Complaint: I purchased my home on or about XX/XX/XXXX.I was forced to sign for 2 mortgages to be able to get the loan i was not aware of this until the day i showed up for closing. The house is underwater now. Iask Wells Fargo for forgiveness on the this loan. I feel that i was taken advantage of in this loan. I am XXXX years old and XXXX and I receive {$1500.00} from an accident at XXXX XXXX in XXXX which left me unable to work .Im currently in a chapter XXXX case # XXXX. Im writing to file a complaint. I also am going to file a complaint to FHA and DOJ about how my request for a Home loan Modification has been handled by your office. Im also researching for a law firm to possible handle a law suite against your company as well as the Substitute Trustees that were assigned to foreclose on my house ( XXXX XXXX XXXX. and XXXX XXXX XXXX. ).
Brief History : I refinance in XXXX with XXXX XXXX XXXX was told it was a fixed rate but later found out it was a sub-prime ARM even though I was a veteran with a credit score of XXXX. When I discovered the mistake I paid a {$150.00} fee to get the loan modified. Which I have a copy of a notarized Permanent Modification Agreement dated XX/XX/XXXX
Wachovia Bank bought up XXXX XXXX in XXXX, then Wachovia sends me a letter that they were changing my mortgage parameters because it was based on a COSI that was not in their program. I asked about my modification and sent copies of the paperwork, they just ignored me and didnt respond.
Wachovia was bought by Wells Fargo XX/XX/XXXX didnt know at the time. Still trying to get my Agreement done Bank says they dont have paper work.
InXX/XX/XXXX I applied for a Government Loan Modification when I was told that on XX/XX/XXXX my mortgage was going from {$1300.00} - to {$2100.00} a month. I had not missed a payment in 5 years or been late.
Told Bank was not doing MODs yet and it was for people who cant make payments.
XX/XX/XXXX unable to make payment ( wife also lost Job ) and savings ran out.
The Bank then put me on a payment plan of {$200.00} a month for XXXX, XXXX, XXXX, and to bring the payment to the local branch and pay while they review my request for a government loan modification that they are now doing.
I sent all Docs at least 3 times cause they said they didnt get them.
XX/XX/XXXX I get a letter that I own a balloon payment over {$7000.00}. Heard nothing of Modification.
OnXX/XX/XXXX called and spoke with a XXXX XXXX she said everything was complete and was being sent to underwriters.
Get letter dated XX/XX/XXXX unable to offer Modification because I did not provide all documents requested.
Called Bank on XX/XX/XXXX was told I didnt provide FORM XXXX ( which I sent XX/XX/XXXX ) and I had to start over. The bank also had a copy of my XXXX Taxes, was told it was my responsibility to make sure everything was up to date Submitted another request XX/XX/XXXX Was inform inXX/XX/XXXX that I was denied after they had sent out an appraiser for the house to do a drive by In XX/XX/XXXX I filed again for a Government modificationXX/XX/XXXX While waiting to here from bank after submitting paperwork 3 times I get letter from XXXX XXXX XXXX XXXX. That a total of {$93000.00} was needed to be paid by XX/XX/XXXX or foreclosure proceedings wood be started.
Never sent paper work or told they were assigned as Substitute Trustees and heard nothing from bank on XX/XX/XXXX Request for modification.
XX/XX/XXXX resubmitted application for modification XX/XX/XXXX XXXX XXXX XXXX acting as Substitute Trustees filed an Order to Docket Foreclosure with Preliminary Loss Mitigation Affidavit ( unknown to me ) XX/XX/XXXX XXXX XXXX XXXX filed the Defendant with the Order to Docket and paperwork ( unknown to me ) Get letter dated XX/XX/XXXX from Wells Fargo Home Preservation specialist XXXX XXXX that he was my contact and what to submit again, Also submitted my wife had a new Job (XX/XX/XXXX ) and her salary was {$68000.00} Letter dated XX/XX/XXXX from XXXX XXXX I was denied a Mod because lack of paperwork.
XX/XX/XXXX resubmit paperwork XX/XX/XXXX XXXX filed Final Loss Mitigation Affidavit ( unknown to me ) XX/XX/XXXXget a letter in mail from a Law Firm offering services because of a foreclosure auction on my house on XX/XX/XXXX Get letter datedXX/XX/XXXX from XXXX XXXX XXXX about pending auction.
XX/XX/XXXX Filed for Mediation XX/XX/XXXX filed chapter XXXX bankruptcy to stop foreclosure XX/XX/XXXX called XXXX XXXX XXXX to ask about docs for Mediation that they were suppose to send me and I filed Bankruptcy, They said there would be no mediation hearing onXX/XX/XXXXsince I filed Chapter XXXX.
XX/XX/XXXX XXXX XXXX XXXX assigned as substitute trustees.
XX/XX/XXXX bankruptcy court entered an order dismissing the case and terminating the automatic stay XX/XX/XXXX letter from XXXX XXXX XXXX that they had been retained with respect to the enforcement of the deed of trust and as of XX/XX/XXXX I owed {$400000.00}XX/XX/XXXX court issued a Notice of contemplated Dismissal Pursuant to Md. ( please note my wife now making {$74000.00} on her job and also her name is not on the house deed or loan ) This case was dropped by me because I was told I couldnt get a government loan because my wifes taxes were not done but they we willing to give me something else but there was a problem cause I got notice the house was sold at tax sale and when the papers were sent to me I sent them to you. XXXX XXXX told me I could reapply after 30 days and other programs would be open to me if I was not in chapter XXXX. So I dropped this case in XX/XX/XXXX think to reapply in 30 days but XXXX XXXX XXXX filed foe another Auction inXX/XX/XXXX and I was forced to file for Chapter XXXX again ( XXXX ) only to find out from XXXX XXXX I would no longer qualify cause the government program endedXX/XX/XXXX.
Sir I am willing to work this out but I have been lied to many times and misdirected and if the Bank is not willing to mediate this I have no other recourse but to file a law suite in federal court for fraud, This is were we are at this time. I hope I here from your bank within the next 10 days in dealing with this matter.

Complaint: On or aboutXX/XX/XXXX, we notice a Mortgage Lien on our Deed from Wachovia Bank in the amount of {$110000.00} that was n't our 's. We contact them to request a copy of all documents as proof of a completed Loan Application, Origination Documents, XXXX Application, Truth and Lending Documents that were signed by the property owners.
We also asked for a copies of all payment received from us as Mortgage Payments.
As of this date, all we have received from them if request for Account Number which we do n't have. They 're ( Wells Fargo formerly Wachovia Bank ) saying verbally there was no Mortgage with them. We brought this house inXX/XX/XXXX for {$92000.00} and we are trying to clear these small matter so we can retire.

Credit card company won't increase or decrease your credit limit
Complaint: Wells Fargo decreased my credit limit based on a recent update to my credit. I have never had a late payment and have made large lump payments in the past. They did not warn me about the change and it is also going to impact my score by increasing my debt to credit limit ratio. This is egregious behavior in their part because they are causing a " double hit '' on my score. I wast even made aware of the change until I tried to use the card for car repairs.

Problem using a debit or ATM card
Complaint: I filed three fraud claims with Wells Fargo- one was approved as fraud ( {$380.00} ) and the other two were not ( {$170.00} and {$270.00} ). I have spent hours talking with the bank to no avail my account is overdrawn. I have not received a debit card. I have been disrespected and belittled by the lead at the bank I have requested to speak to a supervisor and I have yet to receive a call.

Can't get other flexible options for repaying your loan
Complaint: XX/XX/XXXX I consolidated all my sons private college loans with Wells Fargo in the amount of {$86000.00}. My son was the primary borrower and I the co signer on all the private loans consolidated. In order for Wells Fargo to approve the consolidation they told me my son could not be on the loan because of his lack of credit history. The loan for all of my sons student loan debt would only be approved if his debt was consolidated in an educational loan in my name only. Now several years later, over the course of approximately 2 years, I have tried to refinance this educational loan. Every time I am turned down because I am the sole borrower of the educational loan. In order to refinance my son must be the owner of the loan in some way because he was the student. I do not have or remember the names of the institutions that I applied to and was denied for that specific reason. Eventually I stopped applying because each application was a credit inquiry. So instead of applying officially I started to call lending institutions and explain the situation, in each event I was told my son needed to be the borrower of the loan in order to refinance.
As far as i can see there is no way for me to refinance this loan out of Wells Fargo and I am locked into it until the loan is paid.
I have contacted Wells Fargo in XXXX and again just recently in XX/XX/XXXX to try to refinance at a lower acceptable rate and both times what I was offered was not acceptable. The first time after paying this loan for 5 years on time I was told I needed a cosigner with an interest rate that was out of the question. The second time I actually asked to have my son as the cosigner ( figuring if I could get him on the loan some how that maybe I would be able to refinance with another institution at a later date ) But the interest rate they offered again was not acceptable. ( My credit score is excellent ).
I also feel I have should have the right to refinance with another lending institution other than Wells Fargo but the way this loan has been structured by them I do not have that option.

Problem during payment process
Complaint: The problem I have was n't listed, so I choose what I thought to be the closest. My account was paid up, XXXX balance. I made the mistake of not deleting Wells Fargo from my payment calendar and on XX/XX/XXXX made a XXXX payment. When I realized the account had been paid off, I called my credit union to stop the payment but it had already been sent to Wells Fargo. I called Wells Fargo and they said they had n't received it but when they did, it would be credited back to my credit union account, in 5-10 days. On XX/XX/XXXX I still had n't received a credit to my credit union account, so I called WF again and spoke to XXXX in cust service. She said on the day I initally called, they had system problems and the transaction had not been processed and she would submit again. Check would be mailed, account not credited, in 7-10 days, by XX/XX/XXXX. On XX/XX/XXXX I called WF again because I had not received a check. I was told it had not been completely processed but as soon as it happened, the check would be mailed. I asked the man when the processing would be complete and he said he could n't give me a time frame. On XX/XX/XXXX I called again and asked to speak with a supervisor. I was connected to XXXX. He said a check for XXXX was sent to me on XX/XX/XXXX. I told him I never received a check and had no idea where the extra XXXX came from. He said an affidavit would be sent out in the next three days fo me to sign, saying I had n't received a check. Upon sending affidavit back, a check would be issued in 7-10 days. Address was confirmed. Today, XX/XX/XXXX, I called back since I have n't received anything. Asked for a manager and was connected to XXXX. He said no affidavit would be issues for anything under XXXX and that a check had been sent to me and cashed on XX/XX/XXXX for XXXX. He said there was nothing he could do since there was a check cashed and he could n't verify I had n't cashed it. I went back to look at all my deposits from XX/XX/XXXX though today and there is n't a deposit for XXXX, XXXX or from anything other than my pension, SS, deposits from my kids when I babysit my grandkids or when I transfer to checking from savings account. He insinuated I could have cashed the check, for cash and just 'forgot '. I told him if I had done that, I certainly would n't be going through all this for XXXX and informed him I was going to file with FTC. He then connected me to the Executive Office. I spoke with XXXX who has created a case with their investigation dept. Case # XXXX. Agents name is XXXX XXXX. She is suppose to contact me in 4-5 business days.

Cashing a check
Complaint: This problem is with Wells Fargo Bank in XXXX, CT. I am not a customer of Wells Fargo. I have a check drawn on Wells Fargo issued by XXXX. Wells Fargo refused to cash the check without charging a check cashing fee, although the check was drawn on an XXXX account at Wells Fargo bank. Wells Fargo blamed XXXX, saying that XXXX 's account does not allow " free '' check cashing. I spoke with the manager, XXXX XXXX of the branch, whom would not waive the fee and stated that I need to either cash the check at my bank or contact XXXX. It does not make sense to me that Wells Fargo would assess a fee to cash a check - is n't that their core business?

We submitted a lot of documents as supporting documents but they will not give us explanation to why its not going through.
