Complaint: On or about XX/XX/XXXX, the borrower defaulted on his first lien mortgage loan, which loan is serviced by Seterus. Seterus commenced a foreclosure against the borrower on XX/XX/XXXX. On XX/XX/XXXX, the borrower and Seterus entered into a permanent loan modification under the XXXX Standard Loan Modification program. After the borrower 's loan had been permanently modified, Seterus charged {$340.00} of legal expenses to his account on XX/XX/XXXX, and another {$300.00} of legal expenses on XX/XX/XXXX. These legal fees appeared on the borrower 's mortgage statement dated XX/XX/XXXX.
Seterus is barred from charging these {$640.00} of legal fees to the borrower. Under the XXXX Servicing Guide, Section XXXX, " [ t ] he servicer must include the applicable attorney fee as part of the amount required to reinstate the mortgage loan '' and " [ a ] ll out-of-pocket costs that the law firm incurred prior to the cessation of foreclosure proceedings must be collected from the borrower as a condition of the reinstatement or workout agreement. '' If the servicer fails to include these fees and costs as part of the workout agreement, it may not charge these fees to the borrower. See XXXX Servicing Guide, Section XXXX ( providing that " [ i ] f the servicer fails to include as part of the amount required to reinstate or pay off the mortgage loan any legal fees and costs that were incurred in connection with the foreclosure proceedings, or is prohibited from charging the borrower for certain costs under applicable law, it must reinstate or pay off the loan without collection of such legal fees and costs from the borrower '' ).

Complaint: Seterus, Inc. is alleging that I have already had my " XXXX opportunity to qualify '' for a HAMP Modification. However, based on the history and handling of my prior requests for foreclosure prevention assistance, I do not believe that I have been given an unfettered opportunity to qualify for a HAMP. Moreover, as explained in the attached letter that CFPB is copied on, the attempted HAMP by XXXX was nullified by XXXX 's own deliberately improper processing of the HAMP and by the very language in the " Agreement '' itself, at Item XXXX, Section K -- titled " Additional Agreements. XXXX falsely reported to the U.S. Treasury Department that the " implementation process '' for the HAMP on my loan had been " completed ''. Then, with full knowledge that this reporting was false, XXXX proceeded to accept and apply Incentive money from the U.S. Treasury Department to the loan. This was all done by XXXX in a malicious effort to disqualify me from consideration of any HAMP modification in the future. When I refused to comply with XXXX 's request to correct its own error in the notarization of the Agreement ( after XXXX 's XXXX-month delay in even booking the modification ), XXXX proceeded with foreclosure process -- while at the same time having reported the HAMP as completed. When XXXX learned that I did not respond to XXXX 's letter, XXXX retaliated by cancelling my completed application -- requesting re-evaluation for foreclosure prevention ( My employment status changed during the XXXX-month delay ). The reason that XXXX gave was because I would not re-sign and re-notarize the Modification Agreement. But for the last-minute assistance provided through Arizona 's HHF fund, my loan would have been foreclosed on XXXX years ago. I believe that XXXX and/or XXXX have improperly, if not illegally, mishandled prior modifications on my loan -- preventing me from having an opportunity to properly be considered eligible for a HAMP modification. I would like the U.S. Treasury Department or other appropriate government agency to make the determination as to whether BofA/FNMA properly complied with the Servicing Agreements or followed appropriate guidelines regarding my prior requests for foreclosure prevention assistance.

Complaint: We had a mortgage with XXXX that was discharged in chapter XXXX bankruptcy 4 years ago.
Another company purchased the " loan '' and has continued to bill us for back payments.
It clearly states on the bills sent to us that if the property was discharged in bankruptcy disregard the bill.
The company is SETERUS.
I have called and told them the debt was discharged. But the bills continue to come.
This is unfairly affecting our credit score. We are trying to rebuild our credit. We both work hard and have good jobs.

Complaint: Seterus, Inc. was transferred a mortgage from XXXX. The said mortgage was surrendered in Bankruptcy No. XXXX and was discharged on XX/XX/XXXX. Seterus began reporting this mortgage as collections in XXXX. In trying to obtain a new mortgage this came up on the credit report and is hindering us from obtaining the mortgage. Several letters from my attorney were sent advising of this situation and we have had no resolution and they advise it will take 30-45 days to even get a letter from them indicating they were incorrect on their reporting.

Complaint: Numerous issues but what is very concerning is after months of submitting and resubmitting documentation I find out that the submitted documents were uploaded and labeled incorrectly which slowed the process down to an already ridiculous turn around time. Then I have to hear every time I call how their doing their job so well, really? Also I have been told of XXXX different possibilities of the outcome of this modification then the last person I spoke with tells me there is really only XXXX possibility and its not really going to help and it is unlikely the rate will get reduced at all then after I state others have told me of rate reduction the person stated well it could go down a little but not even a percent lower. The last issue I want to mention is that this loan was being serviced at XXXX and a week before transferring to Seterus the loan modification had been submitted for a final approval all documents were received in and accepted the broker price opinion was ordered and then the loan servicing transferred on XXXX/XXXX/2015. I was told the loan should at least transfer with that status, but it did not as I had to redo the loan modification package for Seterus and resend information numerous times because nobody is rarely on the same page and paperwork is labeled incorrectly. Should the status have stayed the same since the investors of the loan have not changed? I have sent everything in that is asked for and many times I have been told different or wrong information I once spent {$17.00} at XXXX to make sure the documents faxed were received. I have with the help of my wife done what has been asked and as of a week ago everything is in we now have a 30-45 day wait for the documents to get reviewed by a processor that is a long time to know if more documentation is needed, then in the meantime how much paperwork is set to expire??? At this rate it will never get done. After mislabeling our paperwork for weeks you really cant accelerate our documents for review. But your ready to accelerate the mortgage.
