Struggling to repay your loan

Student loan: Private student loan

Can't temporarily delay making payments
Complaint: I have been unemployed for over two years, first and primarily because of a sick parent who required full-time caregiving after XXXX XXXX XXXX. I continued to pay the debt monthly as possible with savings because, though the bulk of my student loans were granted an unemployment deferment with ease. I attempted on several occasions to get those deferred as well, but they refused and said private loans are not eligible for the same deferments. Moreover, any application of temporary deferment would only be for 60 days and required a per-loan charge of {$50.00}. These two loans thus charged me {$100.00} for a deferment of two months, which while helpful given that the two loans would be over {$800.00} for the two months, it seems usurious and wrong that this charge is only for an application and is applied to neither principal nor balance. Interest continues to accure. So I waited until absolutely necessary to do so. Since my mother died and I have lost stable housing and support, as well as exhausted savings, while having not earned an income for over two years and living with what little money I gain through odd jobs and help from friends, I ultimately did apply for and was granted a deferment of two months in XXXX because they were filing derogatory remarks on my credit. Mind you, this is all while they allow the bulk of my loans to be deferred. It is untenable as a position when it's the same lender and they have everything in front of them to see that I have been in a prolonged period of financial hardship due to family matters and now prolonged unemployment. I have gone on dozens of interviews and worked with two staffing agencies, but continue to lose out on opportunities because my professional experience is freelance creative work and while I supplemented my income for years with personal administrative support that experience is years ago and does not translate easily to the city in which I now live. It's a wildly unfortunate position to be in considering I have years of work and a master 's degree from a highly reputable institution. But they are now demanding payment again, aggressively calling to collect past due balances and I don't have {$100.00} to get another deferment. What am I supposed to do? I just applied for Income Based Repayment to put my loans onto that plan wherein, for the time being, I won't have to make payments but will be considered current. It's unfortunate as the interest will accrue and I have several hundred thousand dollars in debt, but I can't let my credit rating go down any further, at risk of precluding me from stable housing, banking, credit lines and employment. Many employers run such checks and I don't want to be in default. But why is a lender allowed to do this? Why can they not keep the payments across the board. Why is there no federal oversight of these private loans that protect me in the same way that the vast majority of my other loans do? I did not know this was the case when I took the loans. Servicing these two was for many years all I could do financially and as a result let interest accrue continually on deferment/forbearance. The lender is uncooperative despite many many calls and I have no choice right now but to let them go unpaid while I continue to look for work, and while the process of putting the bulk of my loans on IBR works its way through the system.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: Navient Removed me from the Income Driven Repayment Program ( " IDR '' ), Without notice or full disclosure as to why, While I am disable. Then reported that I was delinquent on repayment 120 days. I contacted Navient, they said It was reporting that way because I failed to renew or re-certify for the IDR program. I provided all the Emails and facts proven that I was never given notice or full disclosure as to any failed payments or that the IDR had expired nor that it was time to re-certify. I was placed on hold, then a representative named XXXX returned to my call admitting that she couldn't find anything explaining why the contact status was changed ; and that she didn't see where I had ever requested that my previous means of contact that I provided, be changed. Then she went on to inform me '' but it was changed from email and phone to contact by mail ( Letter in the Mail ) ; and I don't know how. '' I sent numerous written request as directed to the credit reporting division, at Navient, for the information on my credit report be corrected and that the false, incorrect and inaccurate misinformation be removed. Still over 1 year later the information is showing on my credit report making me financially indigent. Moreover, the loan is paid off.

Received bad information about your loan
Complaint: My provider is Navient. They have been ridiculous to deal with over the years. I despise having them service my loans. Their website is unfair and deceptive and I believe purposely set up to make it difficult to figure out how to apply for a payment repayment program, forbearance, or deferment. I have been struggling to make my payments, but am single so my income artificially inflates my ability to make payments. I finally figured out how to contact Navient in XX/XX/XXXX of this year and was told the round about and difficult way to submit a forbearance request. They approved my request through XX/XX/XXXX. It is now XX/XX/XXXX and they are reporting me past due to the credit bureaus. When I log into my account, they show I have a payment due in XX/XX/XXXX. Not only do I have no payments due because of the forbearance, they never sent me a statement via mail or email to advise me of an upcoming payment in XX/XX/XXXX. Had I received such a statement, i would have contacted them immediately regarding their mistake. Now my credit has suffered a hit. They are in violation of Regulation Z for not providing a statement, FCRA for inaccurately reporting on my credit, and UDAAP for their terrible website as well as causing harm by incorrectly reporting my credit and not providing me the ability to prevent that harm due to their FCRA violations. This servicer of loans is absolutely terrible and I can not stand doing business with them. I hope that the CFPB will take a look into their unfair practices, but, as of right now, I want my credit fixed ASAP.

Student loan: Private student loan

Received bad information about your loan
Complaint: On Tuesday ( XX/XX/XXXX ) I applied for forbearance on my private Navient student loans due to flooding in Missouri ( natural disaster, state of emergency ). I was granted forbearance for 90 days which they told me started that day. We have auto draft and the payment was taken out of our account two days later, not sure why their system didnt put a stop on it. I called yesterday ( XX/XX/XXXX ) and they said they would issue a refund that would take 3-5 business days. I called today ( XX/XX/XXXX ) to confirm the refund was in process- over {$400.00} is a lot of money to just be sitting in limbo. The customer service rep told me today I had to submit my banking information. I told her the lady from the previous day said nothing about this. She apologized and then needed my banking information to process the refund. I told her she already had it because they auto draft our money every month. She then proceeded to tell me it would take 7-10 business days. I dont understand how this company is still in business. They have zero integrity, and their customer service is difficult to understand and does not give accurate information. This 90 days forbearance is suppose to be helping me, but instead is causing a huge headache and saving me XXXX money. I am a stay at home Mom of XXXX kids and pay over {$400.00} a month, how is this right? They offer no help, and one rep even suggested to switch carriers because there was nothing they could do to help me. As of now, I am calling my bank and issuing a refund because I can not trust that Navient put a refund on my account. This is a nightmare, and I understand why they are being sued.

Attempts to collect debt not owed

Debt collection: I do not know

Debt is not yours
Complaint: Navient keeps calling me everyday. I had to look them up to find out what they were. I told the person I have no student loans. I confirmed my name. He insisted that I give them my social security number over the phone ... .I WILL NOT DO THAT! I even asked them to tell me my last four digits to confirm them ... .he refused. He will not take me off their list. I asked for a supervisor, he says he tried but they are all busy. I bet they are! He mentioned a university or college I have NEVER heard of ... that did not phase him. He mentioned an address supposedly for me that I have NEVER heard of ... that did not phase him either. If they are legitimate, why are they operating this way? I said send me a letter stating what you want because I am not giving out any information over the phone ... no response to that. I will say this also happened a few years ago, I asked them to stop and after a long while they finally did. But they have started up again. Any student loans I had were paid off long ago -- a fact that is verified on my credit report. I want this company to stop harassing me and all other innocent people!

Trouble with how payments are being handled
Complaint: I have had the private student loan accounts serviced through Navient for over 10 years. I have been paying on them for a number of years as well. I am disabled ( XXXX XXXX survivor ). This last XXXX I was according to them more than 60 days late in paying my accounts. However, I can't figure out how they are applying my payments. I spent 2 hours on the phone with them today and I still am confused. They reported this to the credit bureau and my credit score has dropped considerably. I have an online account with them and though I receive monthly bills on the account I did not receive any notification online that they were going to report me to the credit bureau. Can you help? Thank you.

Keep getting calls about your loan
Complaint: I haven received calls at XXXX every morning for this week from this company ( Navient ). I explained to 3 different reps that I was homeless last month and am currently no longer living at the zip code associated with my loans and they argued with me there is nothing we can do we go by the zip code and the area code off your phone number and when I explained that I havent changed my phone number but I now live in XXXX and not XXXX therefore a different time zone they still argued with me and gave me a hostile attitude. I have only missed 2 payments and they are harassing me calling me every single day and even leaving me voicemail messages when my voicemail explicitly says not to. The harassment has to stop I can not make a payment at this time I am unemployed and I just moved into a home as I was HOMELESS and literally found out I am pregnant the day I got to AZ, and have been so sick I am unable to look for a job as the XXXX is causing me to be severely ill and dropping weight rapidly. I have XXXX other children to take care of and the fact that Navient calls me at XXXX every morning forces my daily XXXX to begin early, therefor making me sicker for longer portions of the day.

Trouble with how payments are being handled
Complaint: Ive sent out a Cease and Desist letter to Navient requesting that they discontinue any calls or other forms of communicate with Me or the people that are claimed to be linked to my alleged debt with them. I received the certified receipt back and it says that Navient received and stamped it on XX/XX/2019. Since then, I have been receiving calls from Navient ( Several times on XXXX and the days after ). I have been keeping track. Navient has NOT respected my wishes and have been calling from different numbers, sometimes back to back. I received a call as of yesterday, XX/XX/2019. Last week, I answered the call and someone from Navient told asked for my Mom. My Mom is listed as a Co-signer, but the letter asked that calls be ceased with myself AND EVERYONE ASSOCIATED WITH SAID DEBT. Navient informed me that they didnt have to stop calling because the Ombudsman told them not to. I NEVER received anything in writing stating that and that statement she made is monitored and recorded. At this point, my rights are being abused and I am still being harassed about payments. I have been making payments, but when they call, they are asking for different amounts owed. I will be seeking assistance on how to handle this matter. I told them that my Mom does not have this number and they still call. One rep told me that she will not stop calling. HARASSMENT!

Trouble with how payments are being handled
Complaint: My two student loans were consolidated under XXXX XXXX XXXX in XXXX of XXXX at a combined total of {$41000.00}. Several times I inquired about how payments are applied and my balance. At XXXX point, XXXX XXXX, XXXX, I had paid a total of $ XXXX.Of this amount, {$230.00} has applied to late fees, {$15000.00} has applied to interest and the remainder of {$2600.00} has applied to the principal balance of the loan bringing it down the balance only {$39000.00}. Incredible, so after 7 years at that point, I'd only paid off less than {$3000.00} of the principal. Doesn't add up. I inquired about extra payments I made and received this statement, " We are unable to apply funds to the principal balance unless the late fees and the unpaid interest is satisfied. Therefore, if you are making extra payments or payments above and beyond the minimum monthly payment we can not designate for those funds to be applied directly to principal unless the above information has been satisfied. '' Very confusing statement as if I do not have any late fees or unpaid interest after making payment, anything extra should go directly towards the principal. I made extra payments often. Never the case. Most late fees came from issues with the site and payment processing. In XXXX XXXX, my loans were transferred to Navient by XXXX. I'm having a similar issue with payment calculations. As of today according to Navient, XX/XX/XXXX, I still owe {$44000.00} over the next 13 years until XXXX on top of nearly the $ 25,000+ I've paid between XXXX and Navient. To add insult to injury, Navient marked my first two payments late even though I was never notified of the due dates or anything of that after they were transferred. I received an email stating I'd receive information and the next communication I received was an overdue notice. This is unacceptable and unfair to the consumer because there is little we can do to rectify the situation. It doesn't take a genius to see what's happening as payments are applied in a fashion to keep the consumer in debt.
