Complaint: The servicer is asking for canceled Social Security checks from the Borrower because he cashes his checks instead of depositing. The award letter was provided for both him and his wife. THe servicer will not move forward with the modification until they get canceled checks from the social security office which will take some time. The borrower and co borrower are a XXXX XXXX. It is very difficult to get back and forth to the bank and other places when the servicer keeps asking for docs. So it takes time to get the docs and send to them. The home is in danger of foreclosure.

Complaint: I am a XXXX XXXX, on Social Security & XXXX.My mortgage rate is a high 6 1/2, because mortgage lenders consider me a high risk because I was out of work for more than a year, and I ca n't get it refinanced.I obtained the mortgage in XX/XX/XXXX. My mortgage has been transferred several times to different service companies. The current holder of servicing is Select Portfolio Servicing , Inc., XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, Ut XXXX, referred to as SPS. They advertised a modification proposal to lower my monthly payment, sent me a package to fill out & supply supportive documentation. I complied, even providing additional information about my medical history, a seasonal job I have ( I sent a Social Security statement review showing my physical capacity ), etc. The company SPS rejected my request by letter without itemizing what was 'incomplete'.A telephone call ( they said was recorded ) with representative XXXX XXXX on XX/XX/XXXX at XXXX CST produced a litany of things they need that include just a check mark on a IRS Form XXXX, a fancy financial statement for my part time mowing job, a more complete copy of all my bank statement that I gave them redacted pages, two months of my XXXX wife who is on Unemployment Compensation till XX/XX/XXXX and received a stipend from laid off company of {$36.00} per month she just cashes & gives me, but SPS wo n't accept that as proof, etc. THey want me to deposit the {$36.00} to my checking account this month and next, so as to see the proof of it, even though I sent them the entire payroll stipend form with tax withholding information, year to date {$4000.00} of XX/XX/XXXX. I feel discriminated against, that they do n't want to help. I gave them proof of Social Security, my season jobs income verification, my wife 's info, taxes, bank statements, property tax info, medical specifics from XXXX with diagnoses. XXXX. It 's not right what they are doing!

Complaint: Because they failed to validate the debt in the timeframe allotted according to the FDCRA and other applicable laws this item was legally deleted from my file. After my wife filed a claim against them with CFPB stating that had failed to validate her debt and therefore should remove it from her credit report, they in turn RE-INSERTED the erroneous information on my credit report on XX/XX/2016. Select Portfolio Servicing has worked overtime to ruin our life with their fraudulent reporting. They have further sought to even comply with the law in reporting to the credit bureaus and have cause me irreversible harm.

Complaint: This is my second complaint against Select Portfolio Servicing. Complaint : Since XXXX we have been applying for a loan modification from SPS. We have submitted hundreds of requested documents, answered numerous phone calls, and paid for legal representation XXXX times, but to date we have not received any loan modification offer. We submitted requested documents as late as XXXX XXXX, XXXX, only to be told by the SPS representative that our loan will be transferred to XXXX on XXXX XXXX, XXXX. This whole situation has been nothing but excruciating for us. We have seen this change of servicer as a pattern that began with XXXX XXXX XXXX, XXXX XXXX XXXX, and SPS with no resolution in sight. What is most frustrating is that we know that we fully qualify and meet the requirements for the government 's loan modification programs and yet we have been denied by SPS and prior servicers. Therefore, our conclusion is that our loan is being subjected to additional requirements other than those of the government 's by SPS and prior servicers We believe that : 1. The continuing practice of servicers repeatedly requesting documents from homeowners are doing so to purposefully increase our indebtedness for the company 's financial gain and this should be investigated for illegal actions. 2. SPS is using their in-house policies and requirements for our loan modification, and not those of the government 's programs for financial gain.. 3. Discrimination could be a factor in repeatedly denying us a loan modification. This is based on our ethnicity ( XXXX ), age ( XXXX ), and our family structure ( not husband and wife, but parents and adult children ). 3. SPS is continuing to purposefully use delay tactics to deny us a loan modification so that our delinquency indebtedness continues to increase. This conclusion is based on their evaluation policies, repeated requests for the same documents, and general threats about legal action against us. We also believe that information about our mortgage loan status is shared with investors who routinely stop in front of our home and either look until we come out front or come to our door with questions. Recently, we had a visit from a private investigator that was sent to verify who is residing in our home. Background : XXXX XXXX ( son ) is principal on the loan XXXX XXXX ( mother ) is secondary of the loan We have proven we can pay for a reasonable loan modification. In XXXX my son, who is principal on the loan, filed for bankruptcy in accordance with a Florida program for obtaining a loan modification. Through bankruptcy court we paid SPS {$30000.00} @ {$1400.00} per month until XXXX XXXX when the application was denied on the grounds of insufficient income. This was a wrongful denial because SPS disregarded our attorney 's repeated submission of collective income from our family. SPS chose to use XXXX income only for evaluation. Our attorney filed a dispute for the denial but was unsuccessful in getting it overturned. Our financial hardship began in XXXX, XXXX when we refinanced our loan with XXXX XXXX. Six months later we were sued because XXXX XXXX fraudulently forged the signatures of the prior owners to process our loan. Due to this we incurred significant expenses for attorney 's fees. Making home repairs and maintenance on our home then and now continues to be on a cash basis. Our mortgage is an upside down loan - {$330000.00} according to SPS billing, and the latest actual value is {$260000.00}. Even obtaining home owners insurance has been unsuccessful due to the status of our loan.

Complaint: I am contacting you to inform you of the unethical and illegal business practices of Select Portfolio Servicing. They are violating the California Homeowners XXXX rights, they are breaking the rules and guidelines for XXXX, and are engaging in a shell game with distressed borrowers and now have a sale date set for my home on XXXX XXXX, XXXX. I began trying to get them to review my documentation nearly two years ago and have gotten the runaround. Over the last six months I have REALLY focused and pushed them and have been told at least six different times that they just needed XXXX more thing and then after they got " XXXX more thing '' told me a week later that they need " just XXXX more thing. '' This is not about documents that expire. This is about intentional misrepresentation and fraud. I have never once actually spoken with my relationship manager, instead I deal with a revolving cast of characters who totally lie and contradict each other. I have this information documented. I have been contacted by the XXXX XXXX XXXX Attorney because they have received dozens if not hundreds of similar complaints are investigating SPS for these business practices. I submitted a full package to SPS in XXXX, and followed up regularly. I was told on XXXX XXXX that they needed updated bank statements and some clarification on our roommates. I was told that was ALL that was needed in order for the file to be considered complete and go to an underwriter for review. A couple of weeks later they told me they needed XXXX tax return signature and XXXX return, then once sent I would have a full package. This was sent in on XXXX XXXX. When I called in a couple of weeks later I was told that now they needed a bank statement showing my husband 's unemployment going into his account, which was sent on XXXX XXXX. I spoke with relationship manager XXXX XXXX who told me I was missing some other documents as well. I explained they had already been sent and while on the phone with her emailed the original package. XXXX reviewed the documents and stated that I had a " full package '' and everything that the underwriter would need. Of course when I checked up on XXXX XXXX I was told that SPS did NOT have a full package, because they needed another bank statement that showed the receipt of unemployment, which contradicts what I was told on XXXX XXXX. On XXXX XXXX a statement of my husband 's UE debit card was provided to SPS and I was told the file was complete and going to an underwriter. I followed up again and on XXXX XXXX was told that SPS needed bank statements showing two months of rent received. The XXXX bank statement showed a deposit for the rent of {$900.00} on XXXX XXXX as well as a deposit for rent of {$900.00} on XXXX XXXX. The XXXX bank statement satisfied the requirement. I followed up on XXXX XXXX and SPS stated they saw the XXXX rental deposits for XXXX ( satisfying the condition ) but since they were not both CIRCLED they were not going to COUNT IT!!!! So still no full package, I sent in bank statements with both rent deposits circled on XXXX XXXX AND WAS TOLD THE FILE WAS COMPLETE AND GOING TO UNDERWRITER I followed up a few days later and was TOLD I WAS MISSING SOMETHING. THIS TIME IT WAS THE XXXX BANK STATEMENT BECAUSE THEY WANTED TO MAKE SURE I DID NOT GET PAID EXTRA RENT?? SPS had XXXX bank statements that were within the time frame and parameters and that is the requirement, as well as deposits reflecting two months of rent received. THAT SATISFIES THE CONDITION! but they still did not submit to an underwriter. I spoke with XXXX XXXX ( ext. XXXX ) yesterday and he stated that since I had a sale date and they had never conducted a review with an underwriter since I started the process in XXXX XXXX that my review was closed for having an incomplete package and that my house would be sold on XXXX XXXX.

Complaint: We applied for a loan modification. After years we were denied. We have appealed the decision and submitted an entirely new package and we are currently under review for a loan modification. We live in the State of California and are protected under the Homeowner Bill of Rights from dual tracking. The HBOR restrictions on dual tracking foreclosure and loan mods prohibits mortgage servicers from advancing the foreclosure process if the homeowner is working on securing a loan modification. When a homeowner completes an application for a loan modification, the foreclosure process is essentially paused until the complete application has been fully reviewed. In spite of this they have no placed in in foreclosure.

Complaint: We refinanced our mortgage in XX/XX/XXXX. We are just finding out NOW, 14 years ago, that satisfication of mortgage was never recorded at the county. It seemed very strange that we had refinanced XXXX times since XX/XX/XXXX with XXXX XXXX, but apparently this was missed - THREE times. After speaking to XXXX XXXX to ask why a title search was never done, they said that is the title companies responsibility ( which seems rather puzzling thinking this is what we paid closing costs to have the confidence that the tiltle had been searched ). The servicing company that we had previously was called XXXX XXXX. It took me months to go back 14 years ago to find this information. Would have been a lot easier to track a year later when refinanced in XXXX. XXXX XXXX is out of business and merged with a company called XXXX XXXX XXXX. XXXX XXXX XXXX changed its name to Seleect Portifolio Servicing. This company ( Select Portifolio Servicing ) is who we have been trying to get this satisfaction of mortgage from. Even though this shows paid in full on XX/XX/XXXX on our account - no one seems to be moving on this, calls me back, etc. even though I have requested escalated status and call several times a day ( several supervisors who never call me back ). We want to take out a small home improvement loan and we are not able to do this since this lien still shows on our title. It has been a nightmare dealing with this for the last two months. Is there a law in MN that this needs to be released in 60/90 days. We are at 14 years and STILL waiting. Please help ... ..thanks

Complaint: We just paid {$100000.00} to a {$290000.00} loan modification. {$49000.00} field adjustment was the amount paid to XXXX and {$32000.00} was the amount we paid to midland. I guess they gave us partial credit for the {$55000.00} we paid to XXXX XXXX XXXX. XXXX collected the money paid to commerce bank and XXXX. This means that NONE of the {$670000.00} I have paid to my house has been applied to principal. Which means I have paid {$640000.00} to interest. Which again I will point out is OVER 18 % interest on a 15 year loan disclosed at 4.34 %. When are they going to release this lien that XXXX bought for {$90000.00} XXXX reported {$80000.00} extinguished but it was never removed from the balance. We were not given credit for the {$5000.00} HAMP incentives. We did not get credit for the {$17000.00} paid from XXXX other properties. We paid it again.

Complaint: I requested a loan modification in XX/XX/XXXX due to an operation my wife had to undergo which has prevented her from continuing her XXXX. I was asking to skip one month 's payment, and was told that there may be a slight reduction in our total payments due to the modification. I have submitted the same paperwork numerous times, answered the same questions over the telephone numerous times ( several times the same question was asked, then asked two weeks later by another individual in a different way ). We have been late, 30 days, since about XX/XX/XXXX and have been occurring the late payments as well as having the late payments being reported to the credit bureaus. We have over a dozen requests for information by letter, some saying they have all the information they need, with another letter coming the following week asking for information or documentation we have already provided. Had I known that there would be this much red tape and time taken ( I honestly believe they are purposely stinging us along, perhaps to force us into foreclosure ) I would have looked into a new loan with another bank. At this point, I have been late, which precludes me from any HARP loan options and pretty much reduces any other options I may have had. What I would like is that SPS give us an answer ( I never get to speak with the same person and they shield the " decision-makers '' from their clients ), one way or another and to reverse any late payments and clear our credit with the credit bureaus. Complaint: On XX/XX/2016 I sent Select Portfolio Servicing, Inc. ( " SPS '' ) a Qualified Written Request via certified mail # XXXX ( " QWR Letter '' ). I enclosed XXXX exhibits labeled A, B, and C with the QWR Letter. The QWR Letter stated in part, " I am requesting all available information on each of the entries listed in Exhibit A ( copy enclosed ), including but not limited to : 1. ) What party or parties were paid each of the fees and costs removed ; 2. ) What services and/or products were provided by each specific party for the fees and costs they were paid ; and 3. ) What is the identity of each party or parties that paid or advanced funds for each of the removed items. '' Exhibit A identifies over {$23000.00} in FC ATTORNEYS FEES and ATTORNEY ADVANCES listed in Exhibit B " CUSTOMER ACCOUNT ACTIVITY STATEMENT ''. In its response letter dated XX/XX/2016 ( " QWR Response '' ) SPS stated, " In your inquiry, you requested information on various entries listed in your Exhibit A, which reflected the Expenses Paid by Servicer amounts. With regards to your requested clarification regarding the identity of the entity paid, the requested information is either proprietary or confidential ; therefore, we will not be providing such information. '' To this date I have never received any explanation outside of the frivolous QWR response letter from SPS regarding my QWR request about the more than {$23000.00} in attorney charges. This is curious since I have never been sued by SPS nor have I sued them as of the date of the filing of this complaint with the CFPB. Additionally, I have never had a judgment that included attorney fees awarded against me in any court action related to my home or any mortgage.

Complaint: Select Portfolio Services bought my mortgage from XXXX in XX/XX/XXXX. XXXX told them I was behind 3 months in payments which I was not. Those months were XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX SPS paid XXXX for those 3 months when they acquired my loan. I have a bank statement showing each of those months paid to XXXX from my account. Question why are they buying a delinquent- perhaps an easy foreclosure???? They did not realize I was on chapter XXXX ergo they could n't foreclose or even ask me for the money they thought I owed. After Ch XXXX I received lots of stuff in the mail about money I still owed and my lawyer said do not pay anybody so I did n't. XX/XX/XXXX the first I receive a letter from SPS saying I owed them XXXX plus. I sent them a certified letter with copies of payments to XXXX for those months. XX/XX/XXXX I get a letter saying I owe them XXXX. My letter was received by them on XX/XX/XXXX and signed for by XXXX at XXXX. Select Portfolio Services-XXXX I only get a flunky when I call so there is no contacting someone in charge. The XX/XX/XXXX letter ask for XXXX by XX/XX/XXXX I called and asked the flunky if there was anything on the screen about the certified letter and copies I had sfnt and she said no. I 'm really stuck and really scared of these people.
