Complaint: I am a victim of mortgage fraud. My realtor lied about practically everything. My mortgage has been sold three times the first year in XXXX and the interest rate is 5.5 %. XX/XX/XXXX - XXXX XXXX XX/XX/XXXX - XXXX ( XXXX ) XXXX XX/XX/XXXX - Roundpoint Mortgage Here is my story. I was diagnosed with XXXX XXXX XXXX in XXXX and now I am fully XXXX and receiving Social Security XXXX. In XXXX, I applied online for a home loan supposedly thru XXXX XXXX. Later, I discovered thru XXXX XXXX that they never received a home loan application from XXXX XXXX or my SSN and they do not assign Realtors. This is where XXXX XXXX, Realtor, XXXX XXXX XXXX enters the picture. In XXXX, online XXXX XXXX approved a XXXX home loan and assigned a Realtor ( XXXX XXXX ) to me. Ms. XXXX contacts me and shows me two new homes ready for purchase. Then suddenly XXXX XXXX tells me that my loan was not approved. I feel that this is the end of my home search due to recent Identity Theft issues. However, Ms. XXXX still contacts me. I quickly explain to Ms. XXXX that I can no longer afford a home because XXXX XXXX denied my application. She states, " I have a house for you! '' I now know this was all just a ploy to sell this dilapidated old house. By telling me I was approved, showing me new houses, and then canceling the loan left me virtually homeless. I had already submitted my notice to vacate my apartment and I had to move. I was XXXX XXXX, on a fixed income and now soon homeless. I think she planned and took advantage of all this. Since moving in XX/XX/XXXX, I have had nothing but problems and yes I had the home inspected prior to moving in and she manipulated that too. First, there was a strange odor coming from the stove whenever I cooked. So, I lifted up the stove top and underneath was so filthy and rusty the stove had to be replaced. Also, the heating unit went out and I had no heat this past winter. Ms. XXXX said the HVAC was completely repaired two years prior to my moving in. When I had the unit serviced XX/XX/XXXX, the Repairman said the Heating Unit was 20 years old and so rusty that he would have to permanently disconnect it for fear of carbon dioxide poisoning. The pipes are so old I have hard water which have clogged my washing machine ; now, that needs to be replaced. And, XX/XX/XXXX I discovered that there was a leak underneath the kitchen sink that was so bad it actually leaked out into the holes in the kitchen floor tile and underneath the kitchen floor cabinets. Now, all of the cabinets have begun to rot. After replacing the stove, the HVAC needs replacing and that's just the first year in the house! Ms. XXXX told me there were back taxes on the XXXX year old house. The monthly principal is XXXX and at the time escrow was XXXX ; total payment XXXX. The insurance is XXXX. I contacted the tax office who told me the yearly taxes are only XXXX and there are no back taxes. She lied again. Ms. XXXX also said she had the home sprayed for termites. XXXX XXXX came by my home stating that the past tenants were still under contract and they wanted to inspect their outside stakes at no charge. After their visit, I soon discovered lizards in my home. Three months later when XXXX returned I explained that I would exterminate my own home. I later received a bill for XXXX. I contacted the XXXX XXXX Main Office in XXXX who apologized, canceled the bill and sprayed my home for free! There are just some things I did not notice until I moved into this house. For example, the rugs were just filthy and there is so much dust in the attic I can literally taste it. I just believe I was taken advantage of because of my XXXX. I desperately need a much lower interest rate.

Complaint: On XX/XX/2019 Roundpoint Mortgage took my {$820.00} mortgage payment out of my checking account ( recurring payment agreement ). On XX/XX/2019 Roundpoint AGAIN took the {$820.00} payment out of my checking account. I called on XX/XX/XXXX ( when I checked my bank account and saw what happened ) and asked for them to refund that extra payment ; the customer service person said they would issue a paper check and it would take a few weeks. I also sent an email that same day ( as directed ) BUT THEY NEVER RESPONDED! Two weeks later, I called customer service again and was told a check was issued and should arrive in 'a week or so '. On XX/XX/XXXX, after still no refund, I called customer service again and was told they would look into it. I requested a supervisor and was connected to " XXXX ''. He researched and said the payment was being applied to XXXX! No refund was ever issued or received - despite their claims. Why would a double payment in XXXX be applied to XXXX, and why did they lie about sending a refund?

Complaint: Round Point mortgage servicing refuses to acknowledge two inaccurate late payment marks on my credit report. I have been trying to get information and resolution for over a month. I have filed disputes with all three bureaus as well. Most recently I spoke with XXXX and was bounced around a call center for an hour. Still, nobody is able to help me. This is fraud on the part of Roundpoint mortgage servicing, and some quick research shows that they are a cut rate institution, and I am not alone in my complaint. I am under contract on a home, and their inaccurate and disingenuous practices are preventing me from obtaining a loan.

Complaint: XX/XX/2019 on this day I contacted RoundPoint Mortgage Services about a late payment charged to me. The late fee is {$19.00} which is charge if payment is not recieved by XX/XX/2019. I made a payment after XXXX XXXX over the phone and was told by recording it will be posted the next business date. On the next month statement I had a late fee charged to me for {$19.00} for XX/XX/2019 statement. I am being charge for being late over the phone on the XXXX which is the received by the date of the XXXX of the month which is stated on the statement, ( If payment is not received by XX/XX/2019, a late fee of {$19.00} will be charged ) this is stated on all of my mortgage statements. If RoundPoint is charging me a late fee on the XXXX it is a false statement being post on my mortgage statement. I have never been charge a late for paying on the XXXX of the month over the phone making a payment. I spoke with customer service and after debating the charge i was placed on hold while she spoke with someone about this. She did come back on the line and said that they would omit the late charge as a courtesy this time but i need to make my payment by the XXXX. However my statement says payment not received by the XXXX it is late. There is some contradiction on the statement of false misleading information and needs to be corrected.

Complaint: Round Point Mortgage Servicing Corporation Attention : Consumer Ombudsman XXXX XXXX XXXX XXXX XXXX, NC XXXX XXXX XX/XX/2019 Dear Madam/Sir : Thank you in advance for protecting my interests as a customer as well as for an expeditious resolution duly in my favor. BACKGROUND Closing Date : XX/XX/2019 -- -Sell of Property Property : XXXX XXXX XXXX ; XXXX , Texas XXXX ; Account # XXXX Chronology : 1. Pursuant to advice from the title company ( XXXX XXXX XXXX XXXX ), I waited at least twenty ( 20 ) workdays before contacting Round Point ( XXXX ) to inquire about my Escrow Refund. 2. On or about XX/XX/XXXX, I spoke to your Escrow Representative ( a lady who identified herself as XXXX ). I was informed that the Escrow Refund check ( # XXXX ) was mailed to me on XX/XX/XXXX. I had not, and still have not, received it. I asked XXXX to verify the address to which the check was mailed. The sequence of numbers she quoted was INCORRECT, notwithstanding the fact that for the previous three ( 3 ) years all correspondence ( including a Customer Account Activity Statement dated XX/XX/XXXX verifying issuance of the XX/XX/XXXX check ) to me from Round Point has been sent to the CORRECT address, to wit : XXXX XXXX XXXX, XXXX XXXX XXXX, Texas XXXX. 3. As a reasonable person, I am cognizant of the fact that humans make errors. However, the lady ( XXXX ) had a very hard time arranging five ( 5 ) numbers in correct sequence. Finally : ( a ) she was able to comply with my request to quote the numbers to me in correct sequence, ( b ) informed me that she had made corrections and entered into the Round Point system the five numbers in correct sequence, ( c ) advised me of the option to Stop Payment of the XX/XX/XXXX check and ( d ) alerted me to a fact that the Stop Payment process requires a wait period of five ( 5 ) workdays for check to clear plus another seven ( 7 ) workdays for the reissued check to reach me via regular mail. 4. XXXX XXXX XXXX is a small municipality where the regular Postman knows many of us. Consequently, my wife and I have on occasion received in our mailbox inaccurately-addressed mail solely on the basis of our names thereon as addressees. For that reason with hope that the XX/XX/XXXX Escrow Refund check would be delivered, I informed XXXX that I would wait a couple of days before notifying Round Point to Stop Payment on the XX/XX/XXXX Escrow Refund check ( # XXXX ). 5. The wait served no good purpose. Consequently, on or about XX/XX/XXXX, I called Round Point and informed your Escrow Representative ( a lady who identified herself as XXXX ) to initiate the Stop Payment process. 6. On or about XX/XX/XXXX, a conversation with your Escrow Representative ( a lady who identified herself as XXXX ) provided assurance that aforementioned Stop Payment progress had been initiated and was ongoing. 7. Subsequently on or about XX/XX/XXXX, I spoke to your Escrow Representative ( a lady who identified herself as XXXX ) to follow up on the status of the reissued check. After copious dialog and research on her part, she informed me that ( a ) there is no record of Stop Payment on the original check ( XX/XX/XXXX ; # XXXX ), ( b ) I had no option but to again request a Stop Payment, ( c ) upon my request ( which indeed I conveyed to her ), she would comply and again initiate the Stop Payment and ( d ) I would receive the reissued Escrow Refund check by XX/XX/XXXX. Today is XX/XX/XXXX and I have not received the reissued Escrow Refund check. It is simply not right for any person to be treated so inconsiderately and unmindfully, let alone a budget-minded XXXX ( XXXX ) year old customer like me with an impeccable mortgage-payment record with Round Point. If I allow skepticism to prevail, the foregoing sequence of events would smack of chicanery and scamming. I have resisted the temptation to develop such a dubious attitude toward Round Point. However, this wrong cries to be made right. I do have a preference for the manner in which this disputation can be resolved to my satisfaction, to wit : Because our XXXX XXXX and XXXX XXXX dollars ( {$930.00} ) have been held in abeyance or otherwise utilized for over seventy ( 70 ) days, I unflinchingly believe that compensation should be added to the sum to help offset the interest it would have earned in our savings account. Complaint: RoundPoint Mortgage Servicing Corporation is ( 1 ) wrongfully force placing insurance ( 2 ) charging a fee even when we prove that insurance has always been in place ( 3 ) attempting to attach other assets we own. Whether this is a systems issue, or an intentional issue is difficult to know. They actually pay the insurance we have out of an escrow account they manage ; and yet claim no insurance exists, force place insurance, and then when we send the insurance to them that they should already have, they only return a portion of the premium they force placed. Additionally, they have claimed to be an insured on other property we own that they have zero interest or loan on for two consecutive years.

Complaint: I had a 30 fixed mortgage serviced through Roundpoint Mortgage Servicing Corporation located at XXXX XXXX XXXX, XXXX, NC XXXX. The loan number was XXXX. They transferred my loan to XXXX XXXX XXXX on XX/XX/XXXX. I had been paying two months in advance, and my loan was up to date as of XX/XX/XXXX. I contacted Roundpoint at ( XXXX ) XXXX on XX/XX/XXXX asnd they confirned that I was paid up to XX/XX/XXXX. I received my welcome package from XXXX, and they said that I was showing that was paid to XX/XX/XXXX, and that I had to send in my Payment for XX/XX/XXXX. I contacted Roundpoint and spoke to XXXX in their XXXX service center on XX/XX/XXXX and he said that they would do an investigation and send my a payment history that would take about a week to get to me in the mail. It is XX/XX/XXXX and I have not received it. I would like to know what happend to my two month of advance payments that were just over {$990.00} each.

Complaint: In XX/XX/XXXX, I suffered a property loss to my residence that necessitated repairs of less than $ XXXX. Over the last 6 months, I have successfully and without incident retained a contractor and resolved and closed the claim with both participating insurers. However, a small portion ( ~ $ XXXX ) of the Insurance payment is considered 'controlled ' and requires my Mortgage holder to endorse alongside myself. I am currently re-submitting paperwork for the 3rd time to Roundpoint Mortgage Servicing to authorize and close the claim with them. They already hold the check that was endorsed and delivered per their stated requirements, but they have provided faulty information regarding the necessary Notarization of the paperwork on 2 separate occasions that has significantly delayed the process. They are currently refusing to accept properly notarized paperwork because my contractor prepared it in advance, and now I am obliged to spend multiple hours resolving this - again - just to get the funds returned so I can pay an outstanding invoice more than 90 days after it was issued.

Complaint: Refinanced my house with XXXX XXXX XXXX XXXX and I am having a difficult time receiving my overpaid escrow money from the previous mortgage company, Roundpoint Mortgage Servicing Corporation. Timeline : XX/XX/19 Loan paid off by XXXX XXXX XXXX XXXX ( Per Roundpoint Online records ) XX/XX/19 Escrow Disbursed to Mortgagor ( ( Per Roundpoint Online records ) XX/XX/19 Check mailed to me - Per conversation with Roundpoint Rep XX/XX/19 Have not received the {$1500.00} from my escrow account. I have had this mortgage with Roundpoint for 4 years and have made every payment on time every month. I am concern that Roundpoint is attempting to retain my fund as long as humanly possible. I understand they have no incentive to pay my money expeditiously and as quoted by several of the representatives that, by law we at Round Point have 20 days to refund your escrow account. It is well pass those 20 days after the loan was paid off. I have called Roundpoint several times, but receive the same patent answers, the check is in the mail. The minor interest Roundpoint is receiving from retaining my funds may be small, but I am concern that f this same activity could be happening to a large number or all of the Roundpoint customers. And finally should Roundpoint pay me interest beginning on the 21 day along with my Escrow refund?

I hereby request a copy of every and all mailed Periodic Statements to me during the following Dates : XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX Beginning in XX/XX/XXXX, I was informed that the FDIC Office, designated to address all matters pertaining to the failed XXXX XXXX/XXXX XXXX, was scheduled to closed. This, I was told over the phone on the same day as it was announced to me that, the last 5 loans where sold. The new Loan owner, was bound by law, to establish contact within 30 days. When asking for Name and contact information, I was told that she, my FDIC Contact representative didn't have that information, she only new that the office was to be closed by the end of XX/XX/XXXX and It was the Law that the New Loan Owner would contact me with in 30 days. When I didn't receive a my periodical scheduled Statement, I became nervous and the 1-800 number to learn who to make my payment to? But I was told that the 30 Day 's did not begin until XX/XX/XXXX and I should be patient! I became exceedingly nervous and shared my concern with my employer, The City attorney of the Town I live in. A matter fact, I decided to seek councilI with anybody I though could help me understand what was happening. Everybody believing that the due process is to wait! XX/XX/XXXX came and still no contact with the new loan owner. This continued till XX/XX/XXXX, when RoundPoint send there 1st statement! Today, I believe to know the name of the highest bidder, XX/XX/XXXX, was XXXX XXXX XXXX ( XXXX ). I believe that XXXX XXXX XXXX failed to forward periodical scheduled Statement and therefor walked away from my contract! Press Release XXXX XXXX XXXX XXXX FDIC Announces Winning Bidder .... Complaint: I have disputed the amount of what is owed on my mortgage for the past 6 months. I have opened disputes about the amount with all 3 credit reporting agency. The amount that Roundpoint Mortgage company keeps reporting is XXXX as owed this amount has been incorrect for months my amount owed is XXXX as of statement dated XX/XX/2019. I have tried to have this matter rectified for months including today. Today because of Roundpoints inaccuracy in reporting, my credit score has fallen another 30 points. The credit reporting agency keeps closing the disputes because Roundpoint Mortgage Company keeps reporting back to each one as the amount is accurate. Which it isn't.

The title company called because Roundpoint did not give clear wiring instructions on their payoff statement. Roundpoint Mortgage would not give them wire instructions without us calling to give authorization. The title company has been waiting for them to give proper wire instructions and they are not releasing that information causing a delay in receiving the payoff for our mortgage.

Complaint: I have submitted numerous Loss mitigation packages to Round Point Mortgage Servicing Corporation. My application was denied and I was notified at the same time that my loan was being transferred to another servicer and now I have been notified that my home is up for an auction on XX/XX/2019. I tried calling the new servicer XXXX and they told me that my loan would be ported to their system by XX/XX/2019. I did in fact call XXXX on XX/XX/2019 and they told me that there was a hold up on the tranfer of all of the files from RoundPoint Mortgage Servicing Corporation. I can not get my new loan number, I can not do anything to help my self, because of this issue. I house has a sale dte XX/XX/2019 and XXXX may not have time to review a new modification package in order to stop the foreclosure sale. This is not right what RoundPoint Mortgage has done to me and my family. I have a sale date on my home and I am between two servicing companies RoundPoint and XXXX and neither one can help me at this point. What do I do? As of XX/XX/2019 XXXX became the new Servicer for my loan. XXXX has no information concerning my loan.

Complaint: We have never been late on a mortgage payment. Our loan, # XXXX, is owned by XXXX XXXX and serviced by Round point Mortgage Servicing Corporation, XXXX XXXX XXXX, XXXX NC. The first week in XX/XX/XXXX, we contacted Round point to let them know we would be changing the insurance carrier on our house. We followed this up by calling again in the first week in XXXX and the middle of XXXX. Our policy was due to renew on XX/XX/2019. During the last call the customer service agent for Round point said they received the XXXX page from XXXX and all was good as they had not paid the old insurance carrier, XXXX. On XX/XX/XXXX we got an {$890.00} refund check from XXXX. We called XXXX and they had not been paid the {$890.00} owed them. That same day in the mail we received a letter from Round point dated XX/XX/XXXX threatening us if didn't get insurance. We then called them twice asking for a postage paid envelope to mail them the refund check, once speaking with a XXXX, and would they please pay the right insurance company. They have raised our mortgage by {$60.00} a month and have sent another threatening letter saying we owe they them {$1200.00} for the escrow account. Now the are saying they send us a postage paid envelope either. We still don't know if they paid XXXX. The math they are using doesn't add up right. Their mismanagement might mean we may not have insurance on our house. I am not paying the postage to mail them the refund and I don't trust them to put it in our account anyway. I have asked them for control of our own escrow account as we'd actually pay the bills correctly and they said no. How far can they go in threatening us?
