Complaint: I was contacted in XX/XX/XXXX by a company that had an unknown number, telling me I have a bill from XX/XX/XXXX from XXXX ( spelling? ) I asked what the bill was about and to send me back up documentation. I still have not received it. They had my email address and I told them to send to my email address. I would not give them my mailing address. I contacted XXXX and they have been sold, I went thru 3 hours of people trying to find my account and the final lady told me well good luck, those people do not care what they do and they will put it on your credit.
I called back to Southwest Credit Systems and they refused to let me talk to anyone in corporate or anyone that could send me a copy of the bill.
They just put it on my credit this morning, I called them immediately and the call was recorded and the lady refused to say any more after I told her I never lived at that address and gave her my address in XX/XX/XXXX and the internet company I had.
I am purchasing a home for my XXXX year mother and I and it has killed the deal most likely. I do not know owe this bill. How you can let people do this people I just do not understand.

We have provided signed documentation from the management company which proves this fact. ( Figure C ) 2 ) XXXX does not operate in Iowa, where XXXX XXXX resides.
3 ) Southwest Credit SystemsXXXX failed to respond in any measure to the Cease and Desist notice registered with the Civil Court of XXXX County Iowa in XX/XX/2018, which demanded that the aforementioned company immediately cease identifying this account with our client. That document detailed the failure of Southwest Credit Systems and XXXX to comply with : The United States Fair Credit Reporting Act, 15 U.S.C. 1681, 611 The Fair Debt Collection Practices Act, 15 U.S.C.1692 It is because of these facts, and the documentation including : a signed Fraud Affidavit, reports from two law enforcement agencies, a report from the Internal Revenue Service confirming our client as a fraud and identity theft victim ) provided which proves that this account was in no way a result of any application of our client, nor did he benefit from it in any way, that we ask that your organization immediately delete and/or block the reporting of this trade line.

Complaint: On XX/XX/2018 @ XXXX XXXX I called SWC and spoke with XXXX. After the initial greeting I informed XXXX that my phone call was being recorded and proceeded to ask 3 questions : ( 1 ) Who is SouthWest Credit? ( 2 ) How did SWC obtain this physical address as a mailing address considering that's information was not disclosed by me and does not match the address on the account ( 3 ) What physical contract/agreement exist between SWC and this or any XXXX XXXX?
The customer service rep ( XXXX ) became despondent after several failed attempts to verify the account, so XXXX hung up on after we had only been n the phone for 4 minutes and 17 seconds. This behavior proves that professionalism is far from the central values of SWC, which raises questions about there proficiency to adequately and accurately verify and report collections.
I reached out to SWC for a second and spoke with XXXX who already the account pulled up using the phone number I called from. XXXX proceeded with SWC verification process by providing me with a physical address, then asking if it was a past or present address ( PAUSE ). Did XXXX just disclose the personal information of an alleged SWC account holder to a person that has yet to be properly identified? YES! According to FCRA a consumer reporting agency may provide information about you only to people with a valid need usually to consider an application with a creditor, insurer, employer, landlord, or other business. The FCRA specifies those with a valid need for access. XXXX did not verify who she was speaking with before disclosing the physical address of that account holder and I never identified myself as an agent of a creditor, insurer, employer, landlord, or other business with a valid need for this information. So, for a second time, we see inconsistencies with SWC protocol and procedures for accurately verifying and reporting collections.
After I become dissastified with XXXX 's cavalier disposition and lack of proficiency during our discourse, she offered to connect me with her Executive who never picked up phone or returned my phone call. Words are one thing, but everyone reading this correspondence knows that having an actual recording brings this to another level. So SWC has 10 days to report to the credit agencies that the debt assigned to accts XXXX and XXXX are not associated with this XXXX XXXX or this recording will be made public and I promise you your office will experience a flurry of calls from unwitting consumers who have fallen for your predatory tactics. I WILL WIN! This is about my livelihood, if you make your money by jamming other people up, that's your business, but you won't do it to me.
SWC has a legal obligations under the FCRAs Furnisher Rule. Your responsibilities include : furnishing information that is accurate and complete. This information is inaccurate and incomplete, which means you are in violation of FCRA, sending a response thats says you are in compliance doesn't make it true either, so don't waste your 's or my time ( XXXX ). The only way for SWC to be in compliance after this encounter, with incomplete and unverified information, a consumer voice recording of not one but 2 SWC employees who could not adequately assist a consumer after delvulging personal information of acct holders, is go ahead and report is as an error to the credit agencies have this removed so SWC can bow out gracefully. As you can see I'm one of those consumer 's who doesn't stop, won't quit, and will fly to your headquarters to meet you in person, with the XXXX XXXX XXXX, to resolve this matter if necessary. Don't think that XXXX is shell address for your call center cause I do have the physical location of that as well. Thank you

Complaint: On XX/XX/XXXX I sent Southwest Credit Systems a certified letter asking them to validate the debt they are alleging I owe. I asked for them to provide me with the agreement with their client that grants them the authority to collect the alleged debt, the agreement that bears the signature of the alleged debtor stating they agreed to pay the creditor, name and address of the alleged debtor, amount of alleged debt, verification that the debt was assigned to a debt collector as well as many other specific requests for validation and not verification.
Per USPS tracking number XXXX they received this request on XX/XX/XXXX. On XX/XX/XXXX I received a letter in the mail from the company stating they verified the debt and that is was due. They attached a bill from the phone company and none of the requested information I has asked for.
I replied to their letter asking again for them to provide me with validation that the debt was mine. This letter was received on XX/XX/XXXX per USPS tracking number XXXX. In the second letter I asked that they delete the debt from the credit agencies ( XXXX, XXXX & XXXX ) because they had failed to provide validation that the alleged debt was mine.
I got a second letter from the company stating that the debt was mine and due as well as more phone bills showing the alleged debt. None of the information they provided was actual validation of the alleged debt. They failed to provide any information which proves the debt belongs to me.
