Complaint: A former servicer failed to respond to a timely Request for Information and Notice of Error concerning improper handling of a modification application and transfer. On XXXX XXXX, XXXX, Roundpoint Mortgage Servicing Corp. received the borrower 's RFI and NOE according to USPS tracking of the certified mailing. An acknowledgement notice was sent by Roundpoint on XXXX XXXX, XXXX indicating receipt of the RFI/NOE on XXXX XXXX, XXXX. On XXXX XXXX, XXXX, Roundpoint issued an extension notice until XXXX XXXX, XXXX for its response. ( While the XXXX XXXX notice was in the mail, the borrowers sent a NOE on XXXX XXXX complaining about the failure to reply to the RFI/NOE. ) No response to the original RFI/NOE has been received and it is 8 days after the XXXX XXXX deadline. No response to the XXXX XXXX XXXX has been received. The original RFI seeks a copy of the loan transfer schedule that Roundpoint made when it transfered servicing of the loan in XXXX XXXX to XXXX XXXX XXXX. The RFI also requests other documents relating to the transfer of the borrowers ' loan. The original NOE concerns the possible failure of Roundpoint to list the borrowers ' loan as a HAMP eligible loan at the time of transfer. The borrowers had submitted a HAMP modification application to Roundpoint prior to the transfer and had not received notice of eligibility or ineligibility for HAMP. The NOE requested that Roundpoint correct for this error by amending the loan transfer schedule to list the borrowers ' loan as a HAMP eligible loan. Prior to the RFI/NOE, the borrowers had made a request to XXXX XXXX for a HAMP Modification, but XXXX denied the request because the loan was not listed as HAMP eligible at transfer and XXXX is not a HAMP participant. The borrowers desire a HAMP modification to preserve homeownership for a property that they have lived in with their family for 31 years.

Complaint: We refinanced our mortgage in XXXX XXXX. It was quickly sold to RoundPoint Mortgage Servicing. On XXXX XXXX, XXXX I first contacted RoundPoint to notify them my initial escrow deposit of {$3300.00} was missing from escrow. It took until XXXX XXXX, XXXX for the funds to finally be deposited. The agent I worked with told me no analysis would be done because the Initial Escrow Analysis from origination was accurate. The deposit is incorrectly credited on the account as a Hazard Insurance Refund. Today I went to make my XX/XX/XXXX payment and noticed the payment has increased from {$1200.00} to {$1200.00} - increase of {$9.00}. I looked further and realized on XXXX XXXX, RoundPoint performed a short cycle analysis effective for the XXXX XXXX payment. They are violating RESPA guidelines and are not providing at least 30 days notice of a payment increase due to escrow. I was on the phone with customer service for over 1 hour and am no closer to an explanation. The level of customer service I have received is far below the level anyone should be receiving. For example, on the phone today, the agent informed me the analysis was performed and payment increased due to taxes increasing, which is completely false. I was also advised that they received an insurance refund on the account, again false. I should n't have to hand hold every customer service agent I speak with to tell THEM what is happening with my account.

Complaint: Roundpoint Mortgage has repeatedly not returned my attempts at contacting them since they have acquired my mortgage loan. Their phone system hangs up on me at least once during each attempted contact. It is now three months into their acquisition and they ca n't tell me whether or not my insurance is lumped into the monthly mortgage payment. They have locked me out of my own account without any sort of notice or explanation. I feel like I have no way of knowing whether or not my mortgage loan is being taken care of.

Complaint: RoundPoint Mortgage has lost money I have sent to them, miss applied monthly payments and have almost doubled my monthly mortgage payments. Missed paying my homeowners ins. twice causing cancellations of the policies. Refusing to investigate the certified complaint I sent them and now are charging me with late charges when I am current with my mortgage payments which are being mis-applied. I believe if they continue this inept and flagrant behavior in direct violation of the fiduciary laws will lead to unlawful foreclosure of my home.

Complaint: We are a restoration repair company, we performed repairs on a residential home due to water damage. The insurance company issued us a check with the homeowners name on the check and their mortgage company. We sent the check to the mortgage company, for their endorsement, so they could send back to us so we could deposit in our bank. Then the mortgage company kept the check because the homeowner 's had not made a mortgage payment in a year and a half. The mortgage company gave us false information to get us to mail them the check.

Complaint: The original debt and lien was created by XXXX XXXX, XXXX in XXXX, Texas, An unlicensed mortgage banker. The debt was supposedly transferred to XXXX after closing, however, there is no record of that transfer in XXXX XXXX, Texas as is required by law in the State of Texas. " The original creditor, and not the debt buyer, is the party responsible for reporting information about the debt to the credit bureaus. Typically, at some point prior to selling the debt, the original creditor will report that the debt has been " charged off. '' The debt buyer can not change or remove this information from your credit report. Only the original creditor can do so. '' XXXX XXXX was our original creditor and as the chain of title with lack of registering any transfers according to the laws of the State of Texas, that would legally make XXXX the purchaser of a debt and not the legal holder of the Deed of Trust and Promissory note. This debt has been cancelled by Declaratory Default Judgment of wrongful foreclosure in XXXX of XXXX and the Deed of Trust and Promissory Note is no longer enforceable. Therefore, the continued threats of foreclosure constitute harassment and the damage to our credit reports is infinitesimal. " The damages for wrongful foreclosure, particularly a willful ( or knowingly ) wrongful foreclosure ( in a non-judicial foreclosure state ) can be quite substantial, including the loss in value of your property, the costs to you of having a poor credit rating because of the foreclosure, the costs of moving elsewhere, emotional distress, and various other costs, including consequential damages which the bank could have foreseen when it wrongfully foreclosed. '' These actions have caused undue hardships on us financially and personally. A seemingly willful disregard for the laws of the State of Texas and refusing to abide by the orders of the court seems to be a matter of contempt. The reported no payments were court ordered as the dual tracked foreclosure process was wrongful and invalidated the Promissory Note and Deed of Trust is inaccurate because the court ruled in our favor declaring the aforementioned actions as illegal and thus voiding the lien. I am requesting that the item be removed or updated to show paid in full to correct the information. Another part of the case involved the Mortgage Banker that was illegally brokering Mortgages without a license in the State of Texas through XXXX XXXX XXXX. The mortgage began in XXXX of XXXX and involved XXXX lawsuits before final judgment was passed against XXXX XXXX XXXX XXXX in XXXX, Texas and their leaning to Accelerate the loan and all our possessions which is illegal in the State of Texas. Roundpoint Mortgage Servicers is the company, along with XXXX XXXX that put the pressure on us and refused to speak with me, the third person on the mortgage simply because it did n't fit their paperwork system. I have challenged this through the credit bureaus three times now and RoundPoint Mortgage Servicer as a Debt Collector, refuses to close this and wipe the slate clean. Complaint: I sold my home and paid off my mortgage to Roundpoint Mortgage Servicing Corporation via wire transfer on XXXX/XXXX/16. I called them on that day to give them my new address and verify when my escrow balance and mortgage overpayment would be released. I was told by " XXXX '' it would be sent in 20 days. I called again on XXXX and talked to " XXXX '' and was told a check had not been issued yet and that it could take up to 60 days. I requested and was told it would be expidited. I still have not received a check. Why are they allowed to hold my funds for that long when they received a wire transfer on the date of closing? If I am late on a payment I am charged a late fee. Why is Roundpoint not penalized ( and me compensated ) for their failure to pay ME promptly?

Complaint: I recently purchased a new home with builder financing. My mortgage was immediately sold to Roundpoint Mortgage Servicing corporation and I 've been making payments to them for the last 7 months. XX/XX/2016, I received a Real Estate tax bill from the City and promptly forwarded it to Roundpoint so that it could be paid from my escrow account. Despite several phone calls to Roundpoint 's customer service center, one of which ended with a promise from the floor superivsor to get the bill paid, Roundpoint has failed to issue a check and I 've been forced to pay the tax bill out of my own pocket. XXXX 's excuse for not paying the bill is that it is marked " supplemental '' ; in actuality, the city of XXXX XXXX has confirmed that this is the normal real estate tax that is due for the period of XX/XX/XXXX - XX/XX/2016.

Complaint: This is a transfer of servicing issue. My mortgage was transferred from XXXX XXXX to RoundPoint Mortgage effective XX/XX/XXXX. First, the notification was sent by XXXX on XX/XX/XXXX which seems short notice. It is my understanding that under the New regs of CFPB, it is required that the consumer receive at least 30 days notice of transfer. Second, to date, I have NOT received ANY information from RoundPoint Mortgage regarding the transfer. There has been NO notification or documents stating where to send XX/XX/XXXX payments other the information in XXXX 's initially sent in their letter on XX/XX/XXXX. Again, it is my understanding, under the new CFPB regs the retaining servicer must notify the consumer with in 15 days of the transfer of corrected payment locations. Third, and most important is my escrow account. I have attached monthly statements from XXXX XXXX since the loan closing XX/XX/XXXX that indicate an initial escrow payment at closing of {$1400.00} however these funds were pulled out of escrow on XX/XX/XXXX then reinstated in the account on XX/XX/XXXX with no explanation why. Again however, my escrow balance does not reflect the funds in my escrow balance. My calculations show that my escrow balance should be currently, after my XX/XX/XXXX payment {$3000.00}. This calculation is based on the following : ( {$1400.00} Initial escrow+ {$400.00} XX/XX/XXXX+ {$400.00} XX/XX/XXXX+ {$400.00} XX/XX/XXXX+ {$400.00} XX/XX/XXXX ) However, when I called the new servicer ( RoundPoint Mortgage ) today XX/XX/XXXX, their customer service rep stated that my escrow balance only reflected {$680.00}. I asked if there were any payouts showing on the account and the customer service rep stated NO. This is scary because, though the balance on my monthly statements are incorrect from XXXX XXXX the last state at least showed a balance of {$1200.00}. I have filed a compliant with CFPB on this issue but you are only reviewing the initial servicer response however the current server has also paid my real estate taxes that has caused a shortage in my escrow now ( XX/XX/XXXX ) over {$900.00} and the current server is using my payment to pay their advancement. Please take of this ASAP. Do I need to have the VA involved in this issue of how a veteran is being treated through transfer of serving?

Complaint: Have been trying to complete a short sale for over 2 years with Rounpoint mortgage. As of XXXX XXXX they have all documents to make a decision. It has been 53 days now and they still will not make a decision or respond to me. I was told they would approve or decline the short sale in 30 days after they have all docs needed were received. I have a cash buyer ( XXXX cash buyer that has tried to purchase the property ) and he is not going wait much longer. This is not how any mortgage company should be operating. I do n't know why it is taking so long.
