Complaint: Portfolio Recovery Associates sued me on XX/XX/XXXX utilizing address I had not lived at since XX/XX/XXXX; the original creditor never had this address on the account. The received judgement and garnishment. On XX/XX/XXXX the XXXX Municipal Court in court case XXXX the order was vacated all money received from garnishment was to be returned to me. In a recorded conversation with Portfolio Recovery Associates in the month of XX/XX/XXXX agreed to dismiss and settle the case as paid and remove it off my credit. In XX/XX/XXXX, I noticed the case was listed on my credit report and disputed the case, Portfolio Recovery Associates then mailed me documents showing payments in the amount of {$450.00} made on XX/XX/XXXX and XX/XX/XXXX that they did not return and placed on the account. I have tried to discuss this with them on XX/XX/XXXX, they state they have no court documents and do not have anything showing the court case or that the case was settled and the money was to be returned. Additionally, the balance shown on my credit report is only for {$130.00} not the original amount of {$1000.00} or the XXXX they state the balance is after ignoring a vacated court order and keeping the garnished payments received.

So legal proceedings they were pursuing against me were dismissed " WITH '' prejudice. Portfolio Recovery Associates replaced the first page of the Court Order to " dismissed WITHOUT prejudice '' After I signed the ORDER and returned it to them for filing with the courts. I was able to prove their deception and it was corrected with the courts to show dismissed " WITH '' prejudice.

When I asked the caller if Portfolio Recovery could produce a contract that I owe them the money She said that they bought the debt and the contract and I know owe the debt. I told her that I am disputing the debt and that they have no right to report this to the credit agencies and she told me that they are going to continue to report this and were going to continue to call me even thought through letter dated, XX/XX/2019 to Atty. XXXX XXXX XXXX MA who said he was representing Portfolio recovery, and phone called today XX/XX/2019 @ XXXX XXXX EST. I told them to stop contacting me. When I told her that I was going to end the call she said that they would continue to contact me and that I could do whatever with the call and then she hung up on me.

I also requested verbally that they cease phone collection attempts. I was told if I do that they will mark it as temporary hold and that I rub the risk of being sued. They said I wont be called for 4 weeks unless I send a letter. I sent the letter immediately. Complaint: I have constantly received phone calls from this organization with different phone numbers. I received a phone call on Sunday at XXXX XXXX local time. I confronted them how I believed this to be illegal. They hung up on me. They attempted to reach me today and would not verify who they were until they tried gathering information from me. When I would not verify any personal information because I did not know who they were, the woman began to get argumentative and rude to me. She finally stated she was calling from Portfolio Recovery. I responded back saying that it was illegal not to identify that it was an attempt to collect a debt from the very beginning in the conversation. She kept arguing with me and stating that I was wrong. I am tired of them calling from different numbers on a daily basis. I tried resolving this a year ago, and they would not work with me.

I have sent them several letters asking them to provide me with a copy of any viable evidence bearing my signature. They have not been able to provide me with anything except a statement. They can't tell me what was purchased, when or by who. They keep calling me and harass me daily. I will be attaching all my letters with proof they have received these letters and still keep sending me statements. I had another instance with another debt collector where i had something on my credit report that did not belong to me and they were able to provide me with the actual application and there were two different handwriting that were not mine. i have no idea what this portfolio is trying to collect and they can't verify account.
