Complaint: This problem concerns both my Wells Fargo checking and savings accounts. This started happening approximately 3 months ago, although it likely occurred at times in the past where I did not notice, or noticed but did not know how to resolve the issue. Wells Fargo has the option to enroll in their " overdraft protection '' program, and while they take great efforts to convince you that this program inures to your benefit, it clearly does not. They automatically enroll you in the overdraft protection program, shifting the onus to the customer to opt-out. I have now " opted out '' of this program at least 3 times in the last couple of years. On this latest occasion, I started spotting {$35.00} fees here and there, and wondered why ; I looked through my bank records and realized that I had somehow been " opted-in '' without my permission! While I was looking at my records on WF online banking website, I saw that they actually had a box you could click that would take you out of the overdraft protection plan ( the result being that if you attempted to make a charge on the debit card, it simply would decline the transaction ). I therefore clicked the unenroll box and assumed that would take care of the error ( this was after they charged me the {$35.00} approximately 3-4 times ). A couple of months later I again saw a few {$35.00} fees and realized with amazement that they had enrolled me in the overdraft protection again! So I 've lost hundreds of dollars because they keep putting me on this program in contravention to my requests! A sub-issue here is that after I was finally able to get of that program, my card would appropriately decline to charge when I attempted a purchase with insufficient funds, however, when an online store ( a recurring subscription situation ) would run the card it would go right through, causing the {$35.00} fee once again! And often when this occurs, WF seems to mis-order the purchases so that they can make extra money on the overdraft fees! This happened on at least 2 occasions. The second issue is regarding Wells Fargo 's ridiculous ATM fees. WF never used to charge me a fee to use another bank 's atm ( I would have to pay the other bank 's fee of course, but I was aware of that ) ; starting about 6 months ago, they decided to start charging me a fee for using another bank 's atm ( in addition to the other bank 's fees ) without any warning or announcement whatsoever. Even worse, the fees did not show up on my checking account statement ; they would appear on my savings account statement, where I rarely look! This is yet another example of what feels like WF trying to secretly rip me off. I have also seen a couple of " balance inquiry '' fees ( I guess in regards to an atm transaction, but it does n't specify ) that I never incurred. I literally never check my balance on an atm because I have an app on my phone where I can easily check my balance. Finally, I also feel that any atm fees WF tries to charge are ridiculous since they do not have any locations near me, the closest being an almost hour 's drive away ( I 'm in XXXX and XXXX is the closest drive, hardly convenient ) .Why should I have to pay for WF failure to install an ATM anywhere near our town? I am seriously considering finding another bank.

Complaint: I have XXXX student loans serviced by XXXX ( XXXX ). I refinanced both loans into a single loan with Wells Fargo, and my husband cosigned the loan. According to Wells Fargo, they sent a check to XXXX on XX/XX/2017, and began accruing interest on the balance they had lended to me. It is now XX/XX/2017, and XXXX is saying they never received the check from Wells Fargo, and that I am late on my XX/XX/XXXX payment to them. I have already paid the maximum that I can afford to Wells Fargo for the month of XX/XX/2017, because I did not know that I would have to pay both loans simultaneously. I have had multiple conference calls with XXXX and Wells Fargo customer service representatives. XXXX says that Wells Fargo has to provide an image of the check and proof that it was cashed, if in fact the check was cashed. Wells Fargo says that they can not provide that. Also, Wells Fargo says that it can take 60 days for the check to process, but by that time, I will be 63 days late on my payment to XXXX, and XXXX says they will go to the credit bureau by this time. This will damage my credit. I essentially am burdened with twice the debt that I originally had, and am offered no solution from either bank, but to pay XXXX for a 60-day period until the payment processes. My XXXX account is under My maiden name ; XXXX XXXX, and my father XXXX XXXX My Wells Fargo account is under my married name XXXX XXXX, cosigned by my husband XXXX XXXX

Complaint: I have XXXX special term loans with Wells Fargo Financial. XXXX of these loans is set to expire on XX/XX/XXXX. I have been making my payments but only a fraction of my monthly payment is being applied to the special loan balance that will expire the soonest which is contradictory to the information on their website that states that payments are applied to balances with the highest APR and then to balances with special terms that will expire soonest. According to the phone agent that I spoke to today only {$14.00} of the {$190.00} monthly is applied to the balance that is set to expire on XX/XX/XXXX and the majority of the dollars of my monthly payment is applied that will expire in XX/XX/XXXX. I was told that I would have to pay {$550.00} to pay off the balance of {$360.00} to avoid being charged the outstanding interest set to hit in XX/XX/XXXX.

Complaint: This correspondence is in response to a previous complaint I submitted on XX/XX/XXXX, Case no : XXXX. There was a response to my complaint by XXXX XXXX-Senior Correspondence Specialist in which I think was false and incorrect. My exact complaint was also expressed by another customer in the state of Calirfornia. XXXX VS Wells Fargo.In this case the U.S. Supreme Court declined Wells Fargo 's request to review its XXXX loss at trial, where U.S. District Court Judge XXXX entered a {$200.00} XXXX judgment against the bank for manipulating debit card purchases to maximize its overdraft fee revenue in violation of California state law. The XX/XX/XXXX decision ends the Bank 's efforts to escape judgment. Can someone from your agency explain to me why My complaint ( EXPRESSING THE SAME CONCERNS ) were not considered and or investigated? This agency merely allowed a response. At the time I was not in the mood to go back and forth with Wells Fargo. It is also unfortunate that as a consumer/customer who perhaps can not afford proper legal representation but can prove and verify Wells Fargo 's predatory behavior nothing was done on my behalf. This agency let WELLS FARGO respond and accepted its response as " credible '' and neglected my initial concerns. This makes me not so confident in the CFPB as it relates to the ACTUAL Consumer. After receiving the response from wells Fargo back on XX/XX/XXXX, via CFPB I SUBSEQUENTLY closed all of my accounts and my credit card account because of these frequent charges. I have not had this happen since selecting another bank. These are issues that I raised in XXXX and there is no telling the financial loss I incurred while a consumer of Wells FARGO. My prayer for relief is to have my account reviewed by Wells FARGO and to have all refunds that I am due credited to me. In addition perhaps there is some punitive damages that I am entitled too. I am seeking legal representation as I had been trying to advise your agency of this for 2 years now, only for someone who is financially prepared for legal fees to raise the same claim and have it adjudicated because they have the financial means. In XX/XX/XXXX, U.S. District Court Judge XXXX issued a 90-page opinion in the case of XXXX v. Wells Fargo Bank finding that Wells Fargo manipulated its processing of customer debit card purchases by its California customers to maximize overdraft fees in violation of California state law. Instead of posting transaction chronologically, Wells Fargo deducted the largest charges first, drawing down available balances more rapidly and triggering a higher volume of overdraft fees. Judge XXXX ordered that Wells Fargo return to its customers approximately {$200.00} XXXX in restitution and enjoined the abusive accounting practices. Judge XXXX decision followed two and a half years of extended litigation that culminated in a two-week bench trial which ended in XX/XX/XXXX. The judgment against Wells Fargo constituted the 4th largest judgment in California in XXXX, and the largest judgment in a class action lawsuit. The case before Judge XXXX was brought on behalf of California Wells Fargo customers who, from XX/XX/XXXX to XX/XX/XXXX, incurred overdraft fees on debit card transactions as a result of the bank 's practice of sequencing transactions from highest to lowest. Complaint: When my mortgage payments started my loan was sold XXXX and set up for payments with servicing company Wells Fargo. On setup of my payments I chose to have weekly payments for my mortgage for the benefit of paying off the loan earlier..as much as 7 years early ( knowing this from before ) based on a 30 year fixed loan. Soon I found out that I am not receiving full benefits of paying off weekly as servicing company is not applying my weekly payments against the principal immediately, instead they hold on to funds and wait until XXXX of every month and then apply it or waits for the 4th payment ( XXXX of the XXXX mentioned ). Therefore, hundreds of dollars every month in interest I pay extra. In this scenario of weekly payments I only receive XXXX of the XXXX benefits that weekly payments should give. Knowing how exactly mortgage works and that mortgage interested is compounded daily basis, this " inconvenience how servicer deals with my payments " is costing me NOT paying off my mortgage extra 2 years earlier and close to $ 50k in extra payments during the life the loan. I complained about this to Wells Fargo, but their response was simple as " That 's how we operate '' with no further explanation which leads me to initiate this complaint with CFPB.

Complaint: XX/XX/XXXX To Whom it May Concern : My name is XXXX, and I have been victimized and scammed online using my credit card and bank account. I am young and new to the US, immigrating from the XXXX a few years ago. I received a credit card from Wells Fargo to help pay for my used car and make monthly payments which I have been doing successfully until this scam hit my life and account in XX/XX/XXXX. My plea is to have some help to resolve being scammed and helping Wells Fargo resolve the terrible act that has been committed through me. The people were dishonest they were committing fraud through me. What I would like help with and demand are the following : This can be resolved by XX/XX/XXXX Wells Fargo corrects my account # XXXX back to the balance of {$1400.00} @ 0 % interest minus the payments received to date, and all fees occurred during the investigation. Wells Fargo must complete t their investigation with the attached detailed statements and series of events. It took Wells Fargo nearly 6 months after their primary investigation was concluding to say I need a police report. So I am doing that with the Consumer Financial Protection Bureau. This report coincides with the scam which occurred between XX/XX/XXXX and XX/XX/XXXX ( see Wells Fargo Statement XX/XX/XXXX - XX/XX/XXXX ). Wells Fargo must clearly understand that a scam occurred and I was innocently victimized and WF should have and could have stopped it. Now WF must complete their investigation why Wells Fargo allowed my credit limit to be exceeded twice by nearly XXXX and then XXXX dollars and why did their protocols not stop the scam. This occurred both in their branch and online. Please refer to the XX/XX/XXXX wells fargo statement, and our voice recordings with XXXX/XXXX and XXXX from wells fargo credit card support on XX/XX/XXXX, claim # XXXX. XXXX/XXXX of Wells Fargo agreed the over-limit and fraud detection should have prevented this WF error. XXXX/XXXX could not explain why the credit limit was exceeded twice and she agreed it should have been caught by the system and stopped. Accept my monthly payments of {$170.00} per month for the remainder of my balance of {$1400.00} at 0 % interest rate extending 0 % 12 months or more. My balance prior to the XXXX statement was for {$1400.00} for which I stopped making payments per the investigators ( and should not impact my credit, and all fees associated must be removed and voided ). I am now paying ~ {$170.00} per month per the XX/XX/XXXX letter I received in good faith to honor the {$1400.00} balance. Anything above that balance must be removed because this was a scam for which I did not know and Wells Fargo branch employees and credit card processing have been trying to be helpful yet I am now demanding that this be fixed. Wells Fargo must Update and Fix my credit at the XXXX or more main credit reporting agencies immediately and put my credit back in good status. Wells Fargo must correct this incident and problem. Whether or not I am XXXX years old or XXXX years old, a crime has been committed and I was duped into something for which I did not know was fraud.
