Complaint: I recently graduated from graduate school in XX/XX/XXXX, at which point a number of student loans I am holding ( from XXXX expenses ) went from being in deferral to being in their 6 month 'grace period '. After learning that my private student loan debt was being serviced by a company called " University XXXX XXXX '' ( XXXX ), I set up an account with the company to see what I owed. What I found was that XXXX listed two loans in my name, XXXX of which was familiar to me ( and which I have since refinanced with another lender ), and another that was not. Specifically, this second loan that I did not recognize was listed as being held by the XXXX XXXX " XXXX XXXX XXXX '' XXXX XXXX ), which has ( to this day ) not showed up in any of my credit reports. After searching the internet, there is no website or contact information available in connection to this lender. Some of the only relevant information I could find about this lender was that their loans were bought in XXXX by another lender " XXXX '' in connection with a foreclosure sale. I have a document from XXXX stating this ( attached XXXX. I have also contacted XXXX and they assured me that they did not own this loan ( however, they did own my other loan serviced by XXXX, which I have since refinanced with another lender ). At this point, I contacted XXXX for clarification regarding the details of this loan and to express my concern regarding its potential validity. UAS responded via email that " Some loans from EEF were purchased by XXXX but not all ''. I contacted XXXX again shortly after to request contact details for the lender. I was told that contact details were not available for EEF and that I should instead direct all inquiries to UAS. Strangely, after some prodding, a representative at XXXX gave me a phone number for XXXX, which when I called it someone answered and confusedly said I had the wrong number. On XX/XX/XXXX, I called XXXX again to request a copy of the Master Promissory Note ( MPN ) for this loan, as well as any other kind of documentation proving its validity. Also, on XX/XX/XXXX, I mailed a signed, formal request for the MPN for this loan to XXXX ( attached ), which I can verify via tracking ( receipt attached ) was delivered to XXXX on XX/XX/XXXX. As of XX/XX/XXXX, XXXX has still not provided a copy of the MPN or any other documentation establishing debt verification to me for this loan. The loan is now entering delinquency, and I don't feel comfortable making any payments without any evidence that the debt is indeed valid. I have expressed this to XXXX and requested that repayment be halted until proper documentation is provided, but XXXX has continued to threaten me with late fees, collection agencies, and negative credit reportings if I do not pay soon.

Complaint: On XX/XX/XXXX I sent a certified letter to the 3 credit bureaus with regards to TransWorld System Inc. My specific complaint was the re-aging of the account. The original creditor is XXXX ( XXXX XXXX XXXX ), they are the local electric company. This debt has been paid. Neither the collection agency nor the utility company dispute this fact. I contacted XXXX and was told the original date of delinquency dated back to XX/XX/XXXX. I explained to XXXX that the creditor was still reporting this file beyond the 7 year statue of limitations. XXXX instructed me to contact Tranword System. I contacted Transworld system and was told to challenge the inaccuracy on the report. I explained to Transworld I had already done so. Transworld sent me a copy of the last bill XXXX billed me for, dated XX/XX/XXXX. I explained to the Transworls agent, and several supervisors, that XX/XX/XXXX was the LAST date of delinquency and not the first. I was then instructed to call XXXX to get proof. I called XXXX and spoke with several layers of supervisors. I explained that Transworld was reporting an incorrect date. They said to talk to Transworld. I asked XXXX to please send me copies of all my statements as proof that the original date of delinquency occurred in XX/XX/XXXX. XXXX agrees with my date. However, I was told that XXXX did a computer update XX/XX/XXXX. I was told my request was impossible as all statements of charged off account prior to XX/XX/XXXX have been permanently purged. I'm stuck in a vicious circle of the original creditor and the collection agency both pointing the finger at XXXX another. It is my understanding that the collection agency must verify this information. Transworld does not seem to want to take the time to understand my specific complaint. It appears all I get are computer generated templates. Sending me a copy of the last bill XXXX has ever sent me is terrific. It's not what the complaint is. The complaint is SPECIFICALLY the date of first delinquency of XX/XX/XXXX. Can you please help me resolve this and if needed can you guide me on how to sue this collection agency. Thank you.

Complaint: I initially took out two loans from a XXXX XXXX through the website " XXXX '' in XXXX. During the recession, the bank closed down and I was unable to find the servicer to pay the debt. Then, 3-4 years ago I received letters out of the blue from a company called " XXXX '' indicating that my debt had ballooned over 200 %, and charging frankly usurious rates ( 11 % +, variable ). While I began paying knowing that I did indeed take out loans, I recently read about companies ( including specifically XXXX ) requesting payments for debts that they do not actually own. I have since requested actual documentation on the loan ( including the original Master Promissory Notes and records of debt transfer ) in order to refinance. They have repeatedly ignored my requests, and at this stage are no longer responding to my requests. I would like this documentation to prove that the debt is indeed mine, and that I am not paying some random company for no reason.

Complaint: this is my old complaint from XX/XX/XXXXOUR COMPLAINT XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, OH XXXX Re : Unlawful Debt Collection Practices and Harassment To Whom It May Concern, I am writing to you in your capacity as State Attorney General to make you aware of unscrupulous and unlawful debt collection practices by XXXX XXXX XXXX XXXX XXXX and subsequent illegal harassment through its agencies XX/XX/XXXX, XXXX & XXXX, XXXX within the State of Ohio. I am sure if these events that are happening to me, they are also happening to hundreds of other individuals who owe student loans. It is a travesty of justice and needs to be stopped. On or around XX/XX/XXXX, I contacted XXXX XXXX XXXX ( XXXX ) XXXX, which is a Debt Consolidation Company to consolidate my student loan debt which was owed to XXXX XXXX XXXX XXXX XXXX. This was supposed to help make it manageable for me to pay. The consolidation was to be handled through XXXX XXXX and the agreement was for one payment to XXXX and they would be disperse to each of the five loans for a fee of {$50.00}. As soon as I started paying, XXXX started harassing me for payment. I was sent a harassment letter stating that they were going to sue me and garnish my wages. They were contacting my employer between XX/XX/XXXX and XX/XX/XXXX. According to the Fair debt collection practices act, they can not threaten to sue or call your employer after you inform them to not contact employer. ( 806 Harassment or Abuse of the Fair and Accurate Transaction Act ) On or about XX/XX/XXXX, at approximately XXXX XXXX a sheriff to my residence to provide me a return of service of summons. This is past the time allowed by law to serve papers. In the Court records the sheriff wrote that he served the paper at XXXX XXXX but this was an inaccurate statement as I work the third shift and was not home at that time and I have proof taken on my XXXX XXXX phone ( detail on account XXXX ) that my girlfriend took, as she was home when the papers were served. From XX/XX/XXXX, through XX/XX/XXXX, I made payments promptly and was never late. ( Statements from XXXX verifying attached ). XXXX, XXXX XXXX XXXX, the law firm representing XXXX XXXX XXXX ( XXXX ), started requesting that my wages be garnished. I was forced to obtain legal counsel ( Mr. XXXX XXXX ), to negotiate the terms and stop garnishments, even though I was never late making payments to XXXX. An agreement was reached on XX/XX/XXXX through the attorneys, and we agreed that I would pay {$120.00} per loan for five loans, or {$600.00} per month. On XX/XX/XXXX, they filed again for garnishment while I was making payments on time. The first payment under this new agreement was due on XX/XX/XXXX. Despite knowledge of the due date, XXXX, XXXX XXXX XXXX executed a wage garnishment on Plaintiff on XX/XX/XXXX, in violation of the spirit of the payment agreement. I had to go to Court to stop this illegal garnishment of my wages. On my Court date of XX/XX/XXXX, I explained to Judge XXXX that I had not missed any payments and that I was doing everything in my power to pay and could prove my payment history. Judge XXXX said that we had to negotiate terms within 10 days and get back to the courts. On the last day, XXXX XXXX, attorney with XXXX, XXXX XXXX XXXX called to negotiate terms. He admitted that the reason for garnishment was because the payments were not being applied accurately on their part, which went against the agreement. During the negotiation for payments on the phone, I stated what I would pay and asked what his counter would be. Mr. XXXX refused to negotiate with me even knowing he was in the wrong and this now put him in contempt of court. The judge called the law firm to speak with him and he received no response. They were going to consolidate my debt which was only through XXXX XXXX originally. The agreement would be that I would make one payment to XXXX and they would disperse to each of the five loans for a fee of {$50.00}. That is when the harassment began. I was sent a harassment letter stating that they were going to sue me and garnish my wages. They were contacting my employer between XX/XX/XXXX and XX/XX/XXXX. According to the Fair debt collection practices act, they can not threaten to sue or call your employer after you inform them to not contact employer. In XX/XX/XXXX, XXXX XXXX XXXX Merged with XXXX based XXXX XXXX XXXX. These two large banking companies completed the acquisition of XXXX XXXX in quarter three of XX/XX/XXXX. This is when my student loans were sold to XXXX XXXX XXXX XXXX XXXX, which is a debt collector out of Delaware as a trust, not a lender. They bought or sold to multiple private student loans for the purpose of hedging. ( XXXX ( XXXX ) XXXX. Statute of limitations is another thing that was brought to my attention. I had multiple loans that were taken out between XX/XX/XXXX and XX/XX/XXXX and payments were never made, because I never signed an agreement with XXXX. According to the laws in Ohio, no debt collector can take legal action after six years ( XXXX XXXX XXXX XXXX ; XXXX XXXX XXXX XXXX ) Chapter XXXX : INTEREST XXXX Maximum rate of interest. ( A ) The parties to a bond, bill, promissory note, or other instrument of writing for the forbearance or payment of money at any future time, may stipulate therein for the payment of interest upon the amount thereof at any rate not exceeding eight per cent per annum payable annually, except as authorized in division ( B ) of this section. http : //codes.ohio.gov/XXXX Ohio Usury Laws Ohio has established a usury cap on personal loans in that state at 21 %. This usury cap applies to personal loans that are made in Ohio and involve an individual that is borrowing the money in question. In Ohio, if a personal loan agreement that contains an interest rate above the 21 % level is brought before a court in that state, the agreement will be declared illegal. The net effect of such a judicial declaration is that the loan agreement will be voided. Once voided by the court, it no longer is enforceable. In other words, the borrower will no longer be obliged to make payments pursuant to the loan agreement. The borrower is off the proverbial hook. XXXX XXXX XXXX ( Assignment ) When XXXX XXXX XXXX buys the loans, they then transfer them to subsidiaries such as XXXX XXXX XXXX XXXX XXXX XXXX or XXXX XXXX. ( There are several trusts ) For each year from XX/XX/XXXX-XX/XX/XXXX, the transfer from the original lender to XXXX XXXX XXXX is done through what is called an assignment, which they would not produce for me, but would prove that they are the current owners of the loan. Not accurately reporting my payments to each of the three credit bureaus ( XXXX, XXXX, XXXX ) when I filed a dispute about XXXX XXXX XXXX XXXX XXXX, they had 30 days to prove that I didnt make payments. In about 45 days, I received letters that all three bureaus removed them from my report failing to disprove my dispute. ( copies of each report attached ) violating the Fair and Accurate Credit Transaction Act. Breech of Contract. FromXX/XX/XXXX, through XX/XX/XXXX, I had made payments promptly and never late. ( Statements from XXXX verifying attached ). XXXX, XXXX XXXX XXXX, the law firm representing XXXX, started requesting that my wages be garnished. So that is when I got a local lawyer involved, XXXX XXXX, to negotiate the terms and stop garnishments. The agreement was that I pay {$120.00} per loan for five loans. This was agreed to by XXXX XXXX XXXX, XXXX XXXX XXXX XXXX attorney on XX/XX/XXXX. On XX/XX/XXXX, they filed again for garnishment when I was making payments on time. I then decided to fight back and went to court on XX/XX/XXXX, and explained that I havent missed any payments and that I was doing everything in my power and proved payment history. Judge XXXX said that we had to negotiate terms within 10 days and get back to the courts. On the last day, XXXX XXXX, attorney with XXXX, XXXX XXXX XXXX called to negotiate terms. He admitted that the reason for garnishment was because the payments were not being applied accurately on their part, which went against the agreement. Complaint: I checked my credit score for the first time in XX/XX/XXXXafter accepting a seat in a graduate program. I was absolutely shocked to see that I had 9 late payments on my XXXX Loan, as I had received no notices that this bill was not being paid along with the rest of my loans each month. I called XXXX XXXX XXXXs on XX/XX/XXXX and they informed me the only way to clear my credit score of the default and late payments was to get the loan cancelled through a qualifying job. They also gave me access to my account so I could see my bill for the first time. Finally, they told me if I met the requirements for loan cancellation, all negative marks on my credit score would be erased. At the time, I was nearing my one-year anniversary working as a full-time XXXX XXXX. Multiple UAS representatives told me this position qualified for cancellation of my loan payment and erasure of both the default and the late notices on my credit score. I mailed the cancellation paperwork detailing a year of full-time XXXX XXXX employment on XX/XX/XXXX. The 9 month grace period on the XXXX Loan lasted from XX/XX/XXXX ( graduation ) through XX/XX/XXXX, and my cancellation was granted from XX/XX/XXXX-XX/XX/XXXX. On XX/XX/XXXX, I called to confirm my paperwork had been received. I was told to wait a little longer for processing. I was also reassured that once the cancellation paperwork was received, the default and all late payments would be cleared from my credit history. On XX/XX/XXXX there had been no changes to my account. I called and the representative told me the corrections had been processed, that the late notices would be cleared, and that I should wait until the beginning of the month to see the changes. On XX/XX/XXXX, I called again. I was told to wait until the beginning of XXXX to see the changes. When I told them those were my instructions from the previous month, the representative told me he would contact the account specialist. He also confirmed my credit history would be completely cleared. On XX/XX/XXXX, I called to follow up and was asked to send screenshots of my credit report. I did this while on the phone with the representative and she told me they had made an error, that she would follow up with the account specialist, and that the late charges would be cleared. ( The default was cleared at some point before this, but the 9 late notices are still damaging my score. ) She promised to call me the following day and asked me to follow up if I hadn't heard from her. I called again XX/XX/XXXX after the previous representative did not contact me, and was told by a different representative that my credit score had already been cleared and to wait for the beginning of XXXX. After I explained how many times I'd heard these same instructions, she told me she'd email the account specialist. On XX/XX/XXXX, my account still was not cleared. I emailed to follow up and emailed again on XX/XX/XXXX. On XX/XX/XXXX, I received a response that my account would be updated at the beginning of XXXX. On XX/XX/XXXX, I was told to contact XXXX XXXX. I did so and on XX/XX/XXXX, the XXXX representative responded : " I requested the negative history from 2/XX/XX/XXXX-XX/XX/XXXX to be deleted and 'deferred loan ' used for the same time period. Please allow 10 days for the AUD to update. '' On XX/XX/XXXX, I receive a credit score alert that 2 late payments had been removed, bringing the total late notices down to 7. On Friday, XX/XX/XXXX, my history again showed 9 late payments. The XXXX representative sent an urgent email to UAS billing service and requested another credit update. Since then, I have not heard from XXXX despite 2 follow-up emails on XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX, I called and spoke to a supervisor, who discovered a technological error that prevented my credit score from being cleared. He gave me his word this would be fixed immediately and forwarded the issue to the UAS tech department for resolution. On XX/XX/XXXX, I called to confirm the supervisor had done what he promised. That supervisor said the cleared credit history was being submitted to the credit bureaus that afternoon. On XX/XX/XXXX, I'd seen no change to my credit score, so I called and was told the correct information had been submitted XX/XX/XXXX. This was clearly not true, so I called back and was told to wait for the beginning of the next month. I then spoke to the manager, who said the correct credit score was submitted XX/XX/XXXX and to wait 24-48 hours for an email. On XX/XX/XXXX, I'd heard nothing and called to inform her that UAS is in violation of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act for false credit reporting. As of today ( XX/XX/XXXX ), I still have heard nothing from UAS and my credit history is unchanged.

Debt is not yours
Complaint: I received what I believe to be a fraudulent debt collection letter for a debt I never owed or have not been contacted previously. I believe it is a scam. I did not try to contact the company because i did not wan them to even know I was interested. I have attached a copy of the letter. My address is even wrong on the letter. It is a 5 digit house number not a 4 digit.
