Attempts to collect debt not owed

Debt collection: Federal student loan debt

Debt is not yours
Complaint: Allied Insterstate LLC XXXX is a 3rd party and they along with XXXX XXXX XXXX XXXX have been harassing me under a former married name as well as calling and sending mail to my job demanding a wage garnishment for a Federal Student Loan and threatening my job with suing them if they do not comply. The harassment started when I applied for my first Credit Card ( XXXX XXXX ) in my life through the XXXX XXXX Link. I never had a Student Loan and am a client of XXXX XXXX XXXX because I am a Identity Theft victim. The Law firm as let me know that there has never been a student loan on my credit report not now or ever and that goes for all 3 credit bureaus. XXXX XXXX XXXX has stated on their recorded line that these 2 companies are a known scam companies. They have also stated on their recorded line that if my job did the garnishment that all of my jobs info as well as finances of the company the scammers would have access to. I need for the harassment to STOP ASAP. Many thanks,

Debt collection: I do not know

Frequent or repeated calls
Complaint: Recently moved and received new land line phone number approximately one month ago. Allied Interstate ( according to my Internet research, this is a debt collection agency ) calls almost every weekday for several weeks ( from one to four times a day ; my phone keeps a record of each call for the last 2-week period ; see attachments for screenshots ). I assume that they are seeking to speak with the prior owner of my new phone number. I picked up one call and asked for the name of the caller and purpose of the call. The caller identified himself as XXXX XXXX and refused to provide the purpose of the call indicating that it " was against the law '' to provide such information. He insisted on obtaining information from me. I refused. Calls continued to come, unabated. The company is calling from phone number : XXXX.

Written notification about debt

Debt collection: Credit card debt

Didn't receive enough information to verify debt
Complaint: According to Federal Trade Commission guidelines, a debt collection can not be valid without the following criteria from a debt collector : The debt collection must be bonded and licensed. There are no licensing requirements in the state of New York, but the collection firm must show evidence that they are registered to do business in the state of New York through the Office of the Secretary of State in XXXX, New York. No such proof has been submitted with the attached letter. The debt collector must be bonded, no proof of bonding was submitted. A signed copy of the legal right to collect must be submitted showing proof of any power of attorney, transfer rights or ownership. No such documentation was ever submitted. Accordingly, the attached attempt to collect a debt on behalf of XXXX XXXX is deemed VOID. My complaint for such documentation will stand in any state or federal court. Therefore, I demand a full compliance before Allied Interstate attempts any debt from me personally without proper documentation.

Attempted to collect wrong amount
Complaint: Allied Interstate, LLC is attempting to collect a debt on behalf of XXXX XXXX. Section 392.101 of the Texas Finance Code prohibits a third-party debt collector or credit bureau from engaging in debt collection in Texas unless the third-party debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State. Currently, Allied Interstate, LLC of XXXX, Virginia has not obtained a surety bond with the Texas Office of the Secretary of State. The debt collector that has contacted me does not have an active surety bond, therefore, they are illegally attempting to collect debt in Texas.

Debt collection: I do not know

Frequent or repeated calls
Complaint: I am current on all debts however I receive 2-3 calls a day 7 days a week from XXXX and never once a message. I googled a.d found that they are a debt collector and I am not the only one they are harassing constantly. I emailed and asked that they stop calling and send a letter. No response and still calls. I am executor of my mom 's estate and I suspect that may be what they are calling about, but I 've contacted everyone of her creditors already and told them the estate is insolvent. If they want to file a claim there is a way for them to file with probate but they should not me continually calling me.
