Complaint: I am writing this regarding my mortgage servicing company Seterus, Account # XXXX. The phone # is XXXX. XX/XX/XXXX I received an escrow statement from Seterus the statement indicated that my mortgage payment of {$850.00} was increasing to {$1000.00} due to the fact that the escrow was {$1200.00} short and that my town taxes had gone from {$1900.00} to {$3600.00}. I contacted Seterus and told them that my taxes were the same as they have always been and there was no increase. Then asked why they were billing me {$3600.00} for town taxes. They instructed me to call their escrow company XXXX at XXXX. Upon contacting them I told them about the mistake in the town taxes and that the reason why the town levied them for {$3600.00} was because Seterus failed to pay the school taxes of {$1500.00} for the year XX/XX/XXXX. The town XXXX then added that figure to the town taxes of {$1900.00}. They also included interest of {$170.00} which they are holding me liable for. XXXX indicated to me that they would run a new analysis and correct the situation within 10 business days from XX/XX/XXXX I then proceeded to contact Seterus XX/XX/XXXX and they said they were waiting for the analysis. I contacted them again XX/XX/XXXX and was informed that it would be at least another 30 days to complete their analysis. I explained to them that they were over charging me {$250.00} on my original mortgage payment and they were also charging me the interest on the {$1500.00} from the school taxes that they failed to pay XX/XX/XXXX. The money was escrowed and still is being escrowed I was informed by Seterus that if I did not make the XXXX payment of {$1000.00} it would go against my credit report and that if I paid less than the {$1000.00} they would not apply the payment and I would still be held responsible for the full amount making me late on my mortgage. This is totally unacceptable I am being charged {$250.00} more per month on a mistake they made by not paying the taxes XX/XX/XXXX and my normal mortgage payment of {$850.00} is no longer valid. My town taxes consist of {$1900.00} insurance of {$530.00} and school taxes of {$1500.00} for a total of {$4000.00} instead they are escrowing {$5800.00} a {$1700.00} which is the school taxes plus the interest that they did not pay for XX/XX/XXXX which they are penalizing me for.
Please help us in this matter for Seterus and XXXX have given us nothing but a song and a dance and are illegally collecting money that they do not have coming. Thank you for your time.

Complaint: We have XXXX mortgage accounts with the same company which misapplied the payment for XXXX account to the other making the payment late. When we ask for a correction XXXX payments was put into an expense account, not crediting either account making the payments late and reporting it to the credit bureau. XXXX account we 've had for 11 years and the other for 9 years and have never been late on either XXXX. The problem started back in XXXX and have not been totally corrected as of this month and it 's now XXXX. We are still receiving calls from them stating that our payments are late although they have received payment and the checks have been cleared. How do we stop the harassment and get our credit back to the way it was?

Complaint: I had a first mortgage and Seterus, Inc. was the servicing agent. My home was sold XXXX/XXXX/15 & the mortgage was paid off. Seterus overchanged me on the payoff statement for interest to XXXX/XXXX/15 in the amount of {$880.00} & flood insurance premium of {$490.00} that was not due until XXXX 2015. I was also due all the money in escrow for 2015 since not XXXX cent had been paid out for insurance and taxes in 2015. The escrow account should have had {$2300.00} in it. The total amount due to us is {$2800.00}. I received a check from them dated XXXX/XXXX/15 in the amount of {$880.00} XXXX overpayment of interest on closing statement ). I wrote them a detailed letter showing that they owed me and on XXXX/XXXX/15 they prepared an Escrow Account Statement XXXX this statement does not include XXXX and XXXX 2015, ) and it shows a XXXX balance. It notes that {$880.00} was deducted at a " Misc. Escrow ''. Then I received another check dated XXXX/XXXX/15 in the amount of {$490.00} XXXX overpayment on closing statement for Flood Insurance. I am still owed escrow payments for taxes and insurance from XXXX thro XXXX 2015 in the amount of {$2300.00}. Correspondence from Seterus says if you have any questions call them. I have called them many times only to be placed on hold for XXXX minutes and then told that they could not help me and my only way to resolve this was to write to them. These tactics appear to be designed to frustrate customers and are unfair and deceptive business practices. I want my escrow money that I am lawfully entitled to in the amount of {$2300.00}.

Complaint: I am a surviving spouse of a property held in Joint Tenancy in the state of California. I am on the Trust Deed but not on the loan. I have since filed an Affidavit of death ( By Surviving Spouse ) at the XXXX Recorders office, and title has been placed in my name solely, as allowed by California Probate Code XXXX. Since the passing of my wife it has been difficult for me to maintain payments on the note for the last 2 and a half years on my income alone. After careful consideration, I have concluded that the best option for me at this time is to try and have the lien holder approve a short sale, instead of letting the property go to foreclosure. I am still underwater on the property approximately {$80000.00} dollars, with the majority being owed to the XXXX lien holder. I have a real estate agent and a short sale negotiator working on the file, but the Servicer of the first loan Seterus is holding up the deal saying that I am not authorized on the loan, and that I need to go to probate to get authorization from court to sign on my deceased wife 's behalf. I have consulted with an attorney and I do not have the fees requested in order to file a case. It is my understanding that the purpose of holding title in Joint Tenancy is to avoid probate. The short sale negotiator has informed me that XXXX who is the investor on the loan has approved the short sale, but for whatever reason Seterus who is the servicer only, is denying the short sale. I currently have an accepted offer on the property and would like to proceed with the sale.

Complaint: Early this year SETERUS changed their payment coupon making it impossible to allocate funds in excess of the normal monthly payment ie ; the ability to direct the funds to the monthly payment and the excess to the principal. I normally pay in excess of the monthly payment and since the coupon change SETERUS has misapproprited my funds, ,assessed late payments and wasted hours with me on the phone addressing these issues on nearly a monthly basis since the first of the year.
My most recent payment was in the form of XXXX checks, XXXX for the monthly payment and XXXX for the principal. SETERUS is now holding the entire amount in suspense ( unapplied ).

Complaint: When B of A sold my loan to Seterus, my file showed as past due two payments. B of A never advised me of that so that was a suprise. From that point on the nightmare begins. Starting XX/XX/XXXX, I began making my loan payment to Seterus. Seterus showed me past due on a consistent basis which snow balled when my husband had to go on XXXX. I was offered a loan modification in XXXX which unfortunately XXXX of XXXX payments bounced, my husband used to manage the loan payments that changed. So again in XX/XX/XXXX I was offered a trial payment of XXXX which i made XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, at the end of the trail payment I was to recieve the final loan modification documentation. I called weekly to ask about the status of the final loan modification paperwork, during which time, my house was placed for sale, the foreclosure procedures had continued even while Seterus had given me a trial modification. So, while they were getting my money every month, they were pursuing foreclosure on my home. Finally, XX/XX/XXXX, I recieve the loan modification, signed and return the docs promptly thinking this mess if finally fixed and glad it was over only to find out when I called to make my XX/XX/XXXX payment that my XX/XX/XXXX payment had changed to XXXX without notice or explanation. They of course say they sent me the documentation however ; the loan documents that took until XXXX for me to get, reps advised me early after the trial payment ended in XX/XX/XXXX they had sent the paperwork when in fact they had not. I was advised the escrow account was reviewed in XX/XX/XXXX and determined that they were short a significant amount so they increase the monthly mortgage payment almost XXXX without concern to the impact. On the same call, where they advised me of the new amount they said they could do this at anytime due to, paragraph such and such that I signed on the loan modification. So I asked, you sent me the loan documentation in mid XXXX, you say you reviewed the escrow account in XX/XX/XXXX so why was this not noted in XX/XX/XXXX? Why was n't the amount past due added to the total amount of the loan due? Obviously, I recieved no logical responses. Here is what I believe happened, in XX/XX/XXXX, the insurance on the home which is lender imposed, came due in XX/XX/XXXX, when Seterus realized they did not calculate my payment to include that amount, they decided to increase the mortgage payment. They will not admit to that, they state they did not collect enough for the escrow payments last year so they have to collect the money. So again I ask, so why did n't you add it to the total loan amount instead of negatively impacting me like this. At this point, they ( the rep who took my call ) have sent an email to Operations to review the escrow account again however ; I was warned this could take months. Of course it does, because everything they do takes months. This has been such a stressful experience and although I have reached out to XXXX ( apparently that is the owner of my loan ) and the CEO of Seterus no one is concerned. I want this organization be held accountable for their unscruppless tactics and processes but I can not find anyone that overseas them. XXXX says that is who they chosed to service my loan, Seterus says, XXXX does whatever we tell them. So, who cares about the consumer? Not sure. I hope you can help me.

Complaint: XX/XX/XXXX I submitted a complaint ( Claim XXXX ) regarding obtaining a Deed in Lieu release from Seterus. At that point, we had been attempting to obtain this release since XX/XX/XXXX.
Shortly after submitting our complaint to you, we received a letter fromSeterus dated XX/XX/XXXX advising us that our Deed in Lieu hadbeen approved. That letter requested we submit notarized SettlementDocuments to Seterus and their Attorney within 2 weeks. We did that ...
all documents were submitted and loaded into the Seterus system XX/XX/XXXX. Upon receiving these documents, Seterus wasobligated to send {$6000.00} to XXXX XXXX Bank, the junior lien-holderon the property so they could release their lien to enable Seterus to closeon the property. On XX/XX/XXXX I contacted XXXX XXXX whoadvised me that they still had not received the {$6000.00}. On XXXX XXXX, Icalled Seterus to check on the status of the check. It had not beenmailed yet. I was told that the department who handles this had left forthe day but someone would be contacting me. The person at Seterusalso said they were escalating this matter to the supervisor of the person who was to issue the check. No one contacted me, so today, XXXX XXXX, I called Seterus again. When you call Seterus, you are only allowed tospeak to the customer service rep who answers the phone. They never, never transfer your call to any other person either within or outside thedepartment. Each time it is someone who is completely unfamiliar withyour case, so the average call takes 45-50 minutes while the rep reviewsyour file, " reaches out '' to someone else, etc. The first person myreached out to on that call sent a message back saying based on herreview the file was closed.
I said that was impossible, because XXXX XXXX is stillwaiting for {$6000.00} to release their lien before Seterus can close. Therep then reached out to someone else who advised that she saw arequest for the check to be issued, but it appears not to have been issuedThe person responsible for doing so was " out on leave. '' The rep wasadvised that the person she was messaging would have someoneinvestigate the matter tomorrow, since the XXXX Officer assigned to my admy account was " out of the office. '' I told my rep I need to knowimmediately when the check will be issued to XXXX XXXX. She said Ishould call Seterus back " next week '' for an update. I reminded her thatthis DIL process had been going on for more than 1 year, and I need acommitment as to when the check would be issued. The rep reachedout to her supervisor who reviewed what had just transpired and told therep to tell me to call back next week. This is symptomatic of theproblems I have encountered with Seterus, and why it has taken overone year to complete this transaction. I am not new to the DIL process : I have done thishave done this before with other properties and banks, and have neverencountered inefficiency and errors of this magnitude.
