Student loan: Federal student loan servicing

Trouble with how payments are being handled
Complaint: I have three remaining student loans with Navient. About once every other month I have to call to inquire about why the minimum payment has been allocated in a way that is inconsistent or incorrect. Each time I call I am told it will be fixed and they are not sure why it was allocated in this way. These misallocations result in a higher percentage of my payment going towards interest and allows the interest to accumulate ultimately making my final payment further away and costing me more money. Today I spoke to a representative who told me that the way I see my account ledgers online is not consistent with the way she sees the same on her end. She also conveyed that " the system '' was allocating money towards loans I have already paid in full ( one a full year ago and another three full years ago ). She could not explain how or why either of these things were occurring but told me she would " submit a ticket '' and that the problem should " probably be resolved within two weeks ''. Each time this happens, particularly before I understood what was happening, Navient collects more money from me, my interest goes up and my credit is negatively effected based on the total borrowed balance compared with the total paid balance. This also keeps me in debt even longer.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: I graduated from school in XX/XX/XXXX and began payments on my loans with Sallie mae that turned into Navient. There were times I had trouble paying my loans and I had to try different payment options of forbearance. I have since re consolidated my loans with XXXX however my complaint is SallieMae/Navient never gave me the option to refinace my loan so I could possibly get loan forgiveness in the future. I am a XXXX and paid on that loan for 13 years with my balance always going up and never down. After looking at my paperwork I realize they added some XXXX dollars shortly after I graduated calling it an " adjustment ''. I do not even know what this is. I started with a balance in XXXX of XXXX and ended with a balance of XXXX. Mind you paying on it the entire time. If they told me my options I could have refinanced to a loan that allowed me to apply for forgiveness after paying on it for 10 years since I am a XXXX that works in a XXXX XXXX. Since moving my loan to XXXX in XX/XX/XXXX I have paid more in 3 years then I ever paid in 13 years with SallieMae/Navient. This is bad business and I feel like something shady had happened. I shouldn't be graduated from school for 16 years still paying on a large student loan debt. And now finally making a dent in my debt with another lender.

Keep getting calls about your loan
Complaint: On XX/XX/2019, they called at XXXX XXXX, XXXX XXXX, XXXX XXXX, and XXXX XXXX. I finally answered at XXXX XXXX. They were calling because my loan payment of {$XXXX} is late by 9 days. My loan payment was due on XX/XX/19 and they are already calling me this frequently, including on the weekends. This is typical daily call frequency if the loan becomes more than 2 days late

Need information about your loan balance or loan terms
Complaint: I have 2 loans that navient sent into default. I am trying to get the defaulted loans into rehab so they will stop garnishing my social security. Navient changed my name on my account and I did not request it. I spoke to navient and they said it was changed in error and they had no request from me to change my name. I can not sign the docs until they submit the correct name. XXXX XXXX has the defaulted loans. when I spoke with Navient Post Claims they said hey would submit the right name and not to sign the documents. they are already taking payments from me for the defaulted loans. They are taking my social security, my part time job and the monthly payment that was set up for the rehab program. XXXX XXXX told me to sign the documents and worry about the name change later. I need my checks to not be garnished as I am having multiple surgerys and I dont have insurance to cover these and I need the garnishments to stop but Navinet has not sent the info to XXXX XXXX.

Communication tactics

Debt collection: Private student loan debt

Frequent or repeated calls
Complaint: Over several years, Navient has used harassing tactics in attempt to collect a student loan debt. Last XX/XX/XXXX, they called several times before XXXX asking for a payment I had already submitted. I preemptively called and informed them that due to personal circumstances, I nor my guarantor was able to make XX/XX/XXXX 's payment by the due date ( XX/XX/XXXX ). I stated that I would be able to pay it by the first week of XX/XX/XXXX and the representative stated that there was nothing they could do. I asked that they at least notate the payment would be late and they refused. I received a call XX/XX/XXXX at XXXX requesting payment, during which I informed the representative that I would be remitting payment shortly. I completed the payment XX/XX/XXXX, receiving a confirmation number and seeing the deduction from my bank account. Today, XX/XX/XXXX I received 3 separate phone calls from the number XXXX. One at XXXX, one at XXXX, and one at XXXX. I answered the third to discover that it was a Navient representative calling to say they were trying to collect the XX/XX/XXXX payment - the one I had already submitted. I explained that to the representative, who used the computer system to verify it. She said she would make a note that the payment was there and to stop the calls. I asked her to please check for payments before calling - especially 3 times back to back. She became argumentative, stating there was nothing she could do about it and that I should just make my payments on time. I explained to her that this has happened even when I made my payments on time and she became more argumentative, talking over me, and unwilling to hear my position or take responsibility for repeatedly calling me under false pretences.

Trouble with how payments are being handled
Complaint: On XX/XX/XXXX, I submitted an online payment to Navient to pay off in full the remainder of my student loans. The same day, I also cancelled auto-pay because I was afraid that Navient would continue to process the auto-pay, even though the loan was paid off. On XX/XX/XXXX, the payment in full was removed from my bank account AND the auto-pay was also removed. The in-full payment was on the Navient site listed as " processing '' but the auto-pay was not listed at all. I called and spoke with Navient and they told me that the auto-pay would *probably* post in a couple of days, but that a refund would be 3-4 weeks. They further said that auto-pay often takes 5 days to cancel, but no where on the website did it give me any such warning at all. I paid it off in full, INTENTIONALLY cancelled auto-pay, and they STILL charged me and won't return my money for 3-4 weeks. Money that they STOLE.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: I first report on XX/XX/2019 XXXX # XXXX. I asked for a Master promissory Note Proving the Loans that they had under my name for there company. The CFPB dismissed my complaint because XXXX/Navient sent a Promissory Note that had nothing to do with the Loans they Claim they have on file for me. I have Attached to THIS complaint is the Promissory Note that XXXX/Navient attached with my first complaint ( # XXXX ). I have also attached what XXXX/Navient reporting to the creditors. Why are the Original Grantors not the same? Isnt the information suppose to match? I also asked my private loan carrier for A Master Promissory Note and I was shocked to find out that they have the same Promissory Note for my private loans that XXXX/Navient have for Federal loans for different schools. How is that possible? XXXX has told me on multiple occasions and by multiple employees when I have asked XXXX/Navient who my Original Grantor is ; there answer has changed atleast Twice, and now that I see that there reporting that XXXX is the Original Grantor. That's the third misinformation about this loan that they have given not just to me but multiple other companies. I have asked an employee and one of XXXX/Navient Managers for contact information to there legal Department. I was told that XXXX/Navient does not have a legal department. How do they handle lawsuits without a legal department? All conversations were recorded, I have had problems attaching them in the past, but if an email is provided I can submit those recordings Promptly. I hope someone really looks into this!!

Complaint: I have help to write this letter for help. I am currently on XXXX I started drawing this in 2010. I was referred by XXXX worker to Legal aid to assist me with getting XXXX because I was struggling in the program tanf. I tested in the program with XXXX program and my results were very low and under testing requirements low math scores and cognitive scores showing I had scored low intellect scores in many areas. I struggled all through school I graduated but I'm sure they just passed me through. so I eventually tried the 2 year college I scored low but financial aid obviously pushed loans that I never understood the whole process of even where to get my books. so I never completed to gain credits. How could they allow me to enroll and receive fincial aid knowing i couldnt complete. when I clearly struggled to even find the classes. even in school I was not offered special classes when I showed failing always. XXXX sent me to test in many areas and I was shocked when an advisor give me my results basically I had many learning problems. I started Adult ATTN ( ADD ) medication as an adult it helped but I developed insecurities over the years from losing employment I still feel humiliated from so many comments on my ATTN issues math XXXX and on how it takes too long for me to learn tasks. I'm now responsible for these loans that I never gained a degree for with so many attempts to try again to fail ..I wish someone could have not allowed this financial hardship and prevented such a waist of funding with out special placement of some kind.

Trouble with how payments are being handled
Complaint: I've dealt with Navient XXXX XXXX XXXX many times starting from XX/XX/2019 to the current date ( XX/XX/2019 ). Anytime I make an additional payment they somehow administratively XXXX up the payment to be disbursed to the wrong loan. The loan is a Consolidated Subsidized and Unsubsidized Loan. They have a system set up on their website to allocate funds to a specific loan ( i.e. highest current balance, highest current interest ratel, or prorate across selected loans etc. ). I want to pay my loans off as fast as possible, so I have chosen to submit additional payments to the the Consolidated Subsidized loan, which has the least amount of principal left. Anytime I make an additional payment, I have to call them and correct their mistake because they will always split the additional payment between the Subsidized and Unsubsidized Consolidated loan. After calling them and having the additional payment made to the Subsized Loan, they automatically prorate the next payment, so my automatic payment isn't being distributed the way I want as well. I spoke to them on the phone and requested they not do that, but do it every time. It seems their website has a system in place to help the user, but their system isn't functioning properly when you choose what you want. Also, it seems silly that I need to take time out of my day consistently to make sure they are applying my additional payments to a loan I have specified to them numerous times. My additional payments are {$100.00}, and my automatic payment is {$290.00} and it comes out every month on the XXXX. I thought it would be fair for me to put in an official complaint so they understand my frustration.

Trouble with how payments are being handled
Complaint: On multiple occasions between the end of XX/XX/XXXX to XX/XX/XXXX I made contact with Navient in regards to my private loan payment that was back into repayment. I spoke with a representative at length and explained that I was not in a position to afford a {$290.00} payment due to financial hardships-divorce single mom etc. The customer service representative went ahead and specifically communicated that she was going to place my loan into deferment for 1 year. I agreed to the terms and politely thanked the representative. About 2 weeks later my co-signer called me in regards to harassing phone calls happening multiple times a day in the mornings at about XXXX straight through the evening until XXXX. These calls state that I am past due on my payment etc. I explained to my co-signer that I spoke to someone and was able to place a deferment/forbearance on the account. I then called Navient again spoke to another customer service representative and explained how the week prior ( end of XX/XX/XXXX possibly first week in XX/XX/XXXX ) and the agreement that was made. The young woman reviewed my file and quickly apologized and stated, " I am so sorry but that person was not permitted to provide that information or that agreement to you. '' I was immediately irritated and asked what do you mean. She said they didn't know what they were doing and that this was not something they could provide me for my private loan. I then was placed on several holds where she informed me that there was nothing they could do to help my financial situation and when I stated then I was going to unfortunately default on my loan unless they can get my payment down to about {$150.00} a month. She then placed me on another hold and came back and said, " ok what I am going to do is set you up on a payment for 6 months of {$150.00}. '' I quickly responded that I could make that payment and set up an automatic recurring payment for the next 6 months. On XX/XX/XXXX that payment successfully cleared my bank account. Today,XX/XX/XXXX my co-signer contacted me saying that Navient has been calling him about me not making my {$290.00} payment. I then called Navient again and asked to speak to a rep. in private loans. Upon speaking with them she stated that my new plan of {$150.00} was denied. When I asked how it was denied because they already took my payment she placed me on a hold to speak to her manager. She then came back and told me that they would get everything corrected and I would be placed back on my interest bearing forbearance to only make the {$150.00} payments.

Problem with a credit reporting company's investigation into an existing problem

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Their investigation did not fix an error on your report
Complaint: In XX/XX/XXXX I noticed that their was an incorrect reporting on my XXXX credit report. This negative reporting according to XXXX 's online access stated that this account was negatively noted on XX/XX/XXXX and on XX/XX/XXXX, two days later my score dropped by 34 points. Although I was not aware of this reporting until XXXX I immediately notified the Furnisher of this error and I was informed that this error would be removed within several business days. I contact XXXX and informed them of this upcoming correction and was informed to wait until the system updated and it would be corrected. After observing my account daily on XX/XX/XXXX the correction was made and the negative reporting was removed. Although it decreased my score by 34 points immediately after reporting, XXXX only raised my score by 2 points once it was removed and corrected. On XX/XX/XXXX I contacted XXXX 's Consumer Affairs Department and spoke with a representative by the name of XXXX, who attempted on numerous occasions to justify what was clearly improper scoring record keeping towards my account as a consumer and basically dismissed addressing the matter. Their had not been any factors which could justify decreasing someone's account by 34 points due to a negative reporting and once corrected only increasing the score by 2 points. What this bureau has done should be illegal and addressed immediately because their actions is reeking havoc on my credit history and if not addressed I will get legal counsel involved to address my concerns.

Struggling to repay your loan

Student loan: Private student loan

Can't get other flexible options for repaying your loan
Complaint: On XX/XX/XXXX at approximately XXXX XXXX EST, I contacted Navient in regards to reducing my monthly payment amount for all 8 of my private loans. The first representative offered no options so I asked to speak to a supervisor. After speaking to a male supervisor, he also offered minimal options and before the call was over he said to me that I should find gainful employment so that I could be able to pay back my student loans. As a consumer, that was totally unacceptable as he does not know my situation. Also, his tone was rude and he offered no real solution to ensure that my accounts remained in good standing. I have always paid my Navient loans and would consider myself a good borrower. After reviewing the Navient website, it offers Extended Repayment and Rate Modification/ Extended Repayment options for private loans but I was told i am not eligible for either. As the phone call continued and the more frustrated I became, I did state that I'm better off letting the account go into collections. According to the supervisor I spoke to, even though I stated I will still pay Navient what I can afford, the supervisor stated I would still go into collections then default. How am I able to go into default if I still would be making payments but I just am unable to pay the full amount? Navient does not offer any working solutions for a borrower like myself to effectively manage their student loans. Their company rather send you to collections and destroy your credit rather than to help you stay current. Currently, my Rate Reduction Program is extended until XX/XX/2019 but I want Navient to offer me a better long term solution to repaying my student loans such as the Extended Repayment for the life of the loan. Please help.

False statements or representation

Debt collection: Private student loan debt

Attempted to collect wrong amount
Complaint: I have a private student loan through Navient originally Sally Mae for XXXX dollars for school. I have paid over XXXX dollars in the last nine years. some how the loan itself is still only down to XXXX dollars. They continue to raise the interest rate which raises my monthly payment but as you continue to pay the interest is suppose to eventually go down. I will add every single transaction in the following pages as well from the time they gave me the money to the time I started paying off the loan. Either case, its been years and because of this I am still broke every month with a child and wife. I normally wouldn't care as long as my amount owed goes down but I don't understand how XXXX dollars later I have barely made a dent into what I owe. At this rate I will never be done and have paid them over XXXX dollars. When I contacted them they had no explanation or reason why except that its a variable rate which means the rate went up and they are able to pull all interest before the principle balance. Its a vicious loop I am stuck in. I also have a federal loan too but that is going down without any repercussions as a borrower, I am happy to continue to pay. Its just this one in particular I am upset and baffled by. XXXX dollar plus and nothing has changed in nine years. If you could please look to see if it is legal and help in any way possible that would be great because my monthly finances are a great stress in my life. I work hard and continue to pay my bills with nothing to show or prove for it with a child. P.S. I did graduate but did not go into my field. This entire nine years I have paid has been out of my bank account. Yet to get my mother off the original co-signer contract I need proof of graduation. If I am the one paying then why do they need proof of graduation. It took weeks to find! seems obsolete to require proof of graduation when I have individually been the one paying.
