Complaint: A speed fast mortgage payment was made on XXXX XXXX, 2016 at XXXX XXXX. by phone, confirmation number XXXX, but the payment was not posted until XXXX XXXX, 2016 because the cut off time was XXXX XXXX. Since there was a 49 minute difference I requested by fax and I mailed a letter to Ocwen to adjust the payment postdate to the correct date of XXXX XXXX, 2016 and remove the delinquency from my credit report, but Ocwen is denying my request. I talked to XXXX agents at Ocwen who both confirmed the payments are shown to be made on XXXX XXXX, 2016. The first agent was XXXX agent number XXXX and the second was XXXX XXXX agent number XXXX.

Complaint: Applied for a Home Affordable Modification with Ocwen Loan Servicing , LLC and was approved for a three month trial of {$380.00} a month. I made all payments on time and was sent the documents to sign for approval but upon reading the documents this look like extortion. If I could not make my monthly payments due to a injury at work which caused me to be XXXX and a very significant decrease in my income what would make them give me a modification where I make monthly payments in the amount of {$380.00} for 23 months and have a balloon payment of XXXX which is the beginning principle balance. So, what happened to making the loan affordable for the homeowner to keep their home this is more like pay me some money dummy and I still keep your home. The home was going to auctioned off anywhere between $ XXXX in the year XXXX. I guess it is a good thing I can read. I filed bankruptcy due to this injury and was trying to do the right thing and pay for the property because it belongs to my mother who has been helping me through this process. I would love to keep the home so my mom can return when the time is right but I will not be a fool. I know this company has many complaints and bad reviews at the XXXX and I can see exactly why. I thought they were wrong for telling me not to send in my payments to catch it up when I got out of the hospital but this right here takes the cake. This is not an Affordable Home Modification at all. I also told my agent that I had not received my documents and they still sent documents with the XXXX deadline and it was clearly delivered in XXXX just another dishonest tactic. If payments are being made please tell me what is it being applied to : Somebody Pockets because it is definitely not the loan and at what point did Ocwen try to work with me by only dropping the interest rate and not applying the funds to the loan but applying fees. I see that number 2. was just ignored completely : If my representation in section 1 continue to be true in all material respects and all preconditions to the modification set forth in Section 2 have been met, the Loan Documents will automatically become modified on XXXX/XXXX/XXXX ( the " Modification Effective Date '' ) and al unpaid late charges that remain unpaid will be waived. Because I do n't agree to add all amounts including arrearages, unpaid and deferred interest, fees, escrow advances and other costs. If I could have made payments we would not be at this point. It is called a Home Affordable Modification not Unaffordable Home Modification. Please tell me what average person has XXXX to just give at one time. ( Not many if any ) At, this point I 'm not average because I 'm XXXX and just starting working last year in a position that paid XXXX an hour. So, please tell me how and the world can I pay XXXX in 23 months. I have made three payments in the amount of {$380.00} a month on time and no credit has been applied to my account according to these documents.

Complaint: A former lender of my mortgage transferred the mortgage without releasing the title and is holding up the who process of getting a much lower interest rate. I have contacted them and the only method is to submit a fax to there research department. This is not right all the fees we pay during our mortgage and this is what we get. I could potentially loose my lock because of there mistake. Can I file suit for the difference in interest rates. Ocwen offers little help to fix there mistakes and they should be penalized for this.

Complaint: My loan servicer has repeatedly billed my escrow account for lender placed insurance coverage of their own even though I have repeatedly sent them copies of our Condominium Association Master Policy via fax TO XXXX, and the website they provided for transmittal, ( XXXX, XXXX ) every time they have asked. I have fax transmittal receipts as well as confirmation from XXXX for the policies spanning the past few years. I believe this is just another mortgage servicer scam that they perpetrate upon individuals like me. They claim not to have received the required evidence and benefit from the placement of their own coverage through premium commissions or their own company-owned policies. Their premium charged to my escrow account is approximately {$620.00} for each year they have added the coverage in spite of being faxed or uploaded copies. If you multiply that amount times the thousands of mortgages they service and can proliferate the same scam upon those homeowners, it boggles the mind -- especially given that they do this year after year.

Complaint: In XXXX of 2006 I contacted my mortgage company which at the time was XXXX XXXX and ask if my mortgage could be changed from the XXXX to the XXXX. I was told that in order to do that I would have to refinance the mortgage or pay an early payment. I paid the early payment XXXX XXXX of 2006. However the XXXX XXXX payment which was made from my bank, according to XXXX XXXX was not received. The early payment that I made in XXXX on the XXXX was considered by XXXX XXXX to be my XXXX payment and was considered to be late. I have documentation from my bank and from the electronic fund transfer company stating that the mortgage payment in XXXX was deducted from my account and sent to XXXX XXXX. This payment was sent back to my bank but my bank sent it back to XXXX XXXX within 2 weeks and XXXX XXXX received the payment. Though they received the payment XXXX XXXX never documented the payment as being processed so my mortgage continued to appeared to be late. A letter as well as documentation showing that the mortgage was deducted from my bank account and received by XXXX XXXX was sent to Ocwen explaining everything that had happened. Ocwen refused to converse with me so I had a lawyer contact them. My lawyer stated that she was never able to speak with anyone in their law department in attempt to correct this mistake. She felt that my only recourse was to sue them. I am currently in the process of attempting to refinance my mortgage at a lower rate but Ocwen is giving a pay off amount that includes {$6200.00} in late fees which I do not owe. This entire fiasco has affected my credit score and is now going to cause me to lose my locked in rate.

Complaint: We are a XXXX who completed hail damage repairs on a property in XXXX XXXX, WY. The original estimate was {$23000.00}. There was an insurance supplement of {$8300.00} and an additional supplement of {$260.00} bringing the total repair to {$32000.00}. The homeowner has a deductible of $ {$1600.00} so what the insurance company, XXXX XXXX XXXX, paid was {$30000.00}. These funds were sent to Ocwen Loan Serviing, LLC. The claim was made to the insurance company in XXXX of XXXX. Ocwen Loan servicing sent the initial payment of {$20000.00} in XXXX, XXXX with a balance of {$9700.00}. On XXXX/XXXX/XXXX the final bill for the work was submitted to the insurance company for payment and the final inspection was completed on XXXX/XXXX/XXXX. I have been trying since then to get payment from Ocwen Loan Servicing. I have faxed and emailed the same paperwork to them several times and have documented all faxes, emails and phone calls to Ocwen and would like to provide you with this documentation. It has finally come down to the fact that they verified they received the initial check from the insurance co of {$20000.00} in XXXX, {$260.00} on XXXX/XXXX/XXXX, {$8300.00} on XXXX and {$1100.00} on XXXX. They stated to me on XXXX that a payment of {$1400.00} was to be mailed out that day, I asked why that amount and they stated that was all they were holding. I called back and spoke to another representative that day and she verified that they had received the {$8300.00} but the funds were missing. She called the ins. co. and verified that the check had cleared their account so she put a search on that check. on XXXX/XXXX/XXXX I was told the missing funds had been found. a request was put in to expedite release of the funds. I called again today but they could not give me any information on it or when the funds would be released and suggested I call again on XXXX. Because I have been trying for 2 months to get my payment, my concern is that I am not the only person fighting with this company for payment. I feel this company needs to be looked into as their business practices are awful. There may be a miracle and I will receive payment but I have run out of hope of that happening, that is why I am reaching out to you. I am hoping there is a place where I can attach my documentation to this complaint so that you can see what I have been going through.

Complaint: I am currently in the Deed-in-Lieu process with Ocwen. My hardship paperwork has been in their possession for a full 9 months ( since XX/XX/2016 ). The process has been incredibly slow but now we are absolutely stuck because they can not find the assignment of mortgage. Without the assignment of mortgage, they can not complete the deed-in-lieu documents. And without the assignment of mortgage, it 's unlikely I can move the property out of my possession through a short sale either so I 'm stuck with very few alternatives.

Complaint: I 'm requesting a mortgage modification to my existing XXXX mortgages. I just moved out to California for a job. A few months later the entire department was outsourced. As a result, my income is not what was anticipated. I have good credit. I have no wish to miss payments and a modification is appropriate. Moreover, after being XXXX military ( XXXX ) XX/XX/2011, I attempted several times to modify my loans for XXXX XXXX XXXX XXXX XXXX ( XXXX to OCWEN to XXXX ) and XXXX XXXX XXXX # XXXX XXXX, ( XXXX to XXXX ) but was repeatedly denied this opportunity. Finally, this loan companies in question ( all ) continuously misplaced information on the condo HOA and the HOA 's insurance, and demanded updates of the same information every year despite the fact that the information never changed. Worse, the only notice they provided for said demand invariably took the form of a fine or penalty as a result of not providing the same information - provided every year for the last several years already - yet again. Despite the fact that they did n't request it, the HOA has not changed, and it appears to all that they were merely acting ignorant ( as if they have n't repeatedly received the same information the pretend not to have every year ) as a pretext for imposing fines and redundant insurance policies. I think this is wrong and I again renew my requests. Thank you, XXXX XXXX XXXX

Complaint: In XX/XX/2010 my mortgage owned by Litton was sold to OCWEN. OCWEN immediatly served me with foreclosue process, even though I was keeping up with my payments with Litton. I spent 9 frustrating and expensive months ( paying legal fees ) to obtain a loan modification. I tried to send payments in during the 9 month period but OCWEN would reject them. As each month passed I never knew whether me and my young daughter would have a roof over our head the next day. When my loan modification was finally obtained, OCWEN promised that if I made my payments on time for 3 years that they would forgive the fees and penalties they had accessed me during the foreclosure process. I kept my payments on time for the past 5 years and now am getting ready to sell my home only to discover in Escrow documents that OCWEN is charging me an additional {$70000.00} in addition to my mortgage payoff amount. They are calling them " shared appreciation ''.

Complaint: THIS IS NOT A DUPLICATE COMPLAINT This is a new complaint written on XX/XX/2017 addressing Ocwen Loan Servicing 's illegal attempt to sell my home scheduled for XX/XX/2017. For the fourth time, Ocwen Loan Servicing is attempting to illegally sell MY home. I have had to file previous complaints to address the previous three illegal sale attempts of this entity. Once again, Ocwen Loan Servicing is in gross and blatant violation of CFPB regulations, federal and state law, and a consent judgment governing their behavior. What is it going to take to stop the illegal behavior of this entity? We have been struggling to have our mortgage modified with Ocwen Loan Servicing for a number of years now. We have always qualified easily for a modification, but this company has done everything they can do to avoid modifying the mortgage. They have instead continually attempted to foreclose on us illegally, in clear violation of CFPB regulations. Because of a consent judgment against Ocwen Loan Servicing, this company is required to follow a very specific modification process and they are required to modify the mortgage. Ocwen Loan Servicing is completely out of control and we desperately need protection against their endless unlawful attacks. It is likely that the activities of this company are negatively affecting many Americans. Specifically, through their haphazard implementation of a fictitious modification process, Ocwen has continually disregarded numerous provisions of the Home Affordable Modification Program ( HAMP ) enacted under the Troubled Asset Relief Program ( TARP provision of the Emergency Economic Stabilization Act of 2008, Pub.L. No. 110- 343 ; 122 Stat. 3765 ; 12 U.S. C. 5201, 5211-5241 ; 5219 ( a ) ), Regulation X, 12 C.F.R. 1024.41 ( g ) and ( j ), Regulation X 1024.35 ( b ) ( 10 ) and other laws over and over again. In addition to the modification problems, they have also been dual-tracking me by continually attempting to foreclose on me while I have been in the active modification process the whole time. We clearly and easily qualify for a modification, and these people know that. Blatantly attempting to foreclose on and steal the home of someone who clearly qualifies for a mandatory modification is a grossly criminal act. This complaint should be referred to the appropriate authorities for criminal prosecution.

Complaint: Due to a loss of income i have reached out several times to HSBC to reduce my mortgage rate. all they have been doing is extending the term which is putting me in more and more death. i can not understand why as a consumer trying to do the right thing and not fall behind on my mortgage they are not able to assist me. All i want is a permanent fixed low interest rate. I have even hired lawyers spend money, and all lawyers tell me is that its difficult with HSBC you have to fall behind for them to reduce your rate. My credit is already not good, i have credit deaths so why would i want to increase that i also have a kid that i have to show some sort of example for. Why when im trying to do the right thing and not fall behind i am unable to get the necessary to have a roof over my daughter head. I am sure im not the only consumer having this issue.

Complaint: I have been working with Ocwen, my 1st mortgage for a very long time to process a short sale. I have submitted various offers for review and after months and months of having them take their time to review the offers, request several appointments to come into the home to valuate the property, they now refuse to proceed with approving the offer they currently have for a short sale. They have given plenty of excuses as to why they will not work with me today to avoid foreclosure but not once over these last several months have they tried to help me with being able to sell my house. After all of the hoops I jumped through to accommodate them. Today they note that the reason they will not work with me is the current sale date- but they have postponed my sale several times in the past and for some reason today are refusing to work with me and postpone this one sale that will give me enough time to finally get an offer approved at the amount they seek. I have been battling Ocwen for years regarding this home and now that I have spent a lot of time trying to do the right thing they want to ruin my life by foreclosing. All of my efforts have been made to avoid having foreclosure occur, foreclosure will hurt me financially for at least 7 years.
