XXXX prior to the printed expiration date on it. I called in to the fraud prevention team on XX/XX/2019 as my card was declined for potential fraud merely because the chip was no longer working while speaking to them I confirmed the change in address so that I knew they should have the correct address. once we cleared the " potential fraud '' they advised me I would need a new card. I explained I shouldn't have to pay for a new card if they are not making the cards durable enough to last as long as the expiration date on them. they stated I could report the card stolen and no fee would be charged, I declined as it is unfair to me to have to go in to all of my merchant accounts and change the card number, or perhaps forget or miss one and then be charged a return check fee by the merchant because the charge would not go through. they eventually agreed to send me a new card with the same number without a charge. weeks go by and I never received my card so I decided if they would not send me a new card then I will continue using my old card. on XX/XX/2019 I tried to make a purchase and it kept refusing to go through, but would put a pending " hold '' on my account so I couldn't complete my purchase but my funds were not made available to me for 24hrs either. after it failed a second time on XX/XX/2019 I decided to look on my Mobile App and see what was wrong with my card. it is there I found that they had in fact sent my card to the wrong address despite changing it on the app AND with a person over the phone. after the extensive conversation I had on the 1st call in XXXX, I feel that this was done on purpose to spite me for requiring my debit card to be durable and/or not be charged for a new one when it isn't. Bank of America then refused to compensate me for the time I would have to spend changing all my merchant accounts and having to be without access to my own money for up to 6 business days. when I asked to at least be updated when the internal complaint review was complete, they declined. insisting that the team that investigates complaints is not able to make outbound calls, nor received inbound calls when I asked to call them for an update. this leads me to believe that these complaints in fact go no where and there will be no repercussions for the " error '' that appears to be done on purpose in retaliation. I have been with Bank of America for 15 years and never has their customer service been so terrible as it has in the last 2.

Other features, terms, or problems

Credit card or prepaid card: General-purpose credit card or charge card

Other problem
Complaint: On XX/XX/2019 XXXX XXXX charged my Bank of America Visa credit card {$6800.00}. I contacted Bank of America on XX/XX/2019 to discuss disputing this charge because of the poor service provided by their agent, XXXX XXXX XXXX XXXX in XXXX NJ and XXXX XXXX. The issues included underestimating the total weight of the move by several thousand pounds from XXXX XXXX to XXXX XXXX, not providing a moving van on the contracted pick up date, XX/XX/2019, selecting a 26 ft truck not large enough for all items to be moved, delaying 25 % of the delivery for over 3 weeks, and because of the multiple loading and unloading of the goods in their warehouse, damage to many items. I wanted compensation for the lack of communications, poor service, and lack of professionalism from the XXXX agent, XXXX XXXX XXXX XXXX. I spoke several times during the experience to XXXX customer service in XXXX XXXX, MO who, when delivery was finally made, offered me only {$100.00} compensation for my troubles. I spoke to Bank of America on XX/XX/2019 to discuss compensation for the poor service from XXXX XXXX covered under the Fair Credit Billing Act, which protects the cardholder in a dispute over goods or services purchased using the credit card. I was asked by the bank representative how much I was expected to be compensated and I stated {$1000.00}. A report was filed and I received the attached acknowledgement. Over a month later on XX/XX/2019, I was asked by Bank of America to provide additional details of the claim and to sign that I was disputing the charge from XXXX XXXX for {$1000.00}. I immediately complied with this request both by e-mail and US mail delivery. On XX/XX/2019, Bank of America notified me they were unable to determine that a billing error occurred based on the information or documentation available to us and they can not intervene in situations involving a merchant 's contract. When a transaction involves a contract, the consumer has the opportunity to review the terms and conditions before agreeing to or signing. Since my dispute with the merchant did not involve a billing error and had nothing to do with the contract with XXXX XXXX XXXX XXXX or XXXX XXXX, I contacted Bank of America who reopened the investigation. On XX/XX/2019 Bank of America notified me that they re-examined your recent inquiry of the {$1000.00} charge ( s ) from XXXX XXXX, and regrettably, we're unable to obtain credit ( s ) to your account from the merchant ( s ) and that We understand you weren't satisfied with the quality of the service the merchant provided ; however, the merchant has the right to request payment for any services that were rendered. After this letter, Bank of America told me verbally that they had never submitted a dispute charge through the Visa dispute process with the merchants acquiring bank. This is different than stating that they are unable to obtain credit from the merchant since they never notified the merchant of the dispute. Bank of America did not fulfill their obligations for disputing the charge with the merchant ( which is covered under Regulation Z ) and their Visa advertising claims that they will assist cardholders with unsatisfactory service from Visa merchants. When requested, Bank of America could not provide any documentation explaining their procedures for a dispute claim and stating they have the right to decline to file a dispute charge with a merchant. Their correspondence never states they didn't even file a claim with the merchant 's acquiring bank. They have no right to be the judge on what should be a credit card dispute nor could they provide any definitions from Visa on what is a qualified claim. After the letter on XX/XX/XXXX, Bank of America even transferred my call to their benefits department a third party provider group that has nothing to do with cardholder claims for services provided. Certainly, the multiple offices throughout the country within Bank of America dispute claims are poorly trained and lack the understanding of their product. Bank of America misled me in believing that they were working with me to resolve this claim until the time period for filing a claim with the merchants acquiring bank had expired. Further, bank advertisements regarding the guarantees for credit card purchases are false and any compensation for protection covered by the Fair Credit Billing Act was not offered.

Opening an account

Checking or savings account: Checking account

Didn't receive terms that were advertised
Complaint: I opened an account online which was supposed to give me a bonus of {$100.00} in XX/XX/2019 after I met their requirements. I met their requirements in XXXX and they said they would send me a check because some how the online code didnt work and it would be about 30 days and gave me a reference # XXXX. So around XX/XX/XXXX I called back and they had me on the phone for over an hour trying to figure it out and couldnt find the reference #. They again gave me a new reference # XXXX and said it would be expedited so I should have something within 2 weeks. Still nothing. Called back on XX/XX/XXXX and was on the phone for a half hour while they tried figuring it out again. Told me it wasnt ready yet and in review. Then I received a call on XX/XX/XXXX and they said it's still in review and they will call me when they have a decision. It shouldnt be in review I met all their requirements and have 2 reference # s from them saying they were gon na send it out.

Closing on a mortgage

Complaint: On the closing documents, they state that they estimate the taxes and insurance ( Enclosed ). as {$1300.00} a month. Then they state they didn't pay it. And they stated I owe XXXX more and an additional XXXX a month payment. From {$5500.00} a month. to XXXX a month. I have been stupidly paying the XXXX a month, when it clearly states on the GOOD FAITH loan estimate is taxes and insurance is included and my payment is XXXX a month.

Closing your account

Credit card or prepaid card: General-purpose credit card or charge card

Company closed your account
Complaint: hi to whom it may concern bank of america closed 2 of my credit cards for no apparent reason on or about XX/XX/2019. i had both of these credit cards with bank of america . i have perfect history with them and they gave me no indication as to why they closed my accounts. all i was told was i was a high risk, but did not specify why i was a high risk. al tho they didn't inform me or indicate this was a reason my credit report reported high balances. i told them of this and asked if this was the reason but recieved no response. i formed them that some cards had been fully paid and that the report was not accurate. this was a within couple days of account closing. only thing they offered was to try in dispute this and i agreed but no luck. i fried in few times within the week and same result. once my cards had reflected they had been paid off on or about XX/XX/XXXX i tried again but i received the same result. this is the only thing that had changed on my report. i was using both of my cards within terms and conditions, i always paid on time. they gave me no explanation or reasoning for there actions. i believe bank of America is negatively profiling me as they have no reading and can not come up with a just reasoning for there bias decision. i would greatly appricate any help the resolve this

Credit card or prepaid card: General-purpose credit card or charge card

Other problem
Complaint: On XXXX XXXX XXXX XXXX with Bank of America Credit department reduced my credit card limit by {$15000.00}. I have had the card for 15 years and never had one missed payment up to that date. The reduction of credit was done as a result of me asking to have a lower interest rate and having won an arbitration against Bank of America in the past. Clearly retaliation on two fronts. The retaliation has caused me financial harm by causing my credit to be lowered and caused me liquidity and cash flow issues. Bank of America took a bailout from the U.S. taxpayer and now rips off the American taxpayer with predatory credit card interest rates and retaliates against employees and former employees. Clearly the government bailout of Bank of America led to the retaining of corrupt management which abuses the American general public.

Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: I purchased a home in XX/XX/2018 through the XXXX home buying program. I went through all the appointments and classes to make sure that I was ready to purchase a home and that I knew my affordable mortgage amount due. I closed on XX/XX/2018. I was told my mortgage amount would be {$1100.00}. A year alter, I was told by my Mortgage company that my new payment amount would be {$1300.00}. When I closed on the home, the title company told me that I was issued a credit because the sellers paid the property taxes for the home up until the day of closing. A year later, come to find out, they did NOT. Bank of America paid the difference and assessed it onto my mortgage.
