Dealing with your lender or servicer

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: I obtained student loans for medical school from XXXX with Navient ( then Sallie Mae ). My loans were in forbearance/deferment during residency secondary to financial need. I was unaware of income based repayment options during that time. In XXXX, I entered into repayment under an income based repayment plan with the goal of using PSLF ( public student loan forgiveness ) since I employed in a federally funded university. I had spoken to Navient many times about confirmation that my loans would qualify, which each time I was reassured that I was on the right track. Yearly I continued to keep up with the yearly recertification of the income based repayment plan from XX/XX/XXXX to XX/XX/XXXX ( a total of 60 months of income based payments to Navient ). Each year I discussed the desire for PSLF to make sure I was on track and each year I was reassured that I was doing what needed to be done to qualify after the 120 payments. In XXXX of XXXX, I found out that my loans through Navient did not qualify under the PSLF program. In order to qualify I would need to consolidate my federal student loans ( {$340000.00} ) through the Department of Education ( XXXX XXXX XXXX ) and restart my 120 qualifying payments. I tried in multiple time to see if any of the previous years of payments could qualify and each time I was told no. I contacted Navient about the situation and they confirmed that I did not qualify with they types of loans that I had for PSLF, despite their reassurance over the previous years. Currently I have my federal loans consolidated with XXXX XXXX XXXX and I am making payments monthly to reach the 120 payments under a incomed based repayment plan. Had I been given good information from my lender about my loans not qualifying for PSLF, I could have easily consolidated my loans in XXXX.

Struggling to repay your loan

Student loan: Private student loan

Can't get other flexible options for repaying your loan
Complaint: I currently pay {$250.00} in monthly payments to Navient on a Rate Reduction Plan for {$63000.00} on student loans. Approximately $ 200/month goes toward the interest of my loan while only {$56.00} goes toward the principle of my balance. I originally took out about {$50000.00} in student loans through Sallie Mae ( now Navient ). I am on a 30 year repayment as I can't afford the over {$600.00} standard monthly payment. Over the course of the next 30 years based on the current loan rates I pay, Navient will profit at least {$72000.00} on an original {$50000.00} student loan. I've requested alternate payment options- none are available. I've filed formal complaints with Navient- I'm reminded of the original terms and conditions of the loan. When filing the complaint with Navient I was told my complaint is the most frequent complaint about Navient. Even mortgages are available for refinance. I've tried to request my payment allocations be restructured so {$200.00} goes toward principle while {$50.00} goes toward interest- Navent refuses and does not have such a program. Every six months my monthly payments increase with Navient due to a 0.5 % increase on interest. I can not afford the continuous increase in interest payments, I'm frustrated Navient and their shareholders continue to profit off my hard earned money. I've even considered stopping payment altogether but can not as Navient will pursue legal action against myself and my co-signers to garnish wages or put leans against my cosigners property. I comply with the payments to prevent the aforementioned consequences. I do not pay out of consent ; I believe Navient is financially raping thousands of student loan borrowers to line the pockets of the million/billionaire shareholders that have stock in this corporation. Because of Navient and my astronomical $ XXXX/mo student loan payments I can not afford a house, it's a struggle to help support my family, and quality of life is poor. I went to school for a better life, instead, I'm indebted to Navient, paying astronomical interest rates with no benefit to my self or my family. I can not better myself and return to school for a trade because deferment and forbearance will only increase my interest rates and long term repayments. I believe legal action needs to be taken against Navient to assist student loan borrowers reduce payments and help pay loans off faster. After 5 years of repayment to Navient, I have barely reduced overal principle of the loan and will not pay off these loans until I am XXXX years old.

Complaint: My credit score is low, mainly due to my student loans. While I acknowledge that I attended three colleges and have a lot of student loan debt, I began looking closer into the loans I am paying on. Two of them are listed for a school I did not even attend. I have wondered for a long time why and how I ended up with such a high amount due. I am wondering why/how this could have happened? One of the loans is now for more than {$17000.00}! This one is dated to have been dispersed XX/XX/2005. The original amount was {$16000.00}. I have had other issues with my lenders too, such as different payment options being made available at different times and no mention of delinquent loans when I call in.

Complaint: My Federal Loans were transferred by the Department of Education to Navient Loan Services to manage my loans. Around 7 years ago, I was instructed by Navient Loan Services about that my student loans would qualify for XXXX Forgiveness or Public Service Loan Forgiveness programs. In 2017, I submitted the XXXX Forgiveness application. It was turned down for some technicality, I still do not understand. Subsequently, I was recomended to apply for Public Employee Services Forgiveness program. Today, I called them and was told that my 2. ( {$200.00} total ) out the 3 loans do qualify, but not the {$24.00} XXXX loan. I have being making payments under the impression that I would qualify for Loan Forgiveness for working XXXX XXXX areas and providing XXXX XXXX with the government. I was wrlong! I was cheated.I have made payments for the last 7 years and beyond and never compensated for my services as promised.

Complaint: I would like to Lodge a formal complaint against XXXX, as I had a Sale Mae/Navient loan. I had called several times to ensure I was eligible for loan forgiveness, as I was a teacher. I was told I was on track, but every person I talked to told me something different. In the end, it turns out that because I paid more than a minimum monthly payment, I was not eligible for loan forgiveness and none of the payments I had made would qualify for credit towards forgiveness. We ended up paying the balance off ASAP to be done with the mess, as I was given faulty information on multiple occasions.

Improper use of your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Reporting company used your report improperly
Complaint: Navient was reporting a 90 late payment on two accounts in XX/XX/2014. I disputed the accounts in accordance with FCRA. Instead of correcting the errors, Navient removed 7 accounts from my credit reports that were in good standing causing my scores to plunge. The 90 late payments were in XX/XX/2014 and they were eventually brought current. As such, they should have been removed according to Section 623 ( a ) ( 2 ). I have attached an FTC advisory opinion which interprets Section 623 ( a ) ( 2 ) of the FCRA. The issue posed in the advisory opinion is how a lender is to handle a situation when subsequent information updates a report that was allegedly accurate when it was made but no longer is accurate in the present time ( i.e., the identical situation I am currently in ). The advisory opinion states that Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by furnishers, or persons who furnish information to consumer reporting agencies ( CRA ) such as credit bureaus. In particular, this section requires a person that has furnished to a consumer reporting agency information that the person determines is not complete or accurate to promptly notify the consumer reporting agency of that determination and provide any information needed to make it complete and accurate. Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to update accounts as well as to correct. Navient communication regarding retroactive forbearances states If the forbearance was applied retroactively to cover a period of delinquency, any information previously reported to each nationwide consumer reporting agency will remain. However, Section 623 ( a ) ( 2 ) clearly shows that the reports must be updated/corrected regardless of whether they were accurate at one point.

Student loan: Federal student loan servicing

Account information incorrect
Complaint: I have several late payments from Navient on my credit report and I do not know why. I was in school from fall XXXX to spring XXXX. In XX/XX/XXXX my XXXX passed away, and because he was a cosigner I was told the student loans would be forgiven. Years and years passed and I never heard from them again. Not a phone call, not a letter in the mail, literally nothing. Then one day I looked at my credit file and I had several late payments from them. This was in XXXX, years and years after attending school. Any attempts to follow up with the company and get it fixed have not worked. When I call they say someone from the company must have given me wrong information and they couldn't help. I disputed the payments with the credit bureaus, and nothing. I am now paying my student loan payments monthly and have never been late, I don't mind paying. But the late payments on my credit file is ruining my credit and I need it removed.

Trouble with how payments are being handled
Complaint: For the past 3 years I have been under an Income Sensitive Repayment plan, which must be renewed each year with an application and letter verifying employment ( VOE ). Every year it is the same. Navient misreads my VOE and falsely inflates my income. I am a XXXX and am paid on a 10-month salary. Navient does not understand what 10-month salary means. So it gets explained over and over each year, it takes about 5 phone calls, and then by the time they " figure out '' it is the same as the previous years, my term has ended and they say they " must cancel '' my reduced payment plan. This means it takes a month or two at a much higher payment rate to be resolved, right at the time ( summer months ) that as a XXXX I am not being paid. Navient knows this and does the same thing each year. This is a way to gouge a little more cash from their helpless customers. Each time I keep a paper trail. Their customer service people openly lie and say " oh it is fixed, we promise '' but then it does not get fixed. This year again I have the paper trail to prove the following : This year I have the online chat record to prove that back in XXXX Navient approved my application, accepted the VOE, and agreed to the usual reduced payment plan. But once again they cancelled my plan, and claim to have " lost '' my forms. This happens every year! Like the last few years, they also always refuse to send the final confirmation until the end of the previous cycle. That makes it impossible to fix any problems because it is too late. This year it happened again and they are refusing to correct their error ... asking me to go into forbearance ( which just makes them more money ). This is unethical business and they have me in a bind, threatening to ruin my credit. Please help! If you read the attached copies of my correspondence with Navient, they said back in XXXX that all was A O.K. and I need do nothing else. But this week they posted a note to me saying my repayment plan was cancelled, they did not get any forms ( a lie ), and the my payment will now be doubled as of immediately. They pull this stunt every year!

Problem with a credit reporting company's investigation into an existing problem

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Their investigation did not fix an error on your report
Complaint: XXXX and Navient have file negative history on my credit reports with all three bureaus. During the time my student loan debt was reported the companies were sending paperwork and contacting my father ( same first and last name ) that I was not associated with at the time. I had not spoke to my father for several years and was not getting the notifications of who owned my student loan debts. I have now consolidated all of my student loans and not missed a payment for almost two years. My credit score is solid, but these negative marks are holding me back. I am asking for the items to be deleted from my all three bureaus because there is a XXXX balance with the two companies. At this time I am up to dates on everything and would like things to be corrected because I did not know of defaulting.
