Complaint: Select Portfolio Servicing Inc. is my servicer. XXXX XXXX is the note holder. In XX/XX/XXXX we applied and submitted for a Loan Modification on our XXXX, Owner Occupied Home. We were granted a modification in XX/XX/XXXX. We signed and returned the modification agreement, as did our servicer. In XXXX, the servicer unilaterally attempted to change the terms of the modification. Our payment would rise and our Balloon Payment was going to rise from {$200000.00} to over {$800000.00}. We have refused to accept the change as it is NOT beneficial. Recently, Select Portfolio Servicing refused to take our payments and attempted to foreclose on the property. We have reached out to them on a constant and consistent basis. We requested a review on XX/XX/XXXX and were given a 45 day window for a resolution. It has been over 50 days and they have NOT responded in any way. They continue to add late fees even though we have been current since the modification.
The Servicer has verbally responded that they will NOT honor the signed modification from XX/XX/XXXX, given that we did NOT accept their revised modification offer. They have NOT furnished their response in writing nor in a timely manner. We informed them that we will be filing a complaint against them.

Complaint: I have successfully gain a loan modification now over 6 months with Select Portfolio Servicing ( SPS ) through the assistance with XXXX XXXX Law Offices. I have documentation of the completion of the loan modification process and closing. I have abled my trust and confidence to re-establish creditworthiness with SPS and agreed to the terms of the contract, loan restructure and acknowledgements thereof. SPS states to me after I successfully completed the process only after my inquiry because of my BK filing 8 years ago ( discharged ) that they are not required to report and have no intentions on reporting my monthly payment history according to the current agreement. This was my last conversation I had along with a third party ( XXXX XXXX XXXX ) at Law Offices to speak with SPS authorized to speak on my behalf. I find this to be a major setback, not able to regain and build my credit and it restricts me from my efforts in paying on time and agreed.
I absolutely love the new loan and the fresh start and feel I 'm getting robbed of the benefit of paying as agreed. I would like resolution for SPS to report my pay history to the bureaus each month according to how I am paying. If this can not be achieved, I am open to other options, ie stated letter every 3 months of my pay history so I can forward to the XXXX credit bureaus so they will be updated.

All information has been provided to SPS but they still have not pushed the sale back and I am in jeopardy of losing my home to foreclosure. Complaint: I applied for assistance in saving my home with my servicer SPS. I hired an attorney to assist me with the process. On XXXX XXXX, 2015 I was denied for a loan modification. However, the lender missed part of my income in the review. My denial letter offered me 30 days to appeal the decision. My attorney submitted an appeal in writing to SPS on XXXX XXXX, 2015. I have attached the email confirmation showing my attorney sent the appeal and all corresponding documentation on XXXX XXXX, 2015 at XXXX. I have also attached my attorney 's internal notes where they called and confirmed my appeal was received and under review on XXXX XXXX, 2015 at XXXX. SPS issued me a letter on XXXX XXXX, 2015 ( See Attached ) - letter dated XXXX XXXX, 2015 - stating that my appeal was denied due to the appeal was not received within the 30 days after the denial. My attorney contacted SPS and SPS states that they are refusing to review the appeal because they did not receive the appeal in the 30 day period after the denial. My attorney advised them we have confirmation the appeal was in fact received by them on XXXX XXXX, 2015 at XXXX. SPS states their computer system takes up to three days for it to show up on their side so that was after the 30 days was up and therefore they are not willing to review the appeal. My attorney advised them that simply because their IT department decides to hold up all electronic correspondence for three days does n't mean they can use that as an excuse to evade review of a validly submitted appeal. SPS is unwilling to consider my appeal. My attorney states they are in violation of Respa Reg X ( 1024.41 ) and are in fact evading review. Please enforce any penalties against SPS for violating this Respa law. This is not only unethical they would hold my application for appeal past the appeal date, but it appears to also be illegal.

Complaint: I have been approved for a loan modification by the Servicer SPS andthey continue to foreclose on my family even after I have reached out tothem several times for help. They are clearly ignoring our cries for helpalthough we have qualified and have been approved for a loan mod.
I have spoke to several different reps ( XXXX in all- XXXX XXXX XXXX XXXX - XXXX XXXX XXXX XXXX - XXXX XXXX XXXX XXXX - XXXX XXXX @ XXXX XXXX XXXX @ XXXX and XXXX @ XXXX XXXX ) All of them gave me the run aroundevery time I called and they said that the foreclosure would be stoppedand that I would not lose I home because we qualified and they weresending the approval by mail which has not arrived yet. However theTrustee sale is set for Monday XXXX XXXX, 2015 by XXXX XXXX who I also called to request help and all they saidwas to file bankruptcy which is the only option they claimed I hadto save my home. I am very frustrated and scare about the foreclosuresale date and have not been able to get anyone to confirm the stoppageso I still face losing my home on Monday. I need help to stop theServicer from foreclosing on my home. They have negligent and abusivetowards us and now they want to steal our home and kick us out onto thestreet and be homeless.

***************************************************************************************************This is concerning the papers I sign for the Deed-In-Lieu. I sign XXXX different pages and was given copies of all pages NOT sign by me. I met a Notary Public in XXXX, NC.
Met at XXXX off XXXX XXXX on Saturday XXXX XXXX, 2015. Ever since that day, I have requested a copy of the pages I sign and I have received NO response from anyone. Emails to XXXX XXXX were sent in multiple days. Last email sent was just before XXXX. I have copies of other attempts to contact dated XXXX XXXX, XXXX XXXX, and others. I have made more than XXXX calls to SPS and it is a joke. I made sure that the conversations were recorded.
It seems that SPS and the staff have no real desire to finish what they started.!!!!!!!!!!!!!!!

Complaint: As the result of the complaint I filed against XXXX and they sold my Loan to Select Portfolio Servicing , Inc with my monthly mortgage still going up. They want me to pay XXXX a month for a house valued at XXXX maximum. I am petrified to try again to get a loan modified or try keep my home. I contacted a counsel from the Homeowner Hotline she and I spoke with representation for Select Portfolio Servicing , Inc. asking for a short sale. They agreed finally and gave me XXXX XXXX a Real Estate Agent they use from out of Georgia. He came out to my house, took pictures and place them in XXXX along with a sign in my yard and a key in the lock box on my door. Select Portfolio Servicing is telling me that they did agree to the short sale or any other arrangement relating to my house. I have taken all of their calls early in the morning and in the evening hours repeating my intentions and sending any required documentation to them. My desired resolution is to put all of this behind me and the opportunity for a short sale.

Complaint: I sent a letter to Select Portfolio regarding my denial for loan modification : XXXX XXXX, XXXX XXXX XXXX XXXX or XXXX XXXX XXXX, I am not sure why I was denied for my modification it was because of my DTI ratio. Your processor gave me a hard time insisted that I had to circle my wife 's because she was considered a roommate. I knew with all the hassle that was given that they was going to refuse me of the modification.
The first modification you guys gave me messed me up so bad it took approximately 6 months. Calling back and forth for you guys to assist me regarding of the insurance issue by that time I was rejected and you add your insurance and it was difficult for me to get ahead of my mortgage.I have a copy of the letter that I sent to your company and also spoke to the same law office that remove my name and wife name from deed. They advised me the reason that this is taking so long to add me back to the loan was because the mortgage company did not put in the proper paperwork.I have a XXXX son and I gave them all the necessary paperwork so I am not sure why you stated on your letter due to my debt to income that I was unable to get modified. For loss mitigation you offer me Short Sale or Deed in Lieu of Foreclosure. That is your solution. This is the letter that I sent you 2 years ago and never received a follow-up : XXXX XXXX, XXXX XXXX XXXX, To whom it may concern : This is an ongoing issue with your company. I am being penalized due to your bank error ( Select Portfolio ). I obtain insurance with XXXX per my loan modification request. If you look at my loan history you will see that I have been sending my payments out on time. I contact the insurance dept. at XXXX before the cancelation to let them know what was going on. I was told that I am showing ownership on the account not sure what I was talking about. Well my Insurance was cancelled in XXXX when I called the insurance company again I told them the same thing that I am looking at XXXX County Appraiser 's website and Owner Name is XXXX. I was given the ATTY for Select Portfolio I have to contact them and let them know what had happened. Really ok I will do your job no problem. I contacted the Attorney ( Actually your attorney that filed the foreclosure ) I was told that Select Portfolio never filed the appropriate paperwork so the courts can not reverse the name.I did receive a letter from the court that they have filed " MOTION TO CANCEL XXXX XXXX, XXXX FORECLOSURE SALE, VACATE FINAL JUDGEMENT, DISMISS CAUSE OF ACTION, DISCHARGE LIS PENDENS AND TO DIRECT CLERK TO RETURN ORIGINAL LOAN DOCUMENT.I was told that this process would take 30 to 45 days. Well I received a letter from select charging a ridiculous amount on my mortgage telling me that I refused to get insurance. Well technically is due to your negligence not getting the paperwork to the courts to remove your name as the property owner and taking their name off. I am paying for it and I pay big for it so that is why I fell so behind.Today its XXXX XXXX, XXXX spoke to XXXX my loan no updates or actions were taken to get this loan back on track. So I was transferred to XXXX XXXX customer service department. I am not sure what is going on with you guys on your end. Not only you are taking your sweet time getting this resolve you are charging me a tremendous amount. I would like the late fee waived off my account. Looking at my credit SPS still have not updated my credit report. It seems that your company it setting up for failure. Please contact me once the outcome has been taking care of.This is the letter that I sent to your company and so I decided to file for another modification I have a steady job so does my wife and I was denied for the modification. I want to keep my home and make it affordable.
