Complaint: We want XXXX XXXX XXXX investegated they are the servicer on our mortgage. Our loan was originated back in XX/XX/2006. We are victims of a predatory loan. We were misrepresented by the mortgage broker and by XXXX XXXX when this loan was originated. We have reviewed our loan with specialist in the industry and there was fraud on documents from the mortgage broker to the banks and forgery on loan documents and disclosures. Since this loan was originated this loan has been passed along from XXXX XXXX, to XXXX XXXX and now XXXX XXXX XXXX. We also have checked with title specilist and Sps does not hold legal title on our home properly to foreclose on our home since title recording on purchase date and from all the loan transfers from bank to bank .The title chain is broken and not correct. We are victims of predatory lending and now we are stuck with a toxic loan, Due to all these greedy large banks and corporations trying to maximize profits on homeowners that got these toxic loans. We want to hold these corporations accountable for the problems they have caused to our family. We have tried to work with sps over and over to fix our toxic loan and it just seams to fall on deaf ears. We will continue to defend our home until there is a fix on our mortgage.

Complaint: Due to late payment I have been advised that I do not qualify for automatic payments. Consequently I now have to log in every month to make a payment otherwise incur a fee by doing so over the phone. I can not once online schedule a payment any further than a month out. If, for example I need to reset password, then links sent do not work and I have to make a call to get it resolved. SPS is a terrible company. I have only been dealing with them for a few months since transfer, not at my request or wish from XXXX XXXX, to them. It seems to me their priority is to make life difficult for borrowers and encourage practices that make it difficult, not easy, to make payment and therefore instigate late fees, penalties etc. As a consumer I think it is a disgrace that mortgages can be transferred without notice and create hassle for the borrower. This should be a seemless process. I am very angry and frustrated that companies behave this way and the fact that the government does not have the will to alter their behaviour.

Complaint: I am currently struggling to make my mortgage payments to my lender for a legit reason. I had a accident at my place of employment in XX/XX/XXXX and I did recover from it all and then I went back to work and was receiving very small checks from workmans compensation during this time period but not enough for me to make my payments. So in XX/XX/XXXX my lender SPS offered me a Trial Plan and i could not afford this either due to not being able to work at this time, I then went to apply for XXXX XXXX and this is what i now receive today for income with a little help from my wife with her business she has but still not enough to make this affordable for me to able to stay in my home. I am also getting rental income and that is it. In XX/XX/XXXX I applied and i was approved for a RE Payment plan of payments that there is no way i can afford to pay. I then opted out of the repayment plan knowing the lender set me up for failure to not make such large payments to them for 12 mos ( see the attached agreement ) I then re applied again for mortgage assistance cause i am doing all i can to get a affordable payment for me with the income i am receiving now. I had been getting income from my daughter but she is no longer living with my wife and I. So i lost her assistance as well. Per the call to my lender SPS they told the 3rd Party AHR that they will not in any reopen my file for any mortgage assistance at all they will only give me liquidation options ONLY. that is it do short sale or Deed In Lieu and i want to keep my home in some way it can be more affordable to me and my family.

Complaint: My mortgage account was originally set up with XXXX XXXX on or about XX/XX/XXXX and I was never late with any of my payments. On XX/XX/XXXX I made my monthly mortgage payment on time in the same manner in which I made all my previous payments. Apparently sometime in XX/XX/XXXX my mortgage loan was either sold or transferred to Select Portfolio Servicing , Inc, I was never notified of this transfer and shortly thereafter my monthly mortgage payment to XXXX XXXX was returned and I was subsequently considered 30 days late with Select Portfolio Servicing , Inc . I tried calling Select Portfolio Servicing, Inc multiple times and no one from their office returned my calls. I contacted them in writing and they stated their credit reporting to the credit bureaus is accurate. I believe this is totally unfair and may be illegal. My Credit Reports have always been immaculate, and this 30 day late posting has dramatically damaged my credit profile.

Complaint: We ( my wife and I ) entered into a 2nd mortgage with a company called XXXX XXXX XXXX XXXX ( XXXX ) in the year XXXX. Since we did not consult a lawyer as we we did with our first mortgage ; we believed that the promissory note we signed was an adjustable rate, revolving line of credit due to mature in the year XXXX. The amount of the Loan was for {$31000.00}. What bothers us ( my wife and I ) ; is that we've never missed a payment ; and some months ' we paid more than the minimum payment and we owed around XX/XX/XXXX, {$2700.00}. We should have paid off this loan long before the maturity date. We never received a satisfactory letter ; instead we continue to see the balance owed to XXXX in XX/XX/XXXX increase and increase, for example the balance due was {$32000.00}. After doing some research we recently found out that XXXX was sued for millions of dollars for cheating their customers by not applying monthly payments properly ( example XXXX was packing un-necessary fees on the loans, placing multiple points totaling Thousands of dollars on top of double digit interest rates, adding fees on the back of the loan ), result ; one would never pay off their predatory loans. We never part-took in the spoils from this lawsuit. Instead we faithfully kept paying our monthly payments to this predatory company XXXX because our house which we paid off for ( 1st mortgage ) could go into foreclosure with the 2nd lender ( XXXX ) which claimed that we still owed on approximately {$21000.00} as recent as XX/XX/XXXX. We were bounced around in house between XXXX and XXXX who were acting as each other 's Servicer to the tune of hundreds of thousands of dollars. Now entered XXXX XXXX XXXX ( SPS ) ; claiming to be the new Servicer and to start sending monthly mortgage payments to them as of XX/XX/XXXX. We ( my wife and I ) stopped making payments to-date ; enough is enough!, as we saw these payments as a life sentence with no end in sight. Now, SPS is sending us monthly mortgage statements telling to pay {$190.00} so that they can forebear from foreclosure. We stopped because we think we were and still is being de-frauded by these companies. We plan to sue SPS if they continue to harass us with telephone calls and their fraudulent statements. .

Complaint: I submitted a claim previously and I am not satisfied with the effort put forth by any of the parties including the CFPB to resolve it. Look here : According to the FAQ on SPS ' website ( XXXX XXXX XXXX ), they state the following : What happens if I send you more than the amount due for the current months payment? The answer to this question depends on whether you are current on your loan or past due. If you are current on your loan, and you pay us more than this month 's payment, the excess amount is used to reduce any fee balances first, then the principal balance of your loan. Any time additional money is applied to your principal balance, your loan may be paid off faster, assuming you continue to make your payments on time. If your monthly statement shows Past Due Payments, and you pay us more than this month 's payment, the excess amount is held in an unapplied balance until the balance reaches the amount of a regularly scheduled principal and interest payment. We then take the amount out of unapplied balance and apply it as a monthly principal and interest payment. please call attention to the 1st bullet point. It CLEARLY states when one pays MORE ( more than the required payment, it goes to the PRINCIPAL balance. THis is CLEAR as a blue sky. I do not understand why people do not do what they say they are going to do. ANd then the CFPB just turns and does squat? What the heck is that? Donald Trump should FIRE you! Fix this or I will XXXX the XXXX and complain about this garbage!

Complaint: On XX/XX/2018 after documenting complaint # XXXX with the XXXX XXXX XXXX XXXX ; I received a letter from Select Portfolio Servicing , Inc . Proceeding to correct errors in my account, Select Portfolio Servicing , Inc. would be waiving late fees in the amount of {$1000.00} as of XX/XX/XXXX and I would see the update in my next monthly statement. As of the date of the letter the amount of my monthly bill was due for XXXX. On XX/XX/2018 I received another letter that was confusing. I have been paying {$930.00} for years and this letter stated that after they increased my payments to {$980.00} Select Portfolio Servicing , Inc. would be lowering these payments to {$940.00}. But how does that benefit me??? The letter also stated that Select Portfolio Servicing , Inc. did indeed over pay the property taxes. I explained that I have always paid them myself. But Select Portfolio Servicing, Inc. paid them anyway, In error, and now there is a big credit in my property tax account. Also on XX/XX/2018 I received a second letter that stated that I had no home owners insurance although I do. Shortly after the home owners insurance company attempted to cancel my insurance. Blessed, I have continued with home owners insurance without any lapse. More recently, I received a billing statement from Select Portfolio Servicing , Inc. that reflects an increase in fees and an additional sum of {$61.00} that I know nothing about along with an incorrect amount of total payments. If in XXXX Select Portfolio Servicing stated that I owed for XXXX. why does this billing statement reflect over 3 months behind? And why am I after all this time still paying 5 % or more interest when every other company is advising me that I should be charged 3 % or lower?

Complaint: Select Portfolio Servicing has no Explanation as to How Or Why the {$1400.00} is reflected on credit report and Not on my account with them! Hi, So I am reporting of what I believe to be Unfair Lending Practices. Long story short, I am getting out of long nasty marriage, attempting to fix my credit after years of me trusting spouse on finances. Paid mortgage on time last 14 months, until spouse stopped paying support money in XXXX, SELECT PORTFOLIO SERVICING said they will modify my loan, I advised them I might refinance to do some repairs ... ..3 days later my credit took a 71 point Hit due to SELECT PORTFOLIO SERVICING raised my Balance amount {$1400.00} which took my mortgage balance from {$86000.00} to {$87.00}, XXXX in XXXX!!! This I believe was done to PREVENT ME FROM REFINANCING, instead I would be Forced to modify with SELECT PORTFOLIO SERVICING! My statements and all my account info at SELECT PORTFOLIO SERVICING, shows the original balance of {$86000.00}!! When I spoke to them they couldn't answer for the added, {$1400.00} reported to my credit report! I am requesting that this {$1400.00} be removed from my mortgage balance with the credit bureaus ASAP,, Can you please help or tell me what to do? I am working so hard to repair my credit and this is devastating!! Thanks so much for any assistance!

Complaint: A mortgage financial company is providing refinance funds to refinance my property at XXXX XXXX XXXX, XXXX, NY. Select Portfolio Servicing ( SPS ) has been offered a {$850000.00} short payoff amount. The principal owed is only {$680000.00}. The additional amount represents additional fees and interest. I, as well as my authorized representatives, have been negotiating with SPS. They are often put on hold by the SPS representative and nobody returns on the line an hour later. Two months later, I do not have a response from SPS. The last time I spoke with a representative on Tuesday, XX/XX/2018, she said that I did not include the date under my signature in a Hardship Letter that I had provided ( the letter was dated XX/XX/2018 ). Even though the top of the had the date, I printed out a copy and, included the current date under my name. The SPS representative said I would hear back in 24 to 48 hours. It has been a week now and I have not heard anything. SPS is putting me in a position that I may lose my property because the bankruptcy judge does not believe I am trying to resolve this issue with SPS. I will have to escalate this action to a legal one.

Complaint: This is a continuation of Complaint # XXXX which was closed prior to allowing the consumer to respond with additional information. The timeline : Select Portfolio Servicing, Inc. ( SPS ) XX/XX/2017 = Due to financial setbacks, we notified Select Portfolio Servicing , Inc. ( SPS ) we would be unable to cover payments by XXXX 2017 and initiated a Request for Mortgage Assistance with them. SPS recommended and *approved* us for a short sale based on our situation. Furthermore, SPS agreed *not* to report us to credit agencies as past due as long as we were in an active short sale process, which we were. XX/XX/2017 = SPS reported 30 days overdue to XXXX, XXXX, and XXXX XXXX ( we were still in the short sale process ) XX/XX/2017 = SPS reported 60 days overdue to XXXX, XXXX, and XXXX XXXX ( we were still in the short sale process ) XX/XX/2017 = SPS reported 90 days overdue to XXXX, XXXX, and XXXX XXXX ( we were still in the short sale process ) XX/XX/2017 = Short sale completed, SPS reported 120 days or no data to XXXX, XXXX, and XXXX XXXX ( we closed the short sale process and sold the property ) XX/XX/2017 = Account formally closed *We are not disputing any of the language on the short sale agreement. We're disputing that we did not receive the 120 days Marketing Period as spelled out on SPS 's own website. * We submitted our request for mortgage assistance/short sale to SPS in XXXX of 2017 in the attached Hardship Affidavit. In the meantime we lined up a buyer, and SPS dragged their feet to approve until XXXX of 2017, as noted in the Short Sale Agreement pdf attached. Since we gave them plenty of notice and were current with our payments, we were eligible for XXXX payments for a 120 day marketing period, as spelled out on the company 's own website here : https : //www.spservicing.comXXXX ( Short Sale Overview - Select Portfolio Servicing ) A short sale enables you to sell your home for less than the total amount owed on the mortgage. If eligible, we would accept the short payoff in full satisfaction of the total amount due on the mortgage loan. www.spservicing.com ( under Payments During Marketing Period ) : " Eligible customers may be offered a ( {$0.00} ) XXXX dollar payment plan during the marketing period. SPS will not reject the customers payment if they chose to make their full contractual payment. The marketing period may last no less than one hundred twenty ( 120 ) calendar days, and extensions to the original term may be offered upon discretion of Management. The customer may be required to provide a listing agreement and evidence that property is actively listing for sale. " ****We were eligible, the buyer 's offer was in, and SPS assured us everything was in order. Despite this, they reported us overdue in XXXX ( the month we were approved ), XXXX, and XXXX of 2017 to XXXX, XXXX, and XXXX. In essence, 0 marketing days instead of 120. ****
