Complaint: Borrower XXXX purchased her home at XXXX, LA in XX/XX/XXXX for {$39000.00}. To purchase the home, she took out a FHA Loan at 8 % interest. Her monthly principal and interest payments were {$280.00}. For the duration of the loan, she has paid taxes and insurance out of pocket. In XX/XX/XXXX, XXXX lost her job and was placed on a 3 year workout program by HUD. During this time, her monthly payments were reduced to {$79.00}. She continued paying principal and interest out of pocket during this time. She was verbally informed that the {$8000.00} in interest she accrued during this time frame would be forgiven upon the maturity date of her mortgage. After she began making payments towards her mortgage once again in XX/XX/XXXX, XXXX remained current on her loan until this date, aside from two months after Hurricane XXXX in XX/XX/XXXX, which she promptly repaid. As her loan was approaching its maturity date in XX/XX/XXXX, she was made aware that there was still an outstanding principal balance of {$15000.00}, plus an interest arrearage of {$8100.00}, and additional fees for a total payoff amount of {$23000.00}. It is unclear why there is such a large remaining principal balance when the borrower 's loan was fully amortizing, and it appears that the servicer has failed to forgive the interest arrearage as agreed to at the time of the workout option in XX/XX/XXXX-XX/XX/XXXX. The outstanding principal balance on the loan does not appear to be accurate.

Complaint: I currently have a mortgage with Ocwen Financial, back in XXXX I requested a modification, I received the packet sent filled everything in and sent it back to them, they said they received everything by XXXX XXXX, after being told they had a complete packet, weeks later I received a request for additional information, this happened over and over again, each time I would send in the information I would call to be sure they had everything, and each time a week or 10 days later I would get an additional request via snail mail, I would promptly send in whatever was requested, the final hold up was they wanted my sisters financial info even though none of them are on the loan or have anything to do with the loan, however they do live with me. During this process I was told since I had my original packet in before XX/XX/2017, received complete on XX/XX/2017, that I had 90 days from that date to get in any other requested information, I was also told not to get behind on my payments otherwise I would not be considered for a modification. Yet I recently received a letter from Ocwen saying they will not review my request for a modification since I was not behind on my payments and they did not have everything they had requested before XXXX XXXX. I sent in everything they asked for usually the same night, just to make sure they would have it, I sent it email, fax and overnight mail, because some times they would say things were illegible, even though I would send them to multiple devices and not once had a problem. I started this process after learning about the 2.2 billion dollar settlement Ocwen made with the bureau to correct some of the wrongs they were responsible for in this country 's meltdown. I want to keep my house and keep making payments, but being a carpenter I was greatly affected by downturn starting in 2008 caused in large part by companies like Ocwen. I do n't want anything I 'm not entitled to, but I would like fairness and truthfulness especially from my mortgage company, especially when that company has an obligation to fulfill to the tune of 2.2 Billion dollars, for fraudulent practices. I did not choose Ocwen, I had started with another scheming mortgagor Indy Mac, but now that I 'm with Ocwen I am doing all I can to keep up my end of the bargain paying my mortgage each month and I wish they would do the same, I followed the rules to the best of my abilities to get my paperwork in on time, while they did everything in their power to slow it down, it 's disgraceful when such a large company is allowed to treat their customers this way. I just wanted to be considered for a government backed program to help us thru this tough time, and they wo n't even look at my case, why did they keep requesting items if the deal was off XXXX XXXX. What good is a settlement of 2.2 Billion dollars if no one makes sure they follow thru and help their clients.

Complaint: I had a loan from INDYMAC BANK, and have been paying on time since then. In XXXX, Ocwen Loan Services , LLC took over as my loan service ( r ). I was XXXX around this time, and once Ocwen took over, they 've been sending letters stating if I dont provide payment or payment receipt they will foreclose. I send them supporting documents, then they send me another letter stating that some other payments are " missing ''. I fax them those thinking ill be done and everything will be fine. Its been 4 years, I send them proof of payment, they come up with other random days they want proof of payment for. Fast Forward to today, OCWEN stopped accepting my mortgage payment as of XXXX XXXX stating that they cant accept partial payment when I " owe '' for months that I have proof of payment, and if i dont come up with those payments they will foreclose on my home. I am FIGHTING XXXX and FIGHTING OCWEN, im old, im tired, im ILL. Every time I send them three or four payment receipts, they send me a letter stating they received the proof of payments however there are more that are missing. We 've been doing this since XXXX, and its gotten more and more frequent the past year, im speaking to them every 3 weeks now trying to resolve this matter, but every time they get my proof of payments, they come up with other random days they need. As of right now, OCWEN is asking for payment receipts from XXXX, mind you, OCWEN came in the picture in XXXX. They keep playing these games with me and are threatening to Foreclose on my home.

Attached is email evidence of Ocwen Loan Servicing robo-lawyer " XXXX '' denying me the right to discuss Ocwen fraud crimes against me before a congressional hearing. Complaint: I am going thru a loan modified with ocwen, their attorneys and " commissioner '' are harrasing me with 12 letters and certified letters demanding access to my property to access for immediate auction. I have called ocwen, now for the second to clarify the auction threat. At this time ocwen confirms they received my package on XX/XX/XXXX, but have not reviewed as of yet, so they have no scheduled sale. This the second time the ocwen attorneys have made this bogus threat. I had to schedule a meeting with someone otherthanmy case manager to get an update. My case manager available on XX/XX/XXXX but have meeting XX/XX/XXXX @ XXXX. due to judicial malfesience affecting a lien on this property, filed by myself, I think both sets of attorneys are ganging up, illegally pushing for this foreclosure to go thru. In hopes I will be unaware of my rite, and will surrender. I left an extended message with the ocwenz attorneys " commissioner '' and have not gotten any response back, his threat of accessing my property is for the XX/XX/XXXX. As with the 1st time, I was not informed INA timely fashion as well as being told, not asked to property access.

Complaint: I am SO grateful and thankful to the CFPB for your investigation of Ocwen. I have submitted a FOIA request asking for verification of Ocwen 's fulfillment of the XXXX payment requirements of the US District Court consent judgement. My complaint ; what about the additional Ocwen victims not covered in the US District Court Consent Judgement who were forced into unnecessary forced bankruptcies to avoid unsubstantiated foreclosure by Ocwen. Forced to spend money on attorney and bankruptcy fees, unsubstantiated costs while in bankruptcy and the consequences of a bankruptcy on one 's record. These victims have not been abetted. I think that if I started a blog requesting victims respond I am of the opinion numerous victims would respond. When forced to file my unnecessary bankruptcy the bankruptcy judge asked me " why are you filing bankruptcy with only 1 creditor ( Ocwen ) and all this money in the bank. '' I told her Ocwen refused to communicate with me even though I tried calling, emailing, mailing to no avail and that it was a culmination of a 20-year battle with Ocwen trying to steal my home. I can tell you if it was not for the CFPB and the Texas Attorney General 's office soliciting a response to my complaint about Ocwen while in bankruptcy, Ocwen would not have followed the provisions of my bankruptcy. They had already operated in the bankruptcy contrary to Consent Judgement Settlement Term Sheet, Paragraph 1 Foreclosure and Bankruptcy Information and Documentation and sent me numerous letters referencing actions and making demands that were contrary to the requirements of the bankruptcy. My complaint, once again what about the victims forced into unnecessary bankruptcies?

Complaint: Ocwen Loan Servicing lied to a Federal court and indicated to them that they were my Lender and held first position as Lien Holder. Evidence showed that Ocwen was not my Lender but XXXX and Ocwen had submitted a Fraudulent Title search using their own personal Title company to do the Title search, submitted the Fraudulent Title work to XXXX, Director of FHA . They then sold their Servicer Contract to XXXX, another Servicer, a couple of months or so ago when it was discovered that they had submitted a Fraudulent Title to the Director of FHA, XXXX who indicated to them not to pursue a Foreclosure on my Property because FHA had an invalid Lien on my Property.. It has been found that both Servicers pursued Fraudulent Practices in underwriting, processing, closing and Mortgage Fraud. Both Servicers showed that they escalated the amount of payment $XXXX 0f money fraudulently and statements is evidenced. Hence, I am asking that the License be suspended and Revoke of Ocwen Loan Servicing and XXXX and their Records all be Audit. My phine number is XXXX

Complaint: In XX/XX/XXXX I made my mortgage and escrow payment to Ocwen Loan Servicing , LLC in the full amount of the previous ( XXXX ) months, which was received on time. The mortgage has a variable interest rate, which happened to change that month, increasing the total payment amount to {$1700.00}. Therefore, my payment was short by {$56.00}. Once I became aware of this oversight, I IMMEDIATELY made payment for the balance, which the bank says was received on XX/XX/2017 ( two days beyond the 30 day late period limit ). The bank has reported this to the credit agencies as a MISSED PAYMENT, ( 30 ) days late. The payment was NOT MISSED or late, the bank held it in their suspense account rather than any number of other options over a {$56.00} shortage that was immediately resolved. This is not factually the same as a missed payment.

Complaint: I was involved in a settlement case in which I shared with thousands of affected borrowers against Ocwen, the mortgage provider whom foreclosed on my home illegally. Ocwen was charged with engaging in unfair and deceptive acts and practices in violation of the federal Consumer Financial Protection Act. Lenders and their loan servicing operations were accused of misconduct in determining whether foreclosures were warranted for thousands of high-risk " subprime '' borrowers who were having trouble keeping up with payments. Among other things, they were accused of misleading customers about the foreclosure process and alternatives to avoid losing their homes, and charging unauthorized fees. This illegal foreclosure has resulted in financial injury resulting in my being denied credit and obtaining another mortgage loan, due to the nature of the illegal reporting of the foreclosure on my credit file. I am requesting that this account be permanently removed from my credit file with immediate effect.

Complaint: I recently was approved for an in-house modification with Ocwen. I submitted the first payment which was due on XX/XX/XXXX. However, I went to make the second payment, which was due on XX/XX/XXXX and see that everything has reverted back to the foreclosure/default status and my payment due is XX/XX/XXXX and they will not accept payments from me. The agreement and paperwork clearly states that payments must be made " within the month in which it is due or modification will be cancelled. '' XX/XX/XXXX is clearly within the month. However, I see that the status stating " your loan has been permanently modified '' has been changed to " you may be eligible for a permanent loan modification. '' I would like to modify the loan and stay in the home but can not go many more rounds with Ocwen.

'' It further states that, " ... ... which puts you in default of your loan agreement and the property may be referred to foreclosure after 14 days from the date of this letter. '' Account holder, XXXX, affirms the following : 1. I am not in receipt of the claimed " recently sent '' Notice of Default as of this date. a. I have spoken to XXXX, Agent ID XXXX, on this date, Sunday, XX/XX/2017, starting at XXXX EST to your XXXX customer service number and he advised of the following : i. The referenced Notice of Default has never been sent by OCWEN, thus the reason for my having not received it. ii. He has sent a request to the Research Department to find out as to why the referenced Notice of Default has never been sent, yet, it is referenced in the Pre-Foreclosure Referral Letter. To-date, OCWEN has not responded to my request to produce the claimed letter. iii. The recording of the call can be traced to this date between XXXX and the end of the call at XXXX. 2. The letter states a 14-day clock reference as to possible foreclosure action, however, OCWEN 's acknowledged misrepresentation of the existence of a Notice of Default that was never sent to the consumer, makes their threat moot and in direct violation of the terms of the mortgage and applicable governing laws. Servicing of my mortgage is totally out of control with numerous misfires, misrepresentations and fabrications, in addition to OCWEN 's silence on the topic. I am most receptive to an amicable resolution in light of the fact of the many OCWEN missteps it continues to do and that can have significant consequences on my person, family and our home. For an organization to make a representation of the existence and submission of an important document such as a Notice of Default, when in fact it acknowledges and confirms it can not produce the document or any evidence of its existence is unethical and unacceptable.
