Complaint: After a period of rapidly demising remuneration due to technological obsolesence I lost my last job in XXXX XXXX just over two years ago. At aged XXXX it is not easy finding another one. Nevertheless in the last quarter of XX/XX/2018 both my wife and became employed. That income along with a pension, social security and additional fees for professional services rendered should by all expert accounts justify a mortgage modification. The servicer - Select Portfolio Servicing Inc is proceeding with a forced sale despite the fact that they are still considering a restructuring as they repeatedly ask me for data that I have already submitted. I do comply promptly with their requests. It is very challenging to establish enhanced lines of communication with them given no real relationship manager and written correspondence that completely contradicts that which I have been told on the phone. I think it perfectly reasonable for both parties to delay the enforced liquidation until a more thorough examination is made of the additional financial resources being introduced in an attempt to work collaboratively with the servicer.

Complaint: Select Portfolio Servicing XXXX XXXX XXXX XXXX XXXX XXXX, Utah XXXX ATTENTION : Notice of Error RE : HOME Equity Loan, XXXX XXXX, with the following loan numbers : l. XXXX XXXX # XXXX assigned by XXXX XXXX 2. XXXX XXXX number assigned by XXXX on XX/XX/XXXX is Loan # XXXX 3. XXXX new loan number assigned XX/XX/XXXX is XXXX I am requesting a copy of servicing file for all lenders that have had any interest in this loan. Additionally, I am requesting an audit of all the payments, trial loan modification payments and the payments independently paid for escrow account as a part of any trial modifications to bring the escrow account to a level balance, any credits, fees charged, interest of the accounting of all three loan numbers to validate the represented balance on the account plus any additional amounts claimed against this HOME EQUITY LOAN. XXXX XXXXXXXX XXXX, XXXX servicing, and XXXX plus XXXX XXXX have repeatedly sent partial accounting records on this HOME EQUITY LOAN that only go back to XXXX XX/XX/XXXX and have stated they have no further records. Although XXXX XXXX XXXX recorded a questionable transfer and assignment of this loan in XX/XX/XXXX and then filed for foreclosure and received a court order of such in XX/XX/XXXX, they have consistently responded to repeated requests for records by saying they have none from both the time they are claiming ownership of the loan from XX/XX/XXXX up to XXXX XX/XX/XXXX when XXXX reassigned the loan and also they have none of the original XXXXt XXXX records from XX/XX/XXXX up to XX/XX/XXXX including a XXXX trial modification finalized with payments and also a {$2500.00} payment for escrow shortage. Even more conflicting is the fact that AFTER the XX/XX/XXXX alleged transfer of the loan to XXXX XXXXXXXX XXXX and also the XX/XX/XXXX foreclosure action, XXXX XXXX signed XXXX trial modifications in XXXX and then in XXXX and accepted trial modification payments but apparently did not credit those payments anywhere that I can find. They also paid all taxes and insurance on the HOME Equity Loan during all years before the accounting begins with XXXX in XXXX and where it shows that XXXX back charges for taxes and insurance along with many fees and interest. Please see the attached index of events which will show the dates. I have not been able to get the records from either XXXX or XXXX and have spent years searching and rebuilding events as best as I could. I do have a 2 think indexed and tabbed binder of all the documents that have taken a long time to trace back and put into order. I am happy to provide a copy if you require them but in all honestly I would guess that a bank should have that and all previous records to validate the balance and ensure all is in order. In addition, I am requesting validation of the accuracy of legal signatures and representation of the following documents : l. XXXXXXXX Transfer and assignment document recorded in XXXX and XXXX XXXX which is signed by XXXX XXXX and prepared by XXXX XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX have been disposed in several fraudulent signature convictions for signing assignments as representatives of XXXX XXXX XXXX when they were not in fact authorized to sign the documents. ( They signed up to XXXX a day illegally ). Please see the index attached for 5 cited actions against this person and corporation. 2. XXXX XXXX Affidavit for foreclosure filed on behalf of XXXX XXXXXXXX XXXX by XXXX XXXX, who certifies his knowledge of the loan documents and accounting and warrants them and the assignment as legally correct. Mr. XXXX is also cited for falsely signing documents and is also listed in the index document provided for your review of the history and documents of the HOME EQUITY LOAN. 3. XXXX Transfer and assignment recorded in XXXX XXXX ( have not found it in XXXX XXXX yet ) that was prepared by Core Logic and signed by XXXX XXXX, who is also cited for falsely signing documents. In addition, the notary is cited as signing under various signatures and as falsely signing documents. Since there seems to be disparity between the ownership and accounting records and conflicting dates of service and accounting I request clear and accurate chain of title that has been reviewed as to accuracy legally and also an audit and accounting of the loan from the beginning of the loan thru todays date. If errors are confirmed then interest and fees will also require correction. Complaint: On XX/XX/XXXX, I entered into a loan modification contract with XXXX XXXX XXXX. Pursuant to the terms of the contract, the interest rate would increased on XX/XX/XXXX. We received notices from the current loan servicer Select Portfolio Servicing as to the rate increase and that we should take the opportunity to apply for a loan modification. Select Porfolio did not process the loan modification in good faith, thus engaging in Floridas deceptive business practices. The payments increased to {$1600.00}, when i ask why such an increase, was told by a representative that was due to not having a previous escrow account. This statement is false i have attached a copy of the mortgage statement for your records that proves that the account always has maintain an escrows, in fact since the loan originated. In addition According the mortgage statement for XX/XX/XXXX reflects a monthly due of {$800.00}. Then suddenly the mortgage statement for XX/XX/XXXX reflect that we are behind {$7100.00}. Clearly this a fraud. If on XXXX the amount owed was {$800.00} because was making timely payments i can not possibly owe {$7000.00} the following month. Select Portfolio has inflated the amount owed. Moreover, the loan modification proposal reflects a ballon at the end of the loan in the amount of {$53000.00}, which we are not in arrears such amount. It is obvious that Select portfolio has engaged in deceptive business practices and we ask that you investigate. Select portfolio have increase the loan balance without any justification and this is fraud. At this juncture we will not be sending any future payments until the account is given credit for the fraudulent loan balance increased. On XX/XX/XXXX, we send two Qualified Written Request to select Portfolio Servicing under Section 6 of the Real Estate Settlement Procedures Act ( RESPA ). The company failed to acknowledge our request within 5 business days and also failed to respond within 20 days of receipt. We are asking select portfolio to respond to this complaint and the qualified written request under RESPA. Select Portfolio must comply with the request under RESPA, its a Federal Law. I am also requesting transaction history in detail from Select Portfolio since the first day servicing the account.

Complaint: My husband lost his job in XX/XX/XXXX. He was XXXX. This was his 4th job since turning XXXX after being steadily employed for over 15 years by each of his 2 previous employers. Each job was approximately {$10.00} - {$15000.00} less annually than the one before. As we aged, we learned to get by on less and less. On XX/XX/XXXX or XXXX I spoke with a mortgage representative and told her we were not going to be able to pay our XXXX payment. She asked if we could pay the principal and interest as NOT going behind on our payments would be in our best interest in obtaining any kind of mortgage assistance or modification. She was pleasant, full of information, and my husband gave her the {$750.00} she said she needed. We were compliant and expedient on all requests presented to us by the mortgage company. As XXXX progressed and we still did not have an answer, we amped up calling for updates. It wasn't until XXXX that we were able to finally be told that it would go to the next process. During these months we continued to make our {$750.00} as recommended and through XXXX maintained my husband 's credit cards. Due to failing health and inability to work long hours standing, at the recommendation of his primary care physician, my husband filed retirement paperwork and ceased paying his credit cards as we waited for some kind of news from Select Portfolio Services. We had at that point exhausted our savings and learned that his first retirement check would not arrive until the end of XXXX - essentially leaving us a month without that money coming in. Had we been told it was in the BEST interest of assistance to cease paying the mortgage, we would have been able to stretch our resources considerably further. So yesterday I get the final decision. 1 ) we are being denied due to our credit report. My husband 's credit was XXXX in XXXX. It only derailed when he stopped paying our credit cards mid-XXXX. Had this been done on a timely 30-45 day turn around, his credit score would not have been an issue at all. 2 ) We are being denied 3 other programs because our account is NOT in default. WHAT??? We are also being denied under a program that multiplies our GROSS income times 1.25 % and says we can afford the current payment of {$1200.00} ( which includes property tax and insurance ). How can they multiply our GROSS ( they have a copy of every paycheck, letter of declaration, income tax paperwork, etc that they requested. Those are real numbers, factual. Why in the world would real numbers be multiplied by 1.25 %? Our total income is {$4400.00} between us and SPS declares {$5800.00}? I am beyond confused and frightfully angry. We did as we were directed to do. We were denied one program because he was never totally unemployed because he has worked 2 jobs for the past 12 plus months and having some employment disqualified him from unemployment compensation. My husband was encouraged to use my income and my credit score. He has never given either to the mortgage company in the past. My money is absorbed monthly with groceries, XXXX and medicine, as well as our life insurance policies. There is not one penny left from my account monthly. Ever. My credit went south when my daughter had a XXXX XXXX and she and her XXXX children became dependent on us in XXXX - shown in our XXXX tax return. This is my home. Has been since XXXX. During this process - somehow information was released for a short sale as that is the mortgage companies recommendation and I have already received 2 offers in the mail. One before the mortgage companies notice yesterday. Short sale? This is MY HOME. The only home my 13 year old grandson has ever known. We put down roots here to retire. We can not go out and live anywhere any cheaper. I am well aware. I am also aware of our age and the opportunities that SPS has not provided us information on or option on. Bottom line, there is no resolution with SPS ... but lots of excuses. I could write a book on the excuses I heard about missing paperwork over the past 90 days. The bad advice we received, continued to receive as we were ALWAYS encouraged to continue to make the {$750.00} payments, has destroyed my husbands credit, drained our savings, and left us with a recommendation to do a short sale. Someone should be held accountable. When we first talked to the consultant at the end of XXXX this should have all been resolved by XXXX. When we still had a little bit in savings, when we still had credit, when we were in good faith making our {$750.00} mortgage payments. Please, please ... .help. Attached in the file is all personal information. Their response. And our checking account that shows we rarely splurge and when we stopped paying our credit cards ... that our mortgage was paid, etc ...

Complaint: I'm divorced XXXX I had a joint mortgage with XXXX they released me XXXX it was sold to XXXX XXXX then sold again XXXX to Select portfolio services ... ..XXXX Select Portfolio Services is now recording his loan on my credit ... .XXXX is out of business XXXX will not talk to me, because I'm not on the loan, but I was able to get a letter of release from XXXX, SPS will not honor it. SPS says the former banks did not know what they were doing and have be mistaken since XXXX. From what I understand, is that my X husband is the successor because the house was given to him in our divorce decree and when you do a modification after divorce you become solely responsible. My name is not on the Loan Modification and I did not need to sign the modification because the home belongs to him along with the promissory note. I also read that a loan modification is consider an assumption. Please help me, I just tried to help my daughter to get a loan for a car and we were turn down because of this error. The reason for the default was because of the divorce and the ex-wife was living at the property without making any attempts to make payments has she was responsible. I have intentions of keeping the property and would like to be reviewed for a modification assistance and also a principle reduction as my property value its very low with a high principle balance.

Complaint: I had an initial mortgage loan with XXXX XXXX created in XXXX. In XXXX this mortgage was transferred to SELECT PORTFOLIO SERVICING , inc. From XXXX to current I've been paying taxes through escrow with little variation in my monthly payment. In XXXX the mill rate was based on a fair market value of {$200000.00} and in XXXX the mill rate was based on a fair market value of {$130000.00}. AGAIN, there was little variation in my monthly payment during this time and clearly my property taxes being paid through escrow were significantly lower. Despite all these facts, XXXX XXXX claimed a {$2900.00} " escrow advance '' during XXXX just prior to the transfer to SPS. Keep in mind they only paid {$1700.00} to the county in taxes! RATHER THAN SPS disputing this " advance '' they applied this to my loan as a fee that would ultimately create " fees '' and " charges '' of {$8700.00} in total as of XXXX! SPS continues to justify this fraudulent charge of {$2900.00} an all the subsequent fees and charges rather than removing from our account immediately. I've submitted to SPS the tax payment record from XXXX direct from my county showing exactly what was paid by XXXX XXXX during XXXX. Why is this legal?!

Complaint: The following is in response to Select Portfolio Servicings ( SPS ) letter dated XX/XX/XXXX, referencing CFPB complaint number XXXX. Please allow me to outline my continued unresolved issues/concerns. 1- SPS continues to claim XXXX XXXX XXXX XXXX , as indenture trustee for the holders of XXXX Trust XXXX ( note this has changed several times ), is the owner of the account. However, SPS has never provided any documentation substantiating this claim. A Notice of Servicing Transfer does not constitute XXXX XXXX XXXX XXXX alleged legal ownership of the account. Please provide documentation legally substantiating this claim. 2- SPS has yet to provide me with copies of all property inspection reports charged to the alleged account and dated : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. 3- SPS continues to claim, Our records show that the property address reflects the property address on the note. This statement is clearly a false misrepresentation of the facts. First, the alleged note states, YOU ARE GIVING US A SECURITY INTEREST IN THE REAL PROPERTY AS DESCRIBED IN THE MORTGAGE AND LOCATED AT : XXXX XXXX, XXXX, NY XXXX. Again, an address is not and can not be used to legally describe a property secured by a mortgage. In addition, even if it could, as I have stated numerous times, the PROPERTY AS DESCRIBED IN THE MORTAGE, is not the property ( metes and bounds ) coinciding with the property address of XXXX XXXX, XXXX, NY XXXX. Additionally, the two previous notes and mortgages ( XX/XX/XXXX & XX/XX/XXXX ), allegedly consolidated with the alleged XX/XX/XXXX mortgage have two different addresses, which is XXXX XXXX, XXXX, NY XXXX. The zip code XXXX is not even the correct zip code for XXXX, NY. Secondly, SPS, as alleged servicer, has paid taxes on a property they are illegally associating with XXXX XXXX XXXX XXXX, NY XXXX, although current tax records indicate the property address as XXXX XXXX XXXX. SPS has yet to sufficiently explain this discrepancy. Lastly, as the Fiduciary for the Estate of XXXX XXXX XXXX, I continue to dispute and refute any and all claims XXXX XXXX XXXX XXXX, as indenture trustee for the holders of XXXX Trust XXXX, or any affiliates have against the estate of XXXX XXXX XXXX. Based on the stated facts, SPSs response is both inaccurate and misleading. Im sick in tired of SPSs cut and past responses, which provides absolutely no resolution to my issues and/or concerns. I have previously provided documents to SPS, which fully substantiates my claims. A copy of this complaint will be provided to the New York State Attorney General.

Complaint: My mortgage was with XXXX from XXXX until the middle of last year ( XXXX ). The loan was in my name and my now ex-wive 's also. While we were settling the divorce, XXXX had sent me paperwork to allow me to have my ex-wive 's taken off the mortgage note, not a refinance. They told me I had to pay a fee and qualify for the mortgage by myself which I was perfectly fine with. One of the conditions, was a completed divorce decree which unfortunately didn't get finalized until XX/XX/XXXX. I have since reached out to the new company that my loan was sold to Select Portfolio Servicing to complete the process I had started with XXXX. They are telling me they have no way to take my ex-wife off the mortgage except for a refinance. The problem with that is I am about {$450000.00} still under water so that is impossible, which they are fully aware of. I was told that when my mortgage was sold, my terms wouldn't change which to me at least means I am not put in a worse situation as I didn't choose them ( SPS ) they bought my loan without my consent so why should this option no longer be available to me? I feel they need to make good on the process I was going through with XXXX since it wasn't my choice to work with them they chose me. Part of my divorce decree, is to get my now ex-wife off the mortgage which is impossible with their rules which contradict XXXX 's. Thank you in advance for your help and please let me know what documentation you would like me to provide. They have been extremely difficult to deal with compared to XXXX. My relationship manager I was assigned to is XXXX XXXX XXXX.

Complaint: I have had a very difficult time with Select Portfolio Servicing ( SPS ). I recently was unemployed for about 6 months. I am back to work and applied for a modification. I was never able to communicate to the same person which always caused confusion. SPS always seemed to lose my paperwork, which I constantly had to re-fax. After about 6 weeks, I was declined for a modification. SPS told me they would not allow me to do a modification. And the investor said the same thing. I have NEVER had a modification and this is the first time I have had any problems with making my mortgage payment. I can not believe that SPS is not willing to help a homeowner who is over the hardship. How can I be denied for a modification, when I have never had one?
