Closing on a mortgage

Mortgage: Conventional home mortgage

Complaint: I refinanced with XXXX XXXX on XX/XX/XXXX, funds received by PHH mortgage on XX/XX/XXXX and reconciled on XX/XX/XXXX. On XX/XX/XXXX I notice PHH continued to bill me for 2 months mortgage payments and reported to my credit that I Was now 60days delinquent. I called several times to PHH and continue to be put on hold with no one ever coming back. I was told by PHH that the funds had been returned to XXXX because it was short of the payoff they sent. I have all documents and the pay off was accurate yet PHH continued to bill me. All of a sudden I am now being told the funds have been returned to XXXX XXXX on XX/XX/XXXX. PHH held the funds for 6 weeks before returning them to XXXX XXXX. I am currently in a battle when all I wanted to do was a simple refinance and reduce my debt to increase my credit. At this point they have destroyed my credit and I cant understand how PHH could hold these funds for 6 weeks and not communicate with any of the parties involved for 6 weeks and continue to charge me daily interest.

Complaint: Insurance check for hail damage included phh mortgage as payee. Check was sent to phh with the understanding that they would release funds to me and the contractor upon completion as verified by their inspector. I called for an inspection on XX/XX/XXXX and was told that the inspector will call me. The first time I called to ask why no one had called, i was told that the inspection company has 7 business days to respond and it had only been 6. Each time I called after that I was told that another inspection request had been sent. The people who answer the phones in the " Loss Draft '' department say they have no control over the inspectors they hire and can not give me information to allow me to follow up with them. It has been over three weeks since I asked for an inspection. It appears that phh is intentionally delaying the inspection so that they can have the use of my insurance money as long as possible. My contractor has the legal right to a late fee from me and phh would certainly assess a penalty if I was late on a payment to them. So I believe a fair resolution would include a late payment penalty comparable to what they would expect from me if I was a month late on a balloon payment of over {$42000.00}.

Trouble during payment process

Mortgage: FHA mortgage

Complaint: My loan transferred from Ocwen Servicing on XX/XX/XXXX to PHH Mortgage Servicing. At the time I agreed to a loan modification with Ocwen and made the 1st of three trial payments. The remaining two payments were collected by PHH. I tried on several occasions to pay online and was not able to do so, I was told it was due to not having all of the data file transferred. My payments were taken over the phone by an agent for XXXX and XXXX. I have not received any communication from PHH since I made the last trial payment on XX/XX/XXXX. I have called and checked online, even sent messages and have been told that the modification department is still working on my request. In the meantime I received two collection calls but both representatives I spoke to reiterated the thing as before, no further information. I called today XX/XX/XXXX to follow up on a complaint I made on XX/XX/XXXX regarding improper reporting on my credit. I spoke to rep ( XXXX # XXXX ) who refused to provide a reference number for my call. I don't know what is going on with this mortgage, I see property preservation fees ( indication of foreclosure ) however, I have received nothing in regards to the modification of the loan.

Complaint: In XX/XX/XXXX my loan was transferred from Ocwen to PHH Mortgage for servicing. PHH Mortgage is essentially just a new company that Ocwen created. I was given very short notice ( less than XXXX days ) about the change. Not a problem because I pay my mortgage on time. I attempted to locate my historical account statements on the new website provided by Ocwen/PHH and there is no historical account history. There is no form XXXX from XXXX. I have contacted PHH multiple times and they are refusing to post my account history to the website or provide online access to this information. They are also refusing to email this information. I can not verify if my mortgage and escrow balances were transferred correctly but more importantly I can not see/confirm my mortgage history XXXX including charges and payments ). We all understand mortgage servicing can change but the customer should not have to suffer by losing access to their account history, account statements, tax forms ( XXXX ), etc. PHH and Ocwen provided insufficient notice and they did not explain that customers would be unable to access historical account data.

Complaint: THIRD COMPLAINT AGAINST PHH MORTGAGE SERVICES It has been over a month that my insurance company issued checks to repair my home from the Woolsey Fire in CA. We were declared a national disaster. PHH Mortgage has given me wrong and conflicting information regarding the Exception that WAS granted as evidenced by their letters dated XX/XX/XXXX and XX/XX/XXXX. A representative from their " escalation '' department also confirmed on XX/XX/XXXX that my checks had been returned to me and in accordance with this letters. However, she gave me wrong information and the checks arrived not endorsed by the bank today. You will see from the attachments to this complaint that on their online portal, my information ALSO reflects the Exception -- in that all I needed to do was complete repairs and do a final inspection. And now ... they had the audacity to send a completly contradictory letter a week later dated XX/XX/XXXX stating they want to hold my money, do their own process and are ignoring the fact that OVER 50 % OF THE REPAIRS ARE ALREADY DONE. This is added insult to injury. It is also causing severe economic damage to me and my family because I can not even attempt to go back to work until the inside of the house is completed. I need my insurance payments to do these repairs immediately. It is appalling that banks are allowed to get away with their lack of accountability! They need to honor their original letters from XX/XX/XXXX and XX/XX/XXXX!

Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: An auto payment for my XXXX mortgage XX/XX/19 missed due to insufficient funds. I contacted the bank of the situation XX/XX/19 after I realized and informed I would pay using their online pay method on their website. I completed the online payment on XX/XX/19. I then contacted them again to inform them I paid online and to not autodraft again for the XXXX payment. PHH replied and said you will not be drafted again until XX/XX/19. On XX/XX/19 PHH took another XXXX mortgage from my account. PHH customer service stated they would not until XX/XX/19. This additional mortgage draft caused a documented {$190.00} insufficient funds fees in XXXX days before I could recover the mortgage amount to my account. I think PHH is responsible for any insufficient funds charges that would have been avoided if their mortgage would not have been drafted again on XX/XX/19. I have contacted PHH who requested I send documentation of my accounts and proof of the insufficient fund fees. PHH upon receipt has said they are not at fault. I have contacted additionally XXXX other times to customer service in which they state they are not at fault.

Complaint: Ocwen, which recently changed their name to PHH XX/XX/XXXX, and now they are known as XXXX, is fleecing my husband and me as consumers. We are in agreement with the servicing center for a shared appreciation modification. Under this modification, 100 % of our deferred principal balance would be forgiven in equal installments over ( 3 ) years on each of the first, second and third anniversaries of the modification date which originated XX/XX/XXXX. This deferred principal is treated as a non-interest bearing principle forbearance and we are not obligated to pay interests or make monthly payments on any portion of it. This amount has never been reported to the three major credit bureaus over the past 2 years and 6 months since the signing of the modification until recently. 1 ) Ocwen/PHH/XXXX XXXX has breached the terms of the modification by not forgiving one-third of our principal balance on the first anniversary of XX/XX/XXXX, this portion was not forgiven until XX/XX/XXXX, the second anniversary of XX/XX/XXXX which was not forgiven until XX/XX/XXXX and the third anniversary of XX/XX/XXXX which has yet to be forgiven. 2 ) Ocwen/PHH/XXXX XXXX before XX/XX/XXXX was only reporting the regular principal balance to the three major credit bureaus. Once the company changed its name, they added the remainder of the deferred principal to our regular principle balance and increased our debt by {$46000.00}, thus, lowering or credit score by as much as 20 points. 3 ) Owen/PHH/XXXX XXXX has yet to take accountability for their actions after countless conversations with representatives. Today, XX/XX/XXXX we spoke with XXXX, agent identification number XXXX, who stated that the remaining deferred principal of {$46000.00} amount would be added to the backend of our loan per a letter dated XX/XX/XXXX. She asked, " how much do you believe that you owe? '' We immediately asked for a supervisor and was transferred to XXXX, agent identification number XXXX, who stated that a letter was sent out which states that the debt would be forgiven on XX/XX/XXXX. 4 ) Although we have arrived at our third anniversary, we have yet to have the remaining deferred principal forgiven. Our credit score has been significantly impacted by the actions of Owen/PHHXXXX XXXX.
