Complaint: We have a mortgage with Seterus ; it is an interest only loan ; We were contacted in XXXX XXXX that they changed the terms in XXXX XXXX without notify us. At that time I asked for the details on this and contesting the loan, which by the terms of the loan stop all late fees and additional interest at that time. I have, in writing both via letter and fax sent them the request for this and it took them until XXXX XXXX to get me the details, and then only after the Attorney General of MN office had been contacted and was working on this case. During this time Seterus called us weekly and we always took the calls and we always explained what needed to happen and that we are contesting the loan. Once we received the information it was identify they sent the information to the wrong address. We have continue to pay the old monthly payment and will do so until they correct their mistake. We have continue to ask them to remove all late fee 's and interest charged in XXXX because of their mistakes. Our mailing address did NOT change in XXXX or XXXX and this as a mistake do to Seterus record keeping errors NOT ours. We also have asked them to correct all the negative reporting to credit agencies and provide us with a report showing us that this has been done with a letter stating it was their fault incase an agency comes asking in the future. We have been contesting the lone until this point and due to terms of the loan they should have stop late fees and foreclose process. On several cases including the following I was told the case was being contested and ALL late fees would be on hold- Including-On XXXX XXXX XXXX said she was doing this ; XXXX XXXX said she was doing this on XXXX, also XXXX XXXX XXXX said she was. Please understand this has been more than XXXX faxes and Seterus HAS confirmed they have received them.

Complaint: I unintentionally sent XXXX payments [ {$850.00} & {$920.00} ] to Seterus via XXXX XXXX Bill Pay. The mortgage payment had recently gone up to {$860.00} so I planned to pay {$920.00} instead of {$850.00}. Thinking I was editing the payment which was scheduled to go out the next day, I actually created a new payment of {$920.00}. By the time I realized what I had done, it was impossible to undo it. I initially contacted XXXX XXXX hoping they could stop/retrieve the payment. Because I created the payment after XXXX there was nothing they could do until the next morning. But since the payment was scheduled to go out for the next day, it was already in process by the next morning. They eventually explained that Seterus only allows them to send electronic payments, not paper checks. So since it was an electronic payment, they suggested I contact Seterus. I contacted Seterus the next day ( XXXX/XXXX/XXXX ) and explained that the extra payment was sent unintentionally and that I want it back. The first person I spoke with was an agent who identified himself as XXXX XXXX. He said right off the bat that the payment would be applied to the principle. I objected and told him I could not afford to send XXXX payments ; that it was an accident and that I wanted my money back. He told me to contact the bank and stop payment on the check. That 's when I found out from XXXX XXXX that Seterus only allowed electronic payments from them. On XXXX/XXXX/XXXX, I spoke with an agent who identified herself as XXXX. She said the payments had not arrived but that when they arrived she would " set a task '' to reverse the payment. I called back on the XXXX and several times between the XXXX and the XXXX. The automated recording noted at each call that Seterus received a payment of {$1700.00} on the XXXX and that my next payment was due on XXXX/XXXX/XXXX. That never changed although I was being told by XXXX XXXX XXXX that my refund was " in process ''. I had to retell the story to every agent I spoke to. Each time I asked to speak to a supervisor, but was told he ( XXXX XXXX ) was either busy or that they could resolve it for me. I felt like I was being given the run around. They told me in order to get a refund I needed to produce a letter from my bank to prove that I was n't asking for the refund because my account was overdrawn. I have to admit this was stupid and made me angry. I argued it was none of their business whether my account was overdrawn ( it was n't ). After all, they were putting money back into it, not taking money out. Even my banker argued to Seterus ' rude supervisor, XXXX XXXX, that no mortgage company required such, including XXXX which they work with on a regular basis. I objected, but since they insisted, I faxed them a letter from the bank as they required. They emailed me on the XXXX that they received the fax. I expected that my money was in route after the XXXX. On Friday, XXXX/XXXX/XXXX I spoke to an agent identifying herself as XXXX XXXX. She clarified that I wanted the {$850.00} refunded and the {$59.00} extra applied to principle reduction. She said that she would request the refund and that it would take XXXX business days. I clarified that the XXXX was Day 1 of the 5 business days. So I expected to have my {$850.00} in my account by Friday the XXXX, since XXXX would cancel out XXXX day. Needless to say, the money never came. I spoke with an agent identifying himself as XXXX. He found my situation very funny and then put me hold forever. I eventually hung up and called back later and spoke with an agent identifying herself as XXXX. She said it actually takes 14 days to receive a refund. Then she dropped a bombshell. She said she did not see anywhere in the file where a request for a refund was ever submitted. So Seterus lied to me under the tutelage and guidance of XXXX XXXX XXXX. My money was never returned. It was applied to the next payment.

Complaint: I filed a complaint previously ( XXXX ) about serious concerns and practices of Seterus including threatening to take funds out of my bank account without authorization. The response did not address those serious matters and the author of the letter, XXXX XXXX XXXX said she would send response to those issues. I never heard back from XXXX XXXX and was informed later she is no longer employed by Seterus. Those concerns in the original complaint have never been addressed. I applied for modification/forbearance back in XXXX 2015 and never received any notification of the status although I called to follow up many times over the past six months. I was always told it was in review. I spoke with representative XXXX XXXX on XXXX/XXXX/15 who represented herself as part of Seterus management and claimed to be personally working on my case. She assured me that the forbearance application was received and complete and she would personally see why I have n't received a response and would also forward the XXXX page response by Seterus sent to CFPB to answer my other concerns about what was not addressed in my letter. I received a extremely harassing call from XXXX XXXX on XXXX/XXXX/15 demanding to know ( 1 ) if I had an attorney and ( 2 ) if I ever told anyone I was self employed. I requested the conversation be recorded and questioned why he was calling asking me those questions. He repeatedly aggressively said ... " so you are refusing to answer my questions '' every time I asked why was he asking those questions. I informed him that I had spoken with XXXX XXXX in management and she was handling my case and requested to speak with her. He told me XXXX XXXX was " a nobody '' and had only been working there for two months and he had been there for a year and they both have the same position. I received a letter the next day ( although dated XXXX/XXXX/15 ) demanding payment of all past payments in less than 30 days from receipt of the letter. XXXX XXXX never mentioned there was Intent to Foreclose letter already processed and I should have received/be expecting it. I have since spoken to another representative to determine what do I need to complete the modification package and was told social security award letter and profit/loss statement ( letter of explanation ) which I sent. I have not heard anything from Seterus or acknowledgement of receipt of documents. I never received any written or verbal notification about the status of request for mortgage assistance programs. I have a made payment during this period, but unable to pay the entire amount and the date expires on Tuesday. I need help!!!

Complaint: I reference previous case number : XXXX. My present complaint is against SETERUS , Inc., a loan servicing company, to which the collections on a mortgage loan # XXXX, for property at XXXX XXXX XXXX, XXXX, CA XXXX ( " the Property '' ), was transferred in XX/XX/XXXX. The transfer was done by XXXX XXXX XXXX, XXXX. SETERUS has ignored the XXXX XXXX County Superior Court of California 's XXXX/XXXX/XXXX Divorce Dissolution Decree ( Case # XXXX ), in which " the Property '', and all its debts, was awarded to my ex-spouse, XXXX XXXX XXXX. Further SETERUS, has ignored the Court 's XXXX/XXXX/XXXX Order, that " the Property '' be sold. SETERUS has also ignored the Interspousal Transfer Deed, transferring title to XXXX XXXX XXXX XX/XX/XXXX. SETERUS continues to post delinquent payments to my credit report, so that I am unable to obtain credit. Resolution : That SETERUS, Inc., immediately remove any negative reports made to the Credit Bureaus, using my social security number, name, etc.,. That SETERUS, Inc. obey the Court 's Orders, and cease their harassing behavior toward me ( rude phone calls/notices ). That SETERUS, Inc. pursue the legal owner of " the Property '', XXXX XXXX XXXX, who still resides there. ( I have not resided there for almost three years. )

Complaint: My loan was serviced by XXXX, then Seterus Inc purchased the servicing rights. Their initial letter informing me of the transfer, from Seterus, did not come until the end of XXXX, more then 10 days from the date the letter was written. Right after that, I received a letter stating they were going to escalate my loan if the XXXX payments I was behind, XXXX & XXXX, we 're not caught up. I contacted them on XXXX XXXX, spoke with a rep named XXXX, told her I 'd be making a payment Thursday, through their online system, as that was the least expensive method. Their website was literally " under maintenance '' all week. I called to make my payment on XXXX XXXX, spoke with XXXX XXXX, he kept saying he saw I in the notes I was to make a payment, but he needed a commitment date for XXXX paymt. I said since I do n't have an exact date, put XXXX XXXX. He then says he needs to speak with his supervisor, who then gets on the phone and tells me that they need a commitment from me for the past due amounts, now including XXXX paymt. Or my loan will be escalated on XXXX XXXX, when the escalation date expires. I said I did give you a commitment, all payments will be caught up on or before XXXX XXXX. She said that she would n't accept that as a " re-payment '' plan and I needed to give them my financial information and apply for a loan modification. I said I did n't want a remodification & she said then you have to do a payment plan. I said I did n't want to do that because if I was having trouble with my current mortgage payment, why would I agree to a higher payment for up to six months. I reiterated once again, I was giving them a commitment to have everything caught up by XXXX XXXX and I was making XXXX payment that day with her Representative to show I was in fact sticking to my commitment. Also told her I already agreed to call once a week to stay in contact with them. She said if I would not give her my financials to apply for a remod or agree to a higher payment plan then she refuses to accept my mortgage payment & told me she would n't allow me to pay my mortgage for XXXX, which was the full payment amount for XXXX that was due, not a partial payment. She told me that was their right to deny my payment of my loan. I asked for her supervisor and she said sorry she 's off today. I told her fine then get me a supervisor who is over you because I seriously doubt they 're all " off '' today. She placed me on hold for almost XXXX minutes, coming back on the line twice, to tell me so sorry they 're all still on the phone. Finally I told her that I would find a way to make all three payments, XXXX, XXXX, & XXXX before the escalation expiration date, to note THAT in her system and then ended the call. I have found from my research on Seterus they are well known for this type of thing, as well as misapplying payments etc. also, I currently have a + {$200.00} positive currently in my escrow account, verified by their represent ice I spoke to on the XXXX. I bought my home in 2008 & owe less then XXXX, as I put down XXXX on the home that I purchased for approx. {$110000.00}. They are trying to force an escalation of payment or push me into foreclosure by forcing higher payments, that I KNOW I will not be able to afford, or to do a remodification of my loan, that I DO NOT WANT!!! This is unscrupulous business practices and they are doing it to XXXX of consumers daily and I would hope that this is n't the way XXXX wants their loan service providers to service their loans on their behalf. Also, side note : Seterus is owned by a much larger corporation we all know as XXXX, is this how XXXX oversees their subsidiaries business practices and endorses this kind of tactics on consumers already having financial difficulties?

Complaint: On XXXX, 2016, XXXX Mortgage Company sold my home mortgage to a company named Seterus , Inc . I was not send a " Goodbye Letter '' from XXXX notifying me of the sale, and to date, despite numerous requests to XXXX by phone, have never received XXXX. So then did not handle the sale in the manner they are required to do ; they never notified me. This complaint concerns a " mortgage company '' called Seterus , Inc . I learned my mortgage had been sold when I called XXXX to make my monthly payment and they told me they could not take payment ; the loan had been sold. They did not know who they had sold it to and told me all information would appear in the " Goodbye Letter '' that has never come, 4 full months later. I finally was able to learn through other sources that the loan had been sold to a company called Seterus, Inc and called them, spoke to them, asked for my loan number and made my payment. I was told to expect a " Welcome package '' which did not come until I 'd asked many, many times. It contained almost no information. Here 's the problem : Since my first payment to Seterus in XXXX, I have always paid on time. That would, to date, be XXXX, XXXX, XXXX, XXXX, XXXX ... All payments have been made on time. However, Seterus did not show up on my XXXX credit reporting bureaus ( XXXX ) until I wrote and complained. They have added the account now to XXXX, but it is incorrect. It only shows a payment in XXXX only. As far as I can tell, the other credit report bureaus are not reporting at all. I have written to Seterus several times asking that they follow the law and report accurately to all XXXX of the credit bureaus on a MONTHLY BASIS. I even sent XXXX of the letters certified mail, so I can prove it was sent and received. None of the letters have resulted in compliance and Seterus 's lack of reporting is HURTING my credit score a GREAT DEAL. They must report accurately and monthly. Please assist me in getting Seterus to comply and report my payments in a timely and accurate fashion, as is required by law.
