Complaint: We have our house on short sale SPS is the servicer. I have 5 letters that say we could receive up to {$10000.00} in relocation assistance and have had XXXX or XXXX recorded conversations with SPS. Finally they have accepted an offer. I ask about the Relocation assistance and they now say I wo n't get it. When I ask why they say because I am not eligible. I ask why? all they say is if you do n't sign the papers as is then they will just forclose. When I talked to someone yesterday I ask if I could get it in writing that they say I am not eligible. As it is all I have in writing says I get it, and without A letter from them that says they are the ones that refuse the relocation money it would appear that I just signed off. All I ask was some proof in writing from them that I am not eligible. They flatly refused to give me anything in writing. That makes me think they are trying to hide something. The mortgage business is nothing more than paperwork, nothing is done word of mouth.
If I do n't get the money OK I do want something in writing from SPS for my own protection.

I sent them the completed XXXX form several times. Today XXXX/XXXX/16 they are saying that the form is old. I have a buyer that is living in a hotel since the XXXX this month that is threatening to cancel. The seller is XXXX military that just wants to sell.

Complaint: I am trying to sell my home. I am in escrow. My loan was sold to Select Portfolio Servicing. SPS has such poor systems that they could not answer any questions about the loan for 2 weeks. Then they are unable to generate a payoff quote for another week. The SPS call center was completely unable to help and could not provide any info. Banks should not be allowed to offload the cost of their poor systems onto consumers.

Complaint: Good afternoon! I would like to file a harrasment and discrimination complaint.
Last Tuesday I filed a complaint for SPS, inc, their representatives/relationship managers ( rel m, ), and their employer, XXXX XXXX. We were having a hard time receiving an answer for a short pay off offer we made a month ago. Today, for the first time in all this time I 've been trying to reach her with no luck, I receive a phone call from my assigned relationship manager, the one I never found every single time I called. Saying the offer was denied by the owner of the property ( XXXX XXXX ). I was shocked and asked why so soon, last Monday they said it was going to take a week ; what hapenned? She said that owners said NO. I asked her a couple of things, because I was told by one of the rel. m before, that in case our offer was n't accepted they will suggest what they thought was a reasonable amount for us to consider as a better pay off and I was ok with that because at the time we only had a specific amount, not more. So we were preparing even for that. I kept asking why if I was told at first that our case goes directly to a specific Collateral file team Department, why after that, it was also sent to owners? She said the SPS team had the case almost for approval but their boss wanted to show it to XXXX XXXX for them to decide, and because we stood by our only one offer and not more, they said no inmediately, and wanted the house to go on with foreclosure. SPS, inc analized the case and was about to give us ok to go on with the deal, but received a NO from the owner XXXX XXXX, ( I do n't even want to think was because of our complaint, they prefered not to help ). She even said that it was true, sometimes XXXX XXXX and other employers, come forward with a higher amount, and takes them a couple of days to decide, but this was a No at first. We would definitely like a reconsideration and hope they are not receiving offers from others to buy the property at a better price. That 's harrasment, not giving us opportunity after all we 've been thru.

Complaint: We own a small family business. Because we had a great credit standing, we coul n't ask for a home loan modification. When the economy changed here in XXXX XXXX and banks closed by FDIC, we lost credit and commercial lines, immediately we put our house on sale, with no luck. After a while we tried loss mitigation with the Bank but when a new mortgage deal was ready, the bank sold the loan to XXXX XXXX, which we found out who they were when they were foreclosing our home. After several attempts to keep our home and try to contact by letter their lawyer with offer to buy with no answer, we received a new foreclosure date for this XXXX. Our lawyer finally communicates by phone with XXXX XXXX lawyer and she desagrees to go directly to the owners with offer and gives a phone for loss mitigation dept, in SPS, inc. Last XXXX XXXX, 2016, I started conversations with SPS , inc, explaining all this and saying that for more than a year we have been offering money for the loan. Since then I 've been calling weekly doing exactly what told, and sending documents. Everytime I call I have to explain to a different person and they again give me new instructions and tell me to wait a couple of days or one more week for the answer. When I call they always remind me foreclosure date, XXXX XXXX, 2016 and I always tell them the same, why keep delaying?, they are not helping much. I was told this week I was going to receive answer to our offer, now today I was told they sent the offer to the owners to be considered and maybe it can take one more week. Is taking forever and time is what we do n't have. They send letters with an assigned relationship manager that speaks XXXX and everytime I call, I never find her. Every agent says different things, even the first one kept opened the loss mitigation case for us just in case we needed it and I sent all documents required for short payoff and later found out we were n't considered yet because the loss mitigation case was still opened ... really?, and they knew I was looking to short pay off. We 're desperate. We never knew how much XXXX XXXX paid to XXXX for the loan account because we found out late about them, but since that we offered to buy back and now with a higher amount is still difficult to get to the owners. Why not go directly to them since the beginning? They keep sending letters in XXXX, only with the ending in XXXX to make you call, knowing we speak XXXX. We bought that house, put our savings to live with our XXXX children and no one from the two different loan owners have been nice enough to help us keep our home.

Complaint: I have sent notification to this trustee who is attempting to wrongfully foreclose on my property. By their filing of instruments they are in violation of the Equal Credit Opportunity Act ( codified at 15 U.S.C. 1691 et. Seq. ) and the Fair Credit Reporting Act ( codified at 15 U.S.C. 1681 ).
Trustor is exercising his/her right to conclude and inform you that your NOD Instrument does not constitute Notice and is invalid under California Gov't Code 27201 et. Seq. Specifically, the legal sufficiency of the Filed Instrument is disputed and denied by Trustor.
Because of this discovery we have demanded that the trustee cancel TS # : XXXX. To this date, and to our knowledge, they have failed to cancel the Trustee 's Sale.
I believe that if any attempt is made to execute the Trustee Sale identified above, they will be acting with Notice of invalid Filed Instruments and of debt disputed by the Trustor. They have been so advised that, because of and consequent to this Notice of invalid Filed Instruments, " XXXX '' is exposed to full liability, jointly and severally, along with the Beneficiary ( s ) and/or affiliated entities for any damages that may, in the future, be awarded for filing false instruments, breach of contract, or wrongful foreclosure.
A material defect in the NOD, such as gross misstatement of the amount in default, voids the sale, and the trustee may refuse to convey the trustee deed. XXXX v. Superior Court ( XX/XX/XXXX ) XXXX XXXX XXXX XXXX, XXXX XXXX XXXX. The court in City of XXXX XXXX v. XXXX, XXXX XXXX XXXX ( XX/XX/XXXX ) also stated that : " the purposes of the Recording Statute is to provide Notice ... whether valid or invalid ... if invalid instrument is filed, no Notice is given. '' The Trustors ' rights under both the deed of trust and statute are being violated by QLSC. XXXX was never properly and legally substituted as trustee of the subject deed of trust, therefore, you are statutorily prohibited from asserting any such authority.
It is in criminal violation of Cal. Penal Code 115.5, Filing False Instruments. The Filed Instruments identified herein are statutorily defective and false. They were demanded to immediately remove them from the public record permanently and to cause Public Notice of such remediation to be effected immediately.
After receiving no response from XXXX XXXX XXXX XXXX, we mailed them a Notice of Default notifying the company that they were in default on their obligation to rescind the Notice of Default as demanded by the Trustor and were in breach of contract.

Complaint: I fell 2 months behind on my mortgage and requested a loan mod from the servicing company, XXXX XXXX XXXX. I was told I was not eligible. The rate was 6.75 % but the payment was interest-only, $ XXXX/month. Later that month I called to make a payment and it was refused, even though I would have been only 1 payment behind. I re-applied for a modification while they refused to accept payments for another 6 months. I appealed to every agency I could for help. Finally XX/XX/XXXX, I was told to make a downpayment of {$22000.00} to be eligible for a loan mod. Instead, I recieved a Forebearance agreement demanding another {$29000.00}, and higher payments of $ XXXX/month. Since then, all of my money has disappeared. The {$51000.00} that I paid was ADDED TO MY PRINCIPAL BALANCE, and the money just disappeared-as did the employee who had been the main contact. I borrowed more money to hire an attorney to help me who was absolutely WORTHLESS-didnt listen to or review anything, just sent out the same letters I had already sent. I have prof of the wire transfers where these crooks stole my money. Now they have sold my loan. WHY CANT YOU STOP THESE CRIMINALS?

The representative inquired about homeowners plans for the property as payments were delinquent. The representative was advised that there had been a change in material and financial circumstances. That the co borrower spouse on the loan, XXXX XXXX, had been diagnosed with XXXX XXXX on XX/XX/2016 after having been ill but undiagnosed for one year. The XXXX representative was advised that XXXX XXXX 's illness had kept him from working full time in his small business and had caused a substantial drop in business income. The XXXX representative was advised that the homeowners needed a review for loan modification as the interest rate of 8.625 % was too high and made the mortgage payment too high. The XXXX representative advised the homeowner that a review for a loan modification was " not an option '' because a loan modification had been previously completed. It was not until I received a consultation with an attorney, that I learned that the bank and or assigned servicer were obligated by law to review for a loan modification if there had been a change in material or financial circumstances. The statements made by the XXXX representative discouraged the homeowner from pursuing a review for modification. The SPs Representative violated the homeowner 's rights by NOT fully exploring all the available options to avoid foreclosure. A California Declaration Of Compliance was filed XX/XX/2016 with the Notice Of Default, falsely stating that all options to avoid foreclosure had been explored with homeowner. My rights have been violated. My home is being sold without due process of law.

Complaint: XXXX transferred my mortgage to SPS ( Select Portfolio Servicing ). when the transferred what on process SPS sent a letter stating that they will honored all the payment, escrow account etc. However, the first thing they did they recalculated my escrow projection account increasing my payment in XXXX dollars even though the taxes this year in XXXX XXXX count went down XXXX dollars and my Insurance went down XXXX dollars. I contacted them requesting for me paying my taxes and insurance but I have n't received ant replied from them. Second that all the way they are reporting XXXX and XXXX made my score goes down XXXX points.

I advised her that I and co borrower sopuse had a significantchange of circumstance as my husband, XXXX XXXX, the co borrower, was diagnosed with XXXX XXXX on XXXX/XXXX/XXXX after being ill but undiagnosed for one year. I advised her that our business income had significantly dropped. I advised her that our mortgage interest rate of 8.625 % was still too high and we needed a modification review. Complaint: My foreclosure trial case was postponed on XX/XX/2016 waiting for a Loan modification appeal response. Select Portfolio Services failed to use the correct and undisputed monthly gross income figure twice after receiving notification of their mistake. In writing on XX/XX/2016, and alerting them to yet of a worst mistake by phone on XX/XX/2016. This prompted to agreed motion to postpone court trial. See attachments.
I contacted SPS on XX/XX/2016 to find out the status of the review only to be told that there was no review in progress since their decision dated XX/XX/2016 was their final and if I wanted further consideration I would have to start all over.
After it took over 7 months for SPS to be satisfied that I had provided all the documentation needed, I feel SPS is not acting in good faith by demanding the process to start all over. I demand their mistake corrected without having to go through the whole process since a new trial date has been set for XX/XX/2016 where I can lose my home.
It is obvious that SPS is failing in correcting and reviewing submitted and accepted information time and time again.
On their letter dated XX/XX/2016, the loss Mitigation review determined that they incorrectly used the figure of {$3500.00} and updated with the " correct '' amount of {$2800.00}. The correct figure is {$4700.00} plus {$480.00} a month projected Estate distribution from XXXX XXXX once his mother 's Estate is settled. This information and supporting documents were furnished and accepted by SPS as part of the modification application package. So our monthly gross income should have reflected at least {$4700.00} or {$5100.00} not {$2800.00}.
Upset that my Trial date was on XX/XX/2016 I called them to alert them yet AGAIN that they used the wrong amount. The representative then, reviewed my file and realized of the mistake and submitted the file for review again. I asked them to alert my attorney and their attorney that a final review would not be possible before my trial date of XX/XX/2016.
XXXX XXXX XXXX of SPS Document Control Officer advised me that as of XX/XX/2016 a Motion to Continue would be filed to postpone trial on those grounds. It was done and accepted by the court. Unfortunately nothing was done since. Now I am told the review was completed as of XX/XX/2016 which by their motion presented on XX/XX/2016 makes no sense.
Under the above circumstances I feel that SPS is not acting in good faith, by requesting us to do it all over with information that has been submitted, verified, accepted and completed under their own terms. Please help.

XXXX XXXX the Manager of the Ombusman Dept., I have been for ( 9 ) months sending documents to SPS to get a answer on if they will accept a buyers offer on the Condo, I 'm trying to Short sale for ( 9 ) months and can not get a answer XXXX XXXX said on XX/XX/XXXX that he would have an answer with in 24 to 48 hours it is now XX/XX/XXXX, XXXX, I have left message and I 'm always told he is in a meeting.
I have received as of today a letter dated XX/XX/XXXX, requesting a profit and loss for ( 3 ) months they have almost a years of them, but I did send them. also asking again for Social Security awards letter I have given them one for the year, I have tried to explain that the XX/XX/XXXX awards letter will not be out until XX/XX/XXXX Taxes have been done and then I will get and give them XX/XX/XXXX, award letter!!!! ( the Soc Security comes goes auto into my bank, and SPS has all statements for ( 9 ) months ) which matches my XX/XX/XXXX award letter they have.
the other documents is a PRE HUD that the title company has redone ( 4 times all different times ) goes back and forth takes weeks changes to lines XXXX, and XXXX,XXXX,XXXX, now on line XXXX they wanted to know what the exhibit is so the title company broke it down it is from the association dues, ( which do not have anything to do with the acceptance of the Buyers offer to purchase the condo, and to give me a answer if they will except the offer.
SPS has told me to have line XXXX removed off the Pre Hud, the Title Company can not just take off lines???

There is one Document I have been asking for, as you know this property has a XXXX lien it is with XXXX, they need from SPS the approval letter this needs to be " the full payoff '' they need it for there Calculations, they also can only keep the file open for 30days. so I 'm asking again for this document, or XXXX XXXX can not complete the approval for the short sale.
