Complaint: My Mortgage was sold to fay services from XXXX bankThey have had it messed up from day one first the did not have my escrow payment info said they did not get it from XXXXthen they said my payment was late in the amount of XXXX dollars not XXXX and i owed XXXX of those payment ( wrong again ) I sent them XXXX payment for correct amount girl gave me but she says she can not post until escrow is straighten out that she admitted they have XXXX upThis is going on two weeks now and i am not getting phone calls returned have requested a Supervisor to call me but no action on there partI am in the middle of a refi with another property and am going to lose my refi if i do not show my payment paid in full they refuse to do this return calls because you always get a recording when you do get thru every one is to busy to talk to youI have never dealt with a company this bad in my life0 cutomer serviceMy Credit is getting ding aswellPlease help mealso sending this to my congressman

Complaint: I received a letter dated XXXX XXXX, 2015 that my mortgage had been sold to XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX, NY XXXX and the new servicer was XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX NJ XXXX XXXX. The letter indicates the loan was transferred on XXXX XXXX, 2015 but as of XXXX XXXX, 2015, the transfer of ownership had not been recorded in public records. I called the number, only automated service is available, no option to speak to a live person, and was informed my loan had been transferred to a new service provider, and to address any questions to the new service provider, but did not inform me of the name of the new service provider or the date of the transfer. As of XXXX XXXX, 2015, I have not received any notice from XXXX XXXX XXXX or from XXXX, XXXX that they are no longer the owners/service providers of my mortgage. Meanwhile, I have received a letter from an entity " XXXX XXXX '' ( self identified as a debt collector ) submitting a " temporary mortgage statement '' asking me to pay them {$1700.00}. Nothing in the letter indicates my loan has been transferred or sold. I next received a generic note in a hand addressed envelope from XXXX XXXX ( again self-identified as a debt collector ) saying it had recently acquired the servicing of my loan. My name does not appear on the note, no dates are given, and no loan number is identified. I called the number on the card and was told my loan was transferred to them on XXXX XXXX, 2015. As of XXXX XXXX, 2015, I have not received any statement from " XXXX XXXX '' or anyone else indicating my loan was no longer at XXXX XXXX XXXX or from XXXX, XXXX. According to the FTC website, I am entitled by law to receive within 15 days of any transfer, the following information from the new servicer : 1. the name and address of the new servicer 2. the date the current servicer will stop accepting your mortgage payments 3. the date the new servicer will begin accepting your mortgage payments 4. telephone numbers ( either toll-free or collect ), for the current and new mortgage servicer, for information about the transfer 5. whether you can continue any optional insurance, such as credit life or XXXX insurance ; what action you must take to maintain coverage ; and whether the insurance terms will change 6. a statement that the transfer will not affect any terms or conditions of your mortgage, except those directly related to the servicing of the loan. For example, if your contract says you were allowed to pay property taxes and insurance premiums on your own, the new servicer can not demand that you establish an escrow account. 7. a statement explaining your rights and what to do if you have a question or complaint about the servicing of your loan. I have not received this information and am afraid THIS IS SOME SORT OF SCAM. When I requested the information from the person who answered the phone at " XXXX XXXX '' she told me to contact my previous service provider ( presumably the one with only an automated phone system and no information ) and that any complaint I had was with the previous service provider. There is a message on my telephone answering system from " XXXX XXXX '' that states the call is for debt collection. I have never missed or been late on a mortgage payment in 20 years. In the past 20 years, whenever my mortgage has been sold or transferred, I received timely and complete notices, and automatic payments continued without interruption. The lack of professionalism and failure to provide information in this supposed " transaction '' makes me very suspicious as to the legitimacy of the entities involved. I BELIEVE THIS IS A SCAM IN PROGRESS.

Complaint: Applied for Mortgage assistance with Fay servicing and recieved and offer of a loan modification by phone on XXXX/XXXX/15 and recieved written offer on XXXX/XXXX/2015. The new mortage payment under the TPP was more than I had been expecting at almost fifty percent of my take home pay. I consulted with my housing counselor who was unable to determine from the modification offer letter the type of modification i was being offered. My housing couselor then contacted my assisigned specialist at Fay servicing to enquire about the offer I had recieved. The specialist informed him that it was a propriortory, that the HAMP modification had been denied due to insufficant income and insufficant yeild. When my housing counselor asked him if a denial letter had been sent, he was told that no letter had been sent to me because they were able to offer me the propriotory modification. Because I was not sent a denial letter, and therefore did not know that my modification offer was not a HAMP, I was unaware of oppurtunity to appeal HAMP denial. Fay servicing specialist has advised me to appeal denial at this time however if a denial letter had been sent to me at time of HAMP denial, I could have appealed sooner and avoided delays in modification process.

Complaint: During the summer, I was working with account manager, XXXX XXXX, of Fay Servicing , LLC to secure a modification. The loan was in my parent 's name who are deceased but I became owner after I filed the " Death of Joint Tenants at the XXXX XXXX XXXX XXXX Office. I was also appointed Administrator. I submitted the modification papers to her in early XXXX 2015 and provided the necessary supporting documents as requested. My last verbal communication with XXXX XXXX was the XXXX week of XXXX where she informed me that their company had to send someone out to the property to take pictures from the inside and outside to assess the property and to confirm that the property is actually being occupied. She said that this was necessary as part of the modification application. Someone from XXXX XXXX came the same day to assess the property. As soon as I received a copy of the assessment a three weeks later ( see attached assessment ), I received a letter from Fay Servicing reading that my modification I did not qualify for the modification and that I have been deemed ineligible for " Failure to submit a completed initial Package in the time-frame requested. " I called XXXX XXXX many times to explain my I received such letter when I have submitted all requested paperwork to her in a timely manner. She never returned my call. I left several messages on her voicemail. I even called to see if she was in her office. The operator said she was in her office. I sent her an email on XXXX XXXX, 2015 at XXXX. Pacific Standard time stating " I just received a letter from Fay denying my modification due to paperwork not submitted timely. I have submitted all paperwork to your office you requested in a timely manner. What is the issue? '' There was no response ( see attachment ). After several calls to her office again, I emailed her on XXXX XXXX, 2015 at XXXX stating " I have called and emailed you concerning my modification and you have yet to return my calls or email. If I submitted all my paperwork to your office as you requested, why was I sent a letter staying [ XXXX ] that my paperwork was not submitted on time. Last time, I called, the operator said you were in the office. I think it is odd that I am not getting any responses from your office. Please reply. '' Still, no response ( see attachment ).

Complaint: Fay Servicing has taken over one year to get our mortgage dealt with that they acquired XX/XX/XXXX. This has destroyed our credit file, they are unwilling to show current status XX/XX/XXXX, or give me a quick refi due to the over 9 % ( XXXX ) we are at now. It takes weeks to get an answer, and seems this is a top down mentality to ignore clients. I deal with delays due to communication for weeks, up to a month - that is with me emailing weekly doing follow up. All requested paperwork from Fay was sent in XX/XX/XXXX, at once. Then we are told they did not receive parts. We find that strange because it was all sent in as one package, to say you got some parts, but not all is suspect - which meant more delays. Many times I asked for a stays update, always saying not the right paperwork ( company canned answer ). I can prove my paperwork was sent in, however they choose not to act, instead ignore the facts. Finally after 4/5 months XX/XX/XXXX they put me on a Forbearance Agreement that lasted two months, then a Trial Modification Agreement that lasted four months, then finally after a year ( XXXX 5 months wasted ) my loan was modified to be current only - no mention of a better rate. In the meantime our credit file has felt these timely delays on the part of Fay Servicing only to result in a declined score. One would think that this is done by design to trap people in high rates and bleed them as long as possible, due to the unwillingness to work with their client. A simple XXXX search told me a lot.

Complaint: Fay Servicing Appeals RE : XXXX XXXX XXXX Account Number XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XX/XX/XXXXI am writing to appeal in response to the letter of denial on the loan modification application for account XXXX. I am really at a loss in why this was denied and the overall review process that took place was very confusing and perplexing. I submitted the modification packet to Fay Servicing on XXXX/XXXX/XXXX. They requested additional information numerous times. In particular they requested 'official ' bank statements on three separate occasions, even though I had already faxed/emailed them in three times. I received a certified letter, dated XXXX/XXXX/XXXX, stating that the modification had been denied because I failed to submit a completed initial package in the time frame they requested. I submitted everything they asked for in a timely manner and each time I called in to follow up with the account manager I was told you have sent in everything and that it is in review. I then received a notice dated XXXX/XXXX/XXXX, that they received the documentation and no further documents were needed at this time. Three days later I received a notice of intent to begin foreclosure proceedings. Finally I was told the modification was denied because I had insufficient income to achieve a payment that would qualify for the program. I do n't understand this as no explanation was given. In the same denial letter, they said my current housing expenses is less that equal to XXXX % of my gross income ( meaning that I make too much money?? ) Again I am at a loss. And then finally they said that the number of modifications I have received exceeded the allowable amount. I have only received one modification and that was XX/XX/XXXX, after a period of which I was unemployed. I have been offered a modification by XXXX XXXX and I honored it by making the trial period payments. However they sold the note and transferred the mortgage to XXXX XXXX XXXX XXXX, of which they did not honor the modification, even though I completed the third trial period payment to them. They in turn transferred the note back to XXXX XXXX and again they offered me a modification, but transferred to the note to Fay Servicing before the modification trial period even began. This entire experience has been very very stressful and time consuming. I have attached the initial request for a modification due to a divorce and a XXXX XXXX. I would very much like to maintain the home and raise my XXXX boys in the home. I would very much like to continue making payments and improving my credit rating. I feel as though I have done more than my part in effort to make this home affordable. However I have received nothing but red tape and a history of the loan being transferred four times now since I applied for the initial modification with XXXX XXXX XX/XX/XXXX. I have all documentation to support this appeal and will be happy to supply upon request. I further request an appeal of the denied modification as I feel I have sufficient income to support a payment, I have not received a modification that has been honored by the mortgage company 's involved. Complaint: XX/XX/XXXX, my wife and I purchased a home in XXXX, XXXX with a FHA Loan in the amount of {$270000.00}. The house had been on the market for 30 days. The loan was financed through XXXX XXXX, which was later sold to XXXX XXXX, XXXX XXXX, and XXXX other companies, one being Fay Servicing which is located in XXXX, XXXX. Each time our mortgage was sold it became difficult to determine the escrow amount as well as the amount owed on the loan. The mortgage slowly rose from {$1700.00} to {$2100.00} within seven years. My Account Manager at that time was XXXX XXXX XXXX ( XXXX ) of Faye XXXX. We had an arrangement where I would call him on the last working day of each month and make my payment via telephone. He informed me that my new Account Manager was XXXX XXXX XXXX ( XXXX ) and I could continue to contact him and schedule my payments. He said this kind of thing happened all the time. I agreed to continue to make payments until XX/XX/XXXX when I received a letter from my new lender ( XXXX, XXXX, as trustee for XXXX XXXX XXXX ) indicating that they are the new lenders for the loan. I did not know at that time that Fay Servicing would continue to service the loan. After repeated attempts to contact XXXX XXXX, I later attempted to contact XXXX XXXX regarding my loan. I called her over several weeks and was unable to speak to her ( please refer to the email correspondence section for documentation ). When I finally made contact, I was later informed by XXXX XXXX that my mortgage payments were late even though I was paying them as scheduled on the last working day of each month. She then informed me that she could not take any more payments from me until I cleared up any delinquent balances. XXXX XXXX suggested that I complete a XXXX XXXX XXXX with XXXX. She also mentioned that my payments would be roughly between {$2.00}, XXXX and {$2400.00} and she would need approval from her supervisor. I had to submit budget expenses for my wife and I along with bank statements and payroll documentation. When I talked to her about our budget expenses, she indicated to me that I would " just have to make minimum payments on some of our accounts '' in order to get approval. I told her that I could not afford a payment of {$2.00} because I will began making student loan payment in the amount of {$1100.00}. Needless to say, everything change when I finally received the Loan Reinstatement Agreement from her ( please refer to the email correspondence for documentation ) the terms of the agreement, payments and principal amounts were incorrect. Currently, I owe {$240000.00} on this loan. Finally, we discussed the proposed payment schedule ( please refer to the email correspondence documentation ) which has my first payment due XX/XX/XXXX in the amount of {$4200.00} and another payment for XX/XX/XXXX in the amount of {$2900.00}. She later told me that she can work with my on the XX/XX/XXXX payment because its 3 days after the first payment. However, I am due another payment on XX/XX/XXXX. If that was the case, we could she not adjust the payment schedule from the beginning. If I sign this document -- - I would still be delinquent in my repayment due to the payment due dates.
