Complaint: I recently applied on-line with SpringLeaf Financial for a personal consolidation loan and was approved on-line and was told that I to call to speak with a loan officer to process the loan. I called and provided detailed information to the specialist which included the fact that we had XXXX vehicles which were owned and had a loan out on them as well which we desired to consolidate in this new loan. Whereby, the bank would receive the XXXX titles as collateral. I was then informed I only needed to send in my last XXXX pay stubs to complete processing the loan. With this proof on income the loan should have been seemlessly processed. However, on this morning I was told they would not process the loan since the collateral has money owed to XXXX which they were made well aware of on yesterday before requesting me to send in my last XXXX paystubs. This is Credit Discrimination in and of itself. I had a longstanding small loan with them from last year which has been paid back consistently and never late. I repeatedly received solicitations about renewing or applying for an increase, prior to me applying on line yesterday. The practices of this firm is blatant discrimination towards XXXX minorities specifically. They should be ran out of business and not be allowed to practice anywhere in the United States of America.

Complaint: Citifinacial received a default judgment against me in XXXX XXXX. In XXXX XXXX I settled the charged off account with Citifinancial. Since XXXX I have attempted to work Citifinancial and XXXX at the XXXX XXXX XXXX XXXX XXXX XXXX, SC office to get a Satisfaction of Judgment submitted to XXXX County Clerk of Court. Attached is a copy of the settlement offer and also a copy of the letter I received from Citifinancial showing the charged off account was satisfied. They refuse to submit the satisfaction of judgment information and this continues to negatively affect my credit standing and causes me to incur higher interest rates and fees or being outright denied credit.
I am also submitting a complaint to the Consumer Financial Protection Bureau, XXXX, as well as seeking legal representation for damages caused by Citifinancials ' inaction.

Complaint: Today ( XXXX/XXXX/2016 ) My car was repossessed by the loan agency Springleaf Financial after I 've been making payments to them. When I called their corporate office, they kept giving me the run around on things and seemed to not be able to get their own story straight. I am currently XXXX weeks XXXX, I was laid off for 3 months from my old employer after they had found out I was XXXX. I recently was able to get income generated and I explained that to springleaf, they were very inconsiderate, I knew i was behind on payments but I have been doing my best to catch up on my payment, going in to my local office to make payments on weekly basis with whatever money i had even if that meant me not being able to eat for the rest of the week. Everytime I step into the local branch office where I live, the associates are extremely rude and are usually out back smoking and not even at their desks. Springleaf has told me i can only pay cash and I 'm now beginning to wonder if they have been pocketing my hard earned money. I have been told that if I have been paying them money that they should not have been able to repossess my car.

Complaint: On XXXX XXXX, 2016 I was contacted by an agent named XXXX at Springleaf. She advised me that my installment payment of {$170.00} due on XXXX XXXX, 2016 had not been received. I informed XXXX that I had excessive monthly obligations and would be paying late. She offered me a deferment under the condition that I make the XXXX payment that day, which I did. However, I did n't realize that I had paid {$1.00} short so XXXX called back the next day - at which point I paid another {$2.00} and XXXX confirmed the deferment agreement would be mailed to my home address. I received the deferment agreement a few days later. It was dated XXXX/XXXX/16 and signed by an employee named XXXX XXXX. I signed it on XXXX XXXX, 2016, made a copy, and placed it in the outbound bin at work. I continued to receive what I believed were collections calls from Springleaf, which I did not answer. Fast forward to today ( XXXX/XXXX/16 ) I received another call from Springleaf. The agent ( I did n't get his name ) advised me that my XXXX payment was past due. I told him that my XXXX and XXXX payments were deferred per the agreement I received. He explained that there was no deferment in place because the document was not received timely. When I protested he confirmed that Springleaf did not receive my deferment agreement until XXXX/XXXX/16. He stated that the XXXX payment was now due in addition to the XXXX payment, due tomorrow, XXXX/XXXX/2016. I told him that according to the deferment agreement, my next payment was n't due until XXXX/XXXX/2016. He stated " it is n't supposed to say that '' which alarmed me because Springleaf has apparently sent me an ERRONEOUS deferment agreement WHICH THEY WOULD NOT HAVE HONORED in the first place. He stated that Springleaf only offers " half deferments '' and " 1 month deferments ''. He then tried to blame me for Springleaf 's failure to credit the deferment agreement to my account by saying the phone calls I was receiving " should have triggered '' me to know something was wrong!
I asked to speak to a supervisor and was connected to XXXX XXXX. XXXX confirmed that there were " INCONSISTENCIES '' in the deferment agreement. However, per XXXX the " root cause of all of this '' was the fact that the agreement was n't received timely. I acknowledged to XXXX that perhaps the mailroom at my job lost the envelope prior to mailing, as the previous agent did confirm that the envelope was post-marked XXXX/XXXX/16 from zip code XXXX ( my office location ). Then XXXX stated that the image of the envelope in Springleaf 's records DID NOT show the zip code it was mailed from - which means the previous agent lied to me when I asked him to confirm. In any event, my contention is that Springleaf would not have honored the agreement in the first place because it apparently offered terms that were not in line with Springleaf 's deferment programs. XXXX XXXX would not explain why an erroneous agreement which would have extended my maturity date, thus re-amortizing the loan ( hence the lower " new payment amount ), was sent to me. Instead, he started to scrutinize the fact that I did not answer Springleaf 's phone calls. He then stated that the agreement would NOT have extended the maturity date ( even though it clearly says that it does ), so I would have had a BALLOON PAYMENT at maturity ( not stated in the agreement whatsoever ), and that I did not send the agreement by the due date indicated on the agreement ( there is no due date on the agreement ). I asked XXXX XXXX to pull my phone calls with XXXX since he claims that she notated in my account that the deferment was due by the end of the month. I contend that she did not. Regardless, I simply ca n't account for what may have transpired in the mailroom at my job. The reps I spoke to today simply were n't willing to make any effort at remedying this situation. I do n't have the funds to pay at this time which is why I asked for help.

Complaint: XXXX XXXX, 2016 Dear XXXX dba XXXX XXXX, This letter is a formal demand for {$1000.00} in Statutory Damages and is an action for violations under the Fair Debt Collection Practices Act, hereinafter " FDCPA '', 15 U.S.C. 1692a, et. seq. and for {$500.00} per violation under the Telephone Consumer Protection Act 47 U.S.C. 227a et. seq. hereinafter " TCPA '', 47 U.S.C. 227a et. seq. I have received your letter dated XXXX XXXX, 2016 and post marked XXXX XXXX, 2016. Your letter contains multiple violations of FDCPA, 15 U.S.C. 1692a, et. seq. The following is two paragraphs of text extracted from the letter.
" Your account is seriously delinquent and you have not taken any action to remedy the situation despite all of our attempts to get you to do so. As of the date of this letter, {$520.00} is past due on your account. '' " Thus unless you contact us within two ( 2 ) days from the date of this letter to make firm payment arrangements on your loan, we may be left with no recourse other than to proceed with legal action against you. '' The text of the letter contains a demand for payment of {$520.00}. This was not the amount, which was past due. The following amount {$240.00} and late fees {$36.00} for a total of {$270.00} out of the {$520.00} was past due. This constitutes false, deceptive and or misleading representation in connection with the collection of the debt in violation of 15 U.S.C. 1692e. Additionally, the text stated the Account Balance was {$10000.00}, which included without limitation the principal balance, future unearned interest, and late fees. However, the Account Balance was {$5500.00}. This constitutes false representation of the character, amount, and or legal status of said debt in violation of 15 U.S.C. 1692e ( 2 ).
In regards to the text, which stated " Thus unless you contact us within two ( 2 ) days from the date of this letter to make firm payment arrangements on your loan, we may be left with no recourse other than to proceed with legal action against you. '' Your letter indicates that you have been instructed to take legal action if payment is not received by XXXX XXXX, 2016. Thus, this was a threat to take an action that was not intended to be taken ; therefore, is a violation of 15 U.S.C. 1692 ( e ) 5. Providing consumers 2 days is a clear violation of FDCPA, which provides consumers 30 days to validate and dispute such debt. Therefore, your letter is contradicting and misleading, which is a violation of 15 U.S.C. 1692g.
Additionally, you have engaged in a conduct, which the natural consequence was to harass, oppress, or abuse me in connection with the collection of said debt. Including without limitation, you have caused a telephone to ring, engaged in telephone conversation repeatedly and or continuously with intent to annoy, abuse, or harass me at the called number, which is a violation of 15 U.S.C. 1692d ( 5 ). Therefore, on XXXX XXXX, 2016 a revocation of your rights was received by your office. However, you are continuously violating TCPA 47 U.S.C. 227a et. seq. and FDCPA 15 U.S.C. 1692d ( 5 ).

I feel that they have discriminated against me, for they have no valid reason. Since I had ALWAYS PAID Springleaf they have no justification of denying this small loan of {$2500.00}.
Therefore, they are granted a license by the state and federal government agency to help people in time of need. As you are aware 26 % is no bargain.

Complaint: My loan is for only about {$8500.00} but the statements are confusing. They only show the amount owed after all interest over the life of the loan. For example I borrowed the above but my statement shows {$16000.00} and this also appears on my credit report which hurts my debt ratio. It would be as if my mortgage is {$60000.00} but instead of showing what I borrowed they show the amount on my statement with all 30 years interest in the total but no where does it show the original amount borrowed. Which would make it hard to see if my payment is being applied correctly. It also does n't show my interest rate. I am requesting that my statement reflect the basic info that every other business seems to be able to print on theirs.

Complaint: To Whom It May Concern : My name is XXXX XXXX and I would like file a formal compliant of XXXX and racial discrimination against, Springleaf. I applied for a loan where I was trying to consolidate some debt and because at the time : I advised them of my race and XXXX and I did get the loan amount needed. I had to use my car, XXXX Nissan Sentra, as a form of collateral in order to get a loan of {$2000.00}. I was advised that my payments would be no more than {$180.00} but I have been charged an online charge of {$2.00} each time I have to pay online. I was never advised of this information. I was also never advised completely of the high interest charges and now I 've learned that it will take me three years to pay off the loan.
Springleaf also placed me on some type of program where I would get towing and other services but never provided me the information. It was until I made contact with their corporate office in which that information was given. Their corporate office claims that the factors surrounding my credit worthiness had nothing to do with race or XXXX and yet have not been able to provide me evidence upon request.
Sorry, but I paid for a first-class service, and I expect to receive it. Please contact me within ten days to arrange talks in settling these affairs. In other words, I am seeking that the loan be paid out in full and satisfied. I am also seeking mental anguish and punitive damages.

Complaint: I went in to get a loan from spring leaf financial and the representative went over the benefits and features of the payment protection and life insurance. Quoted me a payment with it automatically added. I then declined to take the " optional insurance product '' She then continued to try to sell me the product even after I had declined and said I was not interested. She insisted that she needed to continue telling me the benefits and features in case I wanted to change my mind. They then told me how my rate was going to increase because I did not take the insurance so it put my loan just under XXXX. I then asked them can we increase the loan to the amount they were going to do with the additional insurance on there to get the lower rate and the woman said no. she said we would only allow that loan amount if you were going to take our additional insurance product otherwise we will not increase your loan to that amount if you are electing now to take it. She also then indicated that because I chose not to take it which would have increased the amount and reduced the rate that I would be subject to the higher interest rate. I tried to speak with the woman to say that this seems very deceptive and she said that it was how they did things and that it was an optional insurance product. To me it does n't seem right that they are willing to increase a loan amount if I buy their insurance but not if I do n't and that they are going to raise my rate if I do n't take it by changing the approved amount. Also they kept pressuring me to take the insurance after I had already indicated I did not want it.
