Complaint: DEBT VALIDATION NOTIFICATION : Select Portfolio Servicing Inc. is attempting to collect a debt i, as a consumer, do not owe and i want the CFPB to be witness to my demand for accountability to these criminal actions. i have done everything in my power to shut down these unlawful acts and the FDCPA and CFPB are clear that unsecured debt collectors can not foreclose, and that if a debt is not owed the consumer has protection from these crimes. It is also clear that if a debt is time barred it is also not able to collect and by their own admission this alleged debt they have created is time barred and i have given evidence of their unlawful actions. Select Portfolio Servicing Inc. ( SPS ) is using XXXX XXXX XXXX XXXX as a biased Trustee, an entity that was recording documents in XXXX and XXXX, without having standing to do such. I have given proof of unlawful actions. SPS has no standing, nor does any entity to record any documents against my home regarding these matters and documents of fraud continue to be uttered against my title. Identity theft has been used in attempts to commit grand larceny and i can not allow my private property to be stolen. These entities are claiming to be collecting on behalf of XXXX XXXX Trust, a trust that has no standing by the evidence i have sent all of these entities. i have completed the XXXX XXXX XXXX XXXX and have recorded Notice of Defaults against these entities for their unlawful actions, rendering also, under 15 USC 1635 TILA Rescission i have already verified that the alleged Deed of Trust is to be rescinded and yet the companies continue to attempt to collect a debt not owed, threatening to steal private property. XXXX XXXX is effective for 15 USC 1692 violations.
under 15 USc 1692i and 15 USC 1692g i am requesting Account Loan Data from Original lender - verify and validate in affidavit form swearing under penalty of perjury their statements.
As of this date SPS and all are in default, without the ability to rebuttal, as they never answered, instead of lawful answers they caused fraudulent documents to be uttered and recorded into the County Recorders office and recorded a Notice of Trustee Sale that is now rescheduled forXXXX XXXX, XXXX i issued a cease and desist and demand for cancellation of the sale and rescission to be honored and all funds returned as required by the Tila Rescission.
These entities continue to perpetuate their crimes and it must end. Having met with a title agent and Real Estate counsel who say if these entities do sell the property through grand larceny more damages will be incurred. Title can not pass by fraud and as such i demand accountablity for these actions.
The CFPB is the enforcement end for these actions and as such will be witness to the affidavits if produced by the entities who have first hand knowledge of these documents. Without first hand knowledge it is all hear say and not enforceable. ORIGINAL LENDER VALIDATION AND VERIFICATION : they can not take any real property until they answer this Debt Validation Notification and take it to a Federal Judicial district Consumer court and can not do an unlawful non judicial foreclosure action. i have a right to these demands being met and that no debt collector collect from a consumer without proof they have a right to collect and sworn testimony of first hand knowledge to the facts. i will also hold anyone personally liable for any fraud uttered unless these actions cease and are remedied as required. i have been very clear in all communications. This home has been fraudulently stated in documents as non owner occupied, that has been rebutted in affidavit and still continues to be uttered in fraud by these entities and employees personally making false declarations.

Complaint: I have no idea why they keep calling me are and they keep calling me and leaving messages for me to call them which is against the law to harass a person for a debt that I do not recall ever receiving a letter but I have lots of messages from them and they are constantly calling me and breaking the law by doing so. It is now not a matter of a collection it is now a method of harassment and it is against the law what they are doing regardless if it is concerning a bill no one has the right to keep calling and calling and harassing anyone.

Complaint: I have been making payments on my home mortgage for 15 years and never been late on a payment. When a balloon payment came due, the current service provider told me that I would have to pay the amount in full, or they would foreclose on my home. I could not obtain the large amount of money needed to pay the loan, so I sought to refinance. Select Portfolio Services ( the service provider ) told me they could not refinance the property, that the only option I had was to pay it in full or default and lose my home.
I finally found a company that would refinance for me, and began to ask SPS to provide me certain documentation in order to complete the process. It has taken over three months at this time, and it still is in process. The mortgage changed providers numerous times, and along the way it changed from XXXX as the lien holder to XXXX who apparently owns the lien. When I finally got to the point where we could close, the title company obtained a copy of the title on the home, and it showed XXXX as the lien holder. Since all the supporting documentation showed that SPS was servicing the loan for XXXX, the title company asked that SPS provide a document showing that the lien changed hands from XXXX to XXXX, but SPS refuses to do this. I 'm suspecting that there may be no proof of who owns the loan, since SPS can not provide me with any documentation of this simple fact. I called XXXX and they said they had no records of the loan. I called XXXX and they also told me that there was nothing in their records. SPS insists that they have to say that because SPS is the service provider, and only they can divulge information. I should have been able to close on this months ago, and because they will not assist me, I am now behind in XXXX payments and it will soon begin to affect my excellent credit rating. My mother ( who dwells in the home ) receives almost daily calls from SPS asking for payment and threatening to evict her if payments are n't submitted. She obviously is very upset about this, always in tears and being an elderly woman with serious health problems, this is stress that threatens her well being. I just want to close on my refinance, payoff this mortgage and cut all ties with this company. Can they legally prevent me from moving forward by not supplying the necessary documentation? Are n't I entitled to this information? What can I do to hold them accountable?

Complaint: I requested a list of SPS approved appraisers in order to oreder a valuation and XXXX XXXX advised me that is proprietary infomration although they sent me letters stating I have to order from a SPS approved appraiser. IN addition he stated he has to start the process although the letter states I have to order. Also, he stated I can not use a BPO although documentation states an appraisal or BPO can be used. He also stated he can not give me the price of either valuations and that I would just have to order and they will place the billed amount on my account. I have never order an appraisal with out knowing the costs up front. He stated he would look into it.

Complaint: We received a letter from Select Portfolio Servicing , Inc. dated XXXX XXXX, 2015 which is an invitation to a Free Homeownership Preservation Event at XXXX in XXXX, NY. We will not be attending the event. We are not a customer of Select Portfolio Servicing and deny any contractual or other relationship with your organization.
As SPS knows or should know, we have written previously informing SPS that there is no delinquency. We have disputed the debt -- as well as the authority of SPS to act in any capacity in regard to the alleged account number they reference.
We have disputed this debt ; therefore, until affirmatively validated, SPS knows or should know their information concerning this alleged debt is inaccurate. Thus, since they have already reported this debt to any credit-reporting agency ( CRA ) or Credit Bureau ( CB ) then, they must immediately inform them of our dispute with this debt. We have received a copy of such report from Experian where SPS still lists the debt as a mortgage debt. Reporting information that SPS knows to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act1681s-2.
SPS continues to persist in pursuing collection efforts without validating this debt, we are herewith informing SPS of another complaint that will be filed with the Consumer Financial Protection Bureau based on their failure to comply with the FDCPA, Section 809.
SPS has admitted that it is not the servicer of this account or any account in connection with us ; that it is only attempting to collect an alleged debt based on " servicing rights '' ; that SPS has made contractual arrangements with other parties for their own profit ; that SPS has harassed us and continues to harass us ; that SPS has not proved and is unable to prove that we owe any debt.
