Complaint: On XXXX XXXX, 2015 I changed my mortgage insurance company Fay servicing was faxed the information from my broker on this day. In XXXX Fay servicing said we had no insurance so I had the broker XXXX XXXX Insure All ) re-fax the information to Fay servicing. In XXXX I called Fay servicing to see if everything was in order and the informed me that they had not received the fax any of the times it was sent to them. So I called the insurance company XXXX XXXX underwriting services ) and had them fax directly to Fay servicing the paperwork that shows I have insurance. Fay servicing said that they did not receive it by fax so the insurance company e-mailed me the documents and I e-mailed them to Fay servicing. This has been done XXXX times now and I sent the information by certified mail to them at the address that Fay servicing gave to me. Fay servicing has not recognized my insurance and this is now a problem because if payment to the insurance company is not made by XXXX XXXX, 2015 I will be cancelled. On XXXX XXXX XXXX, 2015 I talked to Fay servicing and spoke with XXXX XXXX, he had me e-mail the PDF directly to him as we talked, he then stated that he received it and was scanning it to send to everyone 's e -mail in the office as he was talking to me. I asked if I should call back tomorrow and he asked if I would give him XXXX hours to get the information to the insurance department and get a response from the so he could correct the issue. He also stated that I talk to no one but him. I gave him his XXXX hours and on XXXX XXXX, 2015 I called him at XXXX at XXXX and XXXX my time and I left a voice message each time. It is XXXX my time today and he has yet to respond to my two messages. This issue needs to be resolved before the XXXX of XXXX.

Complaint: -XX/XX/XXXX Purchased home. Equity soared $ XXXX within first year.
-XX/XX/XXXX. Victim of Predatory Loan thru XXXX and XXXX XXXX XXXX.
Pressured for months into agreeing/signing, forged paperwork and took out way more equity than was requested.
-XX/XX/XXXX XXXX 'acquired ' XXXX-XX/XX/XXXX to XX/XX/XXXX..making on time payments. no problems.
-XX/XX/XXXX Homeowner separated/divorced.
-XX/XX/XXXX Payments were getting bigger and the loan principle rose enormously. Asked XXXX to modify for months. Submitted paperwork XXXX times before acceptance.
-XX/XX/XXXX Granted Trial Plan Agreement from XXXX. 3 months at {$670.00} then modification. Homeowner paid for XXXX months. After XXXX months homeowner 's request for the paperwork to modify was denied and told the offer was rescinded. XXXX would not honor the trial plan and offered no reason. Homeowner was devastated but continued to make the payments. XXXX breached the Trial Modification Agreement.
-XX/XX/XXXX made a CASH payment at the branch ( have receipt ). I was upset they reneged but still wanted to make my payment every month. A few days later I noticed the payment was posted in the computer online account as being 'received ' on XX/XX/XXXX. A blatant mis-posting of my cash payment which quickly sent the account into acceleration and foreclosure as the system saw it as missing a payment in XX/XX/XXXX. Fraud! That has since been admitted to in Federal Court.
-XX/XX/XXXX. Inquired at XXXX XXXX branches with only shrugs from the employees as to the issue. Their stance was that cash payments are posted to the account on the day they are made. They could NOT explain how or why it was posted a day later in their system and could not fix it.
-XX/XX/XXXX attempt to make payment declined-XX/XX/XXXX. Certified letter was sent to XXXX XXXX XXXX , XXXX Vice President of Customer Care explaining the issue of mis-posting my cash payment on the wrong date.
-XX/XX/XXXX. Received response letter from XXXX, they were " looking into it '' -Meanwhile the online account was deactivated by XXXX and the acceleration letters and foreclosure threats stopped! In lieu I was sent multiple offers to short sale my property for {$25000.00} Yes XXXX! I refused as it was a matter of principle and why should I sell my house when XXXX committed fraud?
-XX/XX/XXXX First of several attorneys retained to defend me. Had a Mortgage Audit performed through the attorney and paid an additional {$1000.00}. Homeowner has Never received the results after fervently requesting them for years. Scammed.
-XX/XX/XXXX Mortgage was sold to XXXX XXXX XXXX , XXXX. This was a FRAUDULENT TRANSFER and XXXX has never been held accountable for what they did to me. I have held strong through XXXX, XXXX, XXXX, XXXX, and now Fay. only to lose and have a sale date granted.
-XX/XX/XXXX Advised by my attorney to get her a Bankruptcy # to give the Judge at the summary hearing. That 's MALPRACTICE. Homeowner was forced to file bankruptcy. The attorneys I hired were all unable to ever defend me in my local court system. courts and Judges side with the Banks.
-Assumed owner of loan/plaintiff has been transferred or substituted several times since the case was opened. No chain of title. I know all the lingo just ca n't get it enforced. The current 'holder ' being located in the XXXX XXXX under a tax haven provided by the U.S. government.
-Plaintiffs have been 'substituted ' and changed several times and get full rights on their end but NO JUDGE has ever heard my defenses. Responses and motions are submitted to the docket but never heard. Creditor ignored the Federal Bankruptcy Judges ORDER TO MEDIATE, never complied, then came after the property through the circuit court after debt was discharged.

Complaint: Tried to contact my new mortgage servicing company ( Fay Servicing ) that purchased my loan from XXXX XXXX XXXX. Per their website XXXX I attempted to call them during normal business hours at XXXX at XXXX XXXX central time or XXXX XXXX local time ( mountain ) and the phone message says they are currently closed and gives normal business hours that also say they should currently be open. In addition the mail box for leaving a message so someone can call you back on the next business day is full so I can not even leave a message to have someone contact me. Being closed when you are supposed to be open to help customers makes it very difficult to do business and get help solving issues especially for a customer that just had their loan transferred from a large financial institution to one that has never been heard of.

Take in consideration this loan had a second mortgage for {$69000.00} that was settle with collection agency.
Please know that I Purchase property XXXX on XX/XX/XXXX for {$340000.00} XXXX ( second ballon mortgage XXXX ) {$270000.00} ( first ) and {$69000.00} ( second ) I have been trying to be qualify for loan modification since XXXX since that time my primary lender XXXX sold loan to XXXX XXXX XXXX since then I been working with lender for a loan modification ; I Was placed several trials and after handwork and disputing with the bank who took five years to modify my loan I finally got it. In the middle on the XXXX loan to be modify XXXX XXXX XXXX sold the XXXX loan to XXXX mortgage and took long time to finally modify first mortgage. The XXXX mortgage was sold to a collection agency for {$88000.00} approx I thanks XXXX I negotiated and settled the account XXXX Now XXXX added lots junk fees and other fee that not sure where was coming from that make me to dealing with a predator lender bank is adding all the junk fees back to the loan making me owed more that what is the property worth at the current market.. I owed according to XXXX XXXX XXXX approx $ XXXX all modification paper was sent I contacted lender to explain to me in detail where all this extra fees were coming from ; why my loan is more than previous balance when was originated. i understand that was late on my payment but was not my fault when i was paying my trial and bank took long time to finalize the loan modification. Adding too much money for a property is still underwater and now more than previously. I feel that XXXX XXXX is a predator lender and put me in an very bad financial situation. it feels like will never pay this loan its balance will never ended.. Finally I received a letter where XXXX XXXX XXXX sold the loan to Fay financial servicing like it was a brand new loan with a extremely higher amount.. Would like to know if this is not what we call predator lender and why XXXX XXXX XXXX penalized me so hard increment my loan where it would never be paid. An asking the CFPB to please help me to investigate why XXXX XXXX XXXX charged me so much on extra fees making owing more on a property that will never recap its value.. I need to get some reduction on this overcharged /junk fees amount now I have been charge with.. Also my current monthly payment will be increased for the next 4 years to a monthly payment that probably could not afford.

Complaint: I received a letter from Fay Servicing , LLC dated XXXX XXXX, 2015 that my mortgage loan was sold, transferred or assigned to a new creditor, XXXX XXXX XXXX. The date the loan was sold to the new creditor was XXXX XXXX, 2015. This is the third time my mortgage loan has been sold right before finalization of my deed in lieu of foreclosure resulting in multiple unsuccessful attempts to complete the foreclosure process. Not only is this frustrating, but I was not given the appropriate notice about the creditor change. I should have been given no less than 15 days notice before the effective date of the transfer.
