Trouble with how payments are being handled
Complaint: I would love to know how to go about investigating my loans in connection with the current lawsuit Consumer Finance has against Navient. My state has filed nothing and I am certain I could be included in this, federally and/or locally ( KY ). Recently, first, I tried to setup my payments for auto pay so I could get the reduction in my interest rate. It took MONTHS. They kept taking the payment then kicking it back. If I were not working for my family business, I would not have had time to do all the work I did to finally get it working. Second, I have been submitting payments via my bank ( online ), over and above the monthly payment that is being automatically deducted from my account. My account is setup to direct all overpayments to principle. They have applied them to interest. I can supply you with screen shots showing such. Their answer? I can hardly understand it but I am assuming it is being applied this way because it arrives before my payment is due and they're applying it to my payment, anyway??? This is RIDICULOUS. The last correspondence I received from them says it is being applied correctly. That is all! " Sorry about your bad luck. '' Can you advise me as to how I should proceed? Thank you, XXXX XXXX XXXX XXXX XXXX XXXX, KY XXXX

Received bad information about your loan
Complaint: After, reviewing XXXX Universitys website, I'm concerned about the sourcing of rankings, outcomes and comparative data. I fear the information is either not correct or is misrepresented and therefore misleading prospective & current students. {$110000.00} in Student Loan Debt : For example, XXXX University markets itself as an affordable, first-generation student friendly institution. Yet, I left with an excess of {$110000.00} in student loan debt. My parents ( who did not attend college ) were willing to pay for {$20000.00} of it, leaving me with a monthly student loan payment of {$1100.00} from XXXX while living in Washington, DC making {$38000.00} a year ( a company XXXX XXXX, CFO directed me to ). The response from the finance office my senior year was Oh wow, thats a lot. Youre not going to be able to afford that in this area ( this area being XXXX Pennsylvania ). Unfortunately, Im not the only one. XXXX XXXX, who is featured in the XXXX XXXX segment below, shares a similar fate. Link to XXXX XXXX : XXXX : XXXX Strong Ties to Predatory Student Loan Lenders : Yet XXXX continues to promote affordable degrees that are friendly towards first-generation college students. XXXX Board of Trustees also share strong ties to Navient and Sallie Mae who issued me loans with interest rates from 8 % to 12 %. I find a conflict of interest between the Board of Trustees who are driving XXXX students to take out high-interest loans with private lenders. Link to XXXX XXXX XXXX : XXXX Board Member and Former Executive of Sallie Mae and President of the XXXX XXXX XXXX. XXXX : XXXX XXXX XXXX XXXX serves as chairman of the board of XXXX XXXX XXXX , formerly XXXX XXXX XXXX and is a member of the Governance Committee. He is president and CEO of XXXX XXXX XXXX XXXX, based in XXXX XXXX. He is a retired partner of the XXXX-based law firm XXXX, XXXX XXXX, a former executive vice president of Sallie Mae Inc., and the former executive vice president, general counsel and secretary of XXXX XXXX XXXX. My Goal : My ultimate goal is to provide a voice for those who have been financially disadvantaged by an institution of higher learning who markets themselves as affordable and accessible to first generation and minority students. I'm aware that this is a systemic issue among small, private liberal arts institution who are struggling to find " their niche '' in the competitive higher education market but issues such as transparent marketing tactics and the unwillingness to address student financial literacy need to be confronted. There are better ways to handle this situation and I hope XXXX chooses to be on the right side of history.

Struggling to repay your loan

Complaint: I am a graduate of XXXX XXXX XXXX XXXX XXXX ( my dream school since I was XXXX years old ) which I now regret. I have roughly {$130000.00} in private loans with Sallie Mae and {$40000.00} in federal loans. After graduation I was highered part time and qualified for forms of forbearance. My mother who cosigned my private loans filed for bankruptcy and is my only family, she can not help me pay what so ever. Now that I have a full time job ( and looking for a second ) and make {$430.00} a week I don't qualify for any forbearance, but still cant afford the lowest repayment options, {$590.00} a month from Sallie Mae and {$230.00} for Federal. I have a personal loan, phone payment, {$670.00} rent, and groceries I pay every month. This doesn't include electricity bills, heating bills, water bills, or any other monthly bills. I am currently in the process of moving everything over from XXXX to XXXX XXXX, so my car insurance and car payments are not even included. Student loan: Private student loan

Trouble with how payments are being handled
Complaint: I am a cosigner on a private student loan with Navient. I have reached out to them on multiple occasions about how My payments are being allocated because I have been the primary payer on the loan since XXXX. The initial loan value was approximately XXXX and 6 years later I still owe a little over XXXX. The payment was initially XXXX per month so if you do the math that is over XXXX. I feel like the private student loan companies are stealing from borrowers. The interest rate is variable and when I called to ask how that is calculated they could not tell me. My interest rate is currently over 11 %. Since XXXX of XXXX when my loan was bought from sallie mae by Navient, my balance has actually gone up by {$200.00} although Ive been making monthly payments. My brother, who is the initial borrower, is back in school full time but his loan doesnt qualify for any type of deferment due to the type of loan it is per Navient. Feels like there should be some sort of law against the gross negligence and mismanagement of funds that is obviously taking place at Navient. When I called in on XX/XX/XXXX and asked how we could get my balance down, the man replied I could pay more each month. No other assistance was offered.

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: I have attempted on numerous occasions to dispute the false negative 60 day late payment on my credit report from Navient. Only to be told it was accurate when it couldn't possibly be. The months before and after the month started to be 60 days late are both on time. Aside from that, I never have had to make a payment and was in school. I have mo idea what happened to cause this. I believe that they misallocated payments or messed up with a deferment/forbearance somewhere and they refuse to take responsibility. And fix it. Please help. My credit is suffering from this. Also the loan on there is from XX/XX/2005 and has been transferred twice now, I would like it taken off completely.

Attempts to collect debt not owed

Debt collection: Private student loan debt

Debt was result of identity theft
Complaint: On XX/XX/XXXX, I responded to an email from Navient Student Services that my private loans were due for repayment. At that time, I didn't understand what they were referring to, but I was afraid that if I didn't at least pay the amount they were requesting to put my " private students loans '' in forbearance, they were going to put in delinquency on my credit report. So I paid them the amount of {$100.00} they requested to put my " loans '' in forbearance, which I thought it would be until XXXX, but then when I called back on XX/XX/XXXX, they said that the payment was only for a month forbearance and they need another {$100.00} for another month. That's when I decided to ask for the promissory notes they supposedly had, because even then I did not remember requesting any private loans from them. The only loans I have are through the DOE through fedloan. Those loans are legitimate, but these loans with Navient are not. When I received the promissory notes, they confirmed my suspicion, I never made these loan requests. Someone copied these loan requests from when I was at XXXX College from the loans I had through the DOE. The loans from Navient had originated through XXXX XXXX in XXXX, and I never authorized these loans at all. They were all made electronically with an e-signature and I never did that at all with XXXX. And yet Navient still wants their money, they have harassed me with calls and emails left and right AFTER I told them that these loans are fraudulent. And yet the representatives told me that there was nothing they can do because the loans were dispersed to the college during the time I was there. BUT I NEVER REQUESTED THESE LOANS. Also Navient says that a Stafford Subsidized Loan was made by me to XXXX XXXX University in XXXX, and I never went to XXXX XXXX University in XXXX. I went there ON A XXXX XXXX during XXXX. So that is definitely fraudulent and I should not have to pay anything nor be threatened with delinquency at all.

Problem with customer service
Complaint: On numerous occasions I have had to resubmit financial documents to Naviant in order to have my student loans rehabilitated. I gather all of the need documents such as daycare receipts, bills such as mortgage, utilities and car payments. Each respond that we have received back regarding the submitted documents range from sorry but this form was not included or sorry we need you to resubmit all your documents. This has been on going for a year now. I call naviant today XX/XX/XXXX to discuss making a payment to my account which is supposed to be around {$270.00} a month. The customer service representative tells me that Im supposed to make a monthly payment of {$1300.00}. Written notification about debt

Debt collection: Private student loan debt

Didn't receive notice of right to dispute
Complaint: Navient has failed to provide honest & adequate services to its borrowers. It seems they are constantly dishonest about the structure of their company, and do nothing to help people that are making increasing efforts to make payments or proper arrangements ( that are not only in the best interest of the company, but for the millions of borrowers that are struggling to make their payments every month, without feeling vacuumed by student loan debt. I am constantly being told misinformation, and there is always lack of detail as far as your current loan and your options to make things more comfortable for the borrower. They have denied every request I've made for help : refinancing, releasing co-signer, making structural payments every month that would make an impact in decreasing the debt. I've been paying for nearly 5 years now, and my balance is still the same! I've made arrangements throughout the years, they feed you lies so you think your arrangement will serve you well, if you're consistent and make substantial payments, etc ... but it appears to me the money you pay literally goes into their pockets, your balance remains the same from when you started 5 years prior, and NO, you are not eligable for help as far as refinancing, or even trying to structure a payment plan that would be in the best interest of the borrower. I was told that they could not set up a plan that would benefit me long term. It was up to me to " overpay '' the balance, and therefore the remainder will go towards the principal. I asked for a financial advisor, or someone in accounts receivable that could possibly help me break down my loan that will serve my best interest, make an impact on the principal and possibly divide a percentage of both principal and interest that would actually start to decrease my balance ( which is stagnate for over 5 years, while paying nearly {$600.00} a month on a $ XXXX loan ) ... they told me they have no such department that would do that, they transferred me to " Customer Service XXXX who didn't care to find a solution, just repeating " facts '' like a robot, and telling me he didn't understand my questions. I'm disgusted by their company work ethic and lack of honest service. I can't believe that this is legal.

Problem lowering your monthly payments
Complaint: When I originally signed up for school I was confused in the fact I was getting a grant, paying the school, and signing for a government loan. It was all a very confusing situation where we were constantly interrupted and very unorganized. I was under the assumption I was getting a grant and would pay the school monthly while attending. I was a single mom works now 2 jobs while doing the classes online. This was very exciting to me that I would be able to go to school and earn a degree and start a new career. I worked hard for 2 years finishing assignments staying on the Dean 's list. I could not wait to get my degree and finally start my career in XXXX XXXX and XXXX. I made sure I never missed a monthly payment to the school so there would be no delays of graduating. I was told that upon graduation they would help with job placement. After walking across the stage all of those promises where gone. I was told there were no jobs available where I lived. I would call the school and leave messages and get no response. Then the reality of I had student loans. Now I have a worthless degree and drowning in student loans. I graduated almost 10 years ago and have not even come close to the income promised. I found out after graduating that I didn't even need a degree in XXXX XXXX. I was able to get a XXXX job and took courses and have been working in a physicians office as a XXXX XXXX. I have asked Navient year after year if I can get the loans consolidated so I can make reasonable monthly payments instead of multiple payments at prices I couldn't even imagine paying with my current income. Navient has told me year after year that it would be best if I just did forbearance and deferments. Not fully knowing what those are they set me up for those. In the meantime the interest keeps going up and up. Making it even more impossible to ever imagine paying them off. The college 's and student loan officers should not be allowed to mislead students. When we are signing up we are so excited with our dreams of a better future and your throwing so much information at them and easily confusing them. It's not right and should be against the law. I'm adding my complaint so hopefully it will help stop them from doing this in the future.

Struggling to repay your loan

Student loan: Private student loan

Can't get other flexible options for repaying your loan
Complaint: XXXX XXXX XXXX XXXX XXXX ( XXXX, NC ) use Navient to service private student loans. Navient provides misleading information concerning the loan that forces students to pay over 251 payments of {$300.00} a month for a $ XXXX loan. In return, the information is listed on the student 's credit file. The 251 payments for a XXXX being listed on their credit reports make it difficult to obtain a mortgage, even if the student has a good payment history. It cost over {$75000.00} to pay back an initial {$25000.00} loan. Navient refuses to work with students and make it almost impossible to get out of the loan unless paying it off in full. However, still, the interest is charged daily, so the payoff amount increases substantially before they even apply the payoff check to the account. Next day payments do not even help. The payment amount changes daily. This is what is holding America back. 5 days ago they noted a different payoff of the original payoff which is {$22000.00} onXX/XX/XXXX. Today the new payoff amount is XXXX and that is a rip off. When I initially called they gave me 10 day payoff amount of {$22000.00}. Today I spoke to XXXX XXXX the supervisor and she stated that even though they have received it, it has not been processed yet and if it is not processed by the XXXX the payoff amount will increase.

Student loan: Federal student loan servicing

Account status incorrect
Complaint: I went to XXXX XXXX with the understanding I would not be paying money back. My XX/XX/XXXX taxes were kept this year due to Default on Federal Student Loans through Sallie Mae. I did sign some papers when I started there in XX/XX/XXXX and XX/XX/XXXX with the intent of not having to pay any money back. I called Sallie Mae on XX/XX/XXXX and they informed me that my loan was sent to another company in XX/XX/XXXX. I ran my credit, and according to my credit history my balance owed to Sallie Mae is {$0.00}, and my loan was transferred three times. I have filed my taxes every year with my husband and have never had any money taken for any debt I've owed for any federal misunderstandings before. I called the Dept. of Education in Texas and they will not speak to me until my loan comes out of default, they transferred me to another company, XXXX XXXX on XX/XX/XXXX. I talked to a lady there who said my loan is up to {$21000.00} or more! Now she mentioned my social security number has been in and out of offset through the Dept. of Education since XX/XX/XXXX. With setting up payment plans with XXXX XXXX for {$5.00} for 10 months they can get my loan out of default and then the Dept. of Education will talk to me. I ran my social security number through the IRS and my number comes back with zero debts and no offsets with my name or ss number on XX/XX/XXXX. This was a non accredited college, that's closed. On Thursday, XX/XX/XXXX the Department of Education announced they will begin issuing Borrowers Defense to Repayment Discharges for up to {>= $1,000,000} in contested student loans.
