Complaint: We are the attorney firm representing XXXX XXXX and his family on the foreclosure case against him. Since XXXX, we have been submitting documents for a loan modification and providing every and all documents Fay Servicing has requested in a timely manner. We did so all the way through XX/XX/XXXX when our application was deemed complete and ready for underwriting to decide. At that point, our clients has a sale date scheduled for XX/XX/XXXX and I was informed that on XX/XX/XXXX our application was declined because it was within 37 days of the scheduled sale. A motion was filed to postpone the sale to allow underwriting sufficient time to complete the review. The motion was granted and the sale was postponed to XX/XX/XXXX. On XX/XX/XXXX I called AND emailed Fay to make sure they were aware of the cancelation and I was assured the review would be completed. Ever since, I have been mislead over and over, they said they escalated the file, they said it was under review, then they said it was not. Below a time line : XX/XX/XXXX Called and emailed Fay with the results of the motion so they could resume the review. XX/XX/XXXX A very rude agent told me our application had been deemed complete since XX/XX/XXXX and I would have an answer by XX/XX/XXXX. I emailed Fay servicing with this information. XXXX I was again told by Fay that the file was still being reviewed and they did not have an answer yet. XXXX the file was escalated to a Supervisor ( XXXX XXXX ) for the first time. I was advised I would receive an update the following Monday, XX/XX/XXXX XX/XX/XXXX I called and spoke with another Supervisor who told me our file was NEVER sent to underwriting and that she would do so then. That I should be counting 30 days from the foreclosure was canceled and not from XX/XX/XXXX. XX/XX/XXXX I called Fay for an update again to find out that on XX/XX/XXXX the file was denied because we were " within 37 days of the sale ''. The only possible reason this could have happened is that when the file was sent to underwriting for the second time ( late, as my multiple phone calls and emails were not addressed ), they did not review the account at all. The only thing they saw was a sale date and denied it without considering the escalations. We believe this to be unacceptable and not in good faith. We need our modification to be completed immediately as we have done absolutely everything that has been asked from us and the judge canceled the sale so they could give us an answer.

Complaint: I was in Bankruptcy and my mortgage was sold by XXXX XXXX XXXX to Fay Servicing. When I received notification from Fay Servicing I called and set up my account online with them. I made a payment and told my rep that I would like to set up a repayment plan for the arrearages. I was told to fill out modification paperwork which I did and submitted on XX/XX/XXXX. After that they would no longer accept payments from me. I asked them to just resume payments and give me 12 months to pay off the arrearages. My Rep said he could do that after I completed the modification process, he said even if I did not qualify for modification he could get 12 month arrearage payback accepted by Fay. After countless calls and emails to my rep to finish this up all I ever got was requests for more documents and I was told everything had to be in before they would review my application. Finally after more phone calls and emails to my rep and submission of many documents over and over because they claimed they never had them I received a letter from Fay on XX/XX/XXXX stating they had a complete package and would get back to me within 30 days. On XX/XX/XXXX I received a letter from Fay saying they need additional documentation which I sent to them. They confirmed that they had everything needed. After a couple weeks I had not heard from them and I called to find out what was the status of my application. I was informed that I had now been transferred to a new rep for the third time. She explained that they now needed additional documentation and I had to get it to them by XX/XX/XXXX. I sent it to them on XX/XX/XXXX. On XX/XX/XXXX I found out they had put my Mortgage up for auction date of XX/XX/XXXX. Again I called Fay and was told that since my mortgage was listed for sale and we were within 38 days of the sale that they would no longer consider me for modification.

Complaint: I have been a victim of misrepresentation and unethical conduct by XXXX XXXX XXXXXXXX and now Fay Servicing. On two different occasions I was offered a loan modification and on both we accepted the offer and followed through on our end. Due to no fault of our own we were removed from the first modification because XXXX XXXXXXXX XXXX " Lost our paperwork '' and after filing a chapter XXXX bankruptcy and making trustee payments for several years we were offered a second modification. While making the trial payments on the second modification the servicing was transferred to Fay Servicing who refused to honor the modification, even though XXXX XXXX XXXX sent us a letter that the modification would be honored after the service transfer. This has started a downward spiral and we are now backed into a corner by Fay Servicing because of their misrepresentations and have tried to force us to sign over our home. My husband and I bought this home back in XX/XX/XXXX with a loan through XXXX. In order to come up with the down payment we withdrew $ XXXX from our IRA account which led to problems with the IRS. Even though we both had good jobs ( husband a service technician and me accountant ) the IRS problem put us in a tough situation and we defaulted on the mortgage loan. We then applied for and were approved for a loan modification through XXXX XXXX XXXX ( who now owned the loan ). We made our first trial payment but when I tried to make the second modification payment the bank would not accept it. We soon found out that they had " lost our paperwork. '' and received a letter acknowledging the error. We then filed Chapter XXXX in order to reorganize our debt and continued to try to engage with XXXX XXXX XXXX for a modification ( judge 's instructions ) with no luck. In XX/XX/XXXX we received a check from XXXX XXXX XXXX for {$400.00} as part of a settlement based upon " poor servicing standards but never cashed it for fear we would give up our right to fight back in the future. We were concerned that by cashing the check we would give up all rights to litigate the matter in the future so we never did. As the bankruptcy was nearing discharge ( mid XX/XX/XXXX ) we were offered a SECOND modification by XXXX XXXXXXXX XXXX and we made the first two trial payments and then received a letter from XXXX XXXX XXXX that the loan was being transferred to Fay and that they would honor the modification. As explained Fay would not accept our modification payment and our Account manager XXXX XXXX made misrepresentations to us and said that they " did not care about what XXXX XXXX XXXXXXXX did and that they would not honor the modification. '' At that time we contacted HUD counseling and Senator XXXX to investigate. Eventually we were able to get Fay to offer a modification and made the three trial payments as agreed but found that the permanent modification terms were interest only and that there was a huge balloon payment at the end. We discovered the trustee payments we had made for 5 years towards our mortgage had never been applied to our loan, instead going to late fees, legal fees, junk fees and escrow. We also found that even though we had been approved for modifications on two occasions and then kicked out of the modifications due to servicing errors or unethical conduct that we were still charged interest, late fees, legal fees, Attorney fees etc. for every month during those time periods. Due to all of these factors we determined it was not in our best interest to accept this modification offer. We continued to try and negotiate with Fay but made no progress and filed for mediation and hired an Attorney. At the mediation it seemed that our Attorney was working for Fay Servicing -- he had failed to give us the chance to review an alleged loan modification offer and we were essentially pushed into committing to do a deed in lieu and agreeing to sign the house over to Fay.

Complaint: Fay Servicing forced me to obtain hurricane insurance so I ended up back in XX/XX/XXXX. They threatened me with obtaining expensive outside insurance. I cancelled my existing with XXXX XXXX via XXXX XXXX XXXX in XXXX XXXX, Hawaii. I signed a policy cancellation in XX/XX/XXXX the company sent a refund of {$920.00} and sent it to XXXX XXXX XX/XX/XXXX. I never once received a new policy from Fay Servicing or showing where that refund went and the amount of the policy. I have called numerous times with no success and believe they are crooks and refuse to show me where all the money went. I got a refund from them of {$260.00} because I sold my house in Hawaii which closed on XX/XX/XXXX and I plan to call tomorrow again but do not believe there will be much success. At XXXX years old I have never dealt with such a horrible mortgage company. I want a detailed schedule of where all my money went monthly of {$440.00} plus the {$920.00} that I sent them in XX/XX/XXXX. I believe that Fay Servicing owes me more money so hopefully you can contact them and get them to give me a detailed listing of where all my money went.

Complaint: Back in XX/XX/XXXX my ex spouse while I was XXXX defaulted on a mortgage of the home I won in a divorce. Unaware of the factor when I returned from XXXX, the bank ( Fay Servicing ) refuse to give me information without his consent. After several months going back and forth finally i was given access to the account. I went before a judge on XX/XX/XXXX with an attorney that pleaded for me to be given a chance to conduct a modification. The Modification process was started I was suppose to be given 30-45 days to complete and get a written answer. Fay Servicing only after 14 days denied my Modification given me no written response. Only a verbal denial from a XXXX XXXX who was assigned to my case. There was never a fair chance. now moving forward they have forced me and family to be evicted from the home. They refuse to allow me to buy the home back or even respond to any messages in trying to obtain a newly written loan with them to keep my home. New evidence is that the home had black mold infested in the walls. Which resulted in health matters for me and XXXX children. I have reached out to Fay Servicing they seem to never return phone calls and you can not even get through on the main line that I am using XXXX. I feel as a XXXX for my country, mother, and customer I was not given a fair chance or even compensated for all the legal fees and turmoil that has impaired my ability to keep shelter for me and my children. I even pleaded with the banks to allow me to purchase the house back offering money before it got to this point. I have paid over {$6000.00} to various entities including one bank to conduct a modification that was deemed the trustee under Fay Servicing. This injustice needs to be stop and investigated and corrected due to this business not conducting their foreclosures properly or given the consumers the ability to regain control after a financial hardship.

Complaint: To whom it may concern : Fay Servicing LLC : Address : XXXX XXXX XXXX XXXX XXXX XXXX XXXX, IL XXXX. Account number XXXX. Due to a family hardship, in XX/XX/XXXX, we applied for a loan modification with Fay Servicing LLC. We were approved for a loan modification with trial period of three months and with the new monthly payment of {$3200.00} Fixed interest of 3.78 %. The modification took a long time to be written up and in the mean time we kept paying the {$3200.00} every month until finally in XX/XX/XXXX all parties signed the required paperwork for the Mod. Few days after signing the paperwork, the account manager XXXX XXXX XXXX of Fay Servicing, called and told us that we had over two thousand dollars in the suspense account and that we could use that money for the XX/XX/XXXX payment, so we only had to pay the difference which was {$1000.00}. Unfortunately, the payment for XX/XX/XXXXwas already processing and could not be stopped. So I called XXXX XXXX XXXX and asked if I could use the money in the suspense for the next paymentXX/XX/XXXX. She replied yes certainly and so we agreed on that transaction. Unfortunately, when I received the XX/XX/XXXX statement I noticed that no payment was received for XX/XX/XXXX. I called XXXX XXXX XXXX and she could not explain what happened to the XXXX XXXX XXXX and that she thought the suspense money had been applied to the principal. We were very angry as we do not have any more money and we were never advised or asked if it was OK and the Modification paperwork did not state anything like that. We tried to get Fay servicing to fix this but they want us to agree to a repayment plan or stay behind a month on our mortgage which show us delinquent of 30 day. So after all this work to be honest and pay our mortgage Fay Servicing put us right back in the same hardship pre-modification. As an unemployed XXXX Veteran I am on a tight budget and a I can not afford. It is ashamed that Fay Servicing LLC develops these plots to force people out of their homes and make money for their clients such as XXXX who actually owns the note. Please help!

Complaint: To whom it may concern My name is XXXX XXXX, XXXX. I am writing if reference to Fay Servicings unethical financial practices. Last year XX/XX/XXXX/XX/XX/XXXX Fay Servicing imposed an escrow account to my mortgage. My home was purchased XX/XX/XXXX. At the point of purchase I chose to have my taxes and insurance separate. I want to be forth coming about paying my taxes. I do have a history of paying at the very last minute. Meaning I have paid through the county ( XXXX County, MI ), instead the City of XXXX XXXX, MI. I have been penalized for paying late. I believe Fay Servicing has taken a look at my payment history and made an executive decision on making my escrow account. In late XX/XX/XXXX I had some issues with XXXX my former mortgager and my loan was sold to XXXX XXXX. During this time issue I fell on hard times, I was fired a day before XX/XX/XXXX till XX/XX/XXXX. I have filed bankruptcy in the past through exescive debt and the economic down turn in the XX/XX/XXXX. The former statement was made to show me keeping my home was very important to me. I could have walked away from my home in XX/XX/XXXX. In late XX/XX/XXXX I was in with my trouble, and I looked for help through the State of Michigan. A program named The Michigan Stepforward Program for people behind on payments and taxes. I was awarded {$5900.00}. There is a copy of my XXXX form in this letter. It is to my understanding if my taxes were accessed during the help from Step Forward I could have received help from the program. In turn they would not have had to add an escrow account. My biggest issue with Fay Servicing and other companies like this is ; wondering how for do there powers of discretion go? What will these companies are able to impose one their customers? I not want to look at there pricing for insurance and taxes. I had a policy where I paid roughly {$1300.00} a year. In the enclosed document there is a payment of {$180.00} a month for my insurance. That comes out to {$2100.00} a year. That is an {$810.00} a year difference. What Fay Servicing did was take a look at the average of insurance premium in my subdivision, and charge me accordingly. Just because that is the average does not mean I couldnt find it cheaper. What I am also in the dark about for the policy is the break down of how the policy works : Contact number if I have an issue Dwelling Replacement Value House fires Severe weather issues Flood Insurance Natural disaster Sewage Backup Inside the home Jewelry Valuable items Fay Servicing never told me if they had a contact in Michigan that could come out and take a look at my house for an assessment. The picture they have is probably 10 years old. I am assuming they got home picture from XXXX XXXX. I want to know all of my options in a full disclosure. I dont even have the option to add things to my policy. If my home burns down tomorrow or some godly catastrophe happens whom do I call? If Fay Servicing is a stand up company they should have the decency to provide me with all the particulars about the policy they have imposed on me. For whatever reason I may want better coverage, or may not agree with what they have offered. The tax portion is understandable there is no way around me paying more than the City of XXXX XXXX has deemed to cover my tax bill. Looking at the actions of Fay Servicing I am sure that their actions have not been imposed on me. In my opinion such actions should be regulated, and policed so they cant take advantage of the consumer. I would like this type of ( ESCROW ) adding to be looked into.
