Complaint: I received a phone call from this company on XXXX and I asked for a validation of debt letter, they claim to have sent it out on XXXX, which I have not seen. Now on XXXX, they proceeded to call my employer. Someone answered the phone at my work place and transferred the call to me. I answered and repeatedly said hello, hello. I then took my cell phone out, excused myself outside in the hallway and called the number that was calling me. XXXX and spoke with a lady, she told me she was calling about a debt and I told her I have no knowledge of the debt. I immediately told her to please remove my employers number from there listing as they are not allowed to call my employer. She totally ignored me and continued talking about the debt, I then told her, I requested that they send me a validation letter and I have yet to see it. She said they mailed it out and I said I have not received anything and will they either re-send it out, and I even offered to give them my email address for faster delivery. she refused, but said they would be send out another letter. We discontinued the conversation. I thought about it and immediately redialed her number and to make sure that she understood they are not allowed to call my employer. She proceeded to tell me they would be calling wherever the XXXX they wanted until they get this resolved. I then said, well I know the law and I know my rights and I am asking you to please remove my employers numbers and not to call here as they will make me lose my job, she screamed at me and said well if you know the XXXX law well put it in writing. I came back to my desk and researched the number on google and nothing came up. I then called back and asked what was the name of the collection agency and they responded XXXX. I asked for the address and they hung up in my face.

Complaint: My homeowners insurance is paid from escrow. My lender failed to send payment to right address ( no fault of mine ). The payment was sent back. Lender did not notify me or send any letter out. They simply let my insurance cancel. This was not discovered until XXXX 2017 when a trampoline blew into my house and fence. I found out from XXXX XXXX when I tried to file a claim. I called rushmore ( my lender ). And they admitted their mistake and said they would make me whole. It should be noted at this time there was no forced policy in place by rushmore. My policy rushmore let lapse was only a XXXX deductible. Under my policy my fence would have been covered. Rushmore sent out an appraisal person. Still it should be noted NO FORCED POLICY BY RUSHMORE. Still assured by rushmore I would be made whole according to the policy they did not pay for me. Finally a forced policy was placed and back dated by rushmore. The policy had a ridiculous XXXX deductible. And would not cover my fence which was cover under my policy they failed to pay or follow up on. So after the fact including appraisal. They got themselves out of paying me anything because of the ridiculous policy they made up. This is fraudulent on their part.

Complaint: I filed chapter XXXX bankruptcy which included the property in question which was reassigned XXXX to XXXX XXXX. as the first mortgage holder and Rushmore as the Loan Servicer. This property has been in foreclosure since XXXX and has been sold/reassigned many times since then because XXXX XXXXXXXX XXXX kept the second lien and refuses to release it to the first mortgage holder. Rushmore Loan Managent and XXXX first promised they could do a deed-in-leui and have my name off the property title by XXXX of XXXX. They asked for a hardship letter and paperwork. I cooperated with this effort for months beginning XXXX. Then around XXXX XXXX Rushmore told me the foreclosure date might happen before they can get the deed in leui and that I should wait JUST 6 more months and the foreclosure would occur and the house would soon after be transferred out of my name. On XXXX/XXXX/XXXX, I was informed by XXXX, In XXXX TX, that they were charging off the mortgage as bad debt. He suggested, I get XXXX XXXX XXXX to release the second liens so I could do a short sale quickly. Meanwhile, Rushmore 's employee in the loss and mitigation Dept tells me that the " charge off of mortgage '' is going to hurt my credit scores. I told her that they were not allowed to report that to the credit bureaous. She insisted that they will report it!!! I asked to talk to someone in the whatever department there that could stop Rushmore or XXXX from making this mistake by reporting it to bureaus because it would cause great distress for me financially after just recovering 3 years out from from a BK. She insisted that I was wrong and that I would have to take that up with the credit bureaus after it was reported and if it was not supposed to be on there then the bureaus would remove it. So this seems intentional to me! she would n't transfer me to the appropriate dept. Although, XXXX acknowledged under breath quickly brushing it off that the information could not be reported so it seems Rushmore and XXXX Investors are conflicted on this issue of reporting " charge off mortgage '' to the credit bureaus after its been discharged in Chapter XXXX in XXXX. So this complaint is to make sure they are no longer conflicted. This mortgage was discharged and can no longer be reported on to credit bureaus by Rushmore or XXXX. I am taking these broken conversations as a very serious threat to hurt me and my lines of credit on purpose. These threats I received sounds to me as if they expect me to pay or settle a discharged second lien with XXXX XXXX XXXXXXXX so they do n't have to pay for the foreclosure while threatening to ruin my credit temporality until I do what I am told to do. I sent the loss and mitigation Dept at rushmore an email letter requesting them to get the bankruptcy information to the correct person before they make this grave mistake. However, the email kicked back a message saying she was n't in the office on Friday. I then, called the main number and spoke to XXXX and again asked if she could get me to the person in charge to make sure they understand this mortgage was in my bankruptcy 3 years ago and discharged so if they wanted my bankruptcy paperwork to confirm that information so I could fax it or PDF it to them. She took the time to tell me not to worry. If the company reports it to just dispute it with the bureaus and that It would be no big deal, nothing to loose sleep over. She gave me a fax number and told me to put attn legal dept, still not a name of a person! She also mentioned I should mail the information just in case they do n't get the fax. So I decided to write to the CFPB instead so I know they get the information to the person who understands reporting " charge off '' mortgage on my report is illegal and they would be violating bankruptcy law. Also, would like to mention despite the recent threats and bullying tactics by Rushmore and XXXX I am actively pursing measures to help them get liens released from the property so they do n't have to do the work themselves. I have a complaint filed with CFPB for XXXX XXXX XXXX and I also have the cooperation of my congressmans office in assisting the bureau in getting my complaint for the lien release request to an officer at XXXX XXXXXXXX XXXX that can make an excustive decision. If XXXX XXXXXXXX XXXX cooperates then I will gladly hand over the deed of the property to Rushmore and XXXX. XXXX XXXX Assignment of mortgage to XXXX XXXX is on public record recorded on XXXX/XXXX/XXXX in the county records.

Complaint: Rushmore Loan Management is trying to collect on a debt that is n't theirs to collect and it also does n't exist. Rushmore Loan Management has that my mortgage is one month behind due to not paying a payment to XXXX XXXX XXXX in XX/XX/XXXX. Please note, Rushmore began servicing of the loan as of XX/XX/XXXX. They are trying to collect a debt that is n't owed because XXXX XXXX XXXX made an adjustment to the loan due to a mortgage modification. Rushmore also has an incorrect loan balance from the beginning of the loan. If anything, they owe me money. I 'm attaching the loan transfer information. It has the proof of date that Rushmore began servicing loan. I 'm also attaching XXXX XXXX XXXX 's final statement, dated for XX/XX/XXXX payment. It shows a final principle balance of {$100000.00} ( I circled it ). The statement does not show any late payments. It actually shows " unapplied funds '' which Rushmore does n't show on their records. Rushmore shows in there records of a beginning balance of {$100000.00}, I circled that too. The unapplied funds which Rushmore does n't show on my account is {$490.00} which was actually sitting on account prior to filing a bankruptcy. It should actually be applied to the principle on my loan cause technically I 'm out of Bankruptcy now. This unapplied funds can easily be viewed on the XXXX XXXX XXXX final statement. You can also note my final payment to XXXX XXXX XXXX which was applied XX/XX/XXXX. There are no missing payments reflected on the statement. Rushmore is in violation of the Fair Credit Reporting act on trying to fraudulently collect a debt, putting my loan in a false default and I think their in violation of insurance fraud because I think they have fraudulently collected on mortgage DEFAULT insurance. I 've tried to correct this so many times with Rushmore by even reconciling their statements for them. I want my loan taken out of default. They should also be assessed each individual {$1000.00} for each occurrence for violation of the Fair Credit Reporting act and they should be investigated by the appropriate agency regarding mortgage loan servicing fraud. Please see the attachments. Please also note, I circled all the payments made to Rushmore that are noted in their own records. You will see, I have n't missed a payment. Thanks, XXXX XXXX

Complaint: Rushmore Loan Management is trying to collect on a debt that does n't exist. Rushmore has illegally put my mortgage loan in default since receiving my loan in XXXX XXXX. I 'm providing my final and last mortgage statement prior to the transfer. Rushmore has the principle balance wrong. I also had unapplied funds which they have n't applied to the principle on my loan. In fact, the funds have disappeared. I want Rushmore to correct the principle balance and take my loan out of default. There have been significant violations of the Fair Credit Reporting Act. They should be fined for not having the correct principle balance and trying to collect on a debt that does n't exist. Also, the unapplied funds need to be applied toward the principle on the loan. I 'm attaching XXXX XXXX final mortgage statement prior to transfer. The XXXX XXXX XXXX mortgage statements shows the correct principle balance and it also shows it was current at time of transfer. You 'll notice, there are n't any late fees or any unpaid balances. I 'm also attaching Rushmore 's payment history which was provided to me in XXXX XXXX. This is Rushmore 's own data records. I marked all the payments that Rushmore received. There are NO missing payments. In fact, it shows they have the wrong principle balance from the start. It also shows they have assessed 2 false late charges. It also shows that they never applied my unapplied funds from XXXX XXXXXXXX XXXX. The only payments that Rushmore 's payment history does n't show are the XXXX and XXXX payments. The proof of payments are included. Please also see the most recent Rushmore mortgage statement for XXXX XXXX. The XXXX payment is the only payment due but they are reporting on their statement that they have n't received the XXXX XXXX payment but, they have received it. I 've attached the XXXX and XXXX XXXX payments and the signed receipt of when Rushmore received my payments. Once again, they lied saying I was late with payments when they signed for my payments prior to the XXXX of the month. I 've also attached the XXXX tax mortgage statement form. This is also Rushmore 's document. Please note, they had my loan in default from the onset of receiving my loan because they have noted " property preservation " fees since XXXX XXXX. Property preservation fees are only applied when a loan is in default and in foreclosure. Regards, XXXX XXXX

Complaint: This complaint is against Rushmore Loan Management Services, LLC. My first complaint, was back in XXXX 2017. In viewing my credit report, I noticed Rushmore closed my mortgage loan. But, it should n't be closed. I filed a complaint. They corrected the account to " open '' but now reporting it as in default 60 days. This is false reporting. I 'm providing proof of XX/XX/XXXX and XXXX 2017 mortgage payments. I 'm attaching the XX/XX/XXXX, XX/XX/XXXX and the XXXX XXXX 2017 reports. I believe, they have knowingly reported this falsely reported to the credit bureaus. Complaint: XXXX XXXX XXXX XXXX XXXX/ XXXX XXXX XXXX XXXX XXXX / XXXX XXXX XXXX XXXX XXXX XXXX ( RUSHMORE ) and their Trustee XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ) have made repeated mistakes on my mortgage loan which it refuses to correct or investigate, issued The Reinstatement for amounts that more than what I own, eventually denied my loan modification application and continued foreclosure my property. The servicer continues to charge me late fees every month. XXXX XXXX XXXX XXXX XXXX/ XXXX XXXX XXXX XXXX XXXX / RUSHMORE and XXXX are not respond to the Requests for Information. I am being denied an opportunity to save my home and avoid foreclosure through the Loan Modification program. RUSHMORE denied my loan modification is not based on my income or ability to pay with a balance that I do not agree with because it includes fees and charges I have tried to dispute and be faced with foreclosure against me and I may loss of my home. I 've been submited loan modification many times and RUSHMORE continued to denied it, am not able to compute mathematically, and whose balance includes fees and charges I am not being allowed to dispute or have explained to me by RUSHMORE and XXXX. XXXX XXXX XXXX XXXX XXXX/RUSHMORE denied my loan modification is not based on my income or ability to pay and be faced with foreclosure judgment and I may loss of my home. Their Single point of Contact ( SPOC ) is not working or they have many 300 files so they ca n't not have time to talk to customer nicely or respectfully for all the detail the borrower ask for. Today XXXX XXXX my SPOC told my representative XXXX that do not call him anymore and I am not a customer for service because I am in default, he complaint that my loan have late history, he can not keep talk to XXXX because he have to work on his other file. I request another SPOC because XXXX XXXX is so busy with his more than 300 files. On XX/XX/XXXX, we talk to XXXX XXXX, her extention is XXXX she told us that the Private investor is XXXX XXXX XXXX, XXXX from XX/XX/XXXX. but your respond XX/XX/XXXX you indicate XXXX XXXX XXXX XXXX XXXX is the current owner of the Note. I need to know how many investor, owner of the note?? XXXX XXXX XXXX XXXX XXXX/ XXXX XXXX XXXX XXXX XXXX / Rushmore Loan Management Services , LLC can not continue give me the run around and continue lie to me. Take a look at all their fee and cost, the answer to all complaint just bla, bla, bla ... they do not answer direct questions, just throw all the number and want the borrower pay for their nonsense fee. Please breakdown for all your fee and cost, when you charge and why you charge, I need all invoices and bill and cancel checks you pay for these fee and cost. A lot of your nonsense fee need to void because you over charge and I do not have to pay for your attorney fee when I bring you to court or when I was in bankruptcy You violate the Senate Bill No. 900 in many ways. You charge a lot of fee and cost when I applied for the loan modification.

Complaint: This complaint is regarding Rushmore Loan Management Services, LLC. Rushmore falsely reported my mortgage payment history to the Bankruptcy Court. Rushmore knowingly and falsely reported this information on my mortgage loan to the Bankruptcy trustee on the official Form XXXX which is a final response to cure payment. I 'm providing the official XXXX form completed by the Rushmore employee. Please note, I highlighted where they reported I was 3 months in default for post petition payments. As we both know, this is a very serious matter. It is fraud on the court. I 'm also providing the copy of payment history. The payments for those dates were n't missed as they are reported on Rushmore 's own payment history records. I believe that because there have been so many errors, I am a targeted individual for Rushmore Loan Management Services. I have called and requested they fix this error but they have not. They knowingly did this. The court closed the case upon the response. I am not paying court fees when this was negligent and intentional on Rushmore 's behalf. I want this reported correctly to the Trustee of the Court. I also find that Rushmore assessed with fines that appropriate under the Fair Credit Act. Regards, XXXX XXXX

Complaint: Dear CFPB, This complaint is regarding Rushmore Loan Management Services, LLC. This is in regards to my mortgage being incorrectly placed in default for false reporting and misapplication of payments on behalf of Rushmore Loan Management Services, LLC. I have made so many attempts to fix this issue by phone and in writing. But, when I have tried to correct Rushmore 's errors it has caused more severe and additional issues such as incorrect reporting to credit bureaus. I now believe I 'm being targeted by this company. I believe this company is trying to steal my house and fraudulently file default mortgage insurance. I believe I have been targeted due to numerous false reporting regarding my loan to a Bankruptcy Trustee and Bankruptcy court and the credit bureaus. I received a letter from Rushmore dated XXXX/XXXX/XXXX. Rushmore is stating that I 'm contractually due for my XXXX payment. They have also assessed my mortgage loan with incorrect late charges for both XXXX XXXX and XXXX XXXX. I have provided CFPB with all proof of payment and have provided proof of payment for every month from XXXX/XXXX/XXXX through XXXX/XXXX/XXXX. They still are stating that I did n't pay a payment. XXXX, I spoke with XXXX which states is a Supervisor with Rushmore Bankruptcy department. During the conversation with XXXX, he stated that I did n't make a payment in XXXX XXXX. Rushmore is now trying to collect on a date that was prior to them receiving the servicing of the mortgage loan. I called XXXX XXXX XXXX and spoke with there customer service in Bankruptcy and they confirmed for me during the phone call that I was current and reported as current at time of transfer of the loan. I 'm providing you Rushmore 's letter dated XXXX/XXXX/XXXX which states I 'm due for XXXX. I 'm also providing you with Rushmore 's payment history for XXXX XXXX and XXXX XXXX assessing me falsely with late charges. I 'm providing proof of payment and the CERTIFIED and SIGNED mail from Rushmore. Rushmore received payment prior to the XXXX due date. But, they still assessed me with late charges and noted me as late. They have also reported me as late to credit bureaus, 60 DAYS LATE. I 'm requesting for Rushmore to take my loan out of default. I 'm also requesting the remove their false late charges of my mortgage loan. I 'm also requesting they report correctly to the credit bureaus. Please also stop the fraud and targeting me. I believe they have placed me in default to fraudulently collect on mortgage default insurance. Please report this to an appropriate agency for investigation of these fraudulent practices. Complaint: Since the beginning of XX/XX/XXXXever since the previous lender sold the paperwork to a new investing company XXXX XXXX XXXX has treat us as the previous mortgage company, begining as the previous company ending with with their predatory lending practices. No mortgage statements have been sent from the servicer since XX/XX/XXXX, inquiring with them is impossible, w/ remarks from a Rep. XXXX XXXX recently, on ( XX/XX/XXXX ) @ XXXX, for me to prove it. When l told him l was recording our conversation, he responds, " l 'm going to have to end this conversation '' ... Click! However there 's double standards everytime l call them their message recorder tells me, our conversation will be recorded They 're being totally unreasonable to any of my requests. I 've asked to remove a lien from the previous lender that still shows on my Title Deed, in the amount of {$100000.00}, since they 're the Servicer of my present loan and the previous lender no longer has anything to with my loan as their voice recorder says. " Contact my loan Servicer. '' I am also asking for closing documents on the original loan from the orginal lender. Anything like a documents on the transactions that have transpired and where l stand or better than that where do they have anything or than to raise the amount of my original lender in XX/XX/XXXX.
