Complaint: I have already filed a comlaint about this but have a new issure with this company. I had a mortgage with First Merit bank. They had a law form send me the only notice i ever recieved dated XX/XX/2015 that i recieved on XX/XX/2015. This notice wa as i stated the only notice i ever got from then. It stated that they were plannnig to hold a forclosure sution on XX/XX/2015 for my house. Even this law firm admits they have no prof thatbo recieved prior notice of this. Well i sold this house for cash before they did anything. This loan was paid in full an closed on XX/XX/2015. The title company as well as the broker that did the closing said they never heard of a bank being able to charge for a fee called uncollected attorney costs when this was sold sn paid before it was forclosed. There is also nothing listed as to where an how much was applyied to this account that was being held untill it was paid. Then the final complaint i have is that on tuesday XX/XX/2015 sbout 15 minutes after i was relashed from a hospital where i under went a XXXX that i was unable to complete. I recieved a phone call from collections at First merrt bank. The guy asked me if i can pay the past due smount an if i plan to keep this home. Thats when i let him have it for reuining my day further after not being able to complate my XXXX. They do not have employees that can do there job an dont know to check things before they call an harrash people. I do feel they over charged me for this uncollected attorney costs that should be there exprense then to have to deal with somebody that does not have intellagence to know that this was paid 8 days before they harrash me. I now deel that First merit bank owes me a public appalogy as well as a refund for these fees assl as interest. They do not care about service they only want money. I have been in contact with a consumer protection attorney an looking into suing them for harrashment as well as XXXX medical bils from the strss they have now caused. Thank very much

Complaint: After First Merit Bank branch manger XXXX XXXX learned that I and my wife had filed complaints against the bank, and after he ignored my attempts to contact him about the Bank 's FRAUD & PHYSICAL THREAT, XXXX called me to say that the bank decided to close out my checking and savings accounts. This is RETALIATION. This will now cause me great harm, as I have several bills automatically due and scheduled. This will cause me late fees and damage my credit score. Also, the bank is causing checks to bounce. Such RETALIATION by the bank is totally against the public interest. In light of this, I requested that the bank keep my accounts open for 30 days to allow me to rearrange my bill payments. XXXX ARROGANTLY refused.

Complaint: I told First Merit Bank employees on XXXX XXXX that my wife and I would file complaints against it with the CFPB. Simultaneously, I presented a corporate dividend check for {$3.00}, cashed it, and then deposited the money into my checking account, as has been the pattern I have utilized cashing and depositing for the past five years. However, in retaliation, First Merit Bank employees at the XXXX XXXX, Ohio, branch afterwards put a hold on the check. Since no holds were ever placed previously on at least 99 % of my checks, it is obvious that First Merit Bank maliciously placed the hold in retaliation. I complained to employee XXXX XXXX XXXX the morning of Saturday, XXXX XXXX, 2015 about the " lousy service '' and requested that the branch manager ( not in ) contact me. XXXX 's response was to lean forward, make an ugly face and threaten me physically by " escorting '' me out because he did not want his customers to hear anyone complaining. In disgust, I left.

Complaint: First Merit Bank and its employee XXXX XXXX XXXX committed fraud by lying to me on more than one occasion. On XXXX XXXX, 2015, in response to the Bank 's advertisement for free checking, I inquired in person at its XXXX XXXX, Ohio branch. The ad stated " no minimum balance '' and " no monthly maintenance fee ''. I asked about transfer of money and was told by XXXX that I could transfer the money anywhere without a fee. I and my husband, XXXX XXXX, spent considerable time asking questions, including " whether there were any hidden fees ''. XXXX repeatedly stated that the account was totally free. He also told me that I would be given a {$150.00} bonus if I set up direct deposit. Based on his extensive information and answers, I opened a checking account. The person who handled the opening, under the direction of XXXX, is identified on the receipt as " XXXX ''. I was given a receipt for the deposit, but NO schedule of fees, which I did not expect because XXXX told me that there were no fees.
I then went through the timely effort of switching my direct deposit instructions with my employer.
Shortly afterwards, when I tried to transfer money from this account, I learned that there would be a fee. I complained in person to XXXX. He then told me that only transfers to another account at First Merit Bank are free ( which he knew I did not have ) and that transfers to other institutions required payment of fees. I, with my husband present during this discussion, requested that my account be closed because he, XXXX, had given me wrong information at the time I opened the account. To cover his earlier lies, he said that there would be a fee if I closed the account within 90 days. I was never informed of this when I opened the account, being told that there were no fees whatsoever. He refused to give me the full balance in my account.
So, based on his advice to " wait at least three months to get ALL of your money back '', I did not withdraw any money. XXXX, never told me that by waiting I would be charged an inactivity fee. Again, XXXX committed fraud by misleading me.
Shortly afterwards because I could not transfer my money out to another institution without being charged a fee on the " free '' checking promised by XXXX, I went through additional effort to change my direct deposit of salary from First Merit Bank back to my previous bank.
I was never credited {$150.00} for setting up direct deposit with First Merit Bank.
Today, I went to the same branch to withdraw the balance of my money and close the not useful account. XXXX failed to give me the full amount I had deposited, but kept {$28.00} of my money. When I asked him why he had not given me the full amount of my deposit, he stated that there was an inactive account fee. I was never informed of this, either at the time of opening the account or when I complained about his lying about free transfers.
When my husband complained to him about the lousy service and asked to have the branch manager informed, XXXX with a mean look on his face and a shouted voice, threatened to " escort ( him ) outside '', saying that he, XXXX, did not want any other customer to hear a complaint.
First Merit Bank employee XXXX repeatedly misled me and lied to me. He did not once indicate that there were any fees, but repeatedly stated that there were none. XXXX should be fired for purposely deceiving a consumer and First Merit Bank should both be fined for its fraud upon the public and institute a mandatory retraining of all its employees regarding not lying to, but informing, potential and actual customers of fees.
Furthermore, First Merit Bank should refund to me {$28.00} plus interest and pay me {$150.00} for setting up direct deposit based upon its fraud.

Complaint: FirstMerit recommended that I turn on overdraft allowances to my account so that I can overdraw and they will let me but charge a fee. I did opt in for this. In their Online Banking, it talks about what a great program this is for you and why you should use it. They are just scamming people into entering a program to steal our money basically. I made a few transactions with my debit card and there were plenty of funds in my account to cover them. I then waited a few days and then withdrew {$140.00} at an ATM, knowing that I was going to use the program and overdraw my account and be charged a {$35.00} fee. In my Online Banking then, everything posted just fine. Every transaction that had been done days before the ATM withdrawal were listed and a positive balance listed after. Finally, another day later the ATM transaction showed posted to a negative balance. The following day I was charged XXXX {$35.00} overdraft fees totaling {$240.00} in a negative balance on my account. This is absolute robbery and they refuse to refund my funds for no real reason at all other than having had XXXX fees waived in the beginning of the year already. Those fees were done in branch error and were refunded because it was their fault. So no courtesy waiver was ever given to me, which this is n't even a courtesy waiver! They can not charge XXXX overdraft fees for XXXX overdrawn transaction that was done days after any other transaction and after their cut-off processing times anyway. It 's ridiculous to think that banking regulations would allow such a robbery from the public. But even so, the ATM withdrawal was days after anything else so it should have caused the only {$35.00} overdraft fee. I 'm more than happy to pay this fee, as I did withdrawal these funds in excess of my account balance. But I did this because the bank told me what a great opportunity this program was to be able to do that now and then. I never would have signed up if I knew they were using such deceptive processes, as to turn a {$130.00} overdraft done by XXXX transaction days after anything else into a negative balance of {$380.00}. I followed their recommendation and now it 's going to take my entire paycheck nearly and I do n't know what I 'll do when it should 've been XXXX simple fee since it was done so long after anything else and only XXXX transaction overdrew.

Complaint: My bank is small and only in Michigan. I was out of town for 3 weeks and needed to make a deposit via an app in order to avoid an overdraft fee. First Merit Bank does not allow overdrawn accounts to use any online/app features. So I was unable to make the deposit necessary to avoid the overdraft fees. They also would not close or suspend my account ( because it was overdrawn ) to avoid the overdraft fees. So XXXX {$35.00} overdraft fees were charged for being {$0.00} overdrawn with no means available to me to make a deposit while out of state, or stop further overdraft fees from being added. First Merit asserts that I must pay these fees or have them negatively affect my credit rating. This is the definition of criminal activity.

Complaint: XXXX and myself owned a business we had a BANKER ( XXXX XXXX from XXXX ) come to us and see if he could do some finances for our business with us, we told him we would like to take out a small business loan and use it to pay off our home mortgage and our business mortgages using our XXXX commercial properties he agreed that would be something his bank could handle. It ended up by us loosing our business ALL of our properties to include our home and with paper work that has been used wrongly. It is very hard to explain however what the paper I have does not match what is in Register of needs. We hired Attorney on our home and they did NOT present any evidence on our behalf and I Had given them more then any one could believe, there excuse was it would only confuse the Judge! Well it also confuses anyone who looks at it. So now I am turning to anyone who can help us clean up this mess and get our money back that was wrongfully taken from us. This involves XXXX that is why it is so confusing and the BANKS would not do anything to help I might add the original Bank was bought out XXXX since this all started and I got the run around from all of them. All of the Evidence the banks Attorneys brought forward is in question because we did not knowingly sign any mortgage on our home and we never sign in front of a notary even if they say we did and I can also prove that is a lie. So as you can see this is a confusing mess, but some one has to care enough to get to the bottom of all of this we are now out of money do to all the attorney fees so far and we still have no answers because it never went to court with our evince the Judge did a summary judgment which was never asked for. So if there is any thing you can do for us to find out where the XXXX loan money went if it did not pay off our home. Please help us! We wrote Senator XXXX and he his the one who told us to get ahold of you for help.

Complaint: I has an account with First Merit Bank. In XXXX 2015 I closed the account. In XXXX 2015, I received a text message from First Merit that I owed {$100.00} for an automatic deduction in XX/XX/XXXX made from my closed account and a late fee for not having money in my closed account to pay for it. I confronted First Merit asking them why they would indebt a closed account. They said I now owe {$150.00} since I have n't paid for the XX/XX/XXXX overdraw. I then asked them if a person walked in with a check written by me and tried to cash it after my account was closed in XX/XX/XXXX, would they cash it and they said no.

Complaint: I suffered a severe hardship, I have been XXXX since XX/XX/XXXX. I finally had a hearing for my social security XXXX benefits on XX/XX/XXXX, which the judge approved my case. I contacted my mortgage company the same week and spoke to XXXX and informed him that I had been approved however, I would not receive my approval letter for up to XXXX days per Social Security Administration. XXXX informed me that as long as I keep the lines of communication open I should be ok. I have told the mortgage company almost every month that I have been waiting on Social Security. I fell behind and did not pay XXXX or XXXX payment. I received a letter from First Merit Bank dated XX/XX/XXXX stating that I was in breach of contract and that I need to pay XXXX, XXXX, XXXX and XXXX in order to not face foreclosure. I paid {$800.00} last week and {$1800.00} today XX/XX/XXXX. That is the total due minus XXXX payment. I have been informed of my contract that I signed by many collections agents but when I informed them that I am not yet obligated to pay XXXX payment they keep threatening me because I have not yet paid for XXXX. At this time I feel they are doing something illegal due to the fact that my contract states that my payment is due on the XXXX of each month and not a day before, however, they are trying to squeeze another payment in advance from me and have stated that they will not apply any of the money I have paid to my mortgage, setting me up to be foreclosed on. I have shown good faith by making the past due payment and I just want the threats and harassment to stop. I have health issues and certainly not trying to avoid making a payment. I do have children and XXXX at First Merit uses many threats as I have spoken to her a couple of times. I have asked to speak to XXXX and the team lead refused. I asked XXXX at the bank to give me the total due today minus the XXXX payment and he refused and I called back to speak to XXXX who gave me the amount and yet again he advised me that I am still in breach despite me paying XXXX, XXXX, XXXX mortgage payments and all fees except the XXXX payment. I have applied for modification on XXXX occasions this year and was denied both times due to the amount of income. I have been proactive in contacting the mortgage company however have been received with snide comments and sarcasm. I understand they are in collections but I am reaching out to them and they are rude and callous. The team lead, was the very worst and he was the most rude. First Merit Bank have very limited number of branches in XXXX XXXX, they do not have an online payment system, they are only open Monday-Friday until XXXX thus making it very difficult to make convenient payments or have any questions answered. I have tried to reason with the bank to no avail. I am more than willing to make all payments that I am obligated to make, but I am looking for some reprieve because I am doing the very best that I can and will continue to make the payments and get completely caught up once I start receiving regular payments from the Social Security Administration.
