Complaint: I applied to refinance my home using my VA entitlements with JG Wentworth ( and XXXX XXXX XXXX as the loan officer ) and believe they were deceptive in their practices. I was initially told my interest rate would be 4.25, so I moved forward with the process. I later learned that they would have to raise the interest rate to 4.375. I complained and noted that I had another lender that would process the refi at 4.25 at which point XXXX said they would match if I got them written proof, i.e. the loan estimate from the other lender. Which I did provide. XXXX did match the rate but he raised the loan organization fees without consulting or notifying me. I decided to let them move forward as they reduced some of their other fees making it less expensive than the lender they matched. Then 2 days before I was to close on the refinance, I received a call from XXXX telling me there was a mistake and that I had to have 210 days aging in my current loan ( I had made 6 payments which is what I was told was the new VA requirement to do the refi ) and I would be unable to close on the refi until XXXX At which point XXXX sent out a new disclosure which again without my knowledge or consent included doubling the lender fees. Lastly, to make matters even worse not once, but twice they requested an urgent pay off request of my current mortgage which added fees to my account that I had to pay. I never authorized those transactions nor should I be responsible for those fees that they incurred. Due to these deceptive practices I move my refinance to another lender.

Complaint: This is now my second complaint with the CFPB and I am shocked that no one cares to try to fix my problem. I thought the CFPB had some power to protect the consumer. I am very disappointed in this process. I am have in contact with J.G. WENTWORTH home leading since XX/XX/2018 and have been ignored, disrespected and made to feel worthless. J.G. WENTWORTH screwed up at closing and I am now forced to pay an additional XXXX a year and they said it was bc of taxes. That's a lie. Taxes are not allowed to go up that much in a year California law article XIIIA of the state constituon commonly referred to as prop 13. They are not helpful and condescending. I am tired of calling 100 times and not getting anywhere. I have now found another person who J.G. WENTWORTH also XXXX up with and forced them to change an already signed CD bc they left off PMI and threatened not to fund. These people are scum bags. I have contacted by 3 different dispute resolution employees, 3 managers and VP of the entire department to have almost zero movement. The VP was condescending and flat out lied to me on recording and in writing. I WANT RESOLUTION, NOW!! I AM TIRED OF THIS XXXX!!

Complaint: I used J G Wentworth to refinance my homestead at XXXX XXXX XXXX, XXXX XXXX, Texas XXXX. They sent me payment instructions for my first payment, so I mailed it in early to make sure they got it. A week or two later they state that they have sold my paper to XXXX XXXX XXXX. I called Wentworth to find out what happens to my XX/XX/XXXX payment and they assured me that it would transfer with the mortgage. On XX/XX/XXXX, XXXX redraws the payment again for {$3500.00} which means I have paid XX/XX/XXXX twice. I called XXXX and they stated they did not have the XX/XX/XXXX payment transfer to them when the loan was sold. I called J G Wentworth and have not gotten a reply. 2 Calls and an email later, no answer. Please help! JG Wentworth was a nightmare to deal with on the whole process bty. XXXX XXXX XXXX

Complaint: XX/XX/2018 To : CFPB To Whom it May Concern, I am very upset at how my mortgage process was handled by XXXX. XXXX.Manager XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX, VA XXXX used a tactic called BAIT AND SWITCH on me. When I started my mortgage I was locked in at XXXX % with point. When I finished 4 months later my interest rate was XXXX XXXX with XXXX points. I needed two extensions from HUD which cost me an additional {$700.00}. My mortgage process should never have taken 4 months. The conventional mortgage was changed to a Construction/ Home Improvement Mortgage. The time extension that XXXX. XXXX caused was based on their report stating that the living room/ dining room/ kitchen floor, basically the whole house floors were in need of repair, the total cost being {$7400.00}. The floor did not need to be repaired. In doing my research the previous owner had 4 dogs ( XXXX ) what happened was these dogs XXXX all over the floor which caused an odor. I repaired by encapsulating the oder area with XXXX and XXXX paint. My total cost was {$200.00}. The reports writer never mentions dog XXXX in any report and that was the problem all along. Both XXXX. XXXX and manager XXXX XXXX, are both accountable because of their incompetence extended the mortgage so that I would pay the higher interest rate and additional fees. Complaint: From XX/XX/XXXX until XX/XX/XXXX, XXXX disregarded their duty to promptly credit payments. During this time period, XXXX failed to credit 6 periodic mortgage payments and issued incorrect account statements. Under 12 CFR 1026.36 ( c ) ( 1 ) ( i ), a mortgage servicer must credit a payment to a consumers loan as of the date of receipt. XXXX failed to credit 6 periodic payments for a period up to 1 year and 9 months after the payments were received. In making good faith effort to resolve the account issue, I attempted to contact XXXX by phone between the months of XX/XX/XXXX and XX/XX/XXXX. During this period ( ~1 year 2 months ), XXXX did not initiate calls or return calls, made false and confusing statements over the phone, did not offer loss mitigation options, and did not report the correct amount due or balance on account statements. I made many countless attempts to contact XXXX. Some attempts that were thwarted early due to prolonged hold times. Other instances when I reached someone, and they made me believe they were trying to help you, and they had me hold for just a little bit more while they " researched '' the account, or spoke to an underwriter, only to return and to tell me bluntly and sharply that nothing was accomplished, that no promises could be made, and that there was no open investigation. There were multiple instances when I was told by a representative that they could not promise me a call back. There were other instances when I was promised a call back, one representative gave me their word, another scheduled a specific day with a specific time-frame, only in each and every instance to fail to call me back. On XXXX XX/XX/XXXX, an account statement was issued from XXXX finally crediting payments made between XX/XX/XXXX and XX/XX/XXXX. I have included this statement. I have also included the statement from XX/XX/XXXX which shows the previous incorrect balance reported. They issued these statements without calling me or issuing an appropriate notice to me that after 1 year and 2 months of making multiple requests for XXXX to correct their record, that XXXX had finally recovered the payment I made and credited them to the account. After finally crediting the payments, XXXX never acknowledged the account error. XXXX never issued a statement showing the refund of associated late fees and the refund of any additional interest assessed. I am also concerned that XXXX never reversed any erroneous reports to credit bureaus. Additionally, I believe XXXX has not credited 2 additional payments made for XX/XX/XXXX and XX/XX/XXXX. I have attempted to provide you to this point with a straight forward, unemotional account of what actually occurred in each of my complaints. However, I really hope you understand how truly devastating emotionally and how desperate this situation feels to the consumer. After I was willing to admit what was happening to me, and to come out of my denial and come out of my hiding, I started to read accounts online. The more I read the more I believe that like many others, I was targeted by a corrupt and morally bankrupt corporation. I was targeted for being an at-risk consumer, whom already had burdensome debt, that could be easily pushed to default and stripped of the protections under consumer financial legislation in order to seize my property and collect on insurance. This organization has decided that targeting certain consumers, and defrauding them of their homes is a better business model for success and provides a better return on investment. They have targeted consumers that have just finished trial modification plans. They have targeted consumers that have just modified following bankruptcy. They target at risk borrowers. When this happens to you as a consumer, you can not believe how long it takes and how many times you need to repeat the same story over and over, before people actually start to listen and you begin to gain traction and support. You are the victim, however it takes so long before people around you even understand what is happening to you. XXXX disregarded their duties, they stopped contacting you, they stopped providing accurate statements, they stop crediting payments, and they lie. This is your home. Please read reviews regarding XXXX and see relevant settled caselaw ( XXXX v XXXX XXXX ; XXXX v XXXX XXXX, etc ) and perhaps then we may all begin to see the pattern of abuse. What happened to XXXX XXXX, what happened to XXXX and XXXX XXXX also happened to me.

Complaint: XXXX failed to initiate foreclosure and failed to provide any loss mitigation options in the first 6 months following delinquency in violation of 24 CFR 203.355 ( see also MORTGAGEE LETTER 2013-39 ). XXXX disregarded their duty to comply with loss mitigation procedures. According to HUD guidelines, mortgagees must utilize a Loss Mitigation Option or initiate foreclosure within six months of the date of default. XXXX initiated foreclosure XXXX XX/XX/XXXX ( ~1 year, 7 months after default ). XXXX did not abide by the XXXX XXXX XXXX as set forth in MORTGAGEE LETTER XXXX. XXXX deliberately stalled and hampered loss mitigation efforts. Between the months of XX/XX/XXXX and XX/XX/XXXX, the mortgagor was the only initiator of communication over the phone. During this 1 year 2 month period, XXXX did not initiate calls or return calls, made false and confusing statements over the phone, did not offer loss mitigation options, and did not report the correct amount due or balance on account statements. XXXX first offered loss mitigation options in their XXXX XX/XX/XXXX notice of intention to foreclose. At this time, a loan workout application was started and loss mitigation options were first considered and later denied. Because XXXX violated 24 CFR 203.355 in multiple ways, loss mitigation efforts made by the borrower were rendered completely hopeless and impossible and allowed the account to fall into arrears to an insurmountable amount. I am filing complaints with these agencies that provide oversight to XXXX to report the multiple violations of the Code of Federal Regulations. I am also trying to raise awareness and sound the alarm to a potential and likely scam by XXXX to target certain at-risk mortgagors, whom may already be experiencing financial difficulties, in order to push them into hopeless situations, to strip them of their protections under the Real Estate Settlement Procedures Act, and to defraud them. If XXXX had taken the appropriate action at the appropriate time, and followed the law, I would have been able to cure the default. But as with any consumer that already has burdensome debt, because XXXX ignored my many attempts to seek loss mitigation for over a year, they pushed me into an insurmountable financial situation.

Complaint: I have been trying to work with XXXX. XXXX since XX/XX/2018 to get the MI off my house. They have passed me around several times and nothing has happened ; no help, no responses and no action. I was originally told by a manager that a 3rd party would call me for new appraisal and nothing, the number I was calling no longer worked for that manager. I then requested for my MI to be removed through their email process months ago as well. Generic response with no help, I emailed them back with more information and no response. For the last 6 weeks I have been trying to work with Al XXXX XXXX. for home lending and nothing has happened. I have received 1 email saying he is working on it at week 2. I have called, left messages and emailed with again no responses. My loan has no waiting period and the MI can be removed. This has now cost me more than the cost of a new appraisal which I was told at first my upgrades would prove enough and wouldn't need, then later was told I would need. I agreed and nothing has happened still. This company in my experience is a joke and has done nothing to service my loan. I have phone records and emails to show my interest in the MI being removed and almost nothing in return.

Complaint: We closed on a house on XX/XX/XXXX, but title agent said we still can file complaint. Initially we licked our rate at 4.6 %. Then I asked about lender credit to cover pmi and some closing costs. We increased interest rate to 5.25-5.5 %. And this would have covered upfront pmi and all closing costs and prepaid items. So, the only item we were responsible for is our down payment ( {$11000.00} ). We paid {$4000.00} as an earnest money, so remaining cash to close amount was {$7500.00}. 3 days prior to closing lender released CD where cash to close amount due was almost {$11000.00}. When we tried to clarify this, lender said this is not final amount and it will be corrected. Couple days later we received another CD reflecting little bit more than {$17000.00} as cash to close and our rate was increased to 5.75 % without our knowledge and consent. That triggered our payment increase by almost {$100.00}. Than a day before we received another CD, with increased rate and little bit more {$12000.00} cash to close amount, I tried to connect with Consultant, supervisor and manager regarding this. The only answer I got is that pmi all of the sudden increased. No one disclosed pmi amout to us. We submitted documents 3 weeks before closing and lender waited until the last moment to disclose this info. I still dont know what is increased pmi amount is. It was never disclosed to us. We spent all day at closing table and did not know what is the final cash to close is. When final CD appeared we noticed that lender increased rate even more without our consent and agreement and final cash to close was {$5000.00} more than discussed. This triggered ur to liquidate our savings. I had expressed my concerns to title company and said that current CD is not accurate and was told that we should sign and I still will be able to file complaint. I strongly believe that rate can not be increased without customers consent. Additionally, full disclosure should be provided in advance. Please help to resolve this problem.

Complaint: I applied for a new mortgage with JG Wentworth on XX/XX/18. XXXX XXXX NMLS # XXXX My closing date was supposed to be XX/XX/18 more than 60 days from the origination date. The company used the wrong loan type ( refi vs. new ) to gather information about title processing fees which put my loan outside of the acceptable range so my final loan approval which has been in process for many weeks has been delayed by an additional 3 days. I am selling a property as well as purchasing so coordinating services, utilities, movers, walk through, etc must all be changed now. My moving company is charging me {$500.00} per day to hold my belongings an additional two nights. I have no where to live for two days. I have to reschedule multiple services and several people who were coming to help must also change their plans. I am fully aware that things can go wrong when mortgage originators are involved but it has been established that JG Wentworth caused this problem because they mostly handle re-fis not original mortgages. They didnt disclose that to me when they sought my business. As this unfolded, XXXX boss XXXX called me and chastised me for my attorney speaking harshly to XXXX. He told me he has call recordings of the conversation. How I am responsible for something my attorney said is beyond me. The final result is that XXXX agreed to eat the {$300.00} mistake that XXXX made but that doesnt remedy the additional {$1000.00} that I will have to pay for the movers to hold my belongings for two more days nor the extreme complications this causes multiple parties. XXXX tried to pressure me into using their title company because he said the one the seller chose was too expensive. I refused to do that. That alone seems unethical if not illegal. They also tried to increase the mortgage rate by a quarter percent due to their error but my attorney was able to stop that from happening once they admitted it was their fault.

Complaint: I was already working with XXXX XXXX on an FHA and paid for the FHA appraisal when I received a phone call from XXXX at XXXXG Wentworth Home Lending. He explained to me that they offered a 5 % down payment conventional mortgage with lender paid mortgage insurance so I would save money versus going FHA. Obviously removing mortgage insurance sounded great so I had him draw up a loan estimate. I reviewed it and everything looked good. I signed the documents requested and sent him what he needed. He ordered the appraisal and I paid the {$450.00} for the conventional appraisal. At this point I have now paid {$950.00} for appraisals, but was willing to over look that since XXXX was so confident this was the best move for me and very convincing that the monthly savings I would get from not having mortgage insurance would make up for it. After a little bit of time I did not hear anything so at that point I decided to reach out for an update. This was on a Wednesday early XXXX. XXXX informed me that I need not worry, but he was fighting with underwriting. He said he would call me back with an update. 2 days later I get a call and he tells me that I don't need to worry, but they were switching me from XXXX to XXXX and if I didn't hear from him over the weekend everything was fine. Come Monday I have not heard anything so I reach out to him. He tells me that my LTV is too high and we have to go FHA. I have already expressed to him prior to this that I had no interest in goign FHA. He tells me that the only way to go with conventional route that we are trying for is if I get the LTV under 90 %. So I ask him to redo the loan without the sellers assist. This gets my LTV to 86 %. About a day later I get a new loan estimate. At this time he tells me that secondary already approved my LTV and I just need to get a new bank statement to XXXX the LP to show that I have the new amount for closing. I jump through hoops to get the correct cash to close and provide all documentation showing how I got the funds and that they were available in my checking account. After several days I don't hear anything. I checked in with XXXX and he said we are good and on track to close the XX/XX/XXXX as planned. I followed up with him last friday the XXXX and he said there is no new news we are just waiting for the closing disclosure to set up the closing details. I followed up with him yesterday morning ( XX/XX/XXXX ) and he informs me that they are trying to say they can't do the loan because I make too much money, but that wasn't the loan type he submitted me for so it is an error on their part and I need not worry. He will call me back. I have to call him back becasue he doesn't reach out to me and he tells me he is still waiting for a response, this was around XXXX. Well we arrive at XXXX last evening and he calls me to tell me that they can not approve the loan becasue they can not give me pricing with the LTV that high and when they could get pricing the points were to high. They let me know 4 days before close that everything that was promised to me and supposedly already approved was a lie. I have gotten in contact with a new lender this morning and sent them the loan estimate I received on XX/XX/XXXX from XXXX. After she received it she advised me why it failed. It turns out what XXXX was telling me was due to the " lender paid PMI '' they were charging me outrageous points. So basically I was paying the PMI upfront, but it was being disguised as points. The loan he wrote was illegal. From day one he wrote a phony loan that never would have made it through processing. Why in the world would he string me along with a bogus loan? Why didn't anyone contact me sooner to let me know that the loan could never work instead of allowing me to get screwed 4 days before I'm supposed to close. If someone would have let me know we could have tried to work something out where I paid the PMI and dropped the points so I could still be closing this Friday, but instead I was lead to believe a complete lie. I've been completely understanding and flexible with this company. I have done everything that was asked of me very quickly. Just to be played by a loan officer who apparently doesn't know how to write legal loans. All the calls with XXXX can be reviewed to hear the false promises I was given. I also have email communications and the loan estimate showing the garbage loan he tried to write for me. Due to the false sense of closing on the XXXX, I have already made arrangements for utilities to be put in my name. I am purchasing the property I am renting and this puts me in a very awkward situation with my landlord, the seller. I feel as though JG Wentworth Home Lending should be more aware of the practices their loan officers are doing.

Complaint: I was told if I paid {$500.00} and installed smoke alarms and such totaling another {$250.00} that I could obtain an FHA loan on my property since I had been current in my payments. Then I was told that because my property was listed as a condominium on the county recorders office that the loan was being denied after submitting paperwork and paying fees. Then it was represented to me that I could obtain a conventional loan even though I was recently dishcarged from chapter XXXX bankruptcy in XX/XX/2018. I think more research should have been done on JG Wentworth 's part before taking my {$500.00} which I am sure is nothing to them but is quite a lot of money to me.
