Complaint: I previously owned property which carried two mortgages. The property went into foreclosure and was sold. OCWEN was the holder of the second mortgage. OCWEN is showing a " charge off status '' on the property, which is reflected on my credit, continuing to severely damage my credit. OCWEN has advised that they require a copy of the " Trustee 's Deed Upon Sale dated XX/XX/XXXX '' and that OCWEN never received one. My Attorney has forwarded the document to OCWEN multiple times, beginning on XX/XX/XXXX, but OCWEN has not acknowledged receipt nor advised my Attorney or me, that the " charge off status '' on my credit report has been removed and my credit amended to reflect the XX/XX/XXXX date.

Complaint: I am currently in Chapter XXXX bankruptcy. I have been making payments to the trustee 's office for my mortgage payments since XX/XX/XXXX. However, Ocwen servicing loan ( Mortgage lender ) never filed a proof of claim. I had to incur an additional expense to pay bankruptcy lawyer to file proof of claim on my behalf. I am attempting to get my XXXX Tax Forms and was told I wo n't be receiving one because the there were no payments made XX/XX/XXXX. The trustee was holding onto the money to allow Ocwen time to file claim. My attorney file claim on my behalf after an additional fee on XX/XX/XXXX. Payment of {$16000.00} + was made to Ocwen however, they state they did not receive payment until XX/XX/XXXX and therefore I will not receive a XXXX for XX/XX/XXXX. Did I mention Ocwen file a {$400.00} claim, which is to be paid through my bankruptcy plan as fees they are recouping/charging to " review '' my bankruptcy plan which in turns increases my bankruptcy payment amount?, Ocwen Rep who answered the phone apologized and I am receiving nothing in return for their mistake for not filing claim in a timely manner as well as no taxes. Only an apology.

Complaint: My borrower, OCWEN Loan Servicing LLC has repeatedly caused me problems with disbursement of funds from an insurance claim check that I was given for repairs that I have paid for as a result of Hurricane XXXX in XXXX 2016. The XXXX insurance company paid my flood insurance claim within weeks of the loss and as per policy, the {$22000.00} check was written out to me, my wife and the mortgage companies ( OCWEN and XXXX XXXX XXXX ). XXXX XXXX XXXX had an authorized representative in their office endorse the check the day I received it in XXXX. In that time, I had paid a contractor to perform all of the repairs, and had receipts that they were paid in full.
Numerous times I have called their toll free number and was given different requirements from OCWEN representatives ranging from " All you need to do is send the check and we will endorse it '' to a litany of different requirements. When I sent the check in XXXX, it was sent back, unsigned with a letter attached with a list of requirements as if I was waiting to have access to the funds in order to start the repairs. No phone call to clarify why then sent it back unsigned. In the interim, we were given piecemeal different requirements in order to get access to the funds such as copies of receipts, a XXXX form for the contractors, an affidavit which shows that the contractor could not put a lein on the house, among others ( why this was not specified prior, seems to be unknown ). Finally, once they have all of these documents, they ask for us to endorse the check and send it to them. While unsure of why, this process was not going to proceed without it, we reluctantly signed and sent if off again.
The next issue that we came upon is that they did not accept the Adjuster 's worksheet which The XXXX hired to document to damage. They said it was invalid since the adjuster did not work for The XXXX. This caused us to contact the insurance agent and The XXXX for a letter stating that they hired the adjuster for this claim.
They stated that they needed to send an inspector to verify that the work was complete. An inspector came and spent not one minute to verify that the repairs were completed. Another week went by and they claimed that they had received the inspection and that they were sending us the funds. The check arrived today and it was written out to us and the contractor, so we have to go to the contractor to get them to sign it before we can have access to the funds.
It is unbelievable that this could not be resolved any easier. Should I have not had the resources to pay for the repairs, I would still be waiting for the work to start and be without heat in the house.

An alarming issue should be brought to your attention at once. Ocwen was ordered to provide XXXX in relief to homeowners upon investigation by the Consumer Financial Protection Bureau for a host of complaints, including robo-signing affidavits and other documents.
Attached is an affidavit sent from Ocwen to me the " borrower '' that Ocwen robo-signed ( page XXXX ) my birthdate, incorrectly of course, ( it is Ocwen ) followed by Ocwen representatives informing me by phone on multiple occasions that it was instead " I '' who submitted a affidavit with the incorrect birthdate!? Thereby once again, as they have done since XX/XX/XXXX, deny me the opportunity to secure a home modification at market value and remove the debt, interest and penalty associated with this loan. Once again, this affidavit is robosigned ( page XXXX in which my social security number and XXXX incorrect birthdate ( s ) are robosigned! ) This document was sent from Ocwen to me on XX/XX/XXXX.

Complaint: Ocwen Loan Serving XXXX I first reinstated my loan with this company by paying a reinstatement payment, while filing bankruptcy, was making agreed payments each month, became XXXX, XXXX thing lead to another, but I paid the reinstatement before any finalization of the bankruptcy, in XX/XX/2016 I paid Ocwen in full and have the letter as proof XXXX, XXXX + but they refuse to report that I paid this house off to the credit bureau 's and the XXXX credit bureau 's are not helping me even after sending in the copies of all paperwork and receipts of paying this house off. I feel as if I am being mistreated unfairly and not given my correct credit scores and ratings because of this, I did the right thing by trying to correct my mistake of my financial mistake, but by doing so I am getting the bad end if they can not report the correct information and say they got there monies for this property I would like my monies back so I can go purchase a home for me and my child. or I will take legal action.

Complaint: Ocwen Loan Servicing outside California attorney " XXXX XXXX '' made threats that if I did n't respond to his clients {$750000.00} none negotiable loan modification offer in less then 2 days his client would proceed with the fraudulent trustee sale that was taking place in just a couple of days. Attached is email communication. In addition, I have email communication of California attorney " XXXX XXXX '' harassing me, accusing me of never mailing off the down payment, he also accused me of never putting the pretender lender loan servicers loan number on the cashiers check. If CFPB would like a copy of that email communication just let me know. Also, I have telephone communication voice recording proving Ocwen Loan Servicing representatives enjoyed harassing me, placing my call on hold for hours then forwarding my calls to a credit card advertisement company. Complaint: /Ocwen is in violation of the XXXX guidelines. On XXXX/XXXX/XXXX I submitted an initial package requesting mortgage assistance including XXXX, tax returns, paystubs, rental leases, bank statements, hardship letter, XXXX, XXXX letter and utility bill.I received a letter from Ocwen dated XXXX/XXXX/XXXX acknowledging receipt of my request for assistance. On Tues. XXXX/XXXX/XXXX I spoke with XXXX id # XXXX at Ocwen and was informed that the file was complete, no documents were needed and file was in review. At that time I scheduled a telephone appointment with the single point of contact, XXXX XXXX, for Tues. XXXX/XXXX/XXXX at XXXX XXXX. She never called.On Mon. XXXX/XXXX/XXXX I spoke with XXXX id # XXXX and was told that I had been denied assistance on XXXX/XXXX/XXXX. I was told I was denied for HAMP Tier XXXX and Tier XXXX because Ocwen said that they did not receive the initial package before the deadline of XXXX/XXXX/XXXX which is a blatant lie as evidenced by the XXXX/XXXX/XXXX acknowledgement letter! Futhermore, the denial letter said I was denied an in house modification because " the financial information I provided indicated that I have the ability to pay using my income. " My gross monthly income, as verified by Ocwen, is {$3400.00}. My current XXXX payment is {$2300.00} which represents a front end debt to income ratio of 70 % which is the text book definition of immiment default!

Complaint: Ocwen Loan Servicing falsely reported to the credit bureaus that I had overdue/delinquent amount of mortgage with them and that my account is 120 days passed due. They indicated that the account was opened with them on XXXX/XXXX/2004. I never had a mortgage with Ocwen Loan. I do n't even know where they came from.

By the XXXX Those of us the foreclosure defense industry do n't experience much laughter. For hours each day we try to provide guidance to people who have been victimized by their servicer, attorney and/or the courts. Often, by the time they come to us, the homeowner is in emergency-mode.
Yesterday, we did have a good laugh. While doing some preliminary research on a " corrective '' Assignment of Deed of Trust, we did a little background on an employee at Ocwen who had signed the assignment. We discovered a profile for the document signer XXXX on the Linked-in website.
It appears that XXXX has been a Servicing Operations Specialist at Ocwen since XX/XX/XXXX. Located in XXXX, XXXX was looking for an, " entry level position that offers internal growth potential '' and requires that she, " be able to be a leader as well as follow instructions. '' It looks like she may have landed her dream job as a XXXX at Ocwen Loan Servicing. There is no doubt that she has job security in the burgeoning field of document fabrication, or that she can follow instructions by signing deceptive documents by the thousands.
According to her profile on Linked-in, XXXX says her current duties include, " Researching Mortgage Documents to verify a full Chain of Title is present. If it is not create the needed Documents ( sic ). Work from Excel Spread Sheet daily as well as several internal data programs. '' Is XXXX admitting on a public website that Ocwen Loan Servicing creates documents to create a " proper Chain of Title '' if there are errors?
It is fraudulent to recreate a chain of assignment with fabricated documents to create the appearance the current servicer has standing. As XXXX has repeatedly pointed out- copies of the note and assignment do n't document an actual transaction ( sale, transfer ) - they are nothing but window dressing to create the illusion an event occurred. Homeowners and their attorneys MUST obtain proof that a transaction actually occurred- not simply rely on documents that paint a story the service hopes to tell.
XXXX began her job at Ocwen during XXXX XXXX as a XXXX where she " helped '' homeowners with service issues. She is likely well versed in Ocwen 's documented practice of providing disinformation to ensure a default. Ocwen was recently forced to pony up {$30.00} million to resolve lawsuits that claimed it did n't properly include disclosures for loans it was servicing.
XXXX operates a side business called XXXX XXXX XXXX so she may have an eye for detail. Her background at XXXX XXXX through XXXX XXXX, opening boxes at a Target distribution warehouse and assembling bathroom cabinetry likely provided excellent preparation for her current duties analyzing complex securitizations, real estate documentation and verifying they are accurate.
In this case, the Deed of Trust XXXX XXXX XXXX signed is a complete sham and is referred to as a " corrective assignment '' in an attempt to perfect two incorrect assignments filed 3 and 5 years before. The document in question lists a bankrupt XXXX assigning the Note to XXXX. XXXX notarized signature witnesses a complete fictitious transaction.
Unfortunately for the homeowner who is a XXXX and the victim of these sham documents filed in the county records by Ocwen, he may become homeless unless he is able to find an attorney to stop this fraudulent foreclosure from proceeding. Complaint: My ex-husband, XXXX submitted a fraudulent loan modification with OCWEN Loan Servicing , LLC . on the property that I am co-borrower. The XXXX signatures on the paperwork are forged, I never signed or agreed to a modification. ( I was actually out of the State on the date that the papers were signed ). Per our divorce decree he is required to refinance the property to remove me ( not remodify ). XXXX knowingly submitted the modification with intent to defraud OCWEN ; however, OCWEN is allowing him to do so because they benefit from the fraudulent modification. The property went into default and OCWEN offered my ex husband a modification. There was never any type of hardship, and he should not have been offered a modification ; his income was {$150000.00} in XX/XX/XXXX and his overtime alone was {$35000.00} enough to have covered the {$26000.00} of late payments. OCWEN is allowing fraudulent servicing practices. I have tried several attempts to contact OCWEN to discuss this but each time I called they said that they were protecting their customer and could not discuss the loan with me ( my ex husband was allowed to remove my name as an authorized contact on a loan that I am co-borrower on ). I received a letter today ( XX/XX/XXXX ) stating that after their review they are doing nothing, stating the signatures are " consistent '' against other signatures. THE SIGNATURES ARE FORGED, OCWEN is doing nothing! I filed a police report in XX/XX/XXXX with the XXXX Department ( XXXX ) and it is currently with the District Attorney 's Office.

Complaint: For the third year in a row Ocwen has sent an incorrect form XXXX for my taxes. This requires submitting an amended return, once they realize their mistake - which costs me money. This year I am holding off on filing my taxes even though I could use my refund. The XXXX I got this year says I paid XXXX in mortgage interest. I do not get statements from them but my principle and interest this past year was XXXX a month for a total of XXXX. When I contacted them in 2015 about the incorrect initial XXXX and having to file an amended return they apologized for the inconvenience. Normally mortgage principle and interest are straightforward calculations easily done by any computer. I do think that their financial abilities should be looked into I find it hard to believe that my account is the only XXXX they manage to miscalculate.

Complaint: I have owned and lived in my house for 44 years and never had a problem making the mortgage payment. However, a few years ago my loan got sold to Ocwen Loan Servicing. they randomly sent out an inspector to my home in 2014 and he claimed that I had to redo my roof. Ocwen used this to try and justify cancelling out my insurance and forced me to use their insurance company, which cost way more. I could barely afford my payments when they did that, and in that same time period my wife had to have XXXX. I had a large co-pay and was not able to keep up and fell behind on the mortgage. Now Ocwen is dragging their feet and refusing to negotiate with me and pushing me into foreclosure.
I tried on many occasions to make some progress with Ocwen to try and get them to remove their force placed insurance so I could get back to my more affordable policy but made no progress. I also tried to get Ocwen to work with me to restructure or modify my mortgage loan, but feel that I have run into a brick wall. I ended up hiring a third party to assist me with Ocwen, but after a year of providing documents over and over it feels like no progress has been made. I am semi -retired but still do electrical estimating work and my wife is receiving XXXX, so we have the means to make a fair mortgage payment. Our issue is that our mortgage company Ocwen created a problem when one did not exist and put their greed and profits ahead of the people who live in the homes they financed. My father built this home and I have lived here over 40 years. I never thought it would come to this. I just want to get back to making regular mortgage payments and put this behind me but have been unable to do so because of Ocwen 's failure to communicate and negotiate fairly.
