Complaint: National Credit Systems reported an alleged debt to my credit report. The collection account has appeared on my credit report without me ever been notified. It has been on my credit report for over 3 months. It caused me monetary damages and ruined my credit score since National Credit Systems reported a " collection account '' to the Credit Bureaus rather than reached out to talk or try to collect a debt first. They never sent any written information for over 3 months the account was on my credit report. I disputed the account with the Credit Bureau early in XXXX 2016. I disputed it with the National Credit Systems shortly thereafter. I called them to discuss just today XXXX/XXXX/2016. No resolutions have been reached as of yet. My credit score continues to be ruined. I need my credit report cleared and I need to learn about protections under the law that I can enjoy as related to Fair Credit Reporting Act. It is not right to just have any random person decide to place any alleged debt to another person 's credit report. This alleged debt appeared as a debt on my credit report with no prior checks, controls, verifications, or filtering by neither the collection agency or the Credit Bureaus. It is the same as anybody- your neighbor, ex spouse, ex employee ( XXXX ) would just make up a list of debts against you ( the reader ) and submit it to the Collection Agency. In turn Collection agency reports it to the Credit Bureau. Our XXXX does not attempt to resolve it with you, does not mail you anything, does not take you to courts, but resorts to malice and intimidation that hurts financially you personally and other businesses. I say the damage goes beyond my personal wallet as it also hurts other businesses and banks who decide not to do business with me and ultimately any of us in the same situation because of unjustly low scores. Responsible parties must be accountable for wrongdoing and the entry needs to be removed from my credit report. I need your assistance in this process.

Complaint: This charge is for my son 's lease on an apartment while he was in college. We hired an attorney to get him out of the lease because of proven mold issues and negligence. This lease was only signed by him at the time of termination. He indeed turned his key into the office but they are saying that he did not so they are charging him {$100.00}. I was a co-signer on the previous year lease but was not on this second year lease, that is how they have my information. This is direct retaliation for them having to terminate the lease agreement.

Complaint: A representative from National Credit Systems called my cell phone and did not leave a message. A few moments later, I received a call from my office ( different department ) saying that I had a call. Once the call was transferred, a lady on the other end asked to speak with me. At this point, I have never allowed any debt to contact my job, this is a very embarrassing issue. So I ask what the call is regarding and she says her name I believe, but I was unable to hear her. Then I politely asked her/him to repeat and then she gets a major attitude. She says that her name was XXXX with national Credit Systems and that she was collecting a debt. At this point, because she was being so disrespectful, I wanted to know an address to mail in a complaint. I will not allow anyone to treat me as she did. Then she would not give that information, she was able to say that she will continue to contact me on my job. I told them, on a recorded line, that they are not to contact me at my cell or my job. I will allow them to send me an email, but thats the extent of the communication I will allow. I called back and spoke with another woman, she was able to get me the address to file the complaint. I then asked to speak with a supervisor, who was calm at first, then rude. I asked her full name so that I could include it in this report and she would not give me that information. She only told me her name was XXXX XXXX in XXXX, XXXX. I know my rights as a consumer : " XXXX. Harassment or abuse A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Complaint: The original creditor, XXXX XXXX XXXX XXXX maliciously reported a fraudulent account to National Credit Systems XX/XX/2013. XXXX XXXX and I ( XXXX XXXX ) moved out XX/XX/2013. On our move out date the ledger proves that not only was there a XXXX balance with XXXX XXXX XXXX XXXX but we never missed a payment or was late and we also received our deposit back from them. We did n't have the best relationship with their staff, mind you, they were very rude people and treated residents as if we were inferior. 4 months later XXXX XXXX XXXX, who has managed XXXX XXXX XXXX XXXX for the past 4+ years, reported that XXXX and I allegedly owed {$550.00}. Because XXXX and I have lived in the same place for the past 3 years, we had no clue that this was even on our credit until we were denied an apartment home recently. I visited XXXX to pull my record and ledger to have them fax it over to National Credit Systems. XXXX ( XXXX XXXX XXXX ) informed me in person that they had no record of me ever living there but it was a joint account and she could pull up XXXX 's. NOTE : They deleted me from the account because we had a dispute. XXXX ( office manager ) would not print anything with my name until I brought the lease the next day that they lied and said they did n't have. However their corporate office insists that they do on recording. Once the lease was presented, she then faxed a letter head to NCS stating that they had no rental history on record for XXXX XXXX to National Credit Systems. XXXX and I still have the lease we signed. National Credit Systems also has this lease ( they use as validation of alleged debt ) because it was sent to them by XXXX. Since XXXX would not grant me anything in writing stating that I lived there and did n't ever owe a balance, this was not sufficient enough for the debt collector ( National Credit Systems ) to delete the file. The ledger showing XXXX balance was also not enough. XXXX XXXX of NCS insisted that XXXX was under " NEW '' management although they are not. He explained that because they are allegedly under new management, this is why they do not have my old records. However, XXXX 's name is still on the account there from when we lived there. My name is the only name deleted although it is on the lease. XXXX XXXX of National Credit Systems was very rude and wanted to loudly speak over me anytime I tried to explain this. When I decided that I no longer wanted to speak with this person, they continued to transfer me to him and he changed his name to XXXX XXXX as if I did n't realize I was speaking to the same person. He lied on his XXXX report stating that they are not XXXX in the same because he knows that he broke the FDCPA but they are the same. " XXXX XXXX '' had me send an email to XXXXXXXXXXXX, which is XXXX XXXX work email. I have both the email that was sent and the phone call was recorded. XXXX XXXX XXXX at XXXX has lied exceedingly to cover this up. XXXX XXXX aka XXXX XXXX at National Credit Systems is also going through great lengths to keep this on my credit as well. I have a meeting with my attorney in the morning and will be pursuing further legal action against both parties in their administrative and personal capacity.

Complaint: National Credit Systems put a file on my husband and my credit report. When I called several years ago when it first appeared the amount the were trying to collect was over XXXX. We knew we did not and had never owed that amount. The issue is we moved and had to break a lease. The owner of property had property management company take us to court for judgement on what was owed. They were awarded around XXXX from the court. Nothing more was to be owed. We began paying the property management company and have a ledger with their letterhead to prove that. I am not sure how or when National Credit Systems became involved but I did receive a letter and called them. When I attempted to give the facts they were hostile, rude, cussing me out and yelling. National Credit Systems has over the past few years changed the DATE on the account, the NAME on the account and the amount owed. We have gotten all credit bureaus to take it off when we send documents to them, but 3 or 4 wks later they put it back on with information changed and we start all over again. As the amount they now show is XXXX it is deeply hurting our credit. There is a judgement for the correct amount and per that court that is ALL WE OWE. THey have been told that and send that information on the judgement. If you look up this National Credit Systems online you will see all the shady things they do by reading reviews. We would like this taken off our credit and something done to this fraudulent company so they no longer bother us. I do not believe it is legal to CHANGE DATE, NAME and AMOUNT to keep sneaking it back on to our credit. We have called them as well and again get cussed at, threatened and they do not see that they are doing anything. Their attitude on phone is we can do what we want. This is not ok- to put false information on someones credit and then try to bully them into paying. How many people have they scammed that did not know to fight back? Please help. I have documents I can send that show judgement, ledger of payments and all the times they CHANGED the info to get it back on our reports. National Credit Systems is a fraudulent company scamming people and should be stopped.

Complaint: I have been in contact with this debt collection since day 1 trying to come up with settlement. They have my address and phone number to reach me any time. They garnished my wages a year ago, and I was told I was good with them and the apartment complex from now on. However, the debt collection company called me after I was sent a letter saying my account was settled asking for more money. Then, when I told them that was incorrect and I would not pay, they called my employer. I had made it clear to them that they could not contact my employer before, and I have always made sure they have my contact information. So not only are they asking me for debt that was settled, but they 're also still reporting to the credit agencies that my account is n't settled, and they have attempted calling my employer.

Complaint: For several years I have been trying to resolve a collection account with National Credit Systems. The collection account was originated by XXXX in XXXX, NC. Please see the attached copy of emails which describes the problems encountered. Due to the problems encountered at the XXXX with an infestation of XXXX, the Complainants were offered an early cancellation of the lease by the apartment manager onsite at the time without any fees or penalty. The Complainants accepted the offer and proceeded to move from the apartment. Apparently, later senior management decided to renege on the manager 's offer, and after the Complainant left the apartment they sent the Complainant a bill for the early cancellation of the lease. National Credit System, the debt collector, was allegedly contracted to collect the account. The Complainants had sent several letters to the debt collector explaining the situation, but the debt collector ignored the letters and continued to try to collect the alleged debt without verifying the Complainant 's information. The debt collector has not excised adequate due diligence to determine the validity of the account they are trying to collect despite request to so by the Complainants. The Consumer Financial Protection Board has stated in court case that the FDCPA " grants consumers a legal right to truthful information in their dealings with debt collectors, '' the CFPB said, citing the Supreme Court 's XXXX ruling in XXXX ( XXXX XXXX XXXX ). The debt collector in the Complainants case is in violation of the FDCPA as indicated by the CFPB due failure to provide the Complainants with truthful information. Furthermore, the alleged debt is prescribed by the North Carolina statute of limitations which states that a contract, obligation or liability arising out of a contract, express or implied, '' is three years in accordance with N.C. Gen. Stat. XXXX ( XXXX ). XXXX ( XXXX XXXX XXXX. XXXX XXXX, XXXX ). In addition, the debt collector is listed as an inactive debtor collector by the North Carolina Department of Insurance. As such the debt collector is trying to collect an alleged debt without a valid license as required by the State of North Carolina and in violation of N.C. Gen. Stat. XXXX which constitutes a felony. See citation below. The debt collector has engaged in unfair and deceptive acts, in violation of Regulation AA, by trying to collect a prescribed alleged debt and by providing a negative credit history to the credit bureaus to force the Complainants pay for debt that is not owed and a tool to collect a prescribed debt. This practice is also in violation of Fair Credit Reporting Act which prohibits creditors from providing false and inaccurate information to a credit bureau. The debtor failure to conduct adequate due diligence to determine the accuracy of the debt they are trying to collect after gaining knowledge of the disagreement with Apartment management and continuing to try to collect resulted in violation of the FCRA. The debt collector ignored the Complainants rights under the Fair Credit Reporting Act, and purposely ignored the information provided by the Complainants with the willful intention of inflicting financial damage to the Complainants. The Complainants in good faith recently offered to pay an amount of up to {$200.00} for the nuisance value of the debt 's collector action, but without accepting the alleged debt, however, the debt collector did not respond to the offer. However, the offer was made before the Complainants became aware of the debt 's collectors illegal practices, unfair and deceptive acts and practices, violations of the FDCPA, and North Carolina debt collection laws and criminal violations. Complaint: After giving this company a 30 day notice I mailed and emailed XXXX XXXX XXXX a 30 day notice that I would be moving out at the end of XXXX XXXX. I repeatedly tried to call them to meet me for a final walk through but no one responded. In XXXX XXXX, I received a bill for over {$4000.00} in " damages ''. I contacted XXXX XXXX notifying her that the amount was incorrect and sent pictures as well. She stated, " After my supervisor reviewed the pictures from your move out and your email in response to the charges, he has agreed to remove the paint charge of {$1200.00}. You still have a total of {$1700.00} of move out charges and balance owed to XXXX XXXX XXXX is {$2200.00}. You will need to talk with XXXX to set up payment arrangements. '' I contacted her stating that I did not owe any money for the floor because I did not damage the floor. Also the repair cost they stated was too high. The floor became damaged due to a leak from the AC unit in the attic. The maintenance personnel repaired the leak. Also I did not damage any cabinets or shelves. I noted that they were off track in the move in document. I notified the property management of the damage and they said it would be taken care of. The floor boards were never replaced. I contacted XXXX XXXX about getting a final settlement amount and payment arrangements. I called and sent several emails asking for an explanation of the {$2200.00}. No response from XXXX XXXX XXXX. In XXXX XXXX I received a collection notice from National Credit Systems Collection Agency stating that I owe {$2200.00} and must be paid as soon as possible. XXXX XXXX XXXX did not contact me concerning this after I made several attempts to settle the issue. It should not have been sent to National Credit Systems collection agency without giving opportunity to settle the issue.
