Complaint: My mortgage was bought out by Select Portfolio Servicing & for a while everything was fine. I lost my job and was able to get a modification with SPS. When I had storm damage which my homeowners insurance did n't cover as it was just below the 1 % deductible so I used my mortgage payment to fix some of the damages to the roof with my mortgage payment and I also I fell and broke elbow so I had medical expenses as well which I got behind on my mortgage payments. I called SPS and was told to apply for mortgage assistance as I just wanted to pay back my arrears in a payment plan so I was approved for to pay back at {$840.00} a month for a year. I was doing really well when XX/XX/XXXX, my air conditioner started leaking water into the unit and would n't drain. I called my homeowners insurance and it was n't covered since it was the coil and I would be responsible to repair it. I had barely got these news and I informed SPS about the situation explaining I could pay them a double payment XX/XX/XXXX when I received my student loan so that I could catch up my repayment plan and they said fine. On XX/XX/XXXX, the worst hail storm to hit XXXX XXXX and my home took a hit on the roof. I called my homeowners insurance and once again they denied my claim. I never got a reason why other than they would not fix my roof so I once again had to fix some of the roof so that I would n't have more damage to my home. I called SPS letting them know what happened and would send payment but it would be delayed as I had to make more repairs to the roof and they seemed understanding. I received a letter from SPS that my house was going into foreclosure. I immediately called them back and told them what happened. I asked ca n't I just send my mortgage payment and I will send more once I get my student loan? They would not accept my mortgage payment and would return it back to me. They informed me to apply for a modification. I told them I was happy with my mortgage payment but could n't they just apply the arrears to the end of my loan or let me restart my repayment plan? So I sent in the documents needed for modification, pay stubs, hardship letter, mortgage assistance, tax returns, budget, etc., only to be denied. They wanted {$5500.00} in order to get caught up and this amount included attorneys fees for putting my house in foreclosure! I told them I did n't have that kind of money but I could borrow from my student loan and give them half one semester and the other half the semester and they said No, they wanted the whole amount. I got with XXXX a non-profit that assists homeowners with their mortgage and they helped me in XX/XX/XXXX when I lost my job of 20 years and got my home modified with XXXX XXXX XXXX ( prior XXXX XXXX ) but I digress, they told me to fill out modification forms and they would submit to SPS. All of this was done and no response from SPS. SPS told me that XXXX needs to contact their relationship manager XXXX XXXX and XXXX told me they are supposed to contact them so I ca n't get them to communicate with each other. Once again, it was denied. When I spoke with SPS in XXXX, XXXX and asked why they denied the modification, they said it was due to income. How can that be when you approved a repayment plan at a higher amount of my mortgage on the same income submitted? They wanted me to work another job to get more income but I am going to school at night part-time to get a higher paying job. I asked them as I am borrowing student loan to also supplement my income as I ca n't work a second job while attending school could I put that down as income. He said yes and told me to reapply so I did as they asked, resent more documents again and it seems like I 'm getting the runaround. Yesterday that they denied my modification. XXXX provided a workable solution but they still said No! I do n't know what to do?

In their recent response to me via the CFPB they claim that they sent the note and deed of trust. The PDF file contains a SECURITY INSTRUMENT signed by XXXX XXXX on XXXX/XXXX/XXXX related to XXXX XXXX XXXX XXXXXXXX XXXX. They lied again. Where is MY monetary instrument. Complaint: My mortgage was owned by XXXX XXXX in XXXX. The loan was sold and then returned to XXXX. XXXX sold the loan again. This time to an alleged company called XXXX XXXX XXXX XXXX. XXXX never contacted me. I was contacted by a " servicer '' company called Select Portfolio Servicing. From the onset, I was charged late fees and other fees not disclosed at closing. Ive never been late with a payment. Everytime I ask SPS about XXXX, Im told the same statement. XXXX owns the mortgage, SPS is the servicer. I demanded to see a copy of the note, and to have XXXX provide authorization for SPS to communicate about the loan. SPS replied with the same statement, which leads one to believe that XXXX does n't exist. A search found XXXX to be nothing more than a XXXX corporation using a bank address in Delaware. I wrote to XXXX at that address asking for documentation proving they own my mortagage and authorization for SPS to discuss this loan. SPS sends me a letter that they received my letter and will respond. I did n't write to SPS. I get a pamphlet from XXXX XXXX. It describes what a trust is and the servicer makes the decision to foreclose. This all leads to what the heck is happening with my mortgage? You cant get a straight answer out of anyone. SPS raised my mortgage payments to an amount I can not afford. My ARM went down as it has many times, but SPS raised the monthly payments. This is a common complaint made by others whose loan has been sold and is serviced by SPS. I fear Im about to lose my home because SPS continues to say Im in default even though Im never late. Ive disputed the increase in payments and all of the fees they charged which that say is for my benefit. The internet is filled with people who have lost their homes with SPS as the servicer. XXXX does n't look like a viable solution due to complaints made by others who tried only to lose their homes.

Complaint: We have been trying to find a solution to this foreclosure situation we have been facing with Select Portfolio Servicing ( SPS ) for years now. At first, they reviewed us for the XXXX programs ; then, they told us that we were not eligible due to a " business decision '' by the investor. When we questioned this repeatedly as to what that meant, we were eventually told that the investor does n't participate in the XXXX programs. Why would our income and other underwriting factors be considered if the investor does n't participate in the XXXX program? In XXXX of 2016, we were denied for the in-house program as well. However, the gross monthly income used for the review was shorted about $ XXXX/month even though all documents verifying the household income were submitted in a timely manner. We chose to resubmit a new application with very detailed verifications of income. SPS finally got the gross monthly income correct, but still denied us for any mortgage assistance, once again claiming that the investor did not allow for approval of the in-house program as well. When pressed, we were then told that the reason was actually that they could n't make an affordable payment based on the guidelines of the program. When we pressed SPS for more details such as the proposed modification payment and what terms were used to reach that proposed payment, we were eventually told that this is " proprietary information '' that they did n't want to disclose (!!! ). We have done everything asked of us to try and resolve this issue and get back on track with our mortgage, but we feel like SPS is doing everything they can to complete the foreclosure process. They have scheduled a sale date for XXXX/XXXX/16!!!! How can we not be eligible for the XXXX program when SPS has taken so much bailout money ( almost {$2.00} XXXX " committed '' )? Why wo n't SPS produce this servicing agreement that prohibits our loan from any participation in these programs? And lastly, why wo n't SPS show clearly how we do n't have enough income to be modified under the in-house program they offer others? It 's not right that these people keep misleading us as to why we can not get assistance and when we do n't just accept their denial and ask for details, SPS chooses to be secretive ( indicating they 're likely doing something wrong ).

Complaint: Select Portfolio Servicing XXXX Inc., is the WORST company I have ever dealt with in life! Since XXXX, XXXX, I have been trying get the mortgage ( in my deceased father 's name ) lowered. I have consistently filled out paperwork, and sent in requested documents over and over again. ( I have those documents as proof along with dated receipt emails from Select Portfolio Servicing , Inc. ) My latest attempt has been to go online and request a modification/assumption ( or whatever the latest option ). However, I received a letter from Select Portfolio Servicing stating that my home would go into Foreclosure and up for sale on XXXX XXXX XXXX. I am attaching a letter I wrote to them in XXXX XXXX. It pretty much sums up the situation. I believe Select Portfolio Servicing has deliberately put me off, by loosing documents, and requesting them over and over again. I had an appraisal done on the home. I contacted them about it, they said it was no long valid because it was over 90 days! I did n't know that! They have done checks on my credit so much that I asked them not to do it anymore because they were Hard Hits! I have met with a XXXX XXXX XXXX to help me with my troubles. I feel somewhat of a relief, but I still have foreclosure hanging over my head. This mortgage company seriously needs to be investigated. I 'm sure other people are experiencing, or have experienced somewhat of the same thing.

Complaint: Select Portfolio Servicing keeps delaying the processing of my modification. I sent all requested paperwork to them. They call twice weekly saying the underwriters do not have it. I tell them I know you have it because I sent myself a copy. Then they find it and say it was mislabeled or it was n't sent to underwriters. Every time it sets processing the modification back another 5-7 business days. I spoke to a manager today who said that she was escalating the processing to UW. But I have been told this 3 weeks in a row. I was told I have until XX/XX/2016 before being referred for foreclosure.

Complaint: In XXXX my father passed away and left the house that he had a mortgage on to me in his will that went through legal probate and the house was transferred to me through the courts. My husband and I never re-financed the loan into our names for we were not informed to do so it was my thought the mortgage would be legally put into our names by XXXX who at the time has the servicing of the loan. They informed us that we could do a loan modification and then after a few months told us that was not possible because we were not on the loan, then they suggested assuming the loan and again after a few months told us the at loan was not assumable. The Truth-In- Lending only states not assumable by a buyer, we were not buyers but legal heirs by law. Then my husband and I filed Ch XXXX Bankruptcy to avoid foreclosure by XXXX. Then it was sold to Select Portfolio Servicing , Inc, and we have dealing with them now for 2 years and getting the same run around. We hired a company to help us with reconstructing the loan into our names at a lower interest rate so that we could start making payments. We were not making payments for the mortgage was under a deceased persons SS # and we would not get the interest tax break. It was not for a lack of trying to get this loan into our names. Now SPS has set a foreclosure date for XXXX/XXXX/XXXX and will not postpone even though we received a letter on the XXXX or XXXX of XXXX telling us they have receive our inquiry and would be contact with us within 20 days of receiving the information which would be the XXXX/XXXX/XXXX. After speaking with a manager of SPS along with an analyst of the company we hired to help us with this we were told the sale was going forward on the XXXX and that the letter we received is a computer generated letter that is printed whenever data is entered into the computer that new documentation has been received. This is a deceptive practice on the part of the loan servicing bank and should be illegal. This gives the people facing foreclosure false and misleading hope. Even the XXXX the analyst with the company that we hired agreed. Our house is still for foreclosure on XXXX/XXXX/XXXX and SPS had the power to stop it to look over the documents and did not do so. This is wrong.

Complaint: We have a client in distress we have submitted XXXX offers to the bank we call in every week to check on the status the negotiators " are n't available '' we get have answers and are not properly informed of what is needed on the file. Everytime we send in a document the have XXXX days to review the document and if they need something further they mail the request to an empty house instead of reaching out to the attorney and individual in our office handling the file or heaven forbid telling our office what they need when we call in. We have lost XXXX buyers and about to lose a XXXX buyer because of delays and lack of ability for SPS to move forward appropriately and work with us on getting this file completed. They have no concern for the homeowner and not desire to work with the seller in getting this completed. They wo n't fax a request, call us or email us. They send their request to an empty house.

Complaint: My mother passed away XX/XX/2014. I contacted the mortgage company about the situation. They told me i needed to send them the letters of authority. i did, called them back and they said they did not receive them. so i sent them again, called them, said they did not receive them. called them again and finally got some one to help me. they told me what i needed to send over to them and what email i needed to send it to. i did. never received a response. called them multiple times. would not talk with me. I called the estate attorney and he sent them the letter of authority four times. with a documentation of the fax going through and they received it. He also called them and they told him they did not receive it.I have tried to call them for almost three years now and still get no corporation. Now they are trying to foreclose on the house. The mortgage company is SPS select portfolio. This has been very frustrating to deal with besides the lost of my mother. I am also on the deed of the house. But not the mortgage.
