Complaint: Hi I have been paying my mortgage on time for the past approximately 8 years. I am XXXX years of age and on Social Security XXXX for 8Years. I had no problems paying my mortgage up till now. My initial mortgage co. XXXX XXXX XXXX made a Loan Modification in XX/XX/XXXX with The Making Homes Affordable Program which aloud me a modification to be able to make payments. Then in XX/XX/XXXX XXXX transferred my loan to XXXX XXXX XXXX which transferred the loan to Fay Servicing. Since the transfer my mortgage statement has increased {$160.00} I was told due to interest rate increase an escrow shortage. I was still able to pay that on my fixed income. However I received a letter today saying that my property is in a flood zone and " they '' are buying me flood insurance ( which I have to pay back ) also I know is going to put me in a bad financial situation. possibly in a fearful situation where I might falter on the mortgage. My point is that I have not had flood insurance for approx. 10 years. I 'm not even sure why in XX/XX/XXXX when I modified my mortgage I was not told I required flood insurance and I 'm not sure I 'm even in a flood zone as Fay Servicing is saying. Is this legal since my initial application for my loan modification was signed off with no mention of flood insurance. If so are there any options? My hope is that you understand and assist in any way possible to get though this difficult time. Any assistance would be greatly appreciated.

Complaint: I have been attempting to resolve these concerns with Fay Servicing , LLC since transfer of my mortgage XX/XX/XXXX, while in the midst of a modification with the prior Servicer. The transfer of the loan changed the terms from XXXX XXXX ( since the loan inception in XX/XX/XXXX ) to non-XXXX XXXX, limiting my consumer protections and thus substantially altering the terms of my loan. Despite the completion of the TPPs, Fay immediately began making demands for escalating amounts of monthly payments ; significantly altered the terms of the modification ( while telling us for a year that Fay was obligated to honor the terms of the prior Servicer ) ; lied to XXXX escalation dept stating the mod was HAMP Tier 1 ; lied to CFPB stating the terms of Fay 's mod was more favorable than that of the prior Servicer ; Fay backdated documents and NEVER executed the contracts or returned fully executed documents to me ; refused to provide an accounting of alleged principal error ( and now denying principal error despite the legal dept stating this in response to CFPB ) ; application of tens of thousands of dollars of " misc fees '' including several $ 14K fees ; misappropriation of payments ; demands for arbitrary payments ( altering the monthly demand from {$1300.00} to {$2000.00}, and changing the principal from approx $ 316K to more than $ $ 400K ) ; failure to apply full payments to alleged " suspense funds '' ; dual tracking the loan while payments were current and informing me to " just ignore '' these dunning legal notices ; refusing to honor a year of promises that all payments, credits, and fees would be correctly applied after Fay completed its acct assessment ; refusing to put any information in writing ( including specifically refusing to answer questions we were instructed to put in writing ) - a behavior that is noted on the CFPB site, the RI Atty Genl 's website, and those of other consumer advocacy agencies to be of high concern for fraud. In addition Fay 's deceptive and duplicitous financial dealings, their arbitrary and capricious misapplication of funds and fees, and wreaking havoc with my mortgage and stressors during a time of medical crises, Fay has also utilized harassment and bullying tactics to dual track my account, and to discriminate against us for XXXX and the use of XXXX funds.
Despite the CFPB 's Consent Order against Fay in XX/XX/XXXX, Fay has ceaselessly continued its abusive and coercive tactics. Fay continues to mislead the consumer, dual track my acct, apply exorbitant fees without explanation, extort monies I can not afford, continually threaten default and foreclosure, discriminate against us based on XXXX and the use of XXXX funds, and REFUSED a $ XXXX Hardest Hit Funds award that I was granted ( after initially accepting ) and that would have assisted significantly in making payments affordable and thus avoiding foreclosure.

Complaint: Fay Servicing says since they tried to pay my property taxes that they have a right to set up an escrow account on my mortgage and divert my regular payments into the escrow thus leaving my mortgage in default. 1. fay servicing never paid my taxes I did. 2. I was never notified of this change in my contractual mortgage agreement. as required by law. ( 1. Complaint: We submitted a forbearance ( Borrower Assistance ) application on XX/XX/XXXX to our loan servicer, Fay Servicing. Two months later, we received a letter indicating that certain tax documents are missing and we must submit these documents in order to process our request for assistance. We submitted the documents on XX/XX/XXXX, but did not receive any update as to whether the request is still in process, approved, or denied.
Around XX/XX/XXXX, we called to make a partial payment of the delinquent amount, but we were told that payment can not be accepted unless paid in full. When we inquired about the status of our forbearance request at the time, we were told that no decision was made, because our application was incomplete. However, we were advised to submit a new request ; therefore, on XX/XX/XXXX, we submitted another forbearance request.
As we waited for a decision our application, we received a letter from XXXX XXXX XXXX XXXX, XXXX on XX/XX/XXXX demanding full payment of the mortgage balance on behalf of XXXX XXXX XXXX, XXXX. We doubted the authenticity of this claim, because we never knew XXXX XXXX XXXX, XXXX as our lender, as we had just submitted, on XX/XX/XXXX, documents requested by Fay Servicing regarding the forbearance request. So, we sent a letter by mail postal and email to XXXX XXXX XXXX XXXX, XXXX requesting verification that XXXX XXXX XXXX, XXXX is our lender. We also called Fay Servicing customer service to confirm if XXXX XXXX XXXX, XXXX is our lender, but they could n't confirm that. Therefore, we sent an email to our account manager to verify this information and we are still waiting to hear from him. However, 4 days later, on XX/XX/XXXX, we found a business card from a process server for the XXXX County XXXX Judicial Circuit asking us to contact him, because he has important papers for us. Immediately, we called Fay Servicing customer service again to explain what is going on and we were then told that indeed XXXX XXXX XXXX, XXXX is our lender, but not to worry, because our forbearance application is still in process.
Meanwhile, the process server has made several attempts to serve us foreclosure papers. An attempt was even made to serve our son whose is not on the mortgage and lives in a different state. When we asked why our account manager has not replied to our email, we were told that they have no permission on file to communicate with us via email, so we have to respond to an email they will send us to obtain authorization for contact by email ; however, we have already provided such authorization on XX/XX/XXXX. Nonetheless, we immediately responded to the email requesting permission to contact, but we have still not heard from the account manager.
Up till the time of writing this complaint, neither Fay Servicing nor XXXX XXXX XXXX XXXX, XXXX has given us proof that XXXX XXXX XXXX, XXXX is our lender. Our original loan servicer/lender was XXXX XXXX XXXX, who transferred the loan servicing to Fay Servicing as of XX/XX/XXXX. Fay Servicing customer service told us that if we look on page 13 of the Welcome Kit they sent us, we will see that XXXX XXXX XXXX, XXXX is our lender ; but the Welcome Kit we received is only 6 pages long ( not numbered ) and no one is mentioned as our lender. The Welcome Kit only states that Fay Servicing , LLC is our new loan servicer as of XX/XX/XXXX and XXXX XXXX XXXX, XXXX. will stop accepting payments from us after XX/XX/XXXX. On Friday, XX/XX/XXXX, we called Servicing customer service to pay the full delinquent amount in order to bring our account current, they told us ( for the second time ) they can not accept out payment, because our forbearance application is still pending ; yet the process server made another attempt today to serve us foreclosure papers.

Complaint: I have tried twice on XXXX XXXX to dispute the delinquent payments to no avail, with XXXX credit bureau and Fay Servicing.
Let me also say Fay Servicing did correct the XXXX report but the disputes with XXXX will not change.
I have disputed so many times, that XXXX XXXX will not allow me to dispute the Fay Servicing and XXXX accounts, again.
I also asked my Account Manager with Fay Servicing why does XXXX show 9 missed payments, when there have been no missed payments since the modification.
Fay Servicing even shows a missed payment for this year, and there have been no missed payments, but the Account Manager stated that another office would have to correct my credit reporting with XXXX.

Complaint: We asked Fay servicing for a modification to our mortgage on XX/XX/XXXX and confirmed receipt of all documents. We received an email from XXXX XXXX on the XX/XX/XXXX asking for additional documents, which I provided the same day and receipt was confirmed. I was told we would have a determination in 30 days. I have asked repeatedly, and have not received a response. I am an employee of the US Government ( Department of State ) and have been stationed overseas until very recently, thus, my home has been rented. Our tenants broke the lease, therefore we do not currently have the income to pay the mortgage at the current payment, we have been behind on payments since XX/XX/XXXX. We have had difficulty finding new tenants, and have just had a new lease signed beginning XX/XX/XXXX so we do not need a long term solution. In order to keep my security clearance ( which is necessary for my job ) I have to keep my payments current and have asked Fay Servicing to assist me with my extenuating circumstances. They have been non responsive and unhelpful, and I am hoping you can help mediate the situation and hopefully expedite a solution that we can be satisfied with.

Complaint: A mortgage in my name is being serviced by Fay Servicing, an organization which, according to your website, has already overstepped the law as it relates to moving forward with foreclosure proceedings while borrowers are actively seeking help to save their homes.
Arrangements were made during the summer of 2017 to list the affected home in a short sale. Terms of the short sale were drafted and agreed upon by all parties, and the home was listed and shown to prospective buyers but ultimately was not sold before the expiration of the short sale agreement. According to Fay Servicing, the next step was to reconvene and draft a new agreement listing the home at a lower cost to attract more potential buyers. Multiple representatives of Fay Servicing stated in telephone conversations that they did not want to foreclose upon the property and that they would continue in good faith to find a solution.
Regardless of these declarations of good faith, on XXXX XXXX, 2017 I received an email from my credit monitoring service that my XXXX credit report had been updated to include that my account with Fay had been marked as foreclosed. Indeed, when I went to view the report, it had been marked " Foreclosure Process Initiated ''.
A representative of Fay Servicing responded to inquiries about this change to my credit report by saying that it was part of their normal process and nothing for me to worry about.
Additionally, to date I have not been served with any papers indicating an imminent foreclosure which, as I understand it, are required by law to be provided to the property owner with 35 days notice before any proceedings can be moved forward.
I would like to point out that your organization fined Fay Servicing, in the amount of {$1.00} XXXX on XXXX XXXX, 2017, for doing exactly what they are apparently continuing to do as of three months after their punishment and most likely up to the present time. Fay Servicing CEO XXXX XXXX was quoted as saying that your consent order included asking Fay Servicing to " comply with mortgage servicing rules '', which they clearly have no intention of doing.

Complaint: On XX/XX/XXXX, I requested a Reinstatement Demand from my lender Fay Servicing so that I can reinstate my loan to avoid foreclosure. They stated it would take about 5-7 business days to receive the reinstatement in writing. Then I call back today only to be told the request never got put in and they will be putting it in today. This is really hurting me because I plan to take the funds out of my retirement and the only way they can release the funds is to have the reinstatement figures in writing.
