Complaint: my name at the time of this occurance was XXXX XXXX XXXX and on XXXX XXXX 2012 I typed up and hand delivered a notice to vacate my apartment before the lease term was up and listed the reasons why in this letter, and gave it to the Manager of the XXXX, chapel XXXX failed to provide a safe environment for my children and I so I gave them 30 days written notice and moved my children and myself outta that apartment complex, people in the stairwells doing and selling drugs offering them to my children when they come home, gunshots all the time I recall calling the police several times, unruly children and the list goes on and on ... the manager ignored all reports by doing nothing to prevent these things from happening. She did n't even live on the premises ... XXXX did not abide by the lease terms of providing a safe environment for tenants and they should not be coming after me for the remaining lease and ruining my credit, I had no choice but to move for the safety of my family!

Complaint: The final billing from the vendor ( XXXX DBA XXXX ) for utilities related to a lease agreement did not include validation of the amounts billed as related to administrative fees and proportional billing method ( no individual meter per unit ). The bill included charges for service for administrative fees and for a billing period after possession had been transferred. Information was requested for validation and not responded to in a method that could validate the amounts. The vendor was repeatedly asked for validation and clarification ( for which email documentation exists ) and would not provide, but sent the bill to collections. The billing included amounts accumulated for additional fees and amounts that not disclosed in the lease agreement and therefore not allowed according to the revised statutes of AZ. Also, the billing included charges for utilities after possession of the unit had been transferred back to XXXX. XXXX was requested to adjust the billed amount accordingly. Rather than adjusting, they sent the bill for collections. The lease agreement was for the period of XX/XX/XXXX to XX/XX/XXXX. Possession of the unit was transferred back to XXXX on XX/XX/XXXX and electric utilities were stopped ( included for information but not related to billing ). XXXX began renovation of the unit ( XXXX ) immediately and were utilizing utilities. My repeated attempts to clarify and obtain an accurate bill amount were not fruitful. The final billing was {$66.00} of which {$36.00} was for the period of XX/XX/XXXX to XX/XX/XXXX ( this period was after transfer of property back to XXXX ). Also, during the term the billed amounts included a administrative fee of {$3.00} per month for 11 months : {$38.00}. ( this amount was not disclosed in the lease contract so, by law not valid ). If both charges are invalid, the amount owing is $ XXXX If the Admin fee is valid but the final month not valid, the amount owed is {$30.00}. If the final month is valid, but the admin fee not valid, the amount owing is {$28.00}. As stated in my communication, paying the correct amount is not the issues, but having XXXX provide an accurate billing with proper disclosure of calculation and validation is. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. By law this info requested is to be sent within 5 days notice is received via certified mail. At this time I will also inform you that if your offices have or continue to report invalidated information to any of the XXXX major credit bureaus ( XXXX, XXXX, XXXX XXXX ), this action might constitute fraud under both federal and state laws. Due to this fact, if any negative mark is found or continues to report on any of my credit reports by your company or the company you represent, I will not hesitate in continuing legal action against you and your client for the following : Violation of the Fair Debt Collection Practices Act and Defamation of Character. Complaint: On XX/XX/XXXX I received communication via cell phone from IQ Data Collection Agency. I must admit the phone call was a surprise as I had attempted multiple times to get in touch with XXXX ( the leasing company that sent me to collections ) and never heard back from them. I verbalized this to XXXX, the debt collector who was assigned to my case. She then proceeded to tell me that she worked for XXXX and even made references to my lease agreement. Based on that lie, I continued with the conversation. I have very little experience in dealing with debt collection agencies. So, I was going into this with very little knowledge of my rights or what XXXX 's rights were as the debt collector. I have since educated myself and believe that XXXX violated several laws ( of which I will list at the end of this communication ). I also want it to be known that I am very seriously looking into taking legal action. I took responsibility for my debt and made it clear that I was more than willing to work with XXXX to find a resolution. Despite my willingness to be cooperative XXXX was rude and unhelpful right from the beginning. XXXX told me that I could not dispute the debt without my credit being negatively affected. She also told me that I could not make payments over time on my debt without my credit being negatively affected. I believe I was also told legal action could be taken against me which caused me further confusion and anxiety. Again, at this time I did not know what was possible and what was n't possible so this threat absolutely terrified me. Throughout our entire conversation she was a bully, dishonest, emotionally abusive, unhelpful, and took advantage of the fact that I did n't know what I was doing. I was bullied, yelled at, and berated until I was so upset I could n't even think clearly. I told her the way she was speaking to me was upsetting me, making my thoughts unclear, and that I was afraid. Her emotional abuse made me unable to have an effective and productive conversation. This was only fuel for her fire, and she made it well aware, that she was aware, of my state of mind, and continued with her bullying. I wanted to get the debt I owed taken care of and figured out, but not with her due to the way she was treating me. I asked to speak to someone else or a supervisor and she told me this was n't an option. This entire situation was incredibly traumatic. I am not used to dealing with humans who treat other humans as she did. I believe this to be a bad business practice no matter the type of business. I made a substantial payment towards my debt, but As of right now, I am still unclear what my options are or where my debt lies ; I am too traumatized and afraid to contact IQ Data directly after my horrible experience with them. As I mentioned I will be looking into taking legal action and once I do so I will have an even more clear understanding of which laws were in fact violated. Here are some the laws I believe IQ Data violated : 1. Unfair Acts or Practices The Dodd-Frank Act prohibits conduct that constitutes an unfair act or practice. An act or practice is unfair when : ( 1 ) It causes or is likely to cause substantial injury to consumers ; ( 2 ) The injury is not reasonably avoidable by consumers ; and ( 3 ) The injury is not outweighed by countervailing benefits to consumers or to competition. A " substantial injury '' typically takes the form of monetary harm, such as fees or costs paid by consumers because of the unfair act or practice. However, the injury does not have to be monetary. Although emotional impact and other subjective types of harm will not ordinarily amount to substantial injury, in certain circumstances emotional impacts may amount to or contribute to substantial injury. In addition, actual injury is not required ; a significant risk of concrete harm is sufficient.

Complaint: From the very first time the collection agency IQ Data International contacted my, they were very rude when talking to me. They talk down to me, constantly tell me " It 's not our fault that you did n't pay your rent, learn to pay your bills '', and say other demeaning things. They eventually stopped making contact after I continuously hung up on them when I realized who was calling and eventually stopped answering the calls. However, in an effort to clean up my credit, I have reached out to IQ Data this year in order to set up some type of payment arrangement and I was told " this is not customer service and I do n't have to be nice to you '', they never let me complete a sentence, they talk over you constantly. When I finally got them to offer something, they told me I had to pay {$800.00} and then the rest would come out of my taxes. After telling them that I ca n't afford that because I only make $ XXXX/year, I was told that 's not their problem and I need to call back when I have some money to pay. They stated that they will not work with me on making affordable payments. I do n't understand how I am supposed to pay this debt with such rude people handling the debt. Please help me!

Complaint: I moved out of my apartment and did a walk-through at the ending of XXXX XXXX, 2016. I never received a breakdown of the ending charges for the walkthrough however I was told it would be mailed to me. On XXXX XXXX I received a call from a collection agency called IQ International in regards to my previous Apartments. They told me that I owe {$470.00} was so I told them this was a mistake and I needed to call my previous Apartments. I called the apartment and they told me they made mistake on the bill and that they sent me a statement 2 weeks after I moved out ( XXXX XXXX ). XXXX XXXX XXXX managed by XXXX XXXX XXXX told me to wait a couple days before I call the agency which is not a collection agency. But the collection agency IQ International called me back ( the same day ) and told me if I do n't pay them in 10 days that I will pay 12 % of the balance each day and it will go on my credit report. So my lawyer sent a dispute of payment on XXXX/XXXX/16 & still have n't received a response. It just seems unethical that they did n't even give me 30 days to pay nor for the letter to even reach me. The collection agency responded to the Attorney General that they settled on XXXX/XXXX/16 ; however, my Attorney never received a response from them. And they reported it to the credit bureau.

Complaint: The company has been refusing to properly validate a debt that has been on my credit report for a long time, and I have been damaged as a result. The company claims that I had an original account with some other party and they have been assigned the right to collect it. They need to provide proof of everything about that to me. They need to provide the original contract between them and the original creditor with a true signature and a signature of a qualified employee of that original creditor, they need to provide the full accounting, they need to provide proof of the assignment or the purchase they made from the original creditor. The right of subrogation does not exist for a stranger to the transaction. XXXX XXXX XXXX, XXXX XXXX. There is no right to substitute someone or some entity that was not on an original contract. It is not allowed. I have never done business with this company and I have no idea who this company is.

Complaint: I was initially contacted by this agency and informed about an alleged debt. I then informed them of my bankruptcy case, and the inclusion of the original creditor they were attempting to collect on behalf of. The call stopped for a little over one month, then I began to receive credit monitoring alerts regarding a collection being reported. It turns out this company just, up and decided to start trying to collect during an automatic stay after they were notified. I contacted them regarding this new collection reporting, and they indicated that their compliance department handles this, but they could n't transfer me, nor could they talk to me.

Complaint: On XXXX/XXXX/2013 I received a 3 day pay or quit notice by mail from my apartment complex. I moved out on XXXX/XXXX/2013. The apartment complex never furnished me with receipts to cover the costs of the alleged debts I owed them resulting from damage and cleaning. Especially not within 21 days of my surrender of the unit. The apartment complex alleges that I owe them for unpaid rent and damages to the dwelling.
