Complaint: XXXX XXXX has submitted to the collection company Hunter Warfield unauthorized charges for cleaning fees from apartment I lived in for 1-year until XXXX/XXXX/XXXX California Civil Code Section 1950.5 States : " The tenant is not responsible for damages resulting from normal wear and tear You can not charge cleaning fees for conditions caused by normal wear and tear during the tenancy or previous tenancies, or for cleaning a rental unit that is as clean as it was when you moved in. '' Civil Code Section 1950.5 ( b ), ( e ). The lease agreement states : That I agree to leave the premises clean and in the same condition received, except for ordinary wear and tear. I left the premises in better condition then I received ( included are photos of the dirty apartment when I moved in ). According to the lease, California Civil Code and California Tenant Rights : when I provided my 30-day notice I 'm entitled to an " initial inspection '' that requires a list of proposed deductions beyond normal wear and tear. This inspection was scheduled on XXXX/XXXX/XXXX to be held on XXXX/XXXX/XXXX from XXXX-XXXX and no one showed up. I have phone records showing I called and talk to manager XXXX XXXX and she never got back to me, and no one showed up for my scheduled initial inspection. Under California Tenants ' Rights, the initial inspection shall provide itemized statement of intended deductions beyond normal wear and tear. The cleaning fees that Sequoia equities is charging are from normal wear and tear, which under California Civil Code Section 1950.5 I 'm not responsible for because I left the apartment in better condition and received my full deposit back. They have no documentation, stating that the cleaning fees are from beyond normal wear and tear because they never showed up to the agreed initial inspection providing me with the proposed deductions and the opportunity to fix any identified deficiencies beyond normal wear and tear. On XX/XX/XXXX I sent a letter to Hunter Warfield disputing these claims by providing evidence and asking them to validate the debt within the required 30-day period. Under the Fair Credit Reporting Act they are in violation by reporting these claims to the bureaus some 4-months later with no accurate validation required. After not receiving the validation. I contacted XXXX XXXX on XXXX/XXXX/XXXX no response so I called Hunter Warfield again on XXXX/XXXX/XXXX at XXXX pacific and talked to XXXX asking again for Validation they said " NO '' then a manager got on the phone and I asked him the same thing he said " NO '' then hung-up the phone.

Complaint: I first rec 'd a statement from both XXXX and Hunter Warfield stating that my owned balance was {$580.00} ... statement date XXXX/XXXX/15 from XXXX and XXXX/XXXX/15 from Hunter Warfield ... Now they ( Hunter Warfield ) saying that the balance is {$640.00} which is a difference of {$59.00} ... No explanation given at all. How is it that I receive XXXX statement and then turned over to collection less than 4 days later? The problem is that I was never given a chance to review, confirm or dispute their charges ... What happened to the 30 days I am allowed to dispute or pay and the other statements I should have rec 'd from XXXX XXXX XXXX XXXX XXXX which is owned XXXX XXXX XXXX XXXX? Complaint: An apartment complex has sold a debt to Hunter Warfield in my name. However, I was never legally responsible for the apartment, I never signed a lease or any other legal document ; or entered into a verbal contract. While I stayed at the address temporarily, I am not responsible for the outstanding balance. They obtained my information from mail that was sent to the address. There is an individual responsible and that information has been given to the original creditor and Hunter Warfield. Both XXXX and XXXX consider the debt verified, however I know that there is no legal connection between myself and the debt, and they will not provide me with this verification. The reporting agencies and Hunter Warfield refuse to remove the account from my report and my next step is legal action, Plain and simple ; This debt is not mine.

Complaint: The collection agency told me that if I paid by check instead of credit card I will save {$14.00}. I gave the company representative my routing number and checking account number. He said I could get a receipt by going to a particular website and he gave me my account number and PIN to get the receipt. I checked my bank account this morning and there was no check pending. I went to the website to get a receipt. There was no website. I called the company three times, XXXX at a number they had called me on and twice at the number the man I spoke to yesterday gave me as his number. XXXX call did get a message but with no identifying information such as the name of the company so I hung up. The other XXXX calls just rang and rang with no answer. I sent an email to support services at the company. At that point I became nervous that I had given my checking account number to an unknown man and that this might have been a scam. I called my bank and they advised me to put my account on hold which I did. I then called the number on the company 's website and the company receptionist transferred me to someone. I explained the situation, that I had put a hold on my checking account and why and that I wanted to pay by credit card today. He said that I had the URL of the website to get my receipt incorrect and that it takes 20 days to get a receipt. The person I actually made the payment to yesterday never told me it would take 20 days to get a receipt. The representative I spoke to today said that because I had put a hold on my account I had to pay the alleged debt in full. I explained again that I wanted to pay today by credit card instantaneously and he said I could not. I asked to speak to his supervisor which I did. I explained the situation to him although he interrupted a number of times. I said he should listen to the tape of the call so he could hear that I was not told it would take 20 days before I could get a receipt and that I would like the call to be emailed to me as well. He said that is not going to happen, that I had to pay in full because I put a hold on my account. He was extremely rude, cutting me off and hung up on me. I called back and asked to speak with the VP, President or Founder none of whom were in. I asked to speak with another supervisor higher than the one I had just spoken to. She was also very rude, would not work with me on a solution and was yelling at me. She did say she would pull the recording of the call and if the representative had not told me about the 20 days I could pay the discounted amount by credit card but this would take a while. I reiterated I wanted to pay it today by credit card so it was done and taken care of. She continued to yell at me and was abusive as the prior person had been. I asked her to put what she had said in writing and email it to me. She said they do not put anything in writing. I then politely ended the call. I called back and asked to speak with the administrative assistants for the VP, President or Founder and the receptionist said they were also not in. I asked if there was a quality assurance or complaints person and she said no. I asked to speak with anyone on a VP level. She took my name and phone number and said someone would call me. I asked for the email addresses of the VP, President and Founder and she said she had to get permission to give me those addresses. She was trying to be helpful and was pleasant.

Complaint: I was Leasing a house with XXXX other roommates. Vacated the property on XXXX XXXX - started receiving letters months later from Hunter Warfield that I owed in excess of {$3600.00} after my {$1000.00} security deposit was applied. I never received written notice from landlord stating my rights as a tenant to contest charges. I have repeatedly asked for invoices as to the damage and have been hung up on, harassed when I am working and am badgered with lawsuits, being told I have to get an attorney and that my credit will be wrecked if I do not pay. No one is willing to verify that this debt is accurate and when asked for copies of invoices I am told to get an attorney. I am a XXXX year old XXXX XXXX student supporting my way and do not have the luxury of an attorney. XXXX Statutes mandate that I am to be sent a written letter explaining the charges, the reasoning my security deposit is held and my rights to dispute and I have never received anything like that. I am told that they have photo 's, but I have photo 's date and time stamped as well proving many of the charges were falsified. I was told also that the leasing company is too big to provide the invoices so I should get an attorney just to verify that these charges are accurate. The charges were reported the day I vacated the property - how a house can have drywall, painting, cleaning all in the same day I moved out is ridiculous. The removal of items that they are claiming as well charging me for, are in my friends garage so obviously the leasing company went to our house prior to our move out. These charges make no sense, I was never officially notified by the leasing company and the debt collectors Hunter Warfield have no proof that the debt is even accurate but are putting on my credit report. The only proof of any letter sent by leasing company was to my former roommate. There is nothing showing my name. This is the email sent when I requested invoices " XXXX, Your lawyer can request invoices, not you I can share the pictures of the damage you were charged for as I did with XXXX. You must dispute the charges with a lawyer. They are not that easy to get, this is the XXXX largest XXXX single family home company in the XXXX and all is in XXXX through XXXX. Just dispute with a lawyer and have him request. '' This does not seem fair or legal to just put blanket charges on an invoice and give to collection agency.

I requested debt validation in accordance with FCRA rules and regulations and they failed to proof validity or ownership of this debt. However they are still reporting this on my credit report which is damaging my credit rating to an extend. I request they DELETE this collection from my report and STOP their harassing collection efforts once and for all!

Complaint: Hunter Warfield is attempting to collect a debt that I owe to XXXX XXXX XXXX Apartments. The amount is around {$16000.00}. I am disputing approximately {$10000.00}. I am not doing well health wise and I am having some problems communicating verbally at times. So, I wrote them a letter with the help from the legal aid office in XXXX. In the letter I disputed the {$10000.00} and gave the reasons for the dispute. I also attached another document as proof of the validity of my statement. I also requested them to stop communications with me by phone regarding the account. I requested this because I have n't been feeling well and have difficulties communicating. I want them to contact me in writing. I sent the letter via Priority Mail to Hunter Warfield, XXXX XXXX XXXX XXXX, XXXX, FL XXXX. The signature confirmation receipt # is XXXX XXXX XXXX XXXX XXXX receipt of the package was done on XXXX XXXX, 2015 at XXXX and was signed by XXXX XXXX. XXXX XXXX continued to called me daily and called me twice at work on my first day back since XXXX ( I 've been ill. ) And twice on my cell phone. The phone calls to my cell phone that day were at XXXX and XXXX on Wedenesday XXXX XXXX. The calls to my work were around the same time. I think XXXX calls in an afternoon is excessive. I answered the phone because I do not want to loose my job and they had called twice to it that afternoon. I told the man that I did not consent being recorded. He raised his voice and said that this was a business call and had to be recorded. I told him I did not consent to being recorded and asked him if they had received my letter. He recorded the conversation anyways. He did n't let me speak. I told him that I sent them a letter disputing the amount and requesting not being contacted by phone. That it was delivered and signed by XXXX XXXX. He said that he has n't seen any letter and I told him that they signed for it so they needed to get their act together and find it. I knew they received it. He said he had no letter and that since I did n't want to be contacted by phone that he was going to recommend to their client that they report me to the credit bureau that afternoon. I told him that I wanted communication to be in writing and he would n't let me speak. And continue to state that they were going to report me to the credit agencies. I told him that he needs to find that letter because I 'm disputing a large portion of the amount. He hung up. So he recorded me without my consent. He denied receipt of the letter even though it was delivered and signed by Hunter Warfield. And they are not allowing me to dispute a portion of the debt. In my view, they are attempting to collect the wrong amount by denying receipt of it and by not respecting my request of ceasing communication by phone, and then retaliating against me for it. The address to which I sent the letter is the address that was on the only debt collection letter that I received. If that is not the correct address they are not being fair. They should n't be able to only give people one means to communicate. I should n't have to be bullied into talking to them over the phone if I am not feeling well and I am having difficulties. I should be able to dispute the amount in writing if I think it is wrong and provide documentation for it. Their system does not allow for a fair dispute of debt. In my view, they are trying to confuse people into thinking that they have to do everything by phone. I think that their system is set up so they can deny receipt of dispute letters and then collect full amounts or threaten people with retaliation. It 's not fair. I got my collection letter. Wrote a dispute letter and sent it through registered mail. I asked for communication to be in writing and now I 'm being retaliated against.
