Complaint: I had a loan with Dyck O'neal Inc. that was created as part of a settlement after a short sale of my home in XXXX. I had this loan from XXXX until the autumn XXXX when I paid the loan off and closed the account. I was offered twice a year by Dyck O'neal a 15 to 20 % discount on the principal of the loan if I paid it off all at once instead of the installments. This past fall I had the money to pay off the remaining balance of about {$5000.00}. I took the offer of a 20 % discount and paid the loan off and closed the account. I learned today as I was checking my credit score in preparation for a new mortgage application that I was reported by Dyck O'neal to the credit agencies as having paid my loan off for less than the agreed upon amount. This is a negative report that has resulted in dropping my credit score over XXXX points from XXXX to XXXX. My XXXX score is XXXX, my XXXX score is XXXX and XXXX is XXXX. Dyck Oneal apparently does not report to XXXX. I called Dyck O'neal and they said they have no control over how they report to the credit agencies which I think is a lie. They also never once explained in any of the twice yearly teaser coupons offering a 15-20 % discount that it will be considered a negative on your credit. They never told me this in any conversation I had with them when I called to pay off the loan. They were all too happy to take my money. How can they say I paid the loan off for less than the agreed upon amount if they agreed to offer me a discount so I would pay it off sooner. I ca n't have paid a loan off without them agreeing to it correct? I feel this is extremely deceptive and also harmful to my financial condition because I will now have to pay a much higher interest rate on a loan.

Complaint: The Law Office of XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX XXXX, FL XXXX send me a document that looks like a COURT DOC with a case no. XXXX. XXXX XXXX FL Bar XXXX sign the Document that apparently is Civil Lawsuit. However, it does not have a stamp from the court or it is not even notarize. Furthermore, most of the document is not even completed. The document claims that my wages at the XXXX ( where I work ) are going to be garnishee. I research the company and they do collections. XXXX XXXX and the Dyck-O'Neal have a habit of going after people and try to collect debts using illegal tactics. The Lawsuit is in reference to a house I lost in Foreclosure back in the year 2010 located in XXXX Florida because I could not longer afford the mortgage. The Plaintiff mention on the document is DYCK-O'NEAL INC. Please investigate both of these companies and stop them from continuing doing this type of practice and intimidate people like me trying to rebuild my life after such a huge economical lost.

Complaint: On XXXX/XXXX/XXXX, I submitted CFPB Complaint # XXXX. Dyck-O'Neal was attempting to collect on a debt that was a result of identity theft. The complaint was resolved, Dyck-O'Neal, agreed the debt was the result of identity theft, and Dyck-O'Neal deleted the credit line that appeared on my credit report. Two months later, Dyck-O'Neal issued me a XXXX indicating that it " cancelled a debt. '' I filed CFPB Complaint # XXXX, indicating that the issuance of the XXXX was in retaliation for my CFPB complaint. The following day, Dyck-O'Neal responded to the complaint indicating that the XXXX was issued in error, and that a corrected XXXX would be issued. In an apparent total disregard for the CFPB, Dyck-O'Neal appears to have sold / transferred the original debt that was the result of identity theft. On XXXX/XXXX/XXXX, four months after Dyck-O'Neal agreed to delete the credit line, I received a collection letter from XXXX , XXXX XXXX XXXX, XXXX attempting to collect the debt that was a result of identity theft, referencing both Dyck-O'Neal and the Dyck-O'Neal account number.

Complaint: My ex husband and I owned a house in XXXX, NY. As a result of our divorce, we had sold this house as a SHORT SALE XXXX 2013. Our mortgage company XXXX XXXX used XXXX insurance company for the PMI insurance. After closing of this home, XXXX sold the loan to DYCK O'NEAL collection agency. DYCK O'NEAL then came after my ex husband and I for {$50000.00}. Because of this, my ex husband filed bankruptcy and included this {$50000.00} in the bankruptcy process. Since he was no longer responsible for this, DYCK O'NEAL has now been after me for the FULL amount of {$50000.00}. It shows up on my credit report and is a red flag which is not fair since it was a joint account. My question is why is this {$50000.00} if this was part of my mortgage payment that I paid for four years prior to the short sale. Also, if it was included in the bankruptcy files, why is this still a problem? DYCK O'NEAL has not wanted to work out a deal with me or help me with REASONABLE payments. Now, after speaking with many different mortgage companies and banks, I 'm realizing that this may all be in error or I have been a victim of a scam. The bank representatives told me that they have never heard of the PMI collection agencies requesting this large amount before. I just want to make sure that this is legal and would appreciate information on how to proceed. If proof of my ex husband 's bankruptcy is needed, I can obtain those records. I am attaching the closing documents from my short sale to prove that I no longer have this property and that all paperwork was indeed complete. Thank you for your help.

Complaint: The debt buyer Dyck O'neal Inc has engaged in multiple deceptive, unfair, and misleading debt collection practices. Please closely review the violations listed below and supporting documentation I have included : 1. Dyck O'neal Inc purchased this " deficiency debt '' for only {$1.00} and then claimed I owe them {$100000.00}. However this is totally inconsistent with the final statement I received from the original creditor XXXX XXXX XXXX regarding this property which clearly states that the Balance outstanding was {$140000.00} and the Fair Market Value of the property was {$170000.00}, leaving NO deficiency and making this a phantom debt. ( see judgment assignment and XXXX XXXX XXXX Statement ) 2. The original action occurred XX/XX/XXXX, that is over 5 years ago. The statute of limitation in XXXX is only 1 year, making this time-barred. Also I am a XXXX resident and the statute of limitations in XXXX is only 90 days. So this also violates XXXX public policy. 3. Based on the XXXX XXXX XXXX statement I provided, my drivers license, my credit report, my address has always been in XXXX. But based on the XXXX County Public Records website ( see printout from XXXX/XXXX/XXXX ), Dyck O'neal intentionally and willfully filed this lawsuit with a false XXXX address I have never lived. Potentially disclosing my information to a third party and commencing legal action and obtaining a default judgment without my knowledge. The sewer server service denied me the legal right to defend myself. Since I am a XXXX resident with absolutely no connection or contacts to XXXX. It 's difficult, inconvenient, and expensive for me get out-of-state legal assistance regarding this issue so I am desperate for the Consumer Financial Protection Bureau to assist ensure a fair resolution. I recently became aware of this after reviewing my credit report which dropped XXXX points. I also applied for a job, and after a background check they sent me a Fair Credit Reporting act notice ( see enclosed letter dated XXXX/XXXX/XXXX ). Not only is this embarrassing, but this illegally obtained judgment has devastated my credit score, damaged my reputation, causing me XXXX.

Complaint: in 2012 I entered into a " settlement note '' whereby I would pay {$100.00} a month for 100 months in exchange they would release me from my personal liability for a mortgage that was in foreclosure. We signed all the papers and I began making my payments. After a few months I began to inquire about the release document and was told that it was forthcoming. after that I was told I would have to get it from XXXX. Than I was told to get it from fannie mae all along I continued to make my payments timely. After a few years I was informed that the lender pursuing the foreclosure was going to pursue a judgment against me personally as part of the foreclosure. My lawyer explained that I had been released already and they said not to there knowledge. I than called again and after alomost four years was told that there was a mistake and they were refunding to me my payments. I explained that they had to leave up to their side of the bargain and they said no. It was n't their problem.

I submitted a Federal Trade Commission Identity Theft Victim 's Complaint and Affidavit, signed in front of a XXXX County, Maryland police officer. In cfbp case # XXXX, XXXX Inc. agreed that I was the victim of identity theft and agreed to delete its trade line from my credit file. BUT, within days of receiving the resolution to cfbp case # XXXX, XXXX, Inc. issued me an IRS Form XXXX ( Cancellation of Debt ) for {$210000.00}. At time of closing the Financial Advisor did not have the name, address, and telephone # of the prospective collector. By the time we finally start paying an agreed amount of {$70.00} per month at no interest charge, Dyck O'neal had already figured how to present the month/months prior to our first agreed payment as pass due. We have been paying our dues from the moment we knew who to pay it to, their address and telephone No. for it was a Promisory note, therefore, it was to our best interest to pay this account. Complaint: This is connected to previous complaint submitted on XXXX XXXX, 2015, case # : XXXX. In the previous complaint, I stated XXXX XXXX claims that I owe him money on a debt. I do not owe him any money. After he was contacted XXXX, he sent me a letter stating he was attempting to make a collection on behalf of XXXX XXXX XXXX in XXXX XXXX, XXXX. I contacted XXXX XXXX XXXX around XXXX XXXX, 2015 and inquired about any debt I may have owed them. XXXX XXXX XXXX performed what they called a " thorough check '' and did not find any thing that indicated that I owed them money ; that there was NOTHING NEGATIVE AT ALL on my account/record with the credit union. I was told by XXXX XXXX XXXX that they could only conclude that I was being scamed, as they had no connection with anyone named Dyke O'Neal. If this is true, why is this man contacting me? He is sending mail to me suggesting that he is willing to settle for a lesser amount to collect the debt in an effort to assist me. I have no intention of giving this man any money and would like to have assistance in getting him to leave me and my family alone. As I stated in the previous complaint, he has been calling my family members as well. Additionally, since I made the initial complaint, I have been gettig even more calls with a XXXX area code from Missouri. I get these calls all hours of the night and the day and they are coming over my cell phone which also has a XXXX area code from Missouri. I do not believe this is a coincidence.

This call is from a debt collector. Please call XXXX. '' Always the same words spoken in the same female voice, left on our home voice mail. We ran a Credit Report and found no unsatisfactory ratings. No one has been trying to collect debt from us, to our knowledge. We 've followed advice to avoid communicating directly with the company, and are attempting a solution through the Bureau of Consumer Finance. [ I was distressed to learn that debt collection businesses are exempt from restrictions on telemarketing ( which is what this sounds like to us ) - i.e., it is legal for them to ignore the Do Not Call Registry. ] We are looking for an answer to this recurring annoyance.

I do not owe this person anything at all AND his desperate attempt to reach me by phone is frightening. So, I live in XXXX and on the morning of XXXX XXXX, 2015, while I was talking on my land-line phone with my sister who lives in XXXX, I received a call from the office of XXXX XXXX. I saw the company name through caller-ID. I did not answer the call. About 5-10 minutes later, my sister ( who lives in XXXX ) receives a call and she assumed it was a family she had been XXXX. She placed me on hold and answered the call. In a few minutes, she returned to me and told me that someone named " XXXX XXXX '' had called and sternly asked for " ME '' by name. She told the person that I did not live there, but I was her sister and what did they want? She said the person immediately disconnected the call. Now ... .I DO NOT RECALL EVER, EVER VERBALLY COMMUNICATED WITH THIS DEBT COLLECTOR AT ALL ... ..NEVER. So, there is no way they would have access to my sister 's phone number and I have never, ever used her name for any ; absolutely any form of business. So, how did they get her phone number? And if they have been calling my phone number over time, what would lead them to call a different number? How did they get my sister 's phone number? So, my concern is : somehow, this company was able to tap into my sister 's land-line phone while we were on the phone at the time of their call. I do n't lknow how they did it, but this truly happened and they should not be allowed to get away with it. They clearly had a way to do that which is invasion of privacy and by doing so, exposed a personal issue of mine to my family member, who had no prior knowledge. I am offended ; I feel violated and I am fed up with the constant harrassment I have been receiving from this company. They should not have a right to do this to anyone ; even if they did owe them money. Please help me understand this.

Complaint: my house was set for a deed in lieu. The mortgage company asked the judge to cancel the foreclosure but the motion was denied. The house was foreclosed on. I cooperated fully with XXXX XXXX and vacated the home as agreed. I recently got a letter in the mail from Dyck-'Oneal Inc. stating that they were assigned this debt from XXXX XXXX and that I owed {$44000.00}. They reported to XXXX and XXXX already. I was never given any details on this amount other than them listing XXXX XXXX as the original creditor, no account number was listed. I have not had a XXXX mortgage for over 10 years. I have sent them a request for validation according to the Fair Credit Reporting Act. It is a violation for them to automatically place this item on my credit report without any documentation or proof. These are the items I am requesting : What the money you say I owe is for Explain and show me how you calculated what you say I owe Provide me with copies of any papers that show I agreed to pay what you say I owe Identify the original creditor and loan number Prove the Statute of Limitations has not expired on this account Show me that you are licensed to collect in my state Provide me with your license numbers and Registered Agent Proof that the collection company owns the debt/or has been assigned the debt. ( You are legally entitled to collect this particular debt from me. ) This is basic contract law. Complete payment history, starting with the original creditor. After which time the request for the Assignments of Mortgage were requested. As they were not recorded and in dire need to show ownership of this mortgage. Nothing was done. XXXX, XXXX XXXX ( XXXX ) XXXX x XXXX or anyone else was did not respond to the repeated requests to provide the information. A clear chain of title can not be completed without those assignments of mortgages. Without a clear chain of title the property can not be sold. XXXX XXXX of XXXX XXXX XXXX, XXXX XXXX credit was contacted in reference to this matter on XXXX XXXX, 2015. ( XXXX ) XXXX. XXXXXXXXXXXX. I have spoken with XXXX XXXX from Dyck Oneal ( XXXX ) XXXX at e-mail XXXXXXXXXXXX. At this point he is not responding to my calls. I have reached out to everyone I possibly could in order to resolve this issue. This file started at XXXX Mortgage, then went to XXXX XXXX. At some point, it must have been sent back to XXXX Mortgage because when XXXX XXXX XXXX Acquired the assets of XXXX Mortgage, they gained possession of this loan. Complaint: I went to court to file for a deed in lieu of forclosure at the time of the closing a XXXX $ repay was due to be paid at the time of closing I was unable to close, and the issue was dismissed. Another closing was set and at that time NO REPAYMENT was part of the closing settlement. I had begun the repayment process and when I informed the DYKE-O`NEAL company of the mistake I requested a refund they promised to refund but they have yet to contact me.
