Complaint: on XX/XX/XXXX I received loan documents to have a permanent modification of my loan from steers act number XXXX previously I had opened a dispute with cfb number XXXX in that compliant documents were sent it verifying correspondence with XXXX XXXX of XXXX that I had completed my trial payment plan as well as invoices from XXXX stating the my payment plan was complete and was being considered for a permanent modification. Seterms had bought the loan from XXXX. when the loan was transfered there was XXXX of payments in suspense for trial modification payments were made. the loan documents I signed on XX/XX/XXXX in the loan amount of XXXX. On XX/XX/XXXX I received a notice of debt which states total current amount owing is {$270000.00}. On XX/XX/XXXX 2 days later I got another statement of debt showing XXXX difference. it states notice of debt total XXXX. On XX/XX/XXXX I got another stating current balance is XXXX plus -escrow funds of XXXX which totalled XXXX. On XX/XX/XXXX I received another letter stating I owed an additional XXXX for property preservation costs and XXXX for property inspection costs for a total of {$280000.00}. On XX/XX/XXXX, I received another letter stating ... .At this time your loan reflects contractually current and next installment is not due till XX/XX/XXXX in the amount of XXXX and the suspense account balance is XXXX ... ... Additionally the unpaid principal balance on the loan after the adjustments were completed is {$280000.00} NOT {$280000.00} AS DETAILED IN THE AGREEMENT ( LOAN MODIFICATION AGREEMENT SENT TO ME ON XX/XX/XXXX. ) i signed my loan documents assuming since this was a bank the accounting would be accurate. I CALLED SETERMS AND ASKED WHERE the {$9000.00} transfered from XXXX to Seterms for my payments on my trial balance went to. they said they applied that to payments which were owed for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX while I was in the trial modification with XXXX. XXXX then said they did not acknowledge I had completed my trial modification even though in XXXX XXXX I emailed them a letter from XXXX stated on their own letter head that I had completed the trial modification plan in XX/XX/XXXX. cfpb also received a copy of that letter in the case mentioned above. Seterms originally sent me a letter on XX/XX/XXXX stating they would not honor the trial modification because they had no proof it was completed. XXXX faxing the document proving completion, XXXX offered me a permanent modification. I received information from them by phone in XX/XX/XXXX that I was in final underwriter reviewfor my permanent modification and final was signed on XX/XX/XXXX. I spoke with XXXX at Seterus asking some other issues which they resolved, then asked where the XXXX transfered from XXXX went. she told me they applied the {$9000.00}. to my XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX payments which I never paid. I told her it was my understanding that the payments that I made during the trial balance would go to offset my interest at closing.She told me these went to principle payment when my loan was an interest only. I also did n't see where I was credited the 5 payments I made to Seterus when continuing my trial modification payments of XXXX approx each x XXXX was XXXX so if I am correct I paid XXXX dollars in trial payments which were never applied to my permanent modification. If Seterms did not acknowledge my trial modificaton then why in the letter dated XX/XX/XXXX para. XXXX did they state ... that the agreement offered Isa modification of terms ... and XX/XX/XXXX, ... enclosed loan modificatio, ....

Complaint: Numerous repeated issues with Seterus putting my Mortgage into active bankruptcy since XX/XX/XXXX when the bankruptcy has been finalized and reaffirmed with Seterus receiving all documents necessary to confirm that the bankruptcy is no longer active and the mortage has been reaffirmed XX/XX/XXXX. Every occasion that Seterus falsely puts my account in active bankruptcy prevents me from receiving any documentation of the account current status occurs. When contacting Seterus they claim no documentation has been submitted to prove the bankruptcy is finalized. They prevent access to my account online except payment. Seterus refuses to talk to me without attorney approval due to active bankruptcy which is false. When able to talk to bankruptcy department they always state the mortgage has not been reaffirmed. XX/XX/XXXX I refinanced my mortgage for a better rate and no longer had Seterus as a provider for my account. XX/XX/XXXX my refinanced loan was returned to Seterus for services, which is proof enough that my mortgage has been reaffirmed. Law will not allow a refinance on a mortgage that is not reaffirmed. XX/XX/XXXX after numerous times before, Seterus again put my account in active bankruptcy. This time they reported to the credit bureau that my account has been closed, delinquent, and in active bankruptcy. Seterus claims they did not submit that report but submitted to the credit bureau reaffirmation of my account due to my request, which is false. Since XX/XX/XXXX I have numerous contacts with Seterus every time they state everything has been corrected. I am unable to receive paper statements mailed to my home, no access online to any digital statements, as of XXXX XXXX XXXX they have removed digital statements prior to XXXX XXXX. Numerous complaints filed to the XXXX of XXXX WA have been filed without success. Seterus keeps sending letters that all issues have been corrected. XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX are just a few of the contacts from Seterus that all have stated to me every month since XX/XX/XXXX that everything is fixed and you will received statements and full access to all documents next month. Every billing cycle the issues still exist. Then I contact Seterus and they say wait till next month. XXXX XXXX sent a letter XX/XX/XXXX stating monthly billing statements will be sent to address of record. XX/XX/XXXX I contacted Seterus again because nothing has been resolved. Seterus stated again I have to submit a request to fix the issue. Once again no solution. Now on XXXX I have received a statement from XXXX XXXX that I will not receive any statements for one to two more billing cycles due to " prior status of loan '' it appears they still accept bankruptcy and will not correct issue again .... always wait till next month. its been since XX/XX/XXXX every month I am told it is fixed, but its not .... Every time I contact Seterus they state they require all documentation of bankruptcy even though they have received documentation more than once and also through my legal representation of bankruptcy at the time. I have been damaged from false report submitted by Seterus on my credit report. They have removed it but state that they never submitted that false report or have removed it. I have no solution to the issue of Seterus not correcting all the issues generated from there repeated actions of putting my account into a false active bankruptcy. Over 6 times since XX/XX/XXXX I have issues of this reoccurring. Everything I have requested in the past they state they have no record of request. on XX/XX/XXXX XXXX XXXX has sent a confusing printout of activity since XX/XX/XXXX to XX/XX/XXXX reflecting payment etc. It took since XX/XX/XXXX and numerous complaints to Seterus to receive this. Still no solution.

Complaint: Following the loss of my wife 's job in XXXX XXXX and failure of XXXX to renew the Federal Emergency Unemployment Act for XXXX, my wife and I applied for a modification on the mortgage of our single family residence in XXXX, MO in XXXX XXXX ( see hardship explanation attached ). Our servicer, Seterus, Inc. accepted us for a trial modification which we completed in the latter half of XXXX having made all payments within the stipulated timeframes. The first month we were due to start our permanent modification we noticed we could n't make payments online because Seterus portal referred to our modification as " Reviewing for Completeness '' and would n't let us progress to our mortgage account page. Upon calling customer service on XXXX occasions in late XXXX, we were advised since we paid XXXX of our trial payments in XXXX instalments that Seterus ' automated system had not processed our mortgage as permanently modified and our paperwork was required to be reviewed manually. We were told this explained the " Reviewing for Completeness '' dialog on the website ( screen grab attached ). We were told not to send any more payments as they would be held in a suspense account or returned to us and that the best way to proceed was, in the agent 's own words, to " jump start '' our modification by reapplying for another XXXX. We were told we were still subject to foreclosure at any time. Following this call, my wife and I decided it was not in our best interest to get caught in a cycle of applying and applying and we decided to wait on the outcome of the review of our original documentation. For the rest of XXXX and all of XXXX we received no further written correspondence in relation to our modification and Seterus website was unchanged displaying a dialog that our modification was still " Reviewing for Completeness '' and so in XXXX XXXX we sent them a fax requesting an update on the status of our modification, or completion of the modification, both within 30 days ( copy of fax and confirmation of receipt by Seterus FROM Seterus attached ). To date we have still not received any written correspondence from them except our monthly statement for XXXX showing 683 days past due in the amount of {$16000.00} including fees.

Complaint: In XXXX I paid XXXX XXXX to XXXX Mortgage to reinstate the mortgage on XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX Subsequently I refinanced with XXXX closing, XXXX/XXXX/XXXX in the amount of XXXX XXXX, loan # XXXX. On XXXX/XXXX/XXXX, XXXX became the investor and XXXX XXXX XXXX XXXX the servicer. Payments were made until XXXX/XXXX/XXXX through the servicer. In XXXX I was notified by the V A of a serious medical issue and instructed to report to the VA XXXX XXXX XXXX XXXX in XXXX XXXX Tennessee. On XXXX/XXXX/XXXX I reported as instructed and remained until XXXX/XXXX/XXXX. Due to the medical issues XXXX XXXX XXXX and my temporary inability to pay, the servicer began foreclosure proceedings XXXX which was fraudulent due to the use of an invalid assignment to base proceedings on. The assignment was executed on XXXX/XXXX/XXXX, assignor XXXX XXXX XXXX XXXX the recording date XXXX/XXXX/XXXX and the alleged assigner was XXXX XXXX, assistant secretary of XXXX, who is the nominee of the deed of trust and not the note thereby overstepping any authority XXXX XXXX may have assuming that XXXX XXXX is a real person. XXXX XXXX XXXX 's signature is highly suspicious and was notarized by XXXX XXXX. XXXX XXXX appears to be a robo signer. Recording number for the Assignment : Instrument # XXXX Bk XXXX pg XXXX in the XXXX XXXX North Carolina Register of Deeds. Notice : the assignment is in conflict with XXXX loan look up program which shows that XXXX owns the loan with an acquisition date of XXXX/XXXX/XXXX. The PSA show XXXX XXXX XXXX as a subservicer for XXXX and XXXX XXXX claims to be the assigner for XXXX however if XXXX is the Note owner of record then what is it that XXXX XXXX the alleged robo signer is assigning and with what standing? The assignment by XXXX XXXX is a pretense to obscure other interested parties in the transaction chain. The assignment does not correspond with the endorsement on the note. The note has been separated from the deed of trust which appears to be contrary to XXXX v XXXX and the note appears to have been securitized. I have been through the clerk 's hearing where the clerk allowed the servicer to bring a foreclosure action with no standing in law. I appealed to the court of appeals of North Carolina and the court decided that I had been relieved of my rights of due process. I went back to Superior Court in XXXX XXXX where the Judge disregarded the opinion of the Court of Appeals and still I have not been allowed to the rights of discovery. I filed yesterday XXXX/XXXX/XXXX in Superior Court as objection to the order to foreclose. The firm representing the XXXX XXXX XXXX XXXX, XXXX out of XXXX, XXXX is also the owner of the firm that provided the Substitute Trustee. There are XXXX loan numbers on the property and they are as follows ; XXXX ; XXXX XXXX XXXX XXXX ; XXXX Seterus , Inc . XXXX I have documented every interaction with the courts and the plaintiff. Complaint: My ex-wife made deals with originator and real estate agent to obtain money or credit from my home I purchased XX/XX/XXXX. It appears she received XXXX written approvals XX/XX/XXXX and XX/XX/XXXX via XXXX XXXX. I bought house thru XXXX in XXXX, WA. Apparently my wife tricked me and filed false information to obtain Gov program loan in XX/XX/XXXX. I apparently was tricked some time in XX/XX/XXXX or about year prior as I was told my signature is on page. Then records show anther XXXX loans with XXXX then sold to Setaris. Not one time have they acted in good faith or give me any records. County records show dates different than originals discovered. I also discovered this group involved in many more and I paid all of them as well as massive closing costs, lost escrow money and apparently this multi state group also sold home to themselves as it looks like forgery on older home I sold. I am forced out of home after wife put squatters in and then moved back in getting embellished restraining order that also keeps me from offices at home to run businesses. Everyone is playing games and last contact Setaris lied and said new address had forclosure sent. This has been told to me sense XXXX XX/XX/XXXX yet never any official document sent to my PO Box . I have been discriminated against in every way and lied to repeated times and now threatened to drop issue and lose XXXX home when I was trying to sell it. This is strong arm that has other issues as well. The big thing is real estate lady is family who now has XXXX homes and my ex wife who did n't work juggles more and transferred titles yet legally was XXXX for 17 yrs. I wrongly lost hundreds of thousands over the years starting in XX/XX/XXXX with XXXX XXXX loan, XXXX with XXXX XXXX Bank, XXXX with XXXX, XXXX with XXXX, XXXX, XXXX XXXX loans and XXXX XX/XX/XXXX. Its crazy as I also had all profits, down payments and more stolen in between. How can they break consumer laws and just lie?

Complaint: For my property at XXXX XXXX XXXX, XXXX XXXX, CA XXXX, the flood insurance is covered by the HOA fees I pay monthly. In XXXX 2014, Seterus Mortgage Company bought my mortgage from XXXX. Seterus purchased additional flood insurance for my property even though the property is covered under my HOA dues. Despite numerous of complaints in the form of calls and letters to their customer service, Seterus continues to charge me for this extra and unnecessary flood insurance, taking part of my mortgage payment, applying it to the escrow, and claiming I am short on my mortgage payment, thus negatively affecting my credit and payment history. I have provided Seterus with ample documentation to prove the policy from HOA fully covers the liability required for the property. Thank you in advance for your support. Complaint: My mortgage loan was transferred to Seterus Inc, in XXXX. Seterus collects my mortgage payments which include escrow ( P & I + Home Owner 's Insurance + Property Taxes ) Seterus, Inc. outsources to a third party the payment of the property taxes. XXXX XXXX XXXX XXXX I have been getting letters from the XXXX XXXX, NY that property taxes are still outstanding for XXXX. When I contact Seterus I am automatically transferred over. When I call XXXX XXXX XXXX XXXX XXXX XXXX every time I call they tell me a check was cut. When I questioned when, the dollar amount, and if it has cleared. They tell " oh we have to research that ''. This means another department has to look into it. They say you will get a call back from a supervisor ( never happened ). Another time they told me that XXXX XXXX wrote down the incorrect property lot number and that XXXX XXXX returned their check, but this was back in XXXX XXXX. I asked why has n't anyone research this. This is not the first year Seterus, Inc escrows my account. They have had my loan for since XXXX. Also now the county has XXXX late penalties and fees of over {$1000.00}. They tell oh ma'am you are not responsible for those fees. And they says this cool as can be. They do n't understand that I can lose my home. When they called me back they say we made your property taxes payment in XXXX XXXX. When I checked with XXXX XXXX XXXX XXXX on behalf of Seterus, Inc had paid first have of the taxes for XXXX. Year XXXX is outstanding entirely. Seterus, Inc has performed an escrow analysis on my account using incorrect property taxes due of over $ XXXX. This has made my monthly payments go up from {$1400.00} to double that amount new calculated monthly payment is {$2800.00}. I have called Seterus , Inc . I usally make my payments for {$1500.00}. Seterus, Inc is not applying or crediting my payments accordingly. They are just leaving them in suspense. Until a next the payment is made. This is making me late they are reporting me late with the credit bureaus. And I am assessing charges and fees unnecessarily. I have tried to explain to Seterus, Inc. customer service reps of the mistake on the escrow analysis. All XXXX of them all they do is try to make me understand what the definition of an analysis. " Actual Vs. Projection '' and that they have projected me to property taxes of {$22000.00}. When I try to explain that they are using incorrect data to perform the analysis and that I need them to recalculate them using the correct insurance payment amount and property taxes amount. The reps go into collection mode. They start threatening/intimating that if I do n't make the payments due in their system Seterus, Inc will foreclose on the home. In order to help me I have sing up or agree to a road map. The reps do n't understand that I 'm not late because my payments are late. It 's just that Seterus, Inc is not applying them like they need to be. It is not on Seterus, Inc to liquidate the house. Since the house has not recuperated its value for what the loan is for. Seterus, Inc or XXXX XXXX ( third party company for Seterus ) would not escalate this issue or resolve it. Seterus, Inc would not recalculate my escrow analysis.
