Complaint: I applied for a Modification with Seterus in XXXX XXXX ( over 1.5years ago ) through a HUD counselor. I included with the original application all documents requested. Over the course of 1.5 years I have been made to supply the same documents repeatedly. Every time they are requested I provide them immediately within 24-48 hours to the HUD counselor and to Seterus directly. Every time I call to confirm they receive the docs and then am told I have to wait for a response. After a month of waiting they request more docs that they 've already received numerous times.
They never review the documents in a timely manner which is why things time out repeatedly. If I provide the docs requested within 24-48 hrs each time and its been 1.5yrs I should get some priority for a more timely review. In addition when you call in the reps answering the calls have no idea what they are talking about. So when the underwriter is requesting one thing the rep tells you something else because they do n't understand what the underwriter is requesting and you have to wait another month to find out that they told you to provide the wrong thing because they did n't really understand what the underwriter wanted. The reps are also extremely rude and because of their inability to answer questions they have even hung up on me AND the HUD counselor on more than one occasion.
I am borrowing money from friends to help me with these payments because it is taking so long, on a loan that is backed by XXXX and a loan that I know I meet the criteria for a modification yet Seterus keeps dragging this out clearly hoping that they can foreclose on me. What measures are in place to correct these ongoing problems and is any enforcement in place.
Lastly in the middle of this they increased my monthly payment with no explanation or advance warning. When I called they said that they were implementing an escrow when I have never had an escrow on my account and have always paid my insurance on my own. I have already made my insurance payment for this year so why would they be allowed to add an escrow basically doubling what I have already paid. I am having enough trouble keeping up with my payments and now they have just increased my payment and duplicated a bill that Ive already paid. They never notified me that they were going to place an escrow on my account it just magically showed up on my mortgage statement with no explanation. How can they just add things on whenever they want without my knowledge or approval? I have made all payments and made all insurance payments for over 8 years.
When my most recent mortgage statement arrived, I found out my last mortgage payment was not applied to my mortgage even though my check was deposited by Seterus and cleared by my bank. Seterus is saying I did n't pay the escrow ( which I have never had before ), even though I made my regular mortgage payment. They did not notify me that they did this other than when I received my next statement it appears as though I did n't make the mortgage payment even though I did.
Why are you allowing Seterus to get away with this kind of behavior? They have to notify me in advance and there has to be a reason to do this. Otherwise why me? Have they added escrows to all their other customers also and equally? Have they done this because they know I have requested a modification and they want to foreclose? Are they targeting a specific area of customers, type of customer, location of properties or type of property? I wrote a letter to the Vice President of XXXX XXXX XXXX at Seterus on XXXX/XXXX/XXXX asking for his assistance with all the problems and for them to finalize my modification since its been 1.5 years and have yet to hear from him. At the time I did not yet realize that they had not applied my mortgage payment even though they had deposited my check.

Complaint: My loan was bought out by Seterus and they underestimated my escrow ( taxes and home owners insurance ) and sent me a bill each month for 9 months for the underestimated amount. Finally, they sent me a letter telling me that I had to pay {$2000.00} to bring it current.
I refused and paid {$220.00} then {$100.00} or more per month. And now I believe my balance is only {$48.00}. But they claim that it is more and are threatening me with foreclosure.

Complaint: My loan throuhgh XXXX has been sold to Seterus and I was never notified. I called Seterus on XX/XX/XXXX and found out I owed XXXX to get paid up to date. I let the customer service rep know could pay it on XX/XX/XXXX, the total amount and that I would authorize the payment over the phone to be withdrawn no earlier than XX/XX/XXXX. I had deposited a check for the amount that day, however I knew it would take a couple of days to clear, so I gave her the date of XX/XX/XXXX. The rep said I 'd be all paid up through XXXX XXXX at that point. Seterus withdrew {$2000.00} on XX/XX/XXXX which of course was returned as my check had n't cleared, it went through again on XXXX and cleared, but now it cleared for XXXX. Not sure why that was the amount requested. However, on XX/XX/XXXX they withdrew XXXX. I realized this XX/XX/XXXX, as I was calling to make my XX/XX/XXXX payment. Of course, the rep had no clue and said someone would have to get back with me, after a lengthy hold of course. Two days later I called back as I wanted to make my XX/XX/XXXX payment so it would not be late, and was told they have n't figured out the problem, and I could n't make my XX/XX/XXXX payment as I still owed an additional {$4000.00} to be paid up to the date of XXXX XXXX. Again this was after a 45 minute hold. She said it was a mistake that the original customer service rep did n't give me the correct amount but could n't tell me why those amounts were taken, and on the unauthorized date. Asked me if I 've not ever made a mistake? Seriously, the rep that took my payment even had a supervisor get on the phone to authorize it. So I 'm requesting transcripts of the XXXX phone calls of made. Taking money out of someone 's account is stealing when it is n't authorized. I will be seeking legal counsel. They are the most unprofessional cast of characters I 've ever encountered. Not one person knows what they are doing. A complete travesty. I need some help as I was going through a horrible time, my mother was in XXXX, For 1 month and 1/2, thank God she pulled through, and is doing well but this is criminal., I stayed with her in the hospital, even worked from the hospital, as if I had n't she probably would n't be alive. Furthermore, upon discovery of this transfer, I made the phone call and agreed to pay them up to date! I 'm disgusted! Still have n't received their welcome letter, imagine that!

Complaint: Back in XXXX my second house was damaged by hurricane XXXX, I received a check for damages and repair the house at the time the mortgage company was XXXX, it is now Seterus. In XXXX XXXX was reviewing flood insurance claims and found that I was owed additional payment and was sent a check in XXXX XX/XX/XXXX.The check was sent XXXX Property Loss Department for signature. The check was return with out the signature and when I called them I was told I had to supply them with a list of damages, contactors that did the work and that they would have to inspect the house, I feel this does not have anything to do with this check.

The Seterus/XXXX of his loan and their attorneys were on notice since XX/XX/2015 and still after many requests for an assumption document to assume my dad 's property as his heir they refuse to provide me any documents they never even contact me to assume his loan a requirement by this agency but they care less about any CFPB new rules not even the federal law mandatory to do what Im saying here To them you guys are nothing no matter you the law. Obviously this agency a fake so the people think they do live in the land called free when is not they have put my/dad house for sale 4 times and 4 times say we will agree for you to assume the loan but never they do sent me anything. Complaint: I was approved for a mortgage modification with Seterus because I 'm currently XXXX delinquent. Seterus is proposing a 40 year term to modify my mortgage for that small amount when I currently have less than 16 years left now. The modification include illegal fees and charges. This company takes advantage of the difficult times people are having and force them into terms that are probably illegal but benefits the company greater. This company needs to be investigated and the responsible people should be charged and jailed to the max.

Complaint: My mortgage was sold to Seterus in XX/XX/XXXX. I learned this when I went to make payment at XXXX XXXX XXXX and the teller could not process as the account was closed. I did research and contacted Seterus. Since, I have had nothing but a frustrating experience. While I made my XX/XX/XXXX and XX/XX/XXXX payments, I received a mortgage foreclosure package which was of grave concern! My payment for XX/XX/XXXX was made electronically on XXXX XXXX, 2016 in which I paid a XXXX dollar fee so it would be processed the next day. When I continued to see the monies had not been withdrawn from my account, I contacted Seterus. I was told they had not yet possessed the request. I could not understand why. I was told my account would show payment on XXXX XXXX. I checked my account again yesterday to learn this payment had not been withdrawn from my account. I called Seterus again this morning. I was told by my bank, XXXX XXXX, indicated there were insufficient funds. I was asked by Seterus to make a payment via phone. I stated I needed to followup with my bank. The Seterus representative asked if I were refusing to make payment. I stated that was incorrect ; I wanted time to clarify with my bank why they did not process the payment. Te representative was insistent she had to note my intent. I told her a payment woudl be made by the end of business today. I asked the exact time of close of business. I was told it is XXXX Eastern Time. I have since contacted my bank, XXXX XXXX, and there is NO record of an attempt to draw the amount due {$2400.00} from my account and it was verified that between XXXX XXXX and today, XXXX XXXX, 2016, more than sufficient funds were available. XXXX XXXX has given me a reference number as they are contuning to investigate.
