Complaint: I HAVE BEEN DEALING WITH THIS SITUATION FOR THE LAST 5 YEARS. AS PER YOUR RECORDS, IT CLEARLY SHOWS THAT I'VE FILED SEVERAL COMPLAINTS IN THE PAST TO NO AVAIL. I ENTERED INTO A LOAN MODIFICATION IN XXXX WITH XXXX XXXX XXXX. I MADE SEVERAL PAYMENTS ON THE MODIFICATION, I WAS TOLD BY THE REPRESENTATIVE THAT MY REGULAR PAYMENT OF {$780.00} WILL BEGIN XX/XX/XXXX, DO NOT MAKE THE FIRST PAYMENT UNTIL I HAVE RECEIVED MY SIGNED EXECUTED MODIFICATION DOCUMENTS. SEVERAL MONTHS WENT BY, EACH TIME THAT I WOULD CONTACT XXXX I RECEIVED ONE EXCUSE AFTER THE OTHER AS TO WHY I HAVE NOT RECEIVED THE EXECUTED DOCUMENTS. NUMEROUS OF PHONE CALLS WERE MADE TO CHASE AND THEY LEAD ME TO BELIEVE THAT THEY WERE HAVING DIFFICULTY WITH THE DOCUMENTS BUT I WILL RECEIVE THEM SOON. XXXX OF XXXX, I WAS SERVED WITH FORECLOSURE PAPERS. I CALLED XXXX TO FIND OUT WHAT WAS GOING ON, AND A WEEK LATER, I RECEIVED THE EXECUTED MODIFICATION DOCUMENTS. BY THEN, XXXX REFUSED TO HONOR MY MODIFICATION BY TELLING ME THAT IT HAD ALREADY BEEN MODIFIED. NOT TRUE!! I SENT SEVERAL LETTERS TO XXXX XXXX XXXX EXECUTIVE OFFICES, HOWEVER, NO HELP. THEN IN LATE XXXX AFTER COMPLAINING TO CHASE MANY TIMES, MY LOAN WAS TRANSFERRED TO SELECT PORTFOLIO SERVICING. I'VE BEEN ON A ROLLER COASTER RIDE WITH THEM AS WELL. THEY CONTINUE TO TELL ME TO APPLY FOR A MODIFICATION, BUT THEN I AM DENIED BECAUSE OF THE ERRONEOUS INFORMATION THAT XXXX CONTINUES TO REPORT. I NEED A RESOLUTION, NOW!!! MY HOME IS SCHEDULED FOR SALE AS OF XX/XX/XXXX. I WAS RECENTLY DENIED FOR A MODIFICATION AGAIN WITH SELECT PORTFOLIO SERVICING. THEY DID NOT COMPUTE MY FULL-TIME AND PART-TIME INCOME. WHEN I COMPLETED THE RMA, MY PART-TIME INCOME WAS MISSING. WHEN I SPOKE WITH THE REPRESENTATIVE IN XXXX, SHE VERIFIED MY INFORMATION BY PHONE, SHE STATED THAT SHE WOULD ADD NOTATIONS TO REFLECT THE INFORMATION REGARDING MY PART-TIME JOB, FULL-TIME JOB AND MY HOA DUES. ALL OF THIS INFORMATION WAS EMAILED TO THEM. I HAVE SINCE APPEALED THEIR DECISION. THEY ARE TRYING TO TELL ME THAT MY INCOME ISN'T SUFFICIENT FOR THE PROPOSED PAYMENT. WHAT IS THE PROPOSED PAYMENT, THAT WASN'T CONVEYED TO ME. NOT TO MENTION THE FACT THAT SEVERAL ARE SEVERAL OPEN LAWSUITS AGAINST XXXX FOR THE VERY SAME THING OF NOT PERMANENTLY MODIFYING MORTGAGES WHEN THEY HAVE AGREED TO DO SO. I AM ABOUT TO LOSE MY HOME TO NO FAULT OF MINE. I REACHED OUT TO BOTH LENDERS TO RECEIVE THE HELP THAT I AM ELIGIBLE FOR BUT CAN NOT RECEIVE THE ASSISTANCE. I NEED SOME ONE TO INTERVENE IN THIS MATTER BECAUSE IT IS NOT FAIR THAT I AM LOSING MY HOME BECAUSE THESE LENDERS DON'T WANT TO HELP. IT SIMPLY ISN'T FAIR. I NEED HELP.

Complaint: I made a payment online and whoever enter the information at Select Portfolio Servicing enter the account number incorrectly ( I am at a loss to understand why the information had to be manually enter by the mortgage company ). The reversal was enter as an NSF. I was called and gave the customer service agent my correct account number and she verified in multiple time. Again it was entered incorrectly when Select Portfolio Servicing attempted to collect the check. It was entered again as an NSF, I have talked to three customer service agents and was told it could not be changed. I then called the SPS Consumer Ombudsman Service, and again was told it could not be changed as NSF mean many things to Select Portfolio Servicing.

Complaint: XXXX XXXX went through a tumultuous divorce and then became very ill. As a result, she fell behind on her mortgage and now is facing a sale date on XX/XX/2018. She has since got back on her feet and works as a caregiver and also collect rental income. She can maintain the mortgage payment and need only a loan modification to bring her current, giving her a fresh start. She will be submitting a full assistance request to Select Portfolio Servicing attached to this complaint with the CFPB. XXXX XXXX will also be enlisting the aid of her Congressman in regard to the postponement of her sale date. XXXX XXXX requests that the sale date be put on hold while her new assistance request is under review, per the California Homeowners Bill of Rights and Dual Tracking : Restriction on dual track foreclosure : Mortgage servicers are restricted from advancing the foreclosure process if the homeowner is working on securing a loan modification. When a homeowner completes an application for a loan modification, the foreclosure process is essentially paused until the complete application has been fully reviewed. Guaranteed single point of contact : Homeowners are guaranteed a single point of contact as they navigate the system and try to keep their homes a person or team at the bank who knows the facts of their case, has their paperwork and can get them a decision about their application for a loan modification. Verification of documents : Lenders that record and file multiple unverified documents will be subject to a civil penalty of up to {$7500.00} per loan in an action brought by a civil prosecutor. Lenders who are in violation are also subject to enforcement by licensing agencies, including the Department of Business Oversight, the Bureau of Real Estate.

Complaint: Hello On XX/XX/XXXX I made a current payment on my mortgage in the amount of XXXX.. I was approved for a short sale program and received two letters dated XX/XX/XXXX and XX/XX/XXXX in which I have enclosed. These letters state while I am selling my property short sale it is not necessary or required to make payments. The short sale is ongoing and my home is to be sold as is. Hurricane Irma arrives in Florida on XX/XX/XXXX and my mobile home sustained damages of $ XXXX..I contacted my insurance company and made a claim. An insurance check was cut for allegedly {$7200.00} and sent to my mortgage company instead of me. I contacted the insurance company XXXX XXXX XXXX XXXX on several occasions inquiring on the whereabouts of the check. Per the insurance company the mortgage company demanded that the insurance check be sent to my mortgage company servicer Select Portfolio Servicing ( known as SPS ). I don't know why this occurred. The insurance check should have been sent to me the borrower since I am being charged monthly for this insurance. I have enclosed documentation whereas the insurance is included in my mortgage payments. I contacted SPS and they claim the check was mailed to me. I never received a check. Then I got these three letters attached dated XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX disclosing as a condition of cashing the insurance claim check I agreed to complete the repairs and to request an inspection. I never received an insurance check. The check went to SPS as per the insurance company disclosed. Consequently I have lived in this mobile home in deplorable conditions over one year and the repairs still have not been made. The buyers who I sold the home to " as is " still signed a contact to purchase the mobile home and 5 acres even after the hurricane and with all the damages. To this day I never received the insurance check due to the mortgage company has not sent it to me nor the insurance company. I am being charged for these insurance premiums monthly. On XX/XX/XXXX I received a letter from my mortgage company SPS disclosing that they approved my short sale ; please see attached letter. I was elated that the short sale was approved and so was my buyers. We were all excited and I began moving. The buyers began preparing to move into the mobile home. However on XX/XX/XXXX I received another letter from SPS disclosing the approval letter was sent incorrectly because now the short sale offer was denied by the investor. I am confused an angry with this entire situation. I was current on my loan payments but was told by the mortgage company since I agreed to the short sale not to make any more payments. My credit is awful now and I eventually had to sign a deed in lieu in order to save myself. I never received the insurance check in over a year ; allegedly the check went to my mortgage company when I was the one being charged for the insurance. The short sale was approved as documentation shows yet rescinded since the offer was denied by the investor.I feel betrayed by my mortgage company in so many ways. I even tried to obtain a modification with SPS however the terms and length of the mortgage was outrageous. Please any assistance will be greatly appreciated. THANKS

Complaint: I have received several letters and phone calls from Select Portfolio Servicing , Inc regarding my mortgage for my property in XXXX, PA. All the correspondence that I received was in regards to my interest rate increasing in XXXX stating that I had a variable interest rate. I spoke to multiple people at SPS, who two months ago purchased my mortgage from XXXX, explaining that I entered a 5 year rate lock on my mortgage in XX/XX/2018 where I paid an additional monthly payment to process the 5 year rate lock. I spoke with XXXX XXXX a supervisor at SPS on XX/XX/18 where he looked through my documents was able to see where an agreement was sent to me in XX/XX/2018 and an additional payment of {$570.00} was processed by XXXX for the rate lock. However, since then I received two additional letters and today on XX/XX/18 I received another phone call on the same subject stating that my rate will increase in XXXX. SPS has been innodating me with letters and phone calls in regards to a rate change for my property. This is incorrect and I have asked several times to include today to rectify the situation. I have asked them to review their documents and correct their system which is incorrect. I did not agree to the servicing transfer and since the transfer I have had issues in regards to payments that were not processed because someone on their end keyed it incorrectly and now they are threatening to increase my interest rate. I have exhausted all options to rectify this with the Servicer to no avail. Based on my interactions with them I believe their servicing records are incorrect, the team is not adequately equipped to service my loan. Additionally, it appears that they have a lack of accuracy on servicing records and there were no quality checks done at time of transfer. As of XXXX SPS is indicating that they will raise my interest by over 1.25 basis points. Again, I locked my current rate of 4.25 % in XXXX for a 5 year period. Please help.

Complaint: Because I have been struggling with my mortgage payments for several years and applied for and was denied a mortgage modification in XX/XX/XXXX by my mortgage company Select Portfolio Servicing ( " SPS ), I applied for and was approved to participate in a short sale program with SPS by letter dated XX/XX/XXXX, giving me until XX/XX/XXXX to sell my property. The letter also stated that "... as part of the short sale process, we will accept... a XXXX payment.... '' It was also stated in a letter from SPS dated XX/XX/XXXX, responding to my inquiry regarding a short sale, " Under the Short Sale Agreement, you will not be required to make monthly payments. '' On or about XX/XX/XXXX, I entered into a Contract of Sale, principal amount of {$140000.00}, closing date scheduled for XX/XX/XXXX. Then in XX/XX/XXXX the delay tactics began. SPS stated to my broker 's attorney that the " numbers [ {$8000.00} ] on the RMA form '' needed to be placed in a different section of the form ; and continued to, unbeknownst to me, delay the closing for the next 50+ days. During this time, I was inundated with notices/demands for payments, threats of foreclosure, etc. from the mortgage company. I was assured ( by XXXX of SPS, XX/XX/XXXX, XXXX ) that these notices were " automated communications '' and to disregard them. I obtained affordable housing in the form of an apartment for myself, cleaned and moved out of my home of 26+ years on XX/XX/XXXX, assured that the closing would take place soon thereafter. On or about XX/XX/XXXX, I received an email from my broker 's attorney 's office that " as per my conversation with Ms. XXXX at SPS the above captioned short sale is still pending a decision. There are no documents being requested as of my call, and no foreclosure sale date has been set. '' On or about XX/XX/XXXX, I received an email from my broker 's attorney 's office that " as per my conversation with Mr. XXXX at SPS the above captioned short sale is showing as the offer for the second not being accepted however, I would like to resubmit the offer asking them to reconsider. Please advise if the Buyer would be willing to wait a little longer while we make another attempt. '' I was informed that the mortgage company was now demanding that the buyer pay the full amount of the second mortgage of approximately {$39000.00}, rather than the {$8000.00} that was agreed upon. Needless to say, the buyer withdrew his offer. My broker, the attorney, the buyer and I were shocked by SPS ' decision. We were lead to believe by SPS that this was a done deal, and just the necessary modifications to the RMA had to be made, etc. Before this short sale process, though I was struggling on a fixed income, I was up to date on ALL my expenses pertaining to the upkeep of my house -- mortgage payments ( 2 ), property taxes, quarterly expenses ( water, sewer, trash ), homeowners insurance, even the gas and electric. Before I started this process I was NOT facing foreclosure. Now, because of the delay tactics of the mortgage company in what I feel was an attempt to extract more money from the buyer, I am a XXXX year-old XXXX XXXX XXXX female facing at this time of my life foreclosure and XXXX in debt. This to me is an outrageous abuse of power. I feel as if they took my stressful situation and under the guise of being helpful and giving assistance, with delay tactics, prolonged and then denied the sale of my home and at my age made the remainder of my life even more stressful and thus detrimental to my health.

Complaint: Couple different items occurred with Select Portfolio Services. They acquired the loan after a permanent modification and failed to notify me @ the address on file. I had to seek them out based on data from the prior lender when payments were returned. Despite my efforts they marked the first mortgage payment as late despite my proactive efforts. This has a material impact on my credit score and they refuse to address this. This is the only late payment on this or any other account on my credit report. Secondarily, after repeated attempts they continue to send pertinent mail to the property address. 1098s and things like changes to escrow. Thirdly, they had a 3rd part review the flood insurance on the property. I, within the time allotted procured flood insurance from a national carrier @ $ XXXX/year. Further I followed their process, uploaded the binder and assumed the issue was ended. Instead they are providing flood insurance @ $ XXXX/year and claim to have not received the binder. Customer service rep XXXX on XX/XX/XXXX confirmed the document had been received and I've been billed in error. Fourthly, the password reset routine on their website has been dysfunctional for at least 3 days. Requiring me to call to get a reset to access the latest data. It looks a lot like Select Portfolio Servicing is in the business of making it difficult for folks to pay the mortgage as agreed and have a larger interest in generating fees and challenges for the mortgagee.

Complaint: On XX/XX/2018 I was approved for a streamline modification. The payment amount expressed was {$740.00}. Payments were made in the amount express XX/XX/2018 {$740.00} XX/XX/2018 {$740.00} and XX/XX/2018. Payments were completed successfully on XX/XX/2018. XX/XX/2018 receive Congratulations letter from SPS Servicer on XX/XX/2018 That I was approved for a modification and the {$750.00} and if accepted must signed agreement and return by XX/XX/2018. On XX/XX/2018, I contacted the Sps to informed them I have not received the executed documents back on their end. I was told the payment was {$820.00}. I told him that payment was higher than expressed signed correspondance agreed. I was told they would check it out was a hold up on sending me the executed agreed modification papers On XX/XX/2018 XXXXps rep called me very rude trying to make me pay and oral amount instead of the Express agreed amount. I hung up and first told him he was unfair to the consumer to ask me to pay more than agreed On XX/XX/2018, I called back to speak with a supervisor. I was told that they could not help me and I also informed them my tenant has died. I asked to delay payment to give the spouse time to apply for husband benefits. Inform them because of a change in circumstances because of the death. Tenant was not able to pay. Asked Sps to delay payment. Sps said they had not sent the executed modification docs received by myself because the payment had change. So I have been misled and had to file a complaint since that was not what I was credit and approved for and could not afford. I already had to pay {$3000.00} for water Bill 's for this tenant out of my on pocket that now I cant even pay my own bills.

Complaint: I have concerns about my mortgage payments and why so little, over the course of nearly 15 years, has been applied to the principal. My mortgage has changed mortgage companies several times and is currently held by Select Portfolio Servicing. Im curious to see if records have been kept accurately and my payments applied to my advantage. I purchased my home around XX/XX/XXXX for {$140000.00}. In XX/XX/XXXX, records show I refinanced for {$180000.00} -- I do not remember doing this. Now, 14 years later I owe {$150000.00}. I'm curious to know why the total remains so high. Although I got behind when I was unemployed and underemployed for about 8 years, every payment was made, even if they were made late. For 18 months it was paid through Illinois Hardest Hit. Roughly calculating, over the course of these last 14 - 15 years ( with my house note fluctuating from a low of approximately {$1200.00} and to a high of nearly {$2200.00} ), my debt has been reduced by about XXXX. Estimating monthly payments at a low level : {$1200.00} x 12 months per year = {$14000.00} {$14000.00} per year x 14 years = {$200000.00} All things considered, interest rates, insurance and taxes I've paid {$200000.00} to reduce my house mortgage by {$30000.00}. {$200000.00} ( total $ paid ) - {$30000.00} ( applied to principal ) = {$170000.00} ( remainder ) Over 14 years where has this {$170000.00} been applied? Interest, insurance, fees. Again, roughly speaking since I am not working with actual numbers, about : 15 % has been applied to the principle ( some months as little as {$20.00} ) 85 % to other. Now, I'm curious to see how my payments have been applied and if the processes used have been fair and legal. Id also like to get solid answers and gain an understanding of why I continue to owe so much. Thank you.

Complaint: Upon direction of Select Portfolio Servicing, Inc, XXXX Bank, XXXX XXXX, has been illegally attempting to collect a mortgage debt for the past 2.5 years and has engaged in multiple instances of fraudulent misrepresentation to both me, the state and appellate courts of Ohio, and to the United States Sixth Circuit Federal Court. Specifically, the Bank, by and through its attorneys, alleged that it is the new trustee in the case by virtue of being the successor in interest to XXXX XXXX XXXX. As a result of those false statements, the bank then stated to the courts that it was the 'real party in interest ' in my case. In addition, XXXX Bank itself wrote me a letter ( attached ) in XX/XX/XXXX stating that it was the 'trustee ' for the 'trust ' that owns my note and mortgage. None of the statements above, both made in court and made to me, were true at the time they were made, and they are still not true today. The evidence of their falsity is readily apparent by means of a fraudulent 'Corporate Assignment of Mortgage ' that was filed by Select Portfolio Servicing , INC , the servicing agent on the account. The assignment, which was prepared on XX/XX/XXXX, contains a number of contradictions that prove that the statements made prior to that date were false. In addition, further statements that were made after XX/XX/XXXX are also false since they assignment failed to transfer any 'interests ' to XXXX Bank as they alleged in court documents. XXXX Bank, in addition to committing fraud upon the Courts, is in direct violation of the Consent Decree it signed with the OCC in XXXX, XXXX. As of XX/XX/XXXX, XXXX Bank has filed a new praecipe of sale as part of its ongoing fraudulent scheme to literally steal my home under false pretenses. I filed in state court on XX/XX/XXXX the attached new motion to vacate the summary judgment due to fraud on the court and 'any other reasons justifying relief ', but it was incorrectly denied on XX/XX/XXXX due to 'res judicata XXXX XXXX
