Attempts to collect debt not owed

Debt collection: Medical debt

Debt is not yours
Complaint: A decision was rendered by the XXXX XXXX XXXX XXXX wherein the proposed decision was a finding had been made that the bill for services submitted by XXXX was done so too late and as a result both myself individually and the insurance carrier was found NOT to be financially responsible. A thirty-day period was provided in which to object to the decision and no objection was filed by XXXX. As a result the decision was filed in XX/XX/XXXX. This bill for XXXX has been continuously reported every month to the credit bureaus by XXXX through their collection agent XXXX XXXX XXXX XXXX as an open collection account. In fact, during the specific time frame in which the proposed decision and the final decision was filed, the collection agent XXXX XXXX XXXX XXXX each time updated their reporting again reporting the collection was accurate. Despite several calls to the company, sending them copies of the decision, they have refused to cease reporting it as a collection. In fact, during my most recent conversation with XXXX XXXX XXXX XXXX on XX/XX/XXXX, I was informed by " XXXX '' after he spoke with his supervisor that even with knowledge of the decision, that neither myself or XXXX XXXX was responsible, he advised they intended to continue to pursue repayment from XXXX and while doing so they would continue to report it as a collection account in my name, but would mark it as an " insurance hold '' internally. XXXX XXXX XXXX XXXX are knowingly and willfully reporting false and inaccurate information to the credit bureaus which is having a negative impact on my ability to both obtain credit and to obtain competitive interest rates, all while knowing a decision was rendered finding me not financially responsible.

Attempted to collect wrong amount
Complaint: This collection agency held an unpaid account in my name from a medical bill in NY that did not belong to me, in the amount of {$740.00}. After multiple unsuccessful attempts to remove the listing from my report I made arrangements with this agency to pay the entire amount of the collection account in return for removal. They told me that it might take up to 90 days for removal, which I agreed to. After 90 days the listing remained on my XXXX report so I called XXXX and asked them to submit a dispute to Overton Russell Doerr and Donovan in regard to the agreement to remove. Within a week I was notified by XXXX that Overton Russell Doerr and Donovan is refusing to remove the listing. I would not have paid the account if not for the guarantee of removal. This listing is causing undue harm to my consumer credit report. Further, the original debt dates back to XX/XX/XXXX and is outside of the time staute of reporting. I need for this collection agency to remove the listing as agreed to over the phone in XX/XX/XXXX.

Debt collection: Medical debt

Attempted to collect wrong amount
Complaint: I had a hospital debt from XX/XX/XXXX and had a financial agreement to repay this on a monthly basis ; which was done as agreed. I received a letter from the debt collector last summer ( XX/XX/XXXX) for the amount of XXXX and contacted the firm and explained that I had been making payments and that the amount they were trying to collect did not represent these payments, and the maximum amount the hospital could charge me was XXXX ; which represented my co-pay at the time. The woman I spoke with was pleasant and told me that there would be no action until I sent in documentation to show payments. I did questions why the account was being sent to a collection agency since I was making payments and she told me it did not matter if I was making payments, the hospital could still hire them. I received nothing else form the company and on XX/XX/2017 I finally was able to get the information compiled and sent a copy of payments, with proof of insurance ( to verify the incorrect amount owed ) and a letter to both the hospital and the debt collector. The first week of this year XX/XX/XXXX I received a letter from he collection company dated XX/XX/XXXX with an amount due of {$95.00} which I assumed was the balance after the proof of payment was received. When I called the credit agency they said it was another amount and that they had not received any communication from me regarding the payments made. ( This information was sent certified and I am still looking up the postage receipt - I should have within 48 hours ). I explained the scenario to the call center representative, XXXX. I did not get any real information from him, other than it was my fault if it did not require a signature. ; which it did not - it was certified ; AND, this was a separate bill : which shocked me. If the services provided were only two days apart and I received the first notice last XXXX - why am I receiving my first notice for this account XXXX? I also asked XXXX to request detailed information from the hospital about charges and he responded that they were not allowed to ask for that because it was confidential information. I asked to speak to a manager and he transferred me to a woman who 's name I believe was XXXX. We reviewed my discussion with XXXX and she basically said the same thing. While I thought the issue was taken care of she assured me it was not. I asked why I did not receive any further communication from them and she stated that they are a debt collector, not a billing company and they send out collection notices at differing times on a case by case basis. When I asked her about what they case by case basis was, she could not explain and became defensive. She said she could request detailed billing information via their paralegal. She was very defensive after the questioning about statements and hung up on me. I have dealt with this company before, they adversely affected my credit. It is unconscionable that they are able to accept a debt collection account without proper validation and without constant notification to the patient.

Complaint: The company did not respond to my complaint. I have forwarded the response from the company and my response below. This is under the 180 days and I want it removed. seems this " complaint '' was filed prematurely as the consumer probably should have contacted insurance FIRST before filing a complaint. This consumer was sent numerous billing statements prior to being referred to our office for collections. Our office sent the debtor two written correspondences prior to reporting this to a credit reporting agency.Based on the accounts in collections, these debts appear to all be balances after insurance, such as a copayment, coinsurance or deductible.

Debt collection: Medical debt

Didn't receive enough information to verify debt
Complaint: I have been making {$35.00} per month payments to repay a {$700.00} medical debt for an XXXX. The original medical account is with XXXX XXXX XXXX, with whom I agreed to pay the monthly amount. I am XXXX and as I discussed with XXXX XXXX, I do not have the income to pay more than this. In XX/XX/XXXX I received a letter from Overton, Russell, Doer and Donovan, LLP and discussed this issue with one of their telephone operators. I explained that I was making payments and the person I spoke with said it did not matter, XXXX the company can still report me to a credit collector. I explained that I am XXXX and just moved so my paperwork would take a while to get organized and the persona assured mesa s long as I was speaking to them, there would be no problem. The balance on my account was {$2100.00}. I explained that I only owed {$700.00} and insurance was supposed to cover the remainder of the costs, as they had with all of my other expenses at that time. I collected all of the payments and documentation from the insurance company that confirmed that I was covered and mailed these out certified mail, XX/XX/XXXX. In the interim I received a letter from some agency ( I can not find the letter as of this moment ) stating that I was covered and these charges would be reviewed. I received a letter dated XX/XX/XXXX, I received XX/XX/XXXX with a new amount of {$95.00} of which I thought was the reconciled balance owed to the hospital. On XX/XX/XXXX I attempted to call in and confirm that it was reconciled and make the final payment. I spoke to " XXXX '' and found out that this was an additional bill. He told me that if I did not have the account number on it, it would not have been looked into. They say they have not received the letter I sent to them previously ( obviously received by XXXX XXXX ) and that the other amount was still open and due. I asked why I have not seen invoices/statements not his and they told me they were a debt collection agency not a billing company. I also requested to XXXX that a request be made to verify this debt and he said they could not do that - it was private information. I asked to speak to XXXX manager, XXXX who reiterated that same information and elaborated that " they just send out notices periodically '', I asked what they base that on and she said it is on a case by case basis ''. So I asked what were the requirements and she said " it is not her department '' and then hung up on me while saying " have a nice day ''. I am concerned that with their " notification policies '' that they will submit this incorrect information to the credit report gin agencies and I will lose points on my ratings. I have dealt with this agency before and they should not be allowed to start collections proceedings without the proper documentation and without proper notification to collect debts. I also believe that this practice is detrimental to all Americans who are forced to play within this system. If I have to provide a certified letter to show that they are receiving my information, should n't ; t they have to provide a certified letter to make sure of when I am getting their letters?

Complaint: I contacted the CFPB about this debt before in case XXXX. The hospital is part of XXXX XXXX XXXX XXXX. The service date is shown on a bill but the bill shows a very different amount. I was able to speak XXXX XXXX XXXX billing office about the bill they sent me and they said that the amount they were showing as outstanding was different and they would investigate and send me a revised bill. That phone conversation happened on XXXX17. I am unsure how I can be working with the provider on something that has been sent to collections. I feel that some sort of clarification is needed. The charge may also be the result of identiy theft but I need to have a conversation with someone to figure that out. The people at Overton will just repeat the amount they think I owe and that is not helpful

Written notification about debt

Debt collection: Medical debt

Didn't receive notice of right to dispute
Complaint: I XXXX XXXX hereby file this complaint against a medical debt collector that is not abiding to the Consumer Financial Protection Bureau mandate and settlement with XXXX , XXXX and XXXX XXXX respectively. The attache d medical collections were instantly filed by Overton, Russell, Doerr & Donovan, a law firm located in the state of New York that specializes in medical debt collections. By this attached mandate, the medical debt collection process is supposed to operate as follows : 1 ) The consumer is to be billed by the medical collector, giving a 30-day time frame to pay the medical invoice directly, or to ensure that his/her medical insurance provider is to satisfy the claim in question. 2 ) If the claim is not satisfied by these criteria, the debt can be assigned to a medical debt collector. 3 ) The medical debt collector must submit a 180-day notice that if the medical debt ( s ) are not satisfied, either through medical insurance or directly from the consumer, then the medical debt collector has the right report any or all collections previously ordered paid. In the events of the aforementioned law center, none of the mentioned methods were used, and my credit was tarnished through the violations against me of the CFPB mandate and settlement with the major credit bureaus, but these collection violations are connected to my rights under the Fair Debt Collection Practices Act. My understanding is that there are currently multiple complaints against the law center of Overton Russell Doerr & Donovan for a continuous illegal collection practice ( s ) against consumers without any consideration of the law. An additional complaint will be filed with the state of New York Office of Attorney General through my attorney in due course if the CFPB can not rectify this serious series of violations. My information and all aspects of previous collection postings with all pertinent credit reporting agencies must be purged immediately, and the CFPB must file an additional investigative process with the Federal Trade Commission to sanction the law center of Overton Russell Doerr & Donovan alo ng with a permanent injunction against same from this continuous abusive practice.

Complaint: I saw negative credit on my credit report by Overton, Russel and Donovan debt collection for 6 year old bill. Never received any letter or call from them just directly reported on my credit report. I was not made aware that I could dispute. Being ignorant I paid my 2 weeks paycheck to them. Within 5 weeks they send me another bill from same company regarding my son, same 6 years old. This hospital they send me bills have been taken over by another hospital 2/3 years back. Also my son always had child health plus insurance. I think they saw that I paid one bill so they are purposely sending me more unnecessary bills to collect money. Someone should really investigate in all their collections and revenues.
