Complaint: I obtained a payday loan in XXXX from XXXX XXXX. My checking account was closed in XXXX due to someone committing fraud on it. As a result XXXX XXXX was unable to collect the debt. A few years went on and I got a call from XXXX XXXX as well as XXXX XXXX XXXX XXXX In XXXX I wanted to pay this old debt so I began communicating with both companies. A representative with Ad Astra as well as XXXX XXXX promised to delete the collection from my account if I paid the debt IN FULL. In early XX/XX/XXXX I paid the account in full at {$310.00}. The debt reflects a XXXX balance. What Im upset about is that I have called XXXX XXXX 13 times to discuss the removal that was promised. I called Ad Astra 12 Times requesting that they hold their end of the bargain. They deny promising to delete the account and they told me that they will pull up a recording of the conversation to prove that they did not promise me to remove the account. I havent heard back from them. I would have not paid this account if I was not promised this Paid to Delete. Me paying no the {$310.00} didnt do anything to my credit score. Im happy its paid but Im very u happy with their collection practices. Please help. I can be reached at. XXXX

Complaint: Despite my three requests to delete the speedy cash account that ad astra is trying to collect on that I do not own, Ad astra still remain to report the UNVERIFIED account. The account remain on my credit report in violation of federal law. In the results of AD ASTRA re-investigation AD ASTRA stated in writing that the items on the account is being reported correctly and that they verified the account sold to them by speedy cash that I do not own. I have never had a Contract with speedy cash or AD ASTRA and I still DO NOT have an account nor CONTRACT with the companies. They still have not identified who in their company verified the accuracy of the account or how they verified them. XXXX 's Law Dictionary, 6th edition 1990, defines " verification '' as confirmation of correctness, truth or authenticity, by affidavit, oath or deposition. Affidavit of truth of a matter stated and object of verification is to assure good faith in arerments or statements of persury. AD ASTRA failure to provide me with verifiable proof required for they company to post the account is evidence that it does not exist and therefore is proof that AD ASTRA can not properly verify the accuracy of the disputed account. Under section 611 ( 5 ) ( A ) of the FCRA, AD ASTRA are required to promptly " DELETE all information which can not be verified. DUE TO AD ASTRA willful disregard of the law I intend to pursue litigation in accordance with the fcra to seek relief and recover all monetary damages that i may be entitled to under section 616 & 617 if the unverified account are not deleted within 10 days. AD ASTRA is violating the law by not deleting the account after several requests for the account to be deleted if it wasnt verified. I am well aware that a bill is not verification of a debt. I also stated to AD ASTRA that I wanted to see a contract or something with my signature on it which they did not and can not provide because the account is not mine. AD ASTRA has it bad about not responding to a request and just putting verified as the dispute resoultion without correctly handling the situation. The law is very clear as to the civil liability and the remedy available to me.

I have fully researched my rights and found that the Fair Credit Reporting Act does not allow you to victimize innocent credit worthy people by reporting erroneous false information. Acts 1986, No. 1031, 1. civil code sec. 2 art. 3494 Louisiana Also I would like to state you keep deleting accounts and then the creditors add them back to my credit and re age debts that are in fact 3 + years older and also none of the creditors are registered in the state of Louisiana. I have provided proof were accounts have been deleted and creditors are illegally adding accounts back as new accounts. I have also provided proof that you are reporting accounts open that have been charged off and in my state prescription which is only allowed there Years ... do whats right and delete these accounts as you are reporting false documents!!! Procedure in case of disputed accuracy [ 15 U.S.C. 1681i ] 5 ) Treatment of Inaccurate or Unverifiable Information ( A ) In general. If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation ; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer. B ) Requirements Relating to Reinsertion of Previously Deleted Material ( i ) Certification of accuracy of information. If any information is deleted from a consumer 's file pursuant to subparagraph ( A ), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. Complaint: I am a victim of identity theft. In 2016 my apartment was broken into and several identity documents were stolen, including my photo ID and social security card. I filed a police report with the XXXX Police Department - report ID : XXXX I have attached a copy of the police report to this complaint. The debt being collected does not belong to me. I did not take out a loan, nor have I ever taken a loan, from " XXXX XXXX ''. I have never taken out a payday loan period. I did not receive any funds or benefit in any way from a loan taken from this company. During the course of this identity theft several accounts were opened in my name. All creditors were notified that these accounts were fraudulent and investigations were opened. I have attached copies of letters from other creditors who opened investigations and found these accounts were not opened by me. Several bank accounts were opened in my name as well. I suspect whatever bank this loan was sent to was one of them. Bank accounts fraudulently opened in my name included XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX. All of these accounts have been disputed, closed and removed from my credit reports. I have also attached the FTC affidavit of identity theft to this complaint.

Complaint: On XXXX XXXX, 2017 AD Astra Recovery Services , Inc contacted me about a debt. In conformance to my rights under the Fair Debt Collection Practices Act ( FDCPA ), I requested AD Astra Recovery Services, Inc to provide me with a validation of the debt that they talked of earlier. I stated this is not a refusal to pay, rather a statement that your claim is disputed and validation is demanded. ( 15 USC 1692g Sec. 809 ( b ) ) I do hereby request AD Astra Recovery Services, Inc provide me with complete documentation to verify that I owe the said debt and have any legal obligation to pay you AD Astra Recovery Services, Inc I have not received documentation demonstrating compliance with the Fair Debt Collection Practices Act ( FDCPA ) ( 15 USC 1692g Sec. 809 ( b ). They did attempt to send a deceptive/new contact agreement to sign with no validation as requested. My right to dispute the debt was not in compliance as well. The company sent verification letters not debt validation letters as requested. The verifications letters shows the name of the alleged creditors. The original terms and or agreement stipulates arbitration and not a third party collection agency. The admitted they are a third party and not an arbitrator, which violates the terms. Once again, the requested information is outside of the 30 day FDCPA 15 USC 1692g SEC. 809 b The company stated that they resecarhed the the issue, the could not have if clearly written in the arbitration agree with the alleged creditor XXXX XXXX, which states all conflicts shall be sent to arbitration and not collections. The request for arbitration was ignored by the alleged XXXX XXXX creditor and I received communications from AD Astra Recovery Services , Inc. without researching they sent incorrect informato the credit agencies without verifying what they were validating as a debt belonging to me. A copy of a debt from the alleged original creditor alleging I owed a debt is not validation of a debt.
