Complaint: Despite repeated phone calls to TD Bank, complaining that reordering transactions from High to Low, has resulted in hundreds of dollars of overdraft fees, I was told that I did not " fully opt out ''. I do not understand. They wanted me to listen to a recording and " consent '' at the end. Yet, their recording stated that I may still be charged {$35.00} per transaction, even after I sign up! I immediately denied this and I can prove this because I recorded the conversation. This is lawful because I live in New Jersey, which is a one party state. I also read that despite TD Bank paying a {$62.00} XXXX dollar settlement for reordering transactions, they continue the practice to this day. TD Bank remains the only bank who still reorders transactions from High to Low. I 've tried several times to work this out with TD Bank, to no avail. This is horrific and this predatory practice preys on those who, like me, live paycheck to paycheck, for they know we are also the least likely to fight back. We are unable to close the account with a negative balance yet unable to pay. Meanwhile, they continue to add fees and it feels as if I 'm in TD Bank Prison and I 'm unable to break free. There are two proposed class action lawsuits filed against TD Bank this year alone and one of them is for -- you guessed it -- excessive fees. The other is for their coin counting machines. In my humble opinion, TD Bank has engaged in the predatory practices of Bad Faith and Breach of Contract and it is no accident that the most damage has been levied at those least able to fight back : the working poor. This is unconscionable and they need to be held accountable. Please help us. Thank you.

Complaint: I have federal VA XXXX funds and VA vocational rehabilitation funds deposited in my account with TD bank. I keep getting levied by the child support enforcement agency. The bank says that these are not protected funds and that the agency is the one who determines if they are or not. they also say it is not their responsibility to do a 60 day look back. According to Fed law 5CFR 581.104 these are not allowed to be levied. Also title XXXX part XXXX out lines how to identify the federal deposits and again they insist that it is not their job to check the deposits. It is clearly marked on my statement. Yet they refuse to even consider reading the law. They say that the NJ state law allows them to do this. I did n't think that state law could over ride the the federal law. If so i would like a detailed explanation of how it works. Saying just because of this law or another is n't good enough. When I read the law I see that there are a lot of moving parts and one of them is the exemptions to these types of federal deposits. These levies that i have encountered have put a large strain on me and my family. The bank hits me with Levy fees and low balance fees. I have issues trying to get them back. I have problems paying my bills and bounce checks because of these levies.

Complaint: Account ending in XXXX. I wrote back to you regarding TD Bank car loan. After struggling to make monthly payment on- time due unemployment issue. I received two letter from TD Bank dated XX/XX/XXXX, saying Congratulation! your final payment is now due. please pay the amount indicated below by due date. total principal balance XXXX principal due XXXX financial charge due XXXX Late charges total XXXX. on a second letter i received from TD Bank dated XX/XX/XXXX, stated current due XXXX total amount due XXXX. This second statement raised into questioning. In XXXX I submitted a complain regarding extra payment beginning of the loan in total amount of {$410.00}. I was told that money will apply to the end of the loan. I called this morning I was told that money has been used into Principal. Now I 'm at end of making a final payment, final payment is more than regular monthly payment due to late fees. I would like to know about the excess payment I had made toward my account.

Complaint: In XX/XX/XXXX, I was a victim of identity theft. Someone was able to access my personal checking account at XXXX by making a phone call. They also were able to use my information to open a new checking account online at TD Bank. {$1000.00} was transferred from my account to the fraudulent account at TD Bank. I spoke with the fraud department at XXXX and they gave me thorough instructions and they investigated the incident. The {$1000.00} was returned to my XXXX account. The problem is that TD Bank persisted in maintaining a checking account in my name with {$1000.00} in it. Since I was reimbursed by XXXX and all activity with TD Bank was performed fraudulently by an identity theft, clearly the money in the TD Bank Account is not mine and the account itself, though in my name with my information, is also not mine. I have called TD Bank and spoken to their fraud department in XX/XX/XXXX. I wrote a letter in XX/XX/XXXX to TD Bank explaining the situation. They persist in sending me bank statements and they deduct fees, {$5.00} maintenance fee and {$1.00} paper statement fee. The {$1000.00} balance is now down to XXXX as of XX/XX/XXXX, due to these fees.

Complaint: After setting up an auto payment with TD bank for a loan to finance the purchase of a pellet stove, I received a notice that the account was past due. I called customer service to confirm that auto-pay was set up, to which, they said that it was not. At this time, I set up auto pay for the second time and made a 1 time payment. However, the next month, the same situation occurred, with my receiving a past-due notice. Additionally, the account was set up so that it would not be paid off before the interest-free period was over, despite my stated intention to pay off the loan before the interest-free period ended. I believe that TD bank intentionally did not process the auto payment, and further that they intentionally changed the parameters of this loan so that it would not be paid off in time to avoid interest.
