Complaint: Last year around XX/XX/2017, l received a letter stating that my mortgage was being transferred to another company and that my payments would not change. My payments were XXXX per month with taxes escrow included. This company claims l owe XXXX more in escow and that l had to set up payments. I do not owe XXXX dollars in escrow. Now my payment are XXXX per month. My taxes are less than 4000 per year. I am being ripped off by this company. Also, l have a second mortgage that was transferred to the same company that was a home equity account with payments of less than 200.00 per month and now l am paying XXXX dollars per month and they are trying to make me pay escrow of {$380.00} per month on this account that was never escowed. Please help me with this company because they are trying to make me unable to keep up payments on my home. I was told by my account manager that it would be taken care of but nothing has changed.

Complaint: XXXX XXXX XXXX XXXX is my lender ; I fell into default on or about XX/XX/2018, on my first mortgage.and submitted a request for a loan modification on XX/XX/2018. I contacted XXXX XXXX on or about XX/XX/XXXX to follow up on the application and supporting documents that I had submitted.
On that date, I was informed by XXXX XXXX that the mortgage servicing had been transferred to Fay Servicing on XX/XX/2018 ( one month prior ) while the mortgage was already in default. When I contacted Fay Servicing about this, I was informed by Fay that they would not review my file for loan modification consideration as the foreclosure date was too close. My allegations are : 1. I was not given written notice by either XXXX XXXX XXXX XXXX or Fay Servicing when my loan servicing was transferred ; had I been expressly informed ; I would have submitted my modification request to Fay Servicing.
2. My loan went into default in XX/XX/2018 therefore, loan servicing was transferred while the loan was in default.

Complaint: I have been experiencing financial hardship for several years, but always paid my mortgage within the month due. In XX/XX/XXXX I received an invitation from the mortgage servicing company to apply for loan refinance, modification of loan terms, Making Home Affordable Program, Payment Forebearance, and other less desirable options such as selling, short sale, deed-in-lieu of foreclosure. In XX/XX/XXXX I received an escrow 'overage ' check for $ 2000+, which I used to pay bills. In XXXX I was notified that this refund caused a shortage in my escrow fund and this would cause my mortgage payment to increase to over $ XXXX/month. It was not a huge increase from the mortgage amount, but enough to break the camel 's back, as it is said. In fact, many things peaked at that time. Since then, I have not been able to pay the mortgage, but was active in seeking help via the company 's Loss Mitigation Application Service. In XX/XX/XXXX I received a list of required documentation in order for them to conduct an evaluation. I immediately complied with all requests. In XX/XX/XXXX I received another letter requesting all or most of the same documentation. I immediately complied. This happened again in XX/XX/XXXX. Again I complied. This time there were requests for imaginary documentation such as a business statement, etc., as I had used Schedule C in my taxes because of travel and other expenses for a brief sales job I had. I made sure to document every item and where necessary, provided a signed statement explaining each item that could not be provided. All of application items sent were by email and I have scanned every item they received, as well as some communications without attached documents. In XXXX I received a letter stating that I was in default and on behalf of the creditor, the servicer was formally notifying me of same. I was informed in this notice that they may garnish my social security and death benefit annuity, unemployment, and wages if I happen to have any. I also received a list of government approved housing counseling agencies in my area in a separate letter, and that after 90 days they may commence legal action against me.
I returned to school through the Department of Labor and became in 4 months a XXXX and XXXX XXXX, and returned to work at $ XXXX/hour. I still am unable to make the mortgage payment of $ 1300+. I have continually sent this mortgage servicing company every detail possible about my financial situation. I also utilized a Debt Relief company to take over payments of my debt. ( Over the years XXXX I depleted a retirement fund of {$40000.00}. ) On XX/XX/XXXX of this year I received another letter from the servicing company again requesting all of the same documentation that has been responded to provided over the past months, each time updated in the past.
My complaint is that my original step-rate modification, which has plateaued out in XX/XX/XXXX to 4.875 % ( for the life of the loan ) was due to reach maturity in another 30 years ( XXXX ). I am asking this company to remortgage the property for a 30-year loan to lower the monthly payments. The property is valued at $ XXXX {$200000.00} since the real estate crash in XXXX. The principle remaining on my mortgage is {$210000.00}, perhaps less at this time.

This was a firm that sought me out alleging that I was a victim of predatory lending with mortgage company ( XXXX ) I had completed two trial payment plans ( 6months ) of {$1200.00} a month each to get an approved modification and XXXX in late fees and delinquent payments was added on.

Complaint: To Whom It May Concern, XX/XX/2018 My complaint is against Fay Servicing as they were assigned my Mortgage while I feel behind during my divorce. I had file a complaint in XX/XX/XXXX ( XXXX ) regarding a lien that was placed on my property for unpaid utilities and XXXX quarter taxes, in their response to that complaint they stated that it was for utilities alone and that they werent responsible for those which is true however there was also the XXXX quarter taxes in that lien for which I borrowed the money from my employer to pay this lien on XX/XX/2018 ( see documents ). I called my case manager XXXX XXXX and explained all this to him but he stated they paid the taxes. I then went to the XXXX City tax off ice and spoke to XXXX, the tax collector and he printed everything out for me for which I had sent to my case manager and called to follow up but he never called me back. The only thing that was resolved from that first complaint was that they did grant me a temporary mortgage modification agreement for which I agreed to accept. I am still waiting for the credit ( {$1000.00} ) to apply to my account for the taxes I paid however my case manager XXXX XXXX stated via phone this morning that they are not going to refund me that money as there is no shortage on my escrow account however my mortgage includes the insurance and tax payment therefore I am paying paying them twice, once to the city on XX/XX/XXXX and again in my mortgage payments. I also never received and explanation as to where the {$47000.00} they received from the XXXX went toward my account as it appears there is still a forebearance showing on my account and that money issued to them in XX/XX/XXXX. shouldve covered and past due payments, taxes or fees to my account when I feel behind.

Complaint: My mortgage was in active foreclosure and I was not having any success in working out a modification or repayment with the servicer so I hired the XXXX XXXX XXXX to defend the foreclosure and try to work out a modification in XX/XX/XXXX. On XX/XX/XXXX we submitted a modification application to the servicer, Fay Servicing. On XX/XX/XXXX the banks attorney filed a Referees report. On XX/XX/XXXX I received a letter requesting additional documentation for the modification application to be sent by XX/XX/XXXX. On XX/XX/XXXX I sent all of the information to The XXXX XXXX XXXX who submitted it to Fay Servicing the same day. They followed up with several phone calls to confirm receipt of the documents to no avail. Finally on XX/XX/XXXX they were informed that the confusion was because they had inadvertently opened my loan with an incorrect social security number and that was why they could not get the file moving into underwriting. They said that the only missing docs were an updated 4506T dated in XXXX because 2 months had passed trying to get the file underwritten and a w2 for XX/XX/XXXX and they needed them before XX/XX/XXXX. On XX/XX/XXXX we sent the 4506t and a letter explaining that there was no XXXX for XXXX because I was XXXX injured. The XXXX XXXX XXXX then called Fay Servicing again on XX/XX/XXXX and was told the file was marked complete on XX/XX/XXXX and was sent to underwriting. They said there would be a decision within 30 days. On XX/XX/XXXX The XXXX XXXX XXXX contacted XXXX XXXX at XXXX XXXX ( Law firm for Fay Servicing ) both by email and phone to let him know that the loss mitigation package was complete as per his client and requested that he withdraw the Motion for Foreclosure which he had submitted to the court pending the outcome of the modification review. he said that he would. At the court appearance the following week the attorneys again discussed withdrawing the motion by stipulation. Our attorney handed a Stipulation to the attorney from XXXX XXXX who said he would return it in a few days. We did not receive it back so we contacted XXXX XXXX again and were told by XXXX XXXX that he never signed it because his client now needed an updated pay stub because so much time had elapsed that it was outdated. He also said that he had been informed that our attorney did not show up at the conference and that is why we didnt know this. We sent the updated pay stup to Fay Servicing and we sent him the conference report and stipulation showing that The XXXX XXXX XXXX was in fact at the conference to XXXX XXXX and received a phone call back from the firm saying that XXXX XXXX was no longer with the firm and they did not know what had transpired so were unable to help us. Over the next several weeks we followed up trying to get a decision on the modification before a sale was scheduled but repeatedly were told they would research why it was taking so long and get back to us. In the interim the Judgment of Foreclosure was signed and a sale was immediately scheduled for XX/XX/XXXX. On XX/XX/XXXX XXXX XXXX XXXX XXXX was informed that they were going to stop reviewing the file because the sale was less than 37 days away and that is their policy. They said that the file was again incomplete because they were now missing a pay stub for XX/XX/XXXX -XX/XX/XXXX. I explained and sent a letter that there was no pay stub for that week because I was off that week and if they checked the YTD earnings on the previous and following pay stubs it was obvious that there was no pay stub missing. They stated that it was unfortunate but they still were not going to review the file for a modification. I am now 2 weeks from a sale and they will not even reconsider the decision which was wrong for so many reasons. The application was complete months before the sale was scheduled and due to their errors it was not reviewed in time.

Complaint: I feel behind on my mortgage trying to keep up with my Bankruptcy payments.
I received a demand for payment and contacted the loan servicer, FAYE SERVICES.
I was told that I needed {$13000.00} to reinstate my Mortgage. I contacted my lender and told them that I only had {$10000.00}.
I was told to complete the Borrowers Assistance Form if unable to reinstate my Mortgage.
I was told that my Borrowers Assistance Form was incomplete because I needed to provide proof of hazard insurance coverage and sign the Borrowers Assistance Form. I signed the form and the forced hazard Insurance was put in place by the lender, FAYE Servicing, as forced hazard insurance had been in place for the last 8 years.
I contacted Faye Servicing about obtaining the documentation of the forced hazard insurance and no assistance was provided. Even though Faye Service was listed on the Insurance Declaration Statement. This resulted in again my form not being processed and purposefully holding up the process to ensure foreclosure proceedings. As processing of the Borrowers Assistance Form would have clearly indicated what provided full preservation of my rights and determined my eligibility for assistance.
Faye Services ensures foreclosure by failing to process my Borrower 's Assistance Form even though all necessary documentation was in their possession. As the forces hazard insurance information was accessible to Faye Servicing as they were listed on the Insurance Declaration Page for months prior to requesting it.
I started completing the Borrowers Assistance Form that listed a whole host of documents not previously requested, for the third time with a due date of XX/XX/2018 and I received foreclosure documents on XX/XX/2018.
I am now facing additional fees because Faye Servicing failed to provide me with any protections provided to mortgage lenders by law.
Faye Servicing also failed to keep me informed about critical information about the process of applying for foreclosure relief.

Complaint: In XXXX I entered into a Two Step Mortgage Modification Agreement with loan serviced XXXX XXXX XXXX. The terms included principal reductions in 3 increments upon the XX/XX/XXXX anniversary of the modification in XXXX, XXXX and XXXX. The loan is now being serviced by Fay Servicing and they have not complied with the deduction of the final XXXX principal reduction. I have called, mailed and emailed documents. It is XX/XX/XXXX, an 8 week delay from the XX/XX/XXXX anniversary date.
Also, the Loan is still being held in the incorrect Title of The Estate of XXXX XXXX, an entity which ceased to exist in XX/XX/XXXX upon the closing of my late husband 's Probate. I have made repeated requests to have this switched to the XXXX Family Trust. This inaccurate reporting creates a hardship for me to cash checks such as the Escrow overage as the check was written to a closed entity.
I have attached the Loan Modification Agreement as well as evidence of the XX/XX/XXXX and XX/XX/XXXX principal reduction credits.

Complaint: Due to economic downturn, my business declined and my family went through hardship and fell behind on mortgage payments and eventually had to file bankruptcy. In keeping to our financial responsibility, we worked hard to improve our financial situation through additional employment. In the process most recently, we requested a loan modification to get back on track with our mortgage company Fay Servicing. After a lengthy, stringent process, they approved us for modification only to find out that they want to almost triple our interest rate - from 2 % to 5.5 %, a 175 % increase. Meaning our payment would go from approx. {$3100.00} to {$5200.00}. The whole idea of a loan modification is to receive some type of modification, generally more time to repay or reduction in the interest rate - NOT an increase in the rate. If it was unmanageable at {$3100.00}, how does the lender expect us to make a payment almost 3x more? It is illogical. Also, it is evident they are raping the consumer to make a profit and forcing the homeowner out of their home by making it unmanageable and foreclosing on them. Manipulating the rate during the modification process is very deceptive. The account manager stated that the rate had to increase because that is the market rate and that they could not offer a government program or rate. We knew for a fact that we weren't in a government program or rate at 2 % because we were told that back in 2014, so by making that statement and standing behind it was clearly an excuse. In 2014, Fay Servicing confirmed to us that we had a conventional loan and did not qualify for any of the government programs because of the loan amount. Also, at that time we were told we needed to come up with approx. $ 25K to avoid foreclosure, and when we told them we had the funds, they informed us it was too late to stop the foreclosure - when it was 5 days away. Again, we knew that wasn't true. So we know what the account manager recently stated was not true. Also, I researched the rate with local banks to be sure and they confirmed my belief as I was told the rates were below 4 %. We find this discriminating and illegal - because we filed bankruptcy and imposing an acceleration of our interest rate, respectively. Also, our house is upside down by $ XXXX and the lender didn't even consider a principal reduction or forgiveness. The lender is well aware of this as they recently completed a market valuation of the house. I hope CFPB can assist us in the process to keep our rate the same and get a longer term to repay our lender so we can stay in our home and also work out a principal reduction after they chose to not work with us before and force us into bankruptcy. In XXXX I did a modification on my own through the housing program, they had a program that they were offering if you qualified for {$50000.00} ( non repayable with stipulations ), I did qualify. Which brought my mortgage down to {$160000.00}. In XXXX I filed bankruptcy and my mortgage company had a modification program with HUD/FHA that they advised me to go through I qualified for the modification. Which was for {$47000.00}. Which brought my mortgage down to {$120000.00} that I pay through my mortgage company. Now in XXXX I wanted to do a home equity loan through a federal credit union which I was approved for. Once the underwriter was doing the verification of the title search. She contacted me with a discrepancy of my title search. she explained to me that my home was appraising at $ XXXX {$260000.00}, also I had 2 leans on my home that was filed with my mortgage company that did not match up with my paperwork that I submitted to her. First lean is my mortgage company ( Fay Servicing ) for {$120000.00}, also the second lean is HUD/FHA for {$120000.00} as well. She explained to me that I would be upside down on my mortgage because the two of them would come out to be about {$250000.00}. She advised me to contact my mortgage company and she would forward me the information to show what she received from the title search. Also I should request a payoff from HUD/FHA. Which I did and the payoff is {$47000.00} but Fay Servicing filed {$120000.00} with the title company which they filed incorrectly. I took her advise and contacted my mortgage company ( Fay servicing ) and explained to them the situation as well as forwarded them all of my original paperwork as well as the paperwork from the credit union. They have had my information for awhile and said that they would handle it. They did say that there was an issue with the filing of the title incorrectly. It's been two weeks almost three since I contacted them about this problem. My account manager says that he forwarded things to his manager and things are getting taken care of. I feel as if nothing is getting done. They're giving me the run around and holding me up with my process.. I need this resolved ASAP.
