Complaint: Please be advised that the options above do not describe the issue at hand. We are trying to clear title for property at XXXX XXXX XXXX , XXXX NY XXXX . XXXX XXXX XXXX XXXX holds a lien on the property that we would like to negotiate a settlement for and obtain a release of lien. We have written to their attorney, Overton , Russell , Doerr and Donovan , LLP and the letter was sent on XXXX . They have not responded. Today I called their office to confirm that they have received the letter. The receptionist was being very difficult and would not give me any information. She kept stating that they could not give me any information on the account. I acknowledged that I understood that and wanted to speak to an attorney there to discuss. She would not pass me through to anyone, would not give me a fax number to resend my letter, and kept stating she would not help since I did not have the debtor 's authorization. I again acknowledged that we were not asking for any privacy or debtor info, and that debtor no longer owns the property and I have authorization by the new owner. She did not care and kept telling me they would not give me any information. She would not listen to what I was saying and would not pass me on to anyone else in the office to discuss the matter with. I am uploading our original request that described the issue in detail.

Complaint: Case number : XXXX Related Case Number : XXXX Overton Lied to Federal Agents, considering the fact that Bureau of Consumer Financial Protection is a United States Government Agency, to lie to an employee either directly or via website, that is the same, in my opinion to lying directly to a federal agent. Title 18, United States Code, Section 1001 makes it a crime to : 1 ) knowingly and willfully ; 2 ) make any materially false, fictitious or fraudulent statement or representation ; 3 ) in any matter within the jurisdiction of the executive, legislative or judicial branch of the United States. Your lie does not even have to be made directly to an employee of the national government as long as it is " within the jurisdiction '' of the ever expanding federal bureaucracy. Though the falsehood must be " material '' this requirement is met if the statement has the " natural tendency to influence or [ is ] capable of influencing, the decision of the decisionmaking body to which it is addressed. '' United States XXXX ( XXXX ). ( In other words, it is not necessary to show that your particular lie ever really influenced anyone. ) Although you must know that your statement is false at the time you make it in order to be guilty of this crime, you do not have to know that lying to the government is a crime or even that the matter you are lying about is " within the jurisdiction '' of a government agency. United States XXXX ( XXXX ). For example, if you lie to your employer on your time and attendance records and, unbeknownst to you, he submits your records, along with those of other employees, to the federal government pursuant to some regulatory duty, you could be criminally liable. Source : XXXX The actual lie was stating that my complaint was " baseless ''. Therefore, I respectfully suggest that the compliance officer should be arrested, and criminally charged. It will show that i answered the phone, but I was not verified until long after the debt was disclosed, a violation, in my opinion to title 15 fair debt collection practices act. Complaint: Possible multiple violations of US Code Title 15 Fair Debt Collection Practices Act. The Company, to this day I do not fully know them as a debt collection company because they ahve never disclosed that they are a debt collection company, Overton, as per XXXX. I was called today, XX/XX/2016 from a company the individual stated my first name and made a statement that I owed XXXX money on a debt. They them immediately asked to verify my identity to continue the call, I stated that under the fair debt collection practices act if they were not 100 % sure that I was the debtor ( Alledged ) that they should not discuss any form of debt. In addition now that I think about it this may also be a Gramms Oxley violation as well, because they disclosed financial information about an individual of a federally protected financial institution as haviong an account at XXXX. I have never received a letter N1 or docket letter, no information at all verifying this company as a debt collection company and I have never received mini miranda. I would like to direct stakeholders attention to XXXX vs. XXXX as existing precedent and case law. I called back to XXXX and asked for how I could contact a compliance officer, and the individuals were all in a meeting. I asked for a supervisor so i could receive proepr N1 letter to hand over to my attorneys and according to the switchboard there was no supervisor available.

Complaint: I have a paid credit alert service with XXXX XXXX. I have been alerted that a collection company, named Overton Russell Doeer Donovan, has been falsely reporting that I have an account opened with them. The first alert was an account " opened in XXXX 2016 '', which I had to fight a long time to remove from my credit report. And now they have reported that there is another account " opened in XXXX 2016. '' Their fraudulent actions have continued to affect my credit score negatively. My credit score has gone from mid XXXX to mid XXXX. I am hoping to refinance my house repair cost and possibly the current mortgage. But with their fraudulent reportings to the credit bureaus, I am not able to get the best rate. The consumer credit score and the consumer credit report are extremely important in my financial health, as for many other hard working individuals. I am extremely indignant that this company continues to " toy '' with my personal information and credit information. I do n't even know what they are trying to get out of this. But this needs to stop today. Thank you for your help.

Complaint: I received a notification from my credit monitoring company that I had a collection account. I immediately reached out to the creditor/collection company. I asked for the information. The collection company verified that they had sent the notice to an address which I moved from over two years ago. Given the passage of time, my mail was no longer forwarded. I have updated my address with the credit reporting bureaus as well as the XXXX. I asked for the information to be removed from my credit report, until I received the account information and the opportunity to dispute or pay within 30 days. They have failed to send me the information. Furthermore, they refused to send the original notice to my correct address. I have absolutely no information on this account, except for the name of the collection agency and the fact that it is for {$590.00}. I believe this is an unfair collection practice, as I did not receive the 30 day period during which to dispute or pay the collection. I have acted in good faith, even communicating with the collection agency by mail and telephone, and have not been provided with the same courtesy.

Complaint: I am writing regarding a debt collection action wrongly pursued against me by XXXX and the law firm of Overton, Russell, Doerr and Donovan. The negative information they reported to the credit bureaus has caused me to not qualify for credit I applied for, and to pay higher rates for loans and insurance. I want all traces of this collection action removed from all of my credit reports, and my good credit to be restored. I also want all documentation showing this collection action was taken in error forwarded to me. From XXXX XXXX through XXXX XXXX, my family used XXXX XXXX XXXX for all of our XXXX and XXXX. We always paid our bills on time, and never had a payment issue. In XXXX XXXX, we relocated to XXXX, Virginia. In a notice dated XXXX XXXX, XXXX, XXXX notified me I had an outstanding balance, and if the balance was not paid within 14 days, I would be referred to collections, to be pursued by the law firm of Overton, Russell, Doerr and Donovan. The amount of this outstanding balance was {$82.00}. Please find this notice attached. On XXXX XXXX, XXXX, my wife contacted XXXX XXXX XXXX and made a payment for the outstanding balance of {$82.00}. Please find attached the receipt for this payment with the amount of {$82.00} highlighted. In a Debt Collection Notice dated XXXX XXXX, XXXX, Overton, Russell, Doerr and Donovan, demanded I pay the debt of {$82.00}. I ignored this notice as the debt had already been satisfied. Please find attached this Debt Collection Notice. Today, upon reviewing my credit report, I found Overton, Russell, Doerr and Donovan, had reported this debt as a collection. This debt collection, reported in error, resulted in a XXXX point drop in my credit rating. At approximately XXXX., I contacted XXXX XXXX XXXX billing department and spoke to XXXX. XXXX allowed me leave a message for Business Office Manager, XXXX XXXX. At approximately XXXX., I contacted Overton, Russell, Doerr and Donovan, and notified them the debt was paid prior to any collection action. I was told they would take no action to resolve this issue, and I needed to provide them with proof the debt had been paid, for them to consider taking any action to remedy their error. At approximately XXXX., I received a call back from XXXX XXXX, Business Office Manager XXXX XXXX. XXXX XXXX stated Overton, Russell, Doerr and Donovan were notified by XXXX on XXXX XXXX, XXXX, that the debt of {$82.00} had been paid. XXXX XXXX stated she had just contacted XXXX from Overton, Russell, Doerr and Donovan, and this collection would be removed from my credit report. XXXX XXXX stated she would forward documents to me showing the debt had been satisfied, and that Overton, Russell, Doerr and Donovan were actually notified of this prior to them taking collection action against me. XXXX XXXX could not tell me how soon the error would be corrected. I 'm extremely disappointed with the haphazard handling of this matter by XXXX and Overton, Russell, Doerr and Donovan. Their joint carelessness has harmed my credit and forced me to pay higher rates on loans and insurance. I am seeking your assistance in order to restore my good credit and warn other consumers of their malicious collection practices.

Complaint: I paid off final payment in 2004 and only 3 years ago started getting harassing phone calls and letters of garnishment from this company Overton, Russell, Doerr and Donovan, LLP. I only save my important paperwork for 8 years as does most people. They sent stuff to the XXXX District court and also on the paperwork are garnishee 's that have no idea what is going on and also I never had any loans with, not even associated with original school loans.
